This is the first of five required Compliance Assessment Reports (CAR) prepared for the conditions given in EPBC 2013/6872. It provides the status and compliance of project activities against each condition and its preparation was required in Condition 8 that states: By 31 March of each year after commencement of the action, the approval holder must publish a report on their website addressing compliance with each of the conditions of this approval between 1 January and 31 December of the preceding year, including implementation of the EOMP as specified in the conditions. Documentary evidence providing proof of the date of publication must be provided to the Department at the same time as the compliance report is published. The compliance reports must remain on the website for a minimum of 12 months (beginning on the date of publication). Potential or actual contraventions of the conditions of approval must be reported to the Department in writing within 2 business days of the approval holder becoming aware of the actual or potential contravention. Compliance Assessment Report

for the

Department of the Environment

1 January 2015 to 31 December 2015

The City of Bunbury (‘the Çity’) is the Proponent for the Bunbury Airport Expansion project located in

Bunbury, Western Australia (Figure 1). This project has undergone assessment under the Environmental

Protection and Biodiversity Conservation Act 1999 (EPBC Act) and its implementation is subject to meeting a

range of environmental conditions under the federal environmental approval (EPBC 2013/6872). The

environmental conditions apply to both the airport expansion area, and a separate environmental offset

site.

This project has also undergone assessment under the Environmental Protection Act 1986 (WA) and its

implementation is subject to meeting a range of environmental conditions given in the approved native

vegetation clearing permit CPS 5589/1.

This is the first of five required Compliance Assessment Reports (CAR) prepared for the conditions given in

EPBC 2013/6872. It provides the status and compliance of project activities against each condition and its

preparation was required in Condition 8 that states:

By 31 March of each year after commencement of the action, the approval holder must

publish a report on their website addressing compliance with each of the conditions of this

approval between 1 January and 31 December of the preceding year, including

implementation of the EOMP as specified in the conditions. Documentary evidence providing

Project Background and Environmental Approvals

The Bunbury Airport Expansion Project provides for the future construction of 23 hangars and a rescue

helicopter base at the Bunbury Regional Airport.

The project required the clearing of 2.13 ha of vegetation, comprising of 1.43 ha of native vegetation and

0.7 ha of introduced pine trees. Site surveys identified the presence and potential habitat of

Commonwealth and State listed threatened western ringtail possums, Carnaby’s, Baudin’s and Forest Red

tailed Cockatoos within the clearing impact area.

The project was referred to the Department of the Environment (DotE) and the Department of

Environmental Regulation (DER) in view of the impacts on native vegetation and specially protected fauna

species in the project area.

Both departments issued approvals for the clearing of vegetation subject to conditions including

implementation of agency specific environmental offset management plans. Key to both of these offset

plans was the securing and management of 11.83 ha of native bushland for conservation purposes in

perpetuity within Crown Reserve R40664, SW Highway Bunbury.

The DER issued a clearing permit (CPS 5589/1) on the 31 July 2014 and the DotE issued a clearing approval

(EPBC 2013/6872) on the 15 January 2015.

The project clearing action commenced on 30 March 2015 in accordance with the clearing approvals.

Current status of the project

During this reporting period the Bunbury Airport Expansion Project was completed providing the necessary

infrastructure (taxi ways, roads and underground utilities etc.) for the construction of the Bunbury rescue

helicopter base and additional hangars. The scheduled activities associated with the environmental offset

site were also commenced. An overview of these activities is provided below:

1. Implementation of the Airport Expansion Project

• The clearing of 2.13 hectares of native vegetation within the airport expansion area commenced on

30 March 2015 and was completed on 10 April 2015 with no known injuries or deaths to Western

Ringtail Possums or other native fauna.

• A fauna spotter was engaged to manage native fauna during clearing operations and to supervise

the extent of clearing.

• A fence was installed around the perimeter of the project area.

• Dieback and weed hygiene measures were implemented during clearing and development

operations.

2. Implementation of the Environmental Offset Site within Reserve 40664 SW Highway

• Undertook one feral animal monitoring episode

• Undertook one feral animal control episode

• Installed four gates to manage the spread of dieback

• Mapped location of Pampas Grass and other priority environmental weeds

• Controlled Pampas grass within the offset site area

• Surveyed rubbish within the offset area.

• Commenced process to obtain a Class A classification and Regional Open Space reservation for the

offset area.

• Monitored domestic dog on-lead compliance within the offset

• Monitored unauthorised vehicle access within the offset

Compliance issues:

The City advises that there some non-compliance issues to report in this period. These compliance issues

together with proposed remedial measures are summarised in table 1 below and discussed in further detail

in tables 2 and 3. The City notified the DotE of these compliance issues in November 2015.

The reasons for the forecast partial completion include a combination of the reduced timeframe available

for completing activities under the first reporting period owing to the delayed commencement of the

vegetation clearing (i.e. only nine months are available as opposed to the 12 months originally intended),

unforeseen delays with the advertising and award of a separate contract for the management of feral

animals and installation of gates at the offset site and administrative oversite over the required frequency

of site inspections.

