Chairperson Inouye announced he was returning to the order of the agenda. Chapter 91, HRS Adjudicatory Matters: Chairperson Inouye called for a recess from the Board’s meeting at

Following discussion, it was moved by Chief Perry, seconded by Mr. Denis, and unanimously carried to approve the settlement agreements prior to filing of petition for disciplinary actions and Board’s final orders for the above principal guard. Following the Board’s review, deliberation and discussion on these matters, pursuant to HRS Chapter 91, Chairperson Inouye announced that the Board was reconvening to its open meeting at 11:06 a.m.

Executive Officer’s Report: a. FBI Rap Back The Executive Officer informed the Board that the FBI is

embarking on a program that will alert the Board of anyone for whom we requested a fingerprint of any re-offense. The FBI requires the “Privacy Act” information to be included with the fingerprinting process. This process should be done by Fieldprint, Inc. because it is required before fingerprinting and the Hawaii Criminal Justice Data Center (“HCJDC”) is working with Fieldprint to accomplish this FBI requirement. Agencies must enroll in order

to participate in the rap back process and at this time no fee is being imposed; however HCJDC will track its cost and if warranted will assess fees accordingly. As a reminder, the individual assigned as the Third Party Liability (TPL) may receive all information except criminal history record info.

b. Renewal/Restoration The last day for renewal (online or hard copy) is June 30, 2016 for

principal guards and detectives, guard and detective agencies and guard employees. The restoration period is one year (on or before 6/30/17). There is no online restoration for guard employees this renewal due to the continuing education requirement. A random audit to check continuing education certificates will be conducted in August 2016 of all guard employees. Any guard employee found to have not taken the

4-hour continuing education course or to have taken the continuing education course after 7/1/16 will be referred to the Regulated Industries Complaints Office for investigation.

Examination: a. Review & Report

The Executive Officer distributed the following results of the Private Detectives’ and Guards’ examination:

Security Guard Exam (administered May 20, 2016)

Private Detective Exam (administered June 17, 2016)

Exams Administered 2 Successful 0 Unsuccessful 2

The Executive Officer informed the Board that PROV Inc., an examination contractor has expressed willingness to create exams for the smaller boards and will update exams on a regular basis. Such as the Private Detective and Guard exams; however procurement issues must be addressed. This contractor can also provide testing locations on all islands.

Mr. Denis reported that the following major industry stakeholders have committed to serve on the Ad Hoc Committee to discuss guidelines and standards for distance learning and that he still seeking a retail representative.

Mr. Denis also listed the following Ad Hoc Committee scope of assignments for Board approval:

1) Define “classroom” and propose related rules for distance learning.

2) Identify acceptable technologies to accomplish distance learning for Act 208 initial and CE curricula’s.

3) Develop recommendations for additional 4 hour blocks for continuing education curricula’s to be adopted by Board for instruction to GDE’s for next license renewal cycle (7/1/2016-6/3-2018) and beyond. It is foreseen that eventually five to six CE blocks will need to be created by the committee.

Chairperson Galas to serve as Chairperson and Mr. Denis to serve as Vice Chairperson of the Ad Hoc Committee and to approve the Ad Hoc Committee’s scope of assignments.

Mr. Denis also provided a memo for the Board’s review

and discussion at its next meeting regarding the following:

Rule writing language for the Definition of

Classroom and Acceptable Technologies.

Rule modification regarding record

keeping/retention.

2) Email inquiry regarding guard cards for police officers.

(Deferred from the March 10, 2016 meeting.)

