After a tense time in washington, Congress agreed to immediately end the government shutdown and raise the debt limit on October 16, 2013. The final deal funds government agencies through January 15, 2014, extends the government’s borrowing authority through February 7, 2014, and includes a provision to provide back pay to workers furloughed during the shutdown. The deal also requires members of the U.s. senate and House of Representatives to negotiate a long-term budget plan and report on their efforts by December 13, 2013.

According to the National Association of Home Builders (NAHB) and several

news outlets from across the country, the federal government shutdown impacted the housing industry in various ways. There were actual operational difficulties in accessing government programs and services leading NAHB to issue an advisory to HBA members

to expect delays for any housing-related federal government programs that may still be operating. News outlets reported delays in some mortgage application approvals due to the inability to verify the borrower’s personal information through the Internal Revenue service, which was partially closed, and in processing FHA-insured loans. e-Verify was unavailable to business owners who rely on the program to determine the eligibility of their employees to work in the U.s. In addition, the Occupational safety and Health Administration’s investigation and enforcement activities ceased with the exception of “imminent danger” to life or property and other

builders and remodelers about the New Energy Efficient Home Tax Credit (45L), which is in place through the end of 2013. According to National Association of Home Builders, the tax credit is the only federal incentive available for energy efficiency in new homes. The credit is $2,000 for a dwelling unit that is certified to achieve a 50% improvement in energy efficiency over the 2006 International energy Conservation Code (IeCC). The credit is available to eligible contractors, which the IRS defines as the person that

constructed a qualified energy efficient home and owns the home. A qualified new energy efficient home must be a dwelling unit located in the U.s. and whose construction is substantially completed after August 8, 2005 and sold or leased to another person after 2005 but before 2014.

The 45L tax credit is traditionally renewed by Congress at the end of each year as part of a package of expiring tax credits called “tax extenders.” In the current economic and political climate, the fate of this valuable benefit beyond 2013 is highly uncertain.

OSHA’s Proposed Silica Rule Raises Concerns for Construction Industry

A coalition of construction industry groups is concerned about a proposed rule from the Occupational safety and Health Administration (OsHA) that is intended to protect workers from inhaling dust containing silica, created by activities such as cutting brick or block, and sawing, grinding or drilling concrete.

“we need practical, science-based solutions that protect workers in all facets of construction,” said Rick Judson, chairman of the National Association of Home Builders (NAHB) and a builder and developer from Charlotte, N.C. “Unfortunately, OsHA’s initial announcement about this proposed rule indicates we aren’t there yet.”

Announced August 23 in a press conference that laid out few details, the proposed rule seems to call for one-size-fits-all measures that contradict existing safety and quality assurance practices for different types of contractors.

For instance, spraying water to reduce dust may be practical in some construction projects, but using it inside a home while cutting granite counters can cause mold. In cold weather, spraying water while cutting asphalt roof shingles could cause ice to form on the slanted surface, endangering workers. Ventilation and dust-capture systems can inhibit the safe operation of tools. And if prescribed measures are not practicable, contractors might be forced to eliminate products with silica altogether, including concrete, brick, granite, and other common construction materials.

Independent studies have estimated costs for construction industry compliance will exceed $1 billion per year.

NAHB is part of the Construction Industry safety Coalition, which is seeking a feasible and cost-effective crystalline silica regulation that improves safety and health protection measures for workers. The coalition represents thousands of employers working to protect hundreds of thousands of workers in home building, road repair, heavy industrial production, specialty trades and materials supply. It was formed to encourage OsHA to develop better choices for compliance with the construction-specific silica rule: alternatives that also address costs, consistency with existing federal regulations and do not overly burden small businesses. The HBA’s Government Affairs Com-mittee met on October 22, 2013 to plan the HBA’s 2014 Legislative Agenda. Com-mittee Co-chairs Harold Phelps, Phelps engineering, Inc., and Brenner Holland, Hunt Midwest Real estate Development, Inc., and Committee members reviewed the HBA’s past legislative priorities and discussed issues we expect will be de-bated during the next legislative sessions in Kansas and Missouri. The Committee also discussed issues that HBA members face day-to-day in their businesses and the pro-active steps the Association can take to help alleviate bureaucracy and find savings through changes in state policy.

The HBA expects a big year in gov-ernment affairs as legislators continue to debate tax reform, mandatory fire sprin-klers, statewide licensing and building

codes. The legis-lative agenda will direct the HBA’s lobbying efforts in the Kansas Legisla-ture, Missouri Gen-eral Assembly and at the local level, and serve as a guide for HBA members dur-ing our annual lobby days in Topeka and Jefferson City. In ad-dition to Committee Co-chairs, HBA members in attendance at the meeting included Tommy Angotti; Misty Hanson; Curtis Harris, Kevin Kirt-ley, Richard Mather, George schluter, Jim Pollard, Chris Ragland and Michael Snodgrass. The final agenda will be

According to NAHB Chief economist David Crowe, “A spike in mortgage interest rates along with paralysis in washington that led to the government shutdown and uncertainty regarding the nation’s debt limit have caused builders and consumers to take pause.” Crowe predicted that builder and consumer confidence would bounce back once the government impasse was resolved. The country, however, is still divided on how to solve the debt and deficit problem. There is no guarantee that builders and the housing industry as a whole will be immune from another manufactured crisis.

In memory…The HBA lost a long time friend, board

member, and leader with the passing of Paul Burger, september 27, 2013 at age 77. Paul was born on Akron, OH and spent his early years in wilmington, Delaware and Trenton, New Jersey. He graduated from Villanova University with a BA in Business and moved to Kansas where he met his wife, Carroll. He worked as a real estate developer in the Kansas City area with his company Paul M. Burger & Company. Professional highlights include developing Briarwood estates and Amber Hills estates in Olathe. Paul served as President of the HBA in 1990 and received the Hall of Fame Award in 1998. Paul retired in 2000 and enjoyed traveling, sailing, golf, and especially spending time with family and friends.

Fall Home Building Off to a Strong Start

In cities across the Greater Kansas City Metropolitan Area, housing production continues to climb in 2013 with the total permit number coming in as the highest since 2007, according to the Home Builders Association of Greater Kansas City’s (HBA) monthly Residential Building Permit statistics report. september single family permits increased slightly to 383 over 379 single family permits the same month in 2012. Year to date total permits are the highest in six years with 3,092 single family permits compared to 2012 with 2,406.

“Clearly we are seeing increased building in expanding subdivisions which is good news for home buyers. In addition, we also are noticing a trend with infill and new home construction in established neighborhoods,” said executive Vice President sara Corless. “It is exciting to see new homes in all areas of the metropolitan area. In fact, one of the Grand Award winners in the Parade of Homes award contest was a new home built in Leawood. Numbers of infill lots also are surfacing in Fairway, westwood, Prairie Village, Mission Hills and Kansas City.”

Permit growth is active throughout the eight county area with Jackson County up 44 percent over 2012, Johnson County is up 34 percent and Cass County is up 24 percent. Top cities ranked by single family units year to date are Kansas City with 523, Olathe with 395, Overland Park with 325 and Lee’s summit with 265. Multi-family permits continue to increase with 217 units permitted in september bringing the 2013 total to 2,098 which is the highest since 2006.
