    Policy # 6.2BODY WORN CAMERAS

    Related Policies:

    This policy is for internal use only and does not enlarge an employees civil liability in any way.The policy should not be construed as creating a higher duty of care, in an evidentiary sense,with respect to third party civil claims against employees. A violation of this policy, if proven,can only form the basis of a complaint by this department for non-judicial administrative actionin accordance with the laws governing employee discipline.

    I. Purpose: The purpose of this policy is for providing guidelines on body worn cameras.

    II. Policy: It will be policy of this agency to always use the body worn cameras with publicinteraction.

    III. Procedure:

    A. Agency Responsib il it ies:

    a. All deputies with this agency are to utilize the body worn cameras when interactingwith the public.

    b. This includes the following.

    1. Patrol Deputies

    2. Patrol Sergeants

    3. School Resource Deputies

    B. Use of body worn cameras:

    a. The patrol deputies are to have the cameras in use with any interaction with thepublic that is law enforcement related.

    b. The cameras must be activated for the entire duration of any law enforcementincident, which includes, but is not limited to, driving with lights and siren activewhile in response to a call or in pursuit of a violator, prior to initiating a traffic stop,prior to arriving on scene of a dispatched or self-initiated call, and during anysearch of any prisoners or suspects.

    c. In the event more than one deputy is present on a call, ALL deputies are stillrequired to record the incident to ensure it is documented from each deputiesperspective.

    d. It will be the responsibility of the deputy for the care of the camera and equipmentissued to them.

    e. It will be the responsibility of the deputy to report to their supervisor any defects or

    mechanical issues with their cameras.

    f. Any issues with the camera will be reported up the chain of command in writing.

    g. Any issues with the camera or battery will be reported as soon as the problembecomes apparent.

    h. Cameras, when not in use, will be kept in their designated area.

    i. Prior to use, deputies should ensure the camera is assigned to their name thru theSync software.

    j. Deputies must ensure the camera is facing forward and the microphone on theside of the camera is not obstructed by any objects such as a coat or collar.

    k. Axon Flex Cameras must be docked at the end of shift each day in the SergeantsOffice for upload to Evidence.com.

    l. Deputies are required to change the retention categories on videos for thefollowing types:

    DUI change to retention category DUI, to be kept for 2 years per law.

    Use of Force change to Use of Force to be kept indefinitely.

    Officer Injury change to Officer Injury to be kept indefinitely.

    Domestic change to Domestic to be kept 1 year

    Any incident that you believe may result in legal action, citizen complaint, or anyout of the ordinary incident should be changed to the retention title Keep to bekept indefinitely.

    Additionally, if you receive a subpoena on a case, that video or videos related tothat case should be changed to Keep in order to ensure preservation of theevidence.

    m. All videos, with the exception of training videos, are evidence and should betreated as such. Deputies should only view and/or download videos for a lawenforcement or court related reasons. Deputies may share videos with otherdeputies utilizing the share option on evidence.com when needed for a case.

    n. School Resource Officers should use the Muvi model cameras during any incidentor search. When an Axon Flex camera is available, SROs must document all lawenforcement activity as listed for patrol deputies and Sergeants.

    o. Failure to use camera will result in disciplinary action for each offense up to andincluding termination.

    p. Any misuse or abuse of the camera will result in disciplinary action up to andincluding termination and responsibility of replacement of the camera.
