I know it is important to continue to get moisture in the ground for the next year of crops, but I am happy that we have not had a great deal of snow. I am sure the school kids would like to have a few snow days; I know I always looked forward to them when I was in high school. We had to walk about a mile and a half from the south side of the railroad tracks to the north side to get to the Jr. and Sr. High Schools, back in he 1960’s. It was a very cold walk on some days. Some days we got to ride with Dad to the Earl May Store and just had to walk half of the way to school. Of course, we had to do chores at the store before we left for school. Usually we had to sweep the floor and feed the birds. I would rather sweep the floor than feed the birds as they sometimes liked to bite you as you tried to clean out the cage and fill their food tray. It won’t be long and we will be into March. While I know right now we need the moisture but rather than coming in like a Lion and going out like a Lamb, it would be nice to have a few snowflakes to keep moisture in the ground and not a huge snow storm that closes the roads and shuts down schools…though I will have to admit when I was in high school I loved it when snow days were called. I know I most likely have mentioned this in my newsletters over the years, but I always remember Valentine’s Day in grade school. We all had decorated boxes on our desks and each student was to bring a Valentine for every student in their class. Some parents would come in and bring in treats before we opened our Valentines. It was always a fun party. With our last grandchild in high school, it isn’t such a big event anymore. Though my husband always remembers to get me a card, flowers or candy. I usually try to remember to get him a card. Actually, neither of us needs the candy, but kind of nice to get a small heart shaped box with a few chocolates in it. Published Since April 1997

Well January came and went and while we got snow, it was

not over bearing as it could have been. I know it is important to

continue to get moisture in the ground for the next year of crops,

but I am happy that we have not had a great deal of snow. I am

sure the school kids would like to have a few snow days; I know

I always looked forward to them when I was in high school. We

had to walk about a mile and a half from the south side of the

railroad tracks to the north side to get to the Jr. and Sr. High

It was a very cold walk on some days. Some days we got to

ride with Dad to the Earl May Store and just had to walk half of

the way to school. Of course, we had to do chores at the store

as they sometimes liked to bite you as you tried to clean out the

cage and fill their food tray.

It won’t be long and we will be into March. While I know

lots sold, but no identification of who or how it will be

managed has yet been provided. I was asked to by NP

Dodge, but I refused as a few out here just want to

Random Acts of Kindness

- Spread your skills – If you have a skill

(photography, outfit styling, cooking, website

programming, etc.) and you know someone who

has expressed an interest in what you do offer to

teach them what you know

- Give freely – Go through your things and give

freely to those in need

- Offer to get groceries for your friend or relative

who has a broken leg or other mobility problem

- Make extra copies of photos and send them to the

people who are in the images

- Offer to help your friend unpack

- Give warm clothes, shoes, and boots to the

homeless

- Help someone whose car has broken down

- Connect people to each other

- Walk the cart back to the front of the store

- Reach out to a person who has made a difference in

MINUTES OF THE MEETING OF

SANITARY AND IMPROVEMENT DISTRICT NO. 5,

CASS COUNTY, NEBRASKA

Meeting convened at 6:00 p.m. on January 21, 2020 at Plattsmouth State Bank, second floor community room, 446 Main Street,

Plattsmouth Nebraska. Attached hereto are: the agenda for the meeting; the Affidavit of Printer regarding publication of notice of the

meeting, which communicated the availability of the agenda, in the Plattsmouth Journal, Plattsmouth, Nebraska; advance notice of the

meeting as provided to the County Clerk of Cass County and all Trustees; and the Trustees’ acknowledgment of receipt of said notice

and agenda. All proceedings were taken while convened with attendance open to the public.

ITEM 1

Meeting called to by order by Chairman Kurt Meisinger at 6:02 p.m.

ITEM 2

The Chair announced the locations of the Open Meetings Act and agenda related documents.

ITEM 3

Roll call: Present: Brandt, Grotrian, Meisinger and Petersen. Absent: Gorman.

