Foundation for Democratic Reforms (FDR) and LOKSATTA have been launched with the specific objectiveof engineering democratic reforms in Indian governance.Our focus has always been on electoral reform,decentralization of power, speedy and efficient justiceand instruments of citizen empowerment. FDR wasregistered in November 1996 and LOK SATTA in October1997. In the life of the nation, a few years is a short span.But FDR/LOK SATTA have made rapid strides in buildinga popular reform movement, articulating specific andpractical goals, building consensus around them andactually achieving several significant results.

The Supreme Court judgment of May 2, 2002, theconsequent campaign for disclosure of candidate detailsand the resultant amendments to electoral law providingfor reasonable disclosures of criminal record are a goodrecent illustration of our initiatives leading to success.The Election Watch and screening and disclosure ofcriminal record of candidates in 1999 started this chainof events. Cleaning up voter lists by making post officethe nodal agency for registration is now accepted inprinciple by the Election Commission thanks to ourpioneering work, and we should pursue it to the logicalend. We have been pursuing the issue of making tenderedvotes a ground for repolling in order to check rigging.FDR/LOK SATTA have been in the forefront of electoralfunding reform. Our reform proposals have beensubstantially incorporated in the Bill now pending beforeParliament. This Bill, once enacted, will be a significantmilestone in the evolution of our democracy, and makesa great victory for us.

At the state and national level, we have tasted severalother successes. The citizen’s charters with penalties fornon-performance are very successful, and are beingextended to panchayats. A right to information law has

been enacted recently by Parliament, and we should ensureits effective enforcement and citizen’s active involvementin obtaining information applying it as an instrument ofaccountability. Local courts for speedy justice are vitalfor upholding rule of law. We have created the climate forsuch a law, and its successful application has immensepotential to transform justice delivery all over India.

We need to focus on a National Judicial Commission andan All India Judicial Service for improving the quality ofjustice. Above all, our belief is that mere change of playersis not enough. We need a change in the rules of the game.Genuine empowerment of local governments, to ensurethat our vote is linked to public good, proportionalrepresentation to truly reflect the will of the people andto eliminate the stranglehold of political fiefdoms, anddirect election of the head of government at the state andlocal levels to eliminate unaccountable and disguisedexecutive power and to ensure that popular verdicts arereflected in government formation and survival - theseare the three fundamental goals which will alter the processof power and herald genuine democracy and popularsovereignty.

In order to accomplish these great goals, we need tomobilize people at various levels – local, state and national.And there are many smaller, but important goals whichare the stepping stones for Indian transformation.

Our democracy is ripe for fundamental changes. The peopleare ready for governance reform. There are specific,practical, acceptable, solutions to our maladies. There isno room for cynicism or despair. Collective and informedassertion is bound to yield significant results. FDR/LOKSATTA’s experiences demonstrate that success is inevitableif we work with clarity, determination and good sense.The coming years are crucial for the future of our greatrepublic. If we make the citizen the centre of our universeand rebuild our institutions, we can easily fulfil our great,but so far untapped potential. This is time for decisiveaction.

for criminal records. Lok Satta invited the public toinform the names of the candidates with criminalrecord, along with supporting evidence to Post BoxNo.100 Hyderabad - 4, which was widely publicized.A Screening Committee consisting of 22 eminentcitizens was constituted to scrutinize the informationreceived and arrive at names of the candidates withcriminal antecedents. The screening committee metthrice. LOK SATTA received information on 33candidates who filed nominations. Subsequently 12candidates withdrew. The details of the 14 candidateswho are found to have criminal record is made public,of whom only one candidate got elected.Thanks tothe earlier Election watch efforts, public opinion hasbeen mobilized against criminalization of politics. Asa result most major parties desisted from nominatingpersons with criminal record as candidates.

LOK SATTA started off the year 2002 with “ ElectionWatch” for the Muncipal Corporation of Hyderabadelections held in Jaunary 2002. In the first phase, LOKSATTA took up a campaign for additions of namesof eligible voters and deletion of ineligible names.LOK SATTA’s efforts in this regard were activelysupported by State Election Commission, ChiefElectoral officer, and the Municipal Corporation ofHyderabad. In the second phase of the campaign,LOK SATTA conducted a Mayoral Debate on 12th

January, 2002 at Ravindra Bharathi. Eminent citizensacted as moderators and panelists. The debate wascovered live by most of the cable TV channels. It gavean opportunity for the Mayoral candidates to respondto the questions posed by the audience, elucidate theirviews and commitment on various aspects of localgovernance. It also gave the citizens of Hyderabad anopportunity to gain better understanding of thecandidates.

