Inclusion

1. Reference to the conducted Negotiation Conference at DAP Conference Center in Tagaytay City on 18 October 2019 (Friday) and clarifications sought by interested bidders, please be informed on the following adjustments / changes / agreements:

(a) The Submission of Proposals was adjusted from 31Oct2019 (Thu) to 07Nov2019 (Thu) until 12:00NN. The Opening of Proposals will be at 01:00PM of 07Nov2019 (Thu) at DAP Building, Pasig City;

(b) The BAC Secretariat will provide an e-copy of the DPWH Department Order No.197, series of 2016 to all Proponents/Bidders who attended the Negotiation Conference in DAP Conference Center, Tagaytay City thru their declared email addresses;

(c) On the Bill of Quantities (BOQ), the Bidders can change the “year-estimate” or the Column “C” (in the spreadsheet of the provided BOQ) as long as it will be technically feasible, further subject to the Approved Budget for the Contract (ABC) limit for the year (as indicated in the BOQ);

(d) On SCC Clause 39.1, page 80 of the Negotiated Procurement Documents (NPD) – Advance Payment to the Contractor, the advance payment (or the Mobilization Fee) was adjusted from Ten Percent (10%) to Fifteen Percent (15%) of the Total Contract Price; and

(e) The Detailed Unit Price Analysis (DUPA) will be submitted only in e-copy (excel-format). The said excel file must be included in the USB that should be included in the Financial Proposal.

qualifies it as Unit Price Bid but based on NPD page 93 it is lump sum.

Either way, can we modify the given quantities as needed?

Contractor for the complete execution, implementation, and commissioning of all works/ systems must be included as awarded Contractor’s “one lot responsibility and accountability without additional costs/charges to DAP and extension of project-timeline”.

Additional line item/s may be inserted but the details of the computations must be followed (as explained during the Negotiation Conference in DAPCC Tagaytay).

The proposal/bid shall not exceed the ABC.

02. GENREQ -02 02: Regarding the contents of the technical bid proposal, based on the Invitation for Negotiated Procurement Document (NPD) page 5 to 7 and Bid Data Sheet (BDS) page 39, Organizational Chart, List of Contractor's Personnel and List of Contractor's Equipment Units are not included but are required in the Instruction to Bidders page 21. If it will indeed be required, how will we mark these items: T05, T06 & T07 respectively?

These items will not be marked T05, T06, and T07 respectively because they are not included as part of technical documents submission. However, under BDS Clause 31.4(f) of page 45 of the NPD, these items will be required as part of other contract documents to be submitted by the awarded proponent/bidder.

Refer to Section X: Documentary Requirement Checklist found on pages 140 to 144. This serves as complete guide for all documentary requirements that must be submitted as integral parts of eligibility, technical, and financial documents.

03. GENREQ-03 03: As per Bid Data Sheet (BDS) page 36 Source of Funds, Approved Budget for Construction (ABC) is P838M but the approved in only P652.50M. Is the P185.50M additional amount already approved and allocated for the project?

The remaining amount will be included in the National Expenditure Program (NEP) as specified under BDS Clause 2 – Source of Funds.

The same was also publicly advertised.

04. GENREQ-04 04: Regarding the Completed Similar Contracts, does the Single Largest Completed Contract be required to be at least ten (10) storey high and at the same time at least 50% of the ABC?

Regarding the completed similar contracts, the Single Largest Completed Contract (SLCC) should be equivalent to at least 50% of the ABC adjusted, if necessary, by the Bidder to current prices using the Philippine Statistics Authority (PSA) consumer price index as stated in ITB Clause 5.4(a) found on page 14 of the NPD.

BDS Clause 5.4 under Section III – Bid Data Sheet found on page 36 provides that Similar Contracts shall refer to any contract for construction of conference center/ convention center, or office building, or commercial building, or institutional building, or hotels at least ten (10) storey high, or of greater magnitude and complexity.