ITEM 4

The Chairman asked if anyone was present to address the Trustees regarding matters not on the agenda.

Trustee Gorman arrived at 6:03.

Mr. Rich Purington, 713 Windward Court, addressed the Board regarding drainage in the cul-de-sac. The chair advised that the Board

would have the District’s engineer review the site. Trustee Grotrian asked Mr. Purington to email him any photos so that he could

forward them to the engineer.

ITEM 5a

Following discussion concerning JEO engineer’s review and approval of various plans and specifications, motion by Grotrian, seconded

by Gorman, to recommend to Cass County Planning and the Cass County Board of Commissioners approval of Buccaneer Bay Replat

III, final Plat, Lots 1 through 10, inclusive, being a replat of Lot 6C, Buccaneer Bay - Replat II, Cass County, Nebraska. On roll call

those voting aye: Brandt, Petersen, Grotrian, Gorman and Meisinger. Voting nay: none. Absent: none. Abstaining: None. The Chair

declared the resolution adopted.

ITEM 5b

Motion by Meisinger, seconded by Brandt, to direct the attorney for the District to negotiate with the developer an agreement for the

construction and financing of the public improvements, and the subsequent transfer of ownership of such improvements to the District

following any necessary inspections by, and approval from, JEO Consulting Group, Inc., one of the District’s engineers. On roll call

those voting aye: Brandt, Petersen, Grotrian, Gorman and Meisinger. Voting nay: none. Absent: none. Abstaining: None. The Chair

declared the resolution adopted.

ITEM 6

Trustee Gorman advised that FEMA and NEMA had approved as much reimbursement as they were going to for flood related expenses,

and that ACH transfers would be made to the District in the total amount of $41,659.42, and that upon receipt she would determine the

allocation between the Service Fee Fund and the General Fund.

ITEM 7

Following discussion, Trustees Gorman and Brandt volunteered to work with the District’s attorney to develop a proposed bid

specification for a single trash hauler for the District and to provide for a general levy to bear the expense in an effort to reduce truck

damage to the streets. No action was taken.

ITEM 8

Trustee Grotrian advised he would discuss any changes to the scope of work for a strategic planning contract with RDG Planning and

Design and bring it to the Board for action at the next meeting.

Matt Wilson of PeopleService presented the attached report regarding water and wastewater operations. Trustee Meisinger agreed to

meet with Mr. Wilson to review some tree and brush clearing to make a path to work on the lift station located on Becker Court.

ITEM 9b

The Chair laid over consideration of a request for a contract proposal from JEO Consulting Group, Inc. to engineer improvements to the

water and sanitary sewer systems and infrastructure.

ITEM 10a

Trustee Grotrian provided a verbal report regarding roads, including snow plowing during the last month.

ITEM 10b

The chair laid over consideration of approving the purchase of street signs and traffic control signs from Cass County, and approving a

contract with a third party to replace the missing and damaged street signs and traffic control signs, pending appropriate weather for

installation.

ITEM 11a

Trustee Brandt provided a general grounds report.

ITEM 11b

Trustee Brandt advised that Mr. Johnson had obtained a map for use by the grounds committee in devising a plan for the possible sale

of the park ground consisting of approximately 90 acres. Inclement weather had prevented the meeting on Friday, but it would be

rescheduled.

ITEM 11c

No action was yet taken following discussion of establishing a park area for dog walking in the area north of the pump house road, west

of that road and the hops field, south of the railroad line, and east of Treasure Island Road. The trustees determined that additional

investigation and even consideration of other areas would be appropriate.