As part of the “Know Your Candidate” program,LOK SATTA has taken up screening of candidates

Organizational elections for grassroots units of LOKSATTA were held between January and March 2002.As per the new organizational policy of limiting keyoffices to one term only, new teams of office bearerswere elected in all the districts. The newly elected ApexCommittee, the general body of the organization meton April 27th in Hyderabad to elect key office bearersand the Coordination Committee, which is theexecutive body of the organization.

In a historic meeting, the Apex committee of LOKSATTA has unanimously elected Sri DVVS Varma asthe new Campaign Coordinator for Andhra Pradeshand has thus ushered in the first major leadershipchange for the movement. Recognizing the growingneed for building a national movement, theorganization has created a new position of NationalCoordinator and unanimously elected Dr JayaprakashNarayan for that position. The Apex committee hasalso elected members for the new CoordinationCommittee and has appointed Sri B Ankiah as itsGeneral Secretary.

LOK SATTA continued to spread its reach in the stateof Andhra Pradesh. Our estimates indicate thatapproximately 35 % of the state’s population are awareof LOK SATTA. Thanks to the untiring efforts ofSri DVVS Varma, and his colleagues, the district andlocal units have been strengthened and are functioningwith a new vigor and sense of purpose. As of March2002, there are approximately 1536 primary units, 312intermediate units including 67 municipal and 245mandal units of the organization in AP covering all23 districts of the state.

LOK SATTA has thus emerged as a major force ininfluencing and mobilizing public opinion. It is thelargest non-party civil society initiative in India withwide mass base and credibility. While the goals ofLOK SATTA are national, the movement recognizesthe need to build mass base in Andhra Pradesh.Accordingly the AP chapter of LOK SATTA is fullygeared to meet the challenges of building a non-partisan mass movement for democratic governancereforms.

LOK SATTA’s most vital success in the year 2002 is in thefield of electoral reforms at the national level. Lok Satta’sElection Watch campaigns in the past few years resultedin the successful public interest litigation by sisterorganizations. Lok Satta’s work was cited before courts,and finally it resulted in the landmark Supreme Courtjudgment on disclosures on May 2, 2002. Lok Sattalaunched a national campaign, and in a short span of timeachieved impressive results:

a. A broad national coalition - National Campaignfor Electoral Reforms (NCER) – has beenformed, with Lok Satta playing the lead role.

b. The Election Commission’s order of June 28,providing for rejection of nominations for nondisclosure was largely a result of LokSatta’campaign.

c. The major political parties, notably Congress,which initially opposed disclosures, are now firmlyin support of Supreme Court judgment.

d. Lok Satta sensitized media all over the countryand there is a quantum jump in public awarenessand support for electoral reforms.

e. Lok Satta took the lead in urging the President tointervene decisively and refer the matter toSupreme Court under Art 143. This advocacysucceeded to the extent that, the President sentback the Bill for the reconsideration of the cabinet,

which seldom happens in our parliamentarydemocracy.

f. The greatest success of Lok Satta’s campaign is increating a national platform with tremendouspossibilities for building future movement forcomprehensive electoral and governance reforms.

98 % want disclosuresA people’s ballot was held between the 27-30th ofOctober to gauge public opinion on the disclosureissue. The response was over-whelming.Approximately Eight hundred and fifty four thousand

(8,54,554) people participated in this ballot which wasconducted across the state in 500 centres, out ofwhom 8,38,199 (98.09 %) voted “Yes” to fulldisclosures, 10,434 (1.22%) voted ‘No” and 5,921(0.69%) votes were invalid. People from all cross-sections, well beyond our expectations, enthusiasticallyparticipated in this exercise. The results of the ballotexposed the hollowness of the politicians claims thatdisclosures are not needed as the people are wellinformed about their candidates!