05. GENREQ-05 05: As per BDS Personnel Qualifications and Work Experience pages 39 and 40, please confirm the following:

a) Structural Engineer:

Structural Plans are already available for bidding and later on construction purposes. What will be the role of the Structural Engineer on site? Please confirm this requirement.

b) Professional Mechanical Engineer

a) As specified under BDS Clause 12.1(b)(ii.2) of Section III – Bid Data Sheet, the Structural Engineer is among the key personnel required for the project and whose minimum qualification and work experience is indicated in page 39 of the same clause.

b) Yes, as specified under BDS Clause 12.1(b)(ii.2) of Section III – Bid Data Sheet’s instructions on page 42, designation of key personnel to more than one of the stated fields /professions is not allowed.

c) No, as specified under BDS Clause 12.1(b)(ii.2)

One PME can do both functions. Is it really required that these be assigned to separate individuals. Please confirm.

c) Sanitary Engineer: Can a Registered Master Plumber be a substitute for this position? Please confirm.

of Section III – Bid Data Sheet, the licensed Sanitary Engineer is among the key personnel required for the project and whose minimum qualification and work experience is indicated in page 40 of the same clause.

06. GENREQ-06 06: Please confirm that only two copies of Bid Proposal will be prepared. One (1) original copy and One (1) certified true copy, no Copy 1 and Copy 2 needed.

Yes, as stated in item no.1, Clause 20.3 page 44 of Section III – Bid Data Sheet, “interested contractor” shall submit ONE (1) original copy and ONE (1) certified true copy of their proposal (i.e. final eligibility, technical and financial documents). This was also re-iterated during the Negotiation Conference in DAPCC-Tagaytay last Oct.18, 2019.

07. GENREQ-07 07: Regarding the deadline of bid submission, can we ask for a two (2) week extension to properly prepare the Detailed Unit Price Analysis (DUPA) and quantification.

As agreed during the Negotiation Conference in DAPCC-Tagaytay last Oct.18,2019 (Mon), the submission and opening of proposals/bids was extended for one (1) week only.

The submission of proposal to the BAC Secretariat was finally set on or before 12:00NN of 07Nov2019 (Thu). Opening of the proposals will start 1:00PM.

08. GENREQ-08 08: In connection with Genreq-02 query, based on the BDS Section 31.4(f) Submission of Other Contract Documents, are the documents listed to be included in the bid proposal or they will be submitted in the Post Qualification stage after bid opening? If they will be part of the bid technical proposal, how will they marked?

No, under BDS Clause 31.4(f) of page 45 of the NPD, these items will be required later (NOT during the submission of proposal/bid) as part of other contract documents to be submitted by the awarded proponent/bidder.

09. GENREQ-09 09: Still connected to BDS Section 31.4(f), please confirm that the CV of all Stockholders and Owners of the Company are to be submitted. Normally only the President and General Manager are required. Please confirm.

Yes, under item 3.1 of Clause 31.4(f), page 45 of Section III – Bid Data Sheet, the Curriculum Vitae of Stockholder(s)/Owner(s) is/are required for submission as part of other contract documents of the awarded proponent/bidder.

For entities that are registered as “corporations”, it is required that the CVs of all “ Stockholders & Owners” of the corporation are submitted.

10. GENREQ-09 10: Regarding the Start Date of Project, please confirm that this will be upon receipt of the Notice to Proceed. Is there already a valid Building Permit issued? Major activities cannot begin without a Building Permit.

Under Clause 1.28 of Section V – Special Conditions of Contract found on page 77, the Start Date shall be the date of receipt of the Notice to Proceed (NTP).

As specified under item 2.1.1 of Section VI – Schedule of Requirements and Specifications found on page 86, Application for Building Permit and other necessary permits including payment of fees (i.e., application and other fees imposed by the Local Government) is part of mobilization and general requirements.

This concern should also be part of the Network-diagram that should be provided by the Proponent/Bidder.

Securing the needed “Building Permit”, and other clearances will have to be taken cared of by the Contractor

11. GENREQ-10 11: As per Special Conditions of the Contract (SCC) Clause 2.2 Sectional Completion, only the Design Fit-outs, Furnishings and Fixtures (DFOFFs) are excluded. However as per the BOQ there are other items excluded like Airconditioning Works, Electrical Auxiliary Works and Lighting Fixtures.

