FROM OUR CHAIR

As we enter a new fi scal year I would like to share with our California licensees and consumers of chiropractic care some progress highlights of the California Board of Chiropractic Examiners (BCE) especially in enforcement since our newsletter one year ago

The past year has been significant for us We have continued our efforts to make the BCE more transparent and efficient by building on mdash but never resting on mdash previous accomplishments

In January 2010 the Department of Consumer Affairs briefed us on its efforts for sweeping enforcement reform across all the healing arts boards The Department worked with Senator Negrete-McLeod to initiate comprehensive legislation to achieve this reform Regrettably the result of that collaboration SB 1111 (the Consumer Health Protection Enforcement Act) did not pass the Senate Business and Professions Committee

At the same time however with support from the Enforcement Committee we conducted our own top-to-bottom review of the BCErsquos existing enforcement system

We reviewed SB 1111 and applied principles of the bill that are the most relevant to the BCE in creating a regulation package tailored to expedite our Boardrsquos specific enforcement requirements

I am pleased to report that our enhanced enforcement system has already paid off handsomely We have reduced our average case closure time frame from five years at the beginning of 2007 to its current turnaround rate of 10 months

To my knowledge this dramatic improvement makes us one of the most efficient healing arts boards in the State and arguably the most improved when it comes to more efficiently resolving enforcement cases for both consumers and licensees

Other milestones include the Boardrsquos Manipulation Under Anesthesia regulation which took effect on April 18 2010 With this regulation consumers are better protected from serious injury because chiropractors must follow specific standards when performing chiropractic manipulation on patients under anesthetic sedation

Francesco Columbu DC of Los Angeles was initially appointed to the Board by Governor Schwarzenegger on February 10 2006 and was reappointed to a second term on February 25 2010 He has been a practicing chiropractor

in West Los Angeles since 1978 Dr Columbu has won every major title in bodybuilding and weightlifting and has held a number of power lifting world records He is a two-time Mr Olympia and Mr Universe and also held the title of Mr World

Hugh Lubkin DC of Elk Grove was initially appointed to the Board by Governor Schwarzenegger on February 28 2007 and was reappointed to a second term on February 25 2010 Dr Lubkin has owned and practiced at Laguna

Chiropractic Clinic in Elk Grove since 1991 He is also a qualified medical evaluator for workersrsquo compensation cases and is a medical legal expert for injury and professional malpractice cases Dr Lubkin is a graduate of the Chiropractic Orthopedics Program of Western States Chiropractic College and is a former vice president of the International Chiropractors Association of California where he is currently on the board of directors

GOVERNOR REAPPOINTS TWO BOARD MEMBERS

BOARD HONORED BY INTERNATIONAL REGULATORY ASSOCIATION

Californiarsquos Board of Chiropractic Examiners (BCE) has been honored by the Federation of Chiropractic Licensing Boards (FCLB) with the 2010 Dr Earl L Wiley Outstanding Chiropractic Licensing Board Award BCE is now the only chiropractic board in the history of the award to receive the honor twice

This international award was bestowed on the BCE at the FCLBrsquos Educational Congress in Baltimore Md It represents more than three years of very hard work by the BCE and is the highest award that can be bestowed upon a chiropractic regulatory board

The BCE has been working diligently to improve the standards of care in the chiropractic profession in California Since 2007 we have made several regulatory improvements and have reduced our case resolution time down to one of the shortest of all the Statersquos healing arts boards We have also implemented procedures that make us one of the most transparent regulatory boards in California including live webcasting of our meetings

The Earl L Wiley award is given each year to a board that has set a new standard for chiropractic regulation The award means the board is recognized by its peers as a model for the excellence in carrying out its responsibility to protect the health safety and welfare of the public

CONTINUED FROM P 1 In addition a regulation allowing the BCE to recognize specialty programs went into effect on April 15 2010 The Board has also submitted amendments to regulations on reporting licensee violations which have been approved by the Office of Administrative Law and will take effect on June 26 2010

The BCE also filed live fingerprint regulations on April 19 2010 requiring all licensees to comply with electronic fingerprinting and facilitating the access of law enforcement agencies to licensee fingerprints to further enhance enforcement efforts

Continuing education regulations constitute our most ambitious project to date We have worked with numerous stakeholders for roughly two years and anticipate submitting the fi nal regulation package within the next several months If we gain approval for instituting these regulations we will be able to offer one of the most progressive chiropractic continuing education programs in the country

Although the Board has not levied a license fee increase since 1991 increased litigation and enforcement costs have made it necessary to propose a fee increase to keep the BCE fi nancially solvent Assembly Bill 1996 (Hill) which is pending will increase the annual license renewal fee from $150 up to $250

At the BCE we owe our accomplishments in large part to incredible teamwork In my estimation our staff remains one of the best across Californiarsquos healing arts boards

We are indebted to Interim Executive Offi cer Robert Puleo who has been doing an excellent job since Brian Stiger was promoted from this position to become the Director for the Department of Consumer Affairs Special thanks are also due to the Boardrsquos legal counsel Ms LaVonne Powell for her outstanding contributions to the Boardrsquos work

I would be remiss if I failed to mention the dedication of our Board members and their investment in the BCE Irsquod especially like to thank our Vice Chair Hugh Lubkin DC our Secretary Franco Columbu DC Richard Tyler DC and Jeffrey Steinhardt DC I am hopeful that we will soon be adding two public appointees once more restoring the Board to its full complement of members

A properly licensed chiropractic doctor has completed comprehensive academic and clinical training passed national and State examinations and completed a background check before the Board will issue a license Chiropractic doctors must renew their license annually and post their license in plain view for consumers to see