Condition 2. Avoid and mitigate potential impacts to the Western Ringtail Possum

2. To avoid and mitigate potential impacts to the WRP and ensure that no WRP are

injured during clearing the approval holder must have an experienced wildlife handler

with an approved WA DPaW Regulation 15 Fauna relocation licence on site during

clearing to direct clearing efforts, spot for WRP and shepherd WRP from the project

area to undisturbed vegetation adjacent to the project area.

Possum relocation at the Bunbury airport was undertaken on the 30/3, 31/3, 2/4, 7/4, 8/4, and

10/4/2015. Nineteen WRP’S were relocated (unharmed) and without incident to the bushland

immediately to the north of the clearing site.

Condition 3. Class A Classification and Regional Open Space Designation

3. To offset the loss of WRP habitat, the approval holder must, within 36 months of

the commencement of the action:

• provide written evidence to the Department that the offset site has been

classified as a 'class A reserve' strictly for the purpose of conservation under

the WA Land Administration Act 1997; and

• provide written evidence to the Department that the offset site has been

designated a " Regional Open Space" under the Greater Bunbury Region

Scheme.

The written evidence must include a textual description and map clearly defining the

location and boundaries of the offset site and be accompanied with the offset

attributes and shapefile.

The Department of Lands has agreed to undertake the Class A classification of the

Environmental Offset area for the purpose conservation under the WA Land Administration Act

1997 on behalf of the City of Bunbury. The classification process has commenced and is

The Department of Planning (DoP) has informally advised of its support for this proposal and

indicated that it would likely be achieved via an internal omnibus minor amendment to the

GBRS which are routinely undertaken by the DoP in order to provide accuracy of the scheme.

Based on the City’s previous success in obtaining a ROS reservation over environmental offset

land associated with the Somerville Drive Offset (EPBC 2011/6153) it is reasonably considered

that a ROS reservation might be reasonably achieved within 36 months of the commencement

of the action.

Condition 4. Prepare and submit an Environmental Offsets Management Plan prior to construction

4. To offset impacts to the WRP, prior to commencement, the approval holder must

prepare and submit an Environmental Offsets Management Plan ( EOMP) to the

Minister for approval. The approval holder must not commence the action unless the

Minister has approved the EOMP. The EOMP must include, though not be limited to:

• Objectives;

• Details of the management actions proposed to take place within the offset

site; Measures to exclude and/or manage the impacts of feral animals,

vehicles, people, weeds, pests and dieback fro the offset site;

• Performance indicators for management actions and WRP protection

measures, including contingency measures and corrective actions if

performance indicators are not met;

Condition 7. Record Keeping

7.The approval holder must maintain accurate records substantiating all activities

associated with or relevant to the conditions of approval, including measures taken to

implement the EOMP required by this approval, and make them available upon

request to the Department. Such records may be subject to audit by the Department

or an independent auditor in accordance with section 458 of the EPBC Act, or used to

verify compliance with the conditions approval. Summaries of audits will be posted

on the Department's website. The results of audits may also be publicised through

the general media.

The City of Bunbury maintains a robust document management system known as TRIM that

provides a secure and controlled repository for all project documentation. Evidence provided in

annual Compliance Assessment Reporting such as this is supported by document reference

numbers from the Project’s document management system to substantiate activities

associated with or relevant to the conditions of approval for EPBC 2013/6872. No requests

were made by DotE during the compliance assessment reporting period for specific records.

Condition 9. Variations

9. If the approval holder wishes to carry out any activity otherwise than in accordance

with the EOMP as specified in the conditions, the approval holder must submit to the

Department for the Minister's written approval a revised version of that EOMP. The

varied activity shall not commence until the Minister has approved the varied EOMP

in writing. The Minister will not approve a varied EOMP unless the revised EOMP

would result in an equivalent or improved environmental outcome over time. If the

Minister approves the revised EOMP, that EOMP must be implemented in place of

the EOMP originally approved. The approval holder may revise the EOMP to correct

minor error in or make an administrative change to the document. Where the

approval holder revises the EOMP, the approval holder must provide to the

Department within 14 days of revising the document: a copy of the EOMP, marked up

to show the revisions, in both hard copy and electronic copy; and a clear summary of

all the revisions that have been made to the EOMP, and the reasons for the these

revisions.

10. If the Minister believes that it is necessary or convenient for the better protection

of listed threatened species and communities to do so, the Minister may request that

the approval holder make specified revisions to the EOMP specified in the conditions

to extend the required feral animal

management components into a 6th

year to address the shortfall.

The City appointed a short term

contract for the monitoring and

management of feral animals during

December 2015. Foxes were observed

during the monitoring period but were

unable to be captured during the

specified two week trapping period.

The City has appointed a five year

contract for the management of on-

ground works at the offset site. This

includes monitoring of feral animals

within the offset area.