Please confirm that all items marked as "N/A" in the BOQ are all excluded.

As explained during the Negotiation Conference, DFOFFs were mentioned to in the BOQ to give the Contractor the idea what items will be placed in the building to be constructed.

Those marked “B” in the BOQ are the only items that the Contractor will have to construct /install /provide.

In the submission of the proposal, DFFOFs, marked as “D”, are excluded.

12. GENREQ-11 12: SCC Clause 7.4(c) states that the Performance Security will be released after submission of Warranty Bond and issuance of Final Certificate of Acceptance. Please confirm that the Final Certificate of Acceptance will be given after project completion before the warranty period begins.

No, the Certificate of Final Acceptance will be issued after the warranty period, which is at least five (5) years, against poor workmanship and one (1) year against defects traceable to materials supplied/ installed and/or as specified in the manufacturer’s brochures. This is clearly specified under item no.6 of Clause 51.1 of Section V – Special Conditions of Contract found on page 81 of the NPD.

“Performance Security” is construed as the bond/assurance that the Contractor will faithfully do its obligations to “perform” the awarded contract. “Warranty Bond” is construed to be the protection of the DAP that whatever the Contractor has built will be reasonably compliant with the specifications and conditions set forth in the contract.

A Certificate of Completion (COC) shall be issued by DAP after the construction has been completed within the set terms of references and approved plans, including other incidentals that may cropped-up and will be agreed upon during the actual implementation/ construction period

Certificate of Final Acceptance will be issued after the warranty period.

13. GENREQ-12 13: SCC Clause 12.5 Warranty Against Structural Defects/Failures states that this will be a period of fifteen (15) years. Please confirm the following:

a) This period will begin immediately upon project completion and inclusive of the Five (5) Year Workmanship warranty;

b) No warranty bond needed to be issued with a 15 year validity;

c) This warranty period will have a shared responsibility with the project Structural Designer.

a) No. As specified under General Conditions of Contract (GCC) Clause 12.5, page 56 of the NPD, the warranty against Structural Defects/Failures, except those occasioned on force majeure, shall be reckoned from the date of issuance of the Certificate of Final Acceptance by the Procuring Entity.

b) As specified under GCC Clause 12.7, page 57 of the NPD, there is warranty security and shall remain effective for one year from the date of issuance of the Certificate of Final Acceptance by the Procuring Entity, and returned only after the lapse of said one year period.

c) Please refer to items (a) to (e) of GCC Clause 12.4 which are found on pages 55 to 56 of the NPD regarding the specific responsibilities for

structural defects/failures.

The relevant, pertinent, applicable, appropriate, and prevailing rules and technical standards as enshrined in the enforceable National Building Code of the Philippines, other normally acceptable engineering standards plus other statutory requirements governing construction of such structure shall apply to this transaction.

14. GENREQ-13 14: SCC Clause 51.1 "As Built Drawings", please confirm the Warranty Certificate of is valid for Five (5) years against poor workmanship but the warranty bond to be issued will only be valid for 1 year.

As specified under GCC Clause 12.7, page 57 of the NPD, the warranty security shall be stated in Philippine Pesos and shall remain effective for one year from the date of issuance of the Certificate of Final Acceptance by the Procuring Entity, and returned only after the lapse of said one year period.

However, the Certificate of Final Acceptance will be issued after the warranty period which is at least five (5) years against poor workmanship and one (1) year against defects traceable to materials supplied/ installed and/or as specified in the manufacturer’s brochures.

This is clearly specified under item no. 6 of Clause 51.1 of Section V – Special Conditions of Contract found on page 81 of the NPD.

15. GENREQ-14 15: SCC Clause 51.2, Release of Final Payment will be released upon submission of all items specified in SCC Clause 51.1. How about the Retention Payment, shall it be released thirty (30) days after Final Payment has been released?

As specified under GCC Clause 42.3, page 71 of the NPD, states that the total “retention money” shall be due for release upon final acceptance of the Works.