Writ petition against the Ordinance/ActLOK SATTA along with ADR, PUCL and other civilsociety initiatives filed a PIL in the SC challenging thevalidity of Section 33 B of the Ordinance ondisclosures, which prohibits further disclosures exceptthose provided in the law. The final hearing in the caseconcluded on the 23rd of October and orders werereserved for judgment. Our counsels Sri PP Rao, SriPrashant Bhushan along with Ms Kamini Jaiswal, SriRajindar Sachar and Sri Sanjay Parikh have done acommendable job in articulating our stand that in ademocracy the people’s right to know about theirrepresentatives ought to be a fundamental and naturalright and any law which seeks to impinge on this rightshould be ruled unconstitutional. The uniongovernment’s counsels along with Sri Arun Jaitley havearticulated their position that the judiciary shouldn’tencroach on to the legislative arena and even expresseda view that “ right to vote” is not a fundamental rightand hence right to information about candidatescannot be ruled as a fundamental right either! Theeharing has been concluded, and the supreme courtreserevd its judgment.

Active Citizens’ TrainingLOK SATTA undertook a 3 year programme fortraining of 100,000 citizens in Andhra Pradesh withan aim to impart techniques of collective assertionand citizen’s initiative. The programme was launchedin 2001 and is scheduled to end in March 2004. Thecore focus of this training is on techniques of citizen’sinitiative and effective use of right to information as atool to fight corruption and increase transparency. Theemphasis is on “ collective informed assertion” withLok Satta as a platform. This effort is partly funded bya grant from Sir Ratan Tata Trust.

Empowerment of WomenRepresentativesAs part of their project “Associating of ElectedWomen Representatives of Local Governments”, theSingamma Sreenivasan Foundation has sought LOKSATTA’s assistance in the training and empowermentof elected women representatives in AP.

In the 1st phase, LOK SATTA has launched aprogramme to create awareness among electedwomen representatives in the three districts ofKrishna, Mahaboobnagar and Medak. LOK SATTAheld intensive deliberations with these elected womenrepresentatives at all levels and helped them formfederations in their respective districts. In the 2nd phaseLOK SATTA will undertake similar activities in 11other districts of AP culminating in the formation ofa state level federation of elected womenrepresentatives.

Power Sector Reforms -Leading by exampleEver since power sector reforms commenced inAndhra Pradesh and the Electricity RegulatoryCommission was constituted, LOK SATTA hasendeavoured to assist the authorities concerned toimprove the performance of the electricity sector andenable the consumers to have good quality power

supply at a reasonable price. The RegulatoryCommission has so far issued three Tariff Orders for2000-01,2001-02 and 2002-03 finalising the tariffs forthe respective years and issuing directives to the licenseesto improve their performance. Unfortunately, thoughthe Licensees have been making efforts, the results arehardly encouraging. Many directives of theCommission were not complied with. As such, lastyear, CORE (Consumer Organization for Reforms inElectricity) of LOK SATTA filed an appeal against thelast Tariff Order in the High Court of A.P. The appealis still pending.

In the meantime, the proposal of the Licensees forthe year 2003-04 has been received and objections ifany are to be filed by 3rd Feb. 2003. If we follow theprevious practice of merely raising objections and beingheard at Public Hearings, the Commission willcontinue to pass Tariff Orders with Directives. Butthese will remain ineffective as before. LOK SATTAhas therefore decided to insist on the Commissionsetting reasonable standards of performance such as,Losses, Interruptions, Voltage fluctuations, promptconsumer service etc. and offer to the Licenseesincentive for exceeding the standards set and imposesevere penalties for failure to achieve. Fortunately, thereis a Supreme Court judgment, which gives us hopethat such a course of action may be possible.

Purchase of Power accounts for 70 % of the cost ofelectricity supply. LOK SATTA has last year objectedto the approval of four gas based private powerprojects, unless the long term government policy inregard to gas price is in place and its availability isinsured. As otherwise, consumers of Andhra Pradeshmay have to bear the brunt of escalating gas prices inthe coming years. There is real risk of gas pricesdoubling or trebling in the near future as decontrollingtakes effect fully.

LOK SATTA has just now embarked on setting upfour pilot projects in East and West Godavari, Gunturand Krishna Districts to demonstrate howdistribution systems can be made more efficient andconsumer friendly with a single point responsibilityof a Franchisee, working in tandem with LOK SATTAvolunteers and the consumers of the area, particularly,the farmers. Sri S R Vijayakar, (former secretary,Government of India) one of the foremost expertson power sector in India and Sri Madanmohan (retd.Engineer, APSEB) are spearheading LOK SATTA’sefforts in this sector.

