Memorandum of UnderstandingBetween : The person registered to attend training (Participant)And : Department of Industry, Innovation and Science (DIIS)

1. DIIS agrees to provide training and the Participant agrees to receive the training on the followingconditions.

2. Training(a) The training will be conducted over three days from 9.00am to 5.00pm each day at a location to be

notified by DIIS. This agreement ends on the conclusion of the training.

3. Fees and Payment(a) The Participant will pay the Fee specified in an invoice at least one week before the training

commences.(b) On receipt of payment of the fee DIIS will send the Participant confirmation of attendance at the

training.(c) The fee is charged for the full duration of training. The participant is not entitled to a refund if they

do not attend training or attend only part of the training.

4. Cancelation(a) If the training event needs to be cancelled by DIIS, then DIIS will refund the Fee to the Participant

but will not be responsible for any other costs to the Participant arising from the cancellation.(b) The Participant may cancel their attendance up to 10 business days before commencement of the

Training. That cancelling participant may attend an alternative training course or nominate anotherParticipant to attend training in their place but will not be entitled to a refund.

5. Conduct(a) The Participant acknowledges that they are attending training in their capacity as an Australian

Public Service (APS) employee and are subject to the APS Code of Conduct, provisions of the WorkHealth and Safety Act 2011 and other applicable policies while in attendance.

(b) The participant is not permitted to photograph the training event without the prior writtenconsent of DIIS.

6. Premises(a) The Participant must register at the building reception on arrival and be escorted onto the

premises by DIIS staff.(b) At all times the participant is on DIIS premises they must follow the security directions of DIIS staff.(c) At the conclusion of training the participant must return the premises to the same condition as it

was when training commenced and notify DIIS of any damage incurred during training.

7. Indemnity(a) The Participant indemnifies DIIS and its employees and agents against any loss suffered by DIIS

in connection with their attendance at the training arising out of a negligent or unlawful act oromission of the Participant. This clause survives expiry of this agreement.
