    LAGUNA LAKE DEVELOPMENT AUTHORITY

    RESOLUTION NO. 106, SERIES OF 1999

    Approving the Policy Guidelines Governing All Industrial Estates/Parks within theLaguna De Bay Region

    WHEREAS, Republic Act No. 4850, as amended, empowers the Laguna LakeDevelopment Authority to implement the provisions of Presidential Decree No. 984, otherwiseknown as "The Pollution Control Law of the Philippines", within the Laguna de Bay Region;

    WHEREAS, the Laguna de Bay Region has been the center of industrialization and

    urbanization thereby promoting the LLDA to become pro-active in its effort and manage theresources of the region towards sustainable development and thus, implementing the EnvironmentalUsers Fee System within the region;

    WHEREAS, the Environmental Users Fee System was approved for implementation in theLaguna de Bay Region under the LLDA Board Resolutions No. 25, Series of 1996;

    WHEREAS, under Board Resolution No. 33, Series of 1996, adopting the Rules andRegulations Implementing the Environmental User Fee System in the Laguna de Bay Region, alldevelopment Projects, installations and activities that discharge liquid waste into a pose a threat to theenvironment and the Laguna de Bay Region covering industrial, commercial, domestic andagricultural sources are covered by the System;

    WHEREAS, for efficient and more effective implementation of the foregoing laws, rulesand regulations, there is an urgent need to classify industrial estates/parks within the Laguna de BayRegion and develop guidelines toward self-regulation;

    NOW THEREFORE, foregoing premises considered and pursuant to the provisions ofR.A. 4850 as amended and Board Resolution No. 33, Series of 1996, BE IT RESOLVED, as ithereby RESOLVED, to adopt the following Policy Guidelines Governing all Industrial Estates/Parks

    within the Laguna de Bay Region.

    I. POLICY STATEMENTThe Laguna Lake Development Authority recognizes the unique role of industrial estates/parks as a

    partner in the effective implementation of pollution control rules and regulations as well as theEnvironmental User Fee System in the Laguna de Bay Region.

    Every industrial estate or industrial park within the Laguna de Bay is expected to observe duediligence in protecting the environment and thus required to put up a Centralized Treatment Plantfor all liquid waste discharge by its individual locators. Locators of industrial estates may dischargetheir wastes provided they are connected to centralized treatment plant of the park. As such thecentral treatment facility or central sewage treatment plant as the case may be, is considered as thetreatment facility of individual locators.

    II. SCOPEThese guidelines provide for the policies, standards, monitoring, inspection and assessment protocols

    for implementing P.D. 984, its relates rules and regulations and the Environmental User Fee Systemfor all industrial parks and industrial estates and their locators within the Laguna de Bay Region.

    III. DEFINITION OF TERMSFor the purpose of these policy guidelines, whenever any of the following words, terms or phrasesare used herein or any amendment or supplementary thereto which may be issued hereafter, they shallhave the following meaning, to wit:

    a. "Authority" or LLDAshall refer to the Laguna Lake Development Authority.

    b. Environmental User Fee System (EUFS) is a market based policy instrument currentlybeing implemented by the LLDA. It is primarily aimed at reducing the pollution load into the Lagunade Bay by enjoining all discharges of liquid waste to internalize the cost of environmental degrationand enhancement into their business decisions.

    c. Industrial estate/parkrefers to a tract of land subdivided and developed according to acomprehensive plan under a unified continuous management and with provisions of basicinfrastructure and utilities, with or without pre-built standard factory and community facilities for theuse of a community of industries.

    d. Economic Zones or "Special Economic Zones" (SEZ) shall refer to selected areaswith highly develop or which have potential to be developed into agro-industrial, industrial, tourist,recreational, commercial, banking, investment and financial centers whose meters and bounds arefixed or delimited by Presidential Proclamations.

    e. Centralized Wastewater Treatment Facility or CWTF refers to a facility designed totreat both domestic and process wastewater generated from individual locator within the IndustrialEstate/Park

    f. Central Sewage Treatment Plant or CSTP refers to a facility designed to treat domesticwastewater only generated from individual locators within the Industrial Estate/Park.

    g. Internal Effluent standard shall refer to the prescribed effluent standards for locatorsinside an industrial park/estate that are inter-connected to the CWTF imposed by the park/estate onthe capacity and design efficiency of their CWTF.

    h. Biological waste shall refer to the organic waste that can be easilydecomposed/biodegraded.

    i. Physio-Chemical Parameters shall refer to the six (6) significant parameters under DAONo. 35, i.e., pH, BOD, Cod, TSS, Color, Oil/Grease.

    j. Existing Industrial Estate/Parks shall refer to those parks/estates that have been issuedan LLDA Clearance prior to effectivity of these rules

    k. Effluent is a general term denoting any wastewater, partially or completely treated, on itsnatural law estate or liquid waste flowing out through a pipe or a single outlet structure from amanufacturing/industrial plant or wastewater treatment plant

    l. Domestic Wastewater shall mean wastewater discharges from closets, bath tubs, showers,sinks, wash basins and similar sanitary conveniences in a building. IT synonymous to "domesticsewage"

    IV. REQUIREMENTS FOR A CWTFAll new Industrial Estate/Parks to be developed or established within the Laguna de Bay Region shallbe required to install CWTF for treatment of both physico-chemical, and biological parameters.