After further discussion and review of the Hawaii Revised Statutes (“HRS”) and Hawaii Administrative Rules (“HAR”) it was moved by Chief Perry, seconded by Mr. Denis and unanimously determined that based on the information contained in the emails, active duty police officers who act as guards while they are on regular or special/extra duty are not subject to Hawaii Revised Statutes (“HRS”) section 463-10.5’s guard registration requirements because they are exempt from the definition of “guard” under HRS section 463-1. HRS section 463-1 defines a “guard” as:

“[A] registered uniformed or nonuniformed person responsible for the safekeeping of a client's properties and persons within contractually prescribed boundaries, and for observation and reporting relative to such safekeeping. "Guard" shall not include any active duty federal, state, or county law enforcement officers or personnel.” (Emphasis added).

If those police officers act as guards while they are off duty (i.e., they are not on regular or special/extra duty) or engage in outside employment (i.e., they are paid by outside employers, not the police department, for those guard services), then they are subject to HRS section 463-10.5’s guard registration requirements. HRS section 463-10.5 states that:

“Effective July 1, 2013, all guards, and all agents, operatives, and assistants employed by a guard

agency, private business entity, or government agency who act in a guard capacity shall apply to register with the board, and meet the following registration, instruction, and training requirements prior to acting as a guard . . .” (Emphasis added).

However, because they are employees of a law enforcement agency, they are prohibited from registering as guards pursuant to Hawaii Administrative Rules (“HAR”) section 16-97-8’s conflict of interest provision. Thus, the Board believes that police officers cannot act as guards while they are off duty or are engaging in outside employment. HAR section 16-97-8 provides in relevant part that:

“(b) An employee or a reserve officer of any law enforcement agency shall not maintain or be eligible for any license issued under chapter 463, HRS.”

Although not defined in either HRS chapter 463 or HAR chapter 16-97, the term “license” is defined in HRS section 436B-1 as:

"[T]he permission to engage in a profession or vocation granted by the applicable licensing authority to a person who has satisfied every requirement for licensure, and shall include any registration, certificate, or other document issued by the licensing authority reflecting proof of permission.“ (Emphasis added).

Because a “license” includes a “registration” under HRS section 436B-1, an employee of a law enforcement agency is prohibited from registering as guard under HAR section 16-97-8(b).

Scope: a. Email inquiry asking if a license is required for technical

surveillance counter-measures (TSCM) services.

According to the e-mail, the company intends to provide “the systematic physical and electronic examination of a designated area by properly trained, qualified and equipped persons in an attempt to discover eavesdropping devices, security hazards or security weaknesses” using the following technology most commonly used for a bug sweep:

Multimeters for general measurements of power supplies and device components;

Time-domain reflectometer (“TDR”) for testing the integrity of copper telephone lines and other communication cables;

Frequency scanner with a range of antennas and filters for checking the electromagnetic spectrum for signals that should not be there;

Oscilloscope for visualization of signals;

Spectrum analyzer and vector signal analyzer for more advanced analysis of threatening and non-threatening RF signals;

Nonlinear junction detector (NLJD) for detection of components associated with hidden eavesdropping devices;

Portable x‐ray machine for checking the inside of objects and walls;

Computer security devices and tools for computer‐related threats;

Tools for manual disassembling of objects and walls in order to visually check their content;

Thermal imaging helps find hot spots and areas higher in temperature than the ambient area temperature;

Flashlight one of the most important tools to have beside a ladder for providing a competent sweep.

After some discussion, it was moved by Mr. Denis, seconded by Chief Perry and unanimously carried, based solely on the information provided that a private detective’s license is not required.

Board Election: Chief Perry nominated Vice Chairperson Galas to serve as Chairperson.

It was moved by Chief Perry, seconded by Mr. Denis and unanimously carried to nominate Vice Chairperson Galas as Chairperson of the Board. With no other nominations, Mr. Galas was unanimously elected Chairperson. Mr. Galas accepted the position.

Chairperson Galas nominated Mr. Denis to serve as Vice Chairperson. It

was moved by Chief Perry, seconded by Chairperson Galas and unanimously carried nominate Mr. Denis as Vice Chairperson. With no other nominations, Mr. Denis was unanimously elected Vice Chairperson. Mr. Denis accepted the position.