Current activities in AP

School Education ReformOne of the key issues crying for attention isimprovement of public education. There are threemain goals:

! empowerment of parents as stake holders! Improving the content (syllabus and text books)

and making education child - centered.! better evaluation methods to be able to assess

the real calibre of the pupils.

LOK SATTA formed a core group along with JanaVignana Vedika and Satyanveshana Mandali. Specific,practical and achievable steps are identified forimproving school functioning. This group is in closeinteraction with the government, and detailed work isbeing done on each aspects of school educationreform. We hope to have tangible changes in the policylevel and grassroots education in two years time.

Impact of LOK SATTA in Andhra Pradesh

! Arrested criminalization of politics, through itsinnovative “Election Watch” campaign.

! Introduced Citizen’s Charters in Municipalitieswith provision for penalties - first of its kind inthe country.

! Largely as a result of LOK SATTA’s advocacy,state government has taken up construction ofmillions toilets for individual households acrossthe state.

! Common electoral rolls for all elections became areality in the state.

! The state election commission accepted automaticre-poll provision if tendered votes exceed 2% ofvotes polled.

! Empowerment of stakeholder groups became areality through formation of water userassociations and school education committees.

! Altered the nature of debate on power sectorreforms. Our proposal for micro privatization ofdistribution is accepted and adopted by the stategovernment.

! LOK SATTA has emerged as one of the mostauthoritative and authentic voices on power sectorreforms in the country.

! Emerged as a powerful advocate for genuinedecentralization and empowerment of localgovernments.

! LOK SATTA was instrumental in bringing aboutan enabling legislation for registration of societiesin place of a very restrictive law.

! LOK SATTA created wide public awareness onthe necessity for a Right to Information law in thestate to increase transparency in government.

! LOK SATTA is relied on as a non-partisan andcredible advisor by the government and all majorpolitical parties on arrange of public policy issues.

! LOK SATTA emerged as a powerful civil societyplatform to give voice to people’s concerns.

! Largest people’s movement in AP reaching out toalmost 35% of the state’s population.

Guntur, Krishna, East Godavari, West Godavari,Vishakapatnam and Kadapa. The response was electrifying.Cutting across party lines, hundreds of sarpanchs and otherelected representatives participated in each district. Atpublic meetings held on 26th January, 2003 electedrepresentatives were invited to hoist the flag as legitimateheads of “ Little Republics”, and publicly declare electedlocal bodies as full-fledged local governments.

As part of its campaign to empower the local governments,LOK SATTA will endeavor to bring all these elected localgovernment representatives under a federation to fightfor their rights. As a first step towards that goal, manysenior elected representatives and supporters of localgovernment empowerment were brought under a commonplatform in a meeting held on the 23rd of February inHyderabad. Approximately 400 elected representativesfrom across the state including Chairpersons of DistrictPanchayats, Municipalities and former stalwarts in localgovernments participated in this meeting and laid thefoundation for the formation of a “ Federation forEmpowerment of Local Governments”. This federationwill be a non-partisan platform and received enthusiasticsupport from across the political spectrum. The federationdiscussed, debated and endorsed a policy statement and afuture plan of action. The federation has also unanimouslyelected Dr Jayaprakash Narayan as its coordinator.

LOK SATTA will shortly release a comprehensive reporton status of local governments in AP. This is the report ofthe committee on local governments formed by LOK

New Initiatives

Working for the Health of APLOK SATTA has constituted a panel of eminent expertsin primary health care and organized a conference inHyderabad to come up with practical measures to improvethe delivery of primary health care in the state. Dr R SArole, an eminent public health expert and Magasaysayaward recipient, participated in the deliberations andoffered valuable suggestions. He has kindly agreed to lendhis support to LOK SATTA’s initiatives for theimprovement of health sector in Andhra Pradesh.

LOK SATTA is closely working with Co-operativeDevelopment Foundation (CDF) and MulkanoorCoperative Rural Bank (MCRB) to implement aninnovative public health project in approximately 70villages in the vicinity of Mulkanoor, Karimnagar District.The initiative will be modeled after the ComprehensiveRural Health Care Project (CRHP) of Jamkhed,Maharashtra, pioneered by Dr Arole.