    Locators with heavy metals must have a pre-treatment facility to treat their wastewater prior todischarge. Henceforth, all individual locators to be located thereat shall be connected to the CWTF.

    However, for existing industrial estate parks/without a CWTF, each locator with wastewaterdischarge shall be required to install their treatment facilities.

    Management of industrial estates/parks shall have the responsibility to review and approve the designand monitor the operation of such individual treatment facilities proposed by locators considering theset internal effluent standards as well as for monitoring purposes.

    V. REQUIREMENTS FOR A DISCHARGE PERMITNew and existing industrial parks and their locators within the Laguna de Bay Region whichdischarge, in any matter, liquid waste into the environment shall be required to secure their respectiveDischarge Permits from the Authority in accordance with P.D. 984, its implementing guidelines, rulesand regulations and Board Resolution No. 33, series of 1996, including the required LLDA Clearanceand other permits.

    VI. ASSESSMENT OF ENVIRONMENTAL USER FEE The following guidelines shall govern the assessment of environmental user fees of industrialestate/parks and individual locators within the Laguna de Bay Region:

    a.All industrial estate/parks are required to pay both fixed fee and variable fee for its liquidwaste discharges.

    b. For those locators within the industrial estate/park with interconnection to a CWTF whocomplies with the internal effluent standards of the park, only a fixed fee shall be assessed. No

    variable fees shall be required to paid.

    c. For those locators within the industrial estate/park with interconnection to a CWTF butare not complying with the internal effluent standards of the park, they shall be required to pay

    variable fees in excess if the internal standards including fines and penalties.

    d. For those locators within an industrial estate/park without CWTF they shall be requiredto pay both the fixed fee and the variable fees for all their wastewater discharges.

    VII. APPLICATION OF EFFLUENT STANDARDSIn general, all industrial estate/parks shall comply with the standards for Inland waters Class "C"under DAO 35. For monitoring and self-regulatory purposed, industrial parks may set their owninternal effluent standards provided they have a CWTF.

    For individual locators with interconnection to the CWTF, the parameters stated under the internaleffluent standards of the park as submitted to the LLDA shall apply.

    For heavy metals, all locators shall apply comply with DAO 35.

    VIII. MONITORING AND REPORTING PROTOCOLSBoth the central treatment facilities of industrial estates and those of individual locators are coveredby the LLDA's monitoring and inspection requirements pursuant to the Board Resolution No. 33,Series of 1996. However, each industrial estate shall establish its own monitoring program which

    would include the following:

    a. Monitoring system procedure.b. Effluent sampling on monthly basis to be submitted to the LLDA on a quarterly basis.

    For purposes of carrying out their respective functions, the LLDA and the management on industrialparks may conduct joint ocular inspection at least once a year to determine compliance of both

    locators and industrial parks with these guidelines, LLDA pollution control rules and regulations andthe EUFS.

    IX. ASSESSMENT OF FINES AND PENALTIESFor industries located within the industrial estate/park, the internal effluent standards of the parkshall be observed provided that it is interconnected to the CWTF of the park. However, in case of

    violation of the internal effluent standards, fines/penalties shall be imposed by the Authoritypursuant to the provisions of P.D. No. 984.

    X. OTHER PROVISIONS The LLDA shall furnish the management of industrial estates/parks with copies of legalorder/decisions involving their individual locators for recording and monitoring purposes.

    All industrial estates/parks located within the Laguna de Bay Region shall immediately submit to theLLDA a complete list of locators with and without interconnection to the CWTF together with acopy of their respective internal effluent standards.

    XI. IMPLEMENTATION STRATEGYFor the effective implementation of these guidelines, a Memorandum of Agreement shall be executedbetween the LLDA and all the Industrial Estate/Parks within the Laguna de Bay Region immediatelyafter the approval of these policy guidelines.

    The LLDA-environmental Protection Division and Legal Division shall take the lead insuring thesmooth implementation of these guidelines as well as the preparation, signing and execution of theagreement.

    XII. EFFECTIVITYThese policy guidelines shall take effect fifteen (15) days after publication in a newspaper of generalcirculation.
