We write in response to the Complainant's April 6, 2017 submission regarding the proposedclass in this matter.
In that submission, the Complainant amended the definitions of the classes to the following:
1. Any person who at least once reported, disclosed, or communicated to UBC by anymeans, including telephone, email, fax, or in person in a formal, informal, scheduled,or unscheduled interaction, a concern about the conduct of Dmitry Mordvinov; and
2. Any member of the community of UBC alleging sexual harassment, sexual violence,and/or sexual discrimination between the present and 5 years before this complaintwas filed.
The Respondent submits that the amended classes are inappropriate in light of theTribunal's jurisprudence regarding class complaints and the Tribunal's time limit decision inthis matter (2017 BCHRT86). The classes ought not to be accepted as proposed.
In C.S.W.U.. Local 1611 v. SELI Canada and others (No. 3), 2007 BCHRT 423 {"SELr), theTribunal set out some of the factors it would consider for class complaints as follows (atpara. 104):
Second, the Tribunal must determine whether the complaint as framed is appropriatefor a group or class complaint. Here the factors the Tribunal may consider includewhether:
i) the group or class is defined, or is capable of definition, by clearparameters or characteristics;
