Minutes of the meeting of the GVRD Board of Variance held at 1:05 p.m. on Monday, November 23, 2015 in the 2"d Floor Boardroom, 4330 Kingsway, Burnaby, British Columbia.

ELECTION

1. Election of the Board of Variance Chair Chris Plagnol, Secretary, Board of Variance, called for nominations for the position Board of Variance Chair for the term 2015 to 2018.

Brian Collins was nominated as a candidate for the office of Board of Variance Chair. Mr. Collins consented to the nomination.

The Secretary called for further nominations and after the third call, with there being no further nominations, declared nominations for the office of the Board of Variance Chair closed.

Announcement of Result Brian Collins was acclaimed Chair of the Board of Variance for the term 2015 to 2018.

2. Appointment of the Board of Variance Acting Chair The Chair recommended Jenny Sandy for the position of Board of Variance Acting Chair for the term 2015 to 2018. Ms. Sandy consented to the appointment.

A. ADOPTION OF THE AGENDA

1. November 23, 2015 Meeting Agenda

It was MOVED and SECONDED That the Board of Variance adopt the agenda for its meeting scheduled for Monday, November 23, 2015 as circulated.

B. INTRODUCTION The Chair outlined the hearing procedures.

Conflict of Interest 1:10 p.m. Brian Collins declared a conflict of interest due to the fact that his survey company prepared the plan presented in the application, and departed the meeting.

C. APPLICATION FOR VARIANCE

1. GVRD Electoral Area A Application 15-03 (3 Strachan Point Road) regarding waterfront patio works. Legal Description: Lot A District Lots 1746, 5383 and 7831 Plan LMP17436.

Variance Requested to Greater Vancouver Regional District Electoral Area A Zoning Bylaw No.1144, 2011: • Vary Section 212(2) by reducing the setback from the natural boundary of

the sea (in this case shown as the High Water Mark (HWM) on the survey plan dated May 20, 2015) from 15 metres to 1.5 metres, with all structures sited inside the property line.

a. Applicant or Applicant Representative Sheridan Peter MacRae, Metric Architecture, presented the Board with a poster containing details of the proposed design and reiterated the variance requested.

In response to questions, Mr. MacRae together with the property owner, Mr. Cornell, informed the Board about:

• railing repairs made to address insurance requirements • interest to increase the patio size • proposed landscaping and new construction • erosion of the existing balustrade • location of the intake lines for the geothermal heating system • poor aesthetics of existing shotcrete

• a desire to straighten the property line • other non-conforming structures in the Strachan Point community • written submissions made in support of the variance request

b. Electoral Area Planning Staff Report dated November 12, 2015 from Marcin Pachcinski, Division Manager, Electoral Area and Environment, Planning, Policy and Environment, regarding Board of Variance Application - 3 Strachan Point Road, Howe Sound, Electoral Area A.

Marcin Pachcinski, Division Manager, Electoral Area and Environment, Planning, Policy and Environment, provided members with a presentation on the subject property highlighting location, requested variance, and a portion of the survey plan referenced in the application.

In response to questions, staff informed the Board about building permit requirements.

Presentation material titled "3 Strachan Point Road (PID: 018-824-498)" is retained with the November 23, 2015 GVRD Board of Variance agenda.

c. Written Submissions The following correspondence was circulated to members and is retained with the November 23, 2015 Board of Variance agenda package: i. Email correspondence dated November 19, 2015 from Andrei Kisel,

2 Strachan Point, in support of the variance request. ii. Email correspondence dated November 22, 2015 from Bruce McQuaid,

13 Strachan Point, in support of the variance request.

d. Oral Submissions No items presented.

e. Board of Variance Order The Board expressed concerns about: • discrepancies on the location of the property line • landscaping beyond the property line • new construction beyond the existing staircase

• deck height being out of character with nearby properties • the high water mark extending beyond the staircase • the variance adversely affecting the natural environment

The Board also commented that over time non-confirming use is expected to return to a conforming use and acknowledged that the owner can complete necessary repairs without the variance.

It was MOVED and SECONDED That the GVRD Board of Variance, in relation to Application 15-03 Lot A District Lots 1746, 5383 and 7831 Plan LMP17436 (3 Strachan Point Road), issue an order denying the request to vary GVRD Electoral Area A Zoning

Bylaw No. 1144, 2011 in section 212(2), based on not having found undue hardship in the Application, subsequent correspondence submitted to clarify the variance request, and from information presented to the Board of Variance on November 23, 2015.