Campaign for Empowerment ofLocal GovernmentsLOK SATTA has declared 2003 as the year of localgovernments and launched a “Little Republics” campaignin Andhra Pradesh, calling for genuine decentralizationand empowerment of local governments. District levelmeetings with elected representatives were held in thedistricts of Karimnagar, Warangal, Khammam, Nalgonda,

SATTA under the chairmanship of Sri BPR Vithal, thedistinguished economist and Member, Tenth FinanceCommission. The report will contain an exhaustive reviewof the status of decentralization in AP and thecomparative picture in other states along with concreterecommendations on transfer of funds, functions andfunctionaries to the local governments.

Local Courts for Speedy JusticeSpeedy and accessible justice is one of LOK SATTA’s keyreform goals. The Law Commission in its 114th reportsuggested a viable mechanism of local courts as an integralpart of independent judiciary and due process of law. Onsimilar lines LOK SATTA has prepared a draft legislationfor setting up local courts at the rate of one for 25,000population in rural areas and 50,000 in urban areas headedby a honorary magistrate (Nyayadhikari). The key featuresof the draft legislation are:

● The local court will be an integral part of thejudiciary

● The local court will have original jurisdiction inspecified issues/offences - generally not exceedingone lakh rupees in civil cases and one year’simprisonment in criminal cases

● A person of high repute and legal knowledge will beappointed by the District Judge as Nyayadhikari

● The Nyayadhikari is an honorary office with anhonorarium and secretariat and travel allowance

● The parties have the option to appear in person or berepresented through a lawyer

● The Nyayadhikari may hold court in any village in hisjurisdiction and visit any village or location to inspecta site or to record evidence

● The proceedings of the local court will be in Telugu● The local court will deliver a verdict within 90 days of

receiving a petition/complaint● There will be provision for appeal against the local

court’s orders.

LOK SATTA circulated the draft legislation for local courtswidely to various legal luminaries, jurists and civil societyactivists and sought their suggestions. LOK SATTA held aconsultation meeting on the 12th of February, 2003 inwhich Justice A Lakshmana Rao (former chief justiceAllahabad High Court), Justice Jeevan Reddy ( formerchairman Law Commission), Smt Rama Devi (formergovernor of Karnataka), Justice Chalapathi (former judgeof Punjab & Haryana High Court), Justice SeetharamaReddy (former Lok Ayukta of AP), Justice JagannadhaRaju ( former Lok Ayuktha of AP) and others participated.The participants were very positive about the proposedlegislation and heralded it as a step in the right directionand offered very constructive suggestions to improve onthe draft Bill. A committee comprising Justice LakshmanaRao, Justice Chalapathi , Justice Seetharama Reddy, JusticeJagannadha Raju, Sri KSN Murthy and Dr JayaprakashNarayan was entrusted with the task of considering varioussuggestions received and revising the draft appropriately.The committee met a number of times over the followingweeks and after intense deliberations finalized the draftlegislation which can be accessed at www.loksatta.org/draftlocalcourts.pdf. LOK SATTA intends to approachthe government, political parties and the High Court toseek broad support for this legislation. We will also makeall efforts to build broad public support for this initiative.At the national level also we aim to make this a majoradvocacy issue for other states.

Dr Narayan delivered the Sri Gutta Srirama RaoEndowment lecture on “Constitutional Reforms”at the National Law School (NALSAR), Hyderabad.

Dr Jayaprakash Narayan, was invited to be a memberof the Commonwealth team of observers for theKenyan general elections, which were held on the27th of December. Dr Narayan was in Kenya for 3weeks as part of the successful mission, which saw

the peaceful conduct of the general elections as well asthe first peaceful transfer of power in the Africancontinent outside of South Africa.

Dr Jayaprakash Narayan was invited to inaugurate thestate convention of Citizen’s Action Network inTrichy, Tamilnadu.

Dr Narayan was invited by the government ofNetherlands to participate in a seminar onGlobalization held in Amsetrdam to commemoratethe 400th anniversary of Indo-Dutch trade relations.

HonorsDr Jayaprakash Narayan was honored with the“Rotary Manav Seva Award 2002”for his crusadeagainst corruption.

Dr Jayaprakash Narayan was awarded the Eleventh“Yudhvir Memorial Award” for the year 2002 for outstanding contribution to the cause of good governance.