ITEM 11d

Following discussion concerning Tier I audits or other inspections of the lots and of having title reports completed, motion by Meisinger,

seconded by Brandt, to have title searches performed and to have trustees conduct walking inspections of the following lots, and upon

completion of the searches and inspections to consider accepting a Quit Claim Deed at the February from Bay Hills Limited Partnership

such that the District would then pay $10.00 and any unpaid taxes and special assessments for the lots:

the warrants to be drawn on the General Fund account and to be redeemed no later than January 21, 2020:

Be It Further Resolved by the Board of Trustees of Sanitary and Improvement District No. 5 of Cass County, Nebraska

that both the Board and the District find and determine, and covenant and warrant, and agree that (a) the facilities for

which the above Warrants are issued are for essential governmental functions and are designed to serve members of

the general public on an equal basis; (b) there are no persons with rights to use said facilities other than as members

of the general public; © ownership and operation of said facilities is with the District or another political subdivision;

(d) none of the proceeds of the Warrants will be loaned to any person and to the extent that special assessments have

been or are to be levied for any said facilities, such special assessments have been or are to be levied under Nebraska

law as a matter of general application to all property specially benefitted by such facilities in the District; (e) the

development of the land in the District is for residential or commercial use; (f) the development of the land in the

District for sale and occupation by the general public is proceeding with reasonable speed and (g) the District hereby

authorizes and directs the Chair or Clerk to file, when due, an Information Reporting Form pursuant to Section 149(e)

of the Internal Revenue Code of 1986 pertaining to the above Warrants.

Be It Further Resolved by the Board of Trustees of Sanitary and Improvement District No. 5 of Cass County, Nebraska

that the District covenants, warrants and agrees as follows: (a) to take all actions necessary under current federal law

to maintain the tax exempt status (as to taxpayers generally) of interest on the above Warrants; and (b) to the extent

that it may lawfully do so, the District hereby designates the above Warrants as its “qualified tax exempt obligations”

under Section 265(b)(3)(B)(ii) of the Internal Revenue Code of 1986, as amended, and covenants and warrants that

the District does not reasonably expect to issue warrants or bonds or other obligations aggregating in the principal

amount of more than $10,000,000 during the calendar year in which the above Warrants are to be issued.

Be It Further Resolved by the Board of Trustees of Sanitary and Improvement District No. 5 of Cass County, Nebraska

that this and the preceding Resolutions are adopted as the Certificate with Respect to Arbitrage of the District

pertaining to the above Warrants and the District and Chair and Clerk of the District hereby further certify, as of the

date of the registration of the above Warrants with the County Treasurer of Cass County, Nebraska, as follows:

1. No separate reserve or replacement fund has been or will be established with respect to the above

Warrants. This District reasonably anticipates that moneys in its Bond Fund reasonably attributable

to the above Warrants in excess of the lesser of: (a) 10% of the net principal proceeds of the above

Warrants, (b) the maximum annual debt service due on the above Warrants, or © 125% of average

annual debt service due on the above Warrants will be expended for payment of principal of and

interest on the above Warrants within 13 months after receipt of such moneys. That amount which

is currently held in the District’s Bond Fund which exceeds the amount which is to be expended for

payment of principal and interest on the above Warrants within 13 months after receipt of such

moneys, plus that amount arrived at pursuant to the immediately preceding sentence, will not be

invested in any securities or any other investment obligations which bear a yield, as computed in

accordance with the actuarial method, in excess of the yield on the above warrants.

2. To the best of their knowledge, information and belief, the above expectations are reasonable.

3. The District has not been notified of any listing of it by the Internal Revenue Service as an issuer

that may not certify its bonds.

4. This Certificate is being passed, executed and delivered pursuant to Section 1.148-2(b)(2) of the

Income Tax Regulations under the Internal Revenue Code of 1986, as amended.

Be It Further Resolved by the Board of Trustees of Sanitary and Improvement District No. 5 of Cass County, Nebraska

that $2,496.09 be transferred from the Service Fee Fund to the General Fund (OPPD electric service for November

2019 less the cost of street lighting).

On roll call those voting aye: Brandt, Petersen, Grotrian, Gorman and Meisinger. Voting nay: none. Absent: none. Abstaining: None.

The Chair declared the resolution adopted.
