BILL NO. 7063 ORDINANCE NO. Introduced by AN ORDINANCE OF THE CITY OF FERGUSON REPEALING SECTION 44-31 OF THE TRAFFIC CODE AND ENACTING A NEW ARTICLE III OF CHAPTER 33 ESTABLISHING A CITIZEN REVIEW BOARD NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FERGUSON, MISSOURI, AS FOLLOWS: Section 1. Section 44-31 of Article I of Chapter 44 of the Municipal Code is hereby repealed. Section 2. Article III of Chapter 33 of the Municipal Code is hereby established by the addition of a new article which shall read as follows: CHAPTER 33 POLICE ARTICLE III CITIZEN REVIEW BOARD Sec. 33-24- Citizen Review Board Established There is hereby created and established a Citizen Review Board which shall advise the Mayor, City Council, City Manager, and Chief of Police on any and all matters relating to the operation of the department of public safety including, but not limited to, the provisions of public safety services to the city and recommendations related to traffic matters, and shall carry out such further duties as set forth herein. Sec. 33-25- Composition; organization; meetings. (a) The board shall consist of seven (7) members, 2 citizens from each ward of the City, plus the mayor or his/her designee, and a member of the City Council. The Chief of Police shall be a non-voting ex-officio member of the board and shall attend all meetings of the board. The municipal judge and the city prosecutor (assistant city attorney) shall also be ex officio members of the citizen review board with the right to discuss and suggest matters before the citizen review board, but with no right to make motions or to vote on any matter before the citizen review board. (b) The Mayor, with approval of the City Council, shall appoint members of the Citizen Review Board for staggered terms of three (3) years. Vacancies on the board shall be filled by the appointment for the unexpired term of the member vacating the office. (c) Each member of the commission shall have the following qualifications: (1) Shall have been a resident of the city for one (1) year preceding their appointment and shall at all times while holding office be a resident of the city; (2) Each member must be at least twenty-one (21) years of age prior to the effective date of appointment;

No person shall serve on the commission if he/she is in arrears on any taxes due to the city or is not registered and qualified to vote or has been or is convicted of a felony. (d) The commission shall meet upon call of the Mayor. (e) Members of the commission shall serve without compensation Sec. 33-26- Powers, duties and responsibilities (a) The citizen review board shall act in an advisory capacity to the Mayor, City Council, City Manager, and Chief of Police on policy matters relating to the operations of the department. Policy matters shall be defined to include manpower levels and salaries, budgets, community relations, training programs and law enforcement programs. (b) The board shall, on request, make recommendations to the Mayor and City Council regarding the placement of traffic control devices and other matters regarding the administration and enforcement of traffic regulations. (c) No member, nor shall the board, have the power, nor shall they assert the power to exercise direct supervision over any member of the department. The board shall not usurp or exercise, nor attempt to usurp or exercise, any of the powers of the Chief of Police or City Manager but shall meet with the director and advise him/her of any matter it believes requires attention or remedy.