Final payment shall be subject to all requirements as specified, and shall be in accordance and compliance with the prescribed government accounting and auditing rules and regulations.

16. GENREQ-15 16: Please provide a layout and details of the board-up to be installed.

This shall be taken up during the implementation stage or pre-construction meetings with whom the Project will be awarded to.

Boards-up shall be decent and sturdy enough to ensure safety and protection for all concerned personnel. The overall look shall blend to the requirements on the context of “business-as-usual” for the operating units of the DAP Conference Center.

17. GENREQ-16 17: Please identify the utilities/facilities to be relocated / restored during implementation works.

This shall be taken up during the implementation stage or pre-construction meetings with whom the Project will be awarded to.

Reasonable checks and balance, including documentation (written and digital) should be in compliance with ISO-standards on quality management system.

18. GENREQ-17 18: Will a field office be needed for Owner's representatives, Construction Management Team or Design Consultants? If yes, please provide the office space, amenities and equipment requirements so we can include in our costings.

Yes. Field Office is needed for the Owner’s representative, Construction Management Team or Design Consultants. However, the winning Proponent/Bidder shall have its own Field Office, amenities, etc as part of the general requirements.

19. GENREQ-18 19: Regarding the Weekly Coordination Meetings, please confirm that the snacks and beverages will be provided by DAP.

Arrangement on venues and meals during coordination meetings shall be subject to agreements between the winning Proponent/Bidder and End User Representative.

20. GENREQ-19 20: Please specify when will be the last day of queries and deadline of answers from consultants. For items that are not made clear by then will be deemed and marked as not included?

As agreed during the Negotiation Conference in DAP-Tagaytay, the last day of submission of request for clarifications is on Oct. 21,2019 (Mon) and posting of answers thru Bid Bulletin will be on Oct.24,2019 (Thu).

Items that are not raised for clarification shall be dealt with in compliance with the pertinent provisions of the 2016 Revised IRR of RA9184.

21. GENREQ-20 21: Regarding the Additional Requirements as per NTB page 87, please clarify the following:

The Ground Breaking minimum requirements shall include a 3m x 4m tarpaulin backdrop including portable metal scaffoldings, 4 sets of 4m x 4m portable tents, 8 shovels, 15 safety vests, 15 safety helmets, 3m high metal tripod, 150mm PVC capsule, 200mm capsule concrete casing, excavation works, concreting and backfilling.

It is assumed that all of these items are part of the OCM of the financial bid.

22. GENREQ-22 22: Regarding the BOQ and DUPA, please clarify the following:

a) We see a lot of discrepancies in the BOQ vs the plans. Can we add more rows & line items in the Others portion of the BOQ to include them?

b) In the DUPA there is no provision for the Others Items. Can we add rows for these?

a) Add these items in the allocated rows marked with “Others for Division ‘#’, if any”; else encode zero “0” for all items marked “?”.

23. GENREQ-23 23: Please confirm that the DUPA will be submitted in softcopy in usb flash drive only.

Yes, the Detailed Unit Price Analysis (DUPA) will be submitted only in e-copy (excel-format) and shall be found in the USB Thumb Drive to be submitted by the proponent/bidder as specified under item no. 4 of Clause 13.1(b) at Section III – Bid Data Sheet on page 43 of the NPD.

The said excel file must be included in the USB that should be included in the Financial Proposal.

24. GENREQ-24 24: Kindly provide us a copy of the Minutes of the Prebid Meeting.

Proponents/Bidders may request a copy, in writing, of the minutes of the meeting from the BAC Secretariat.

25. CIVIL-01 25: As per the Landscaping Plans, there are no trees to be added only shrubs and ground cover but in sheets SE-01 to SE-03 there

a) Where shall we charge these post tensioning works?

b) We highly recommend the project BOQ be revised and make this a regular cost item.

We would need your clear advice on this matter.

43. MECH-02 43: In BOQ Item 23.5.6, Duct Insulation is styropore insulation, 1200mm x 2400mm but in the specifications Item 23.4.2.E it is fiber glass insulation with aluminum foil barrier, class 5. Please confirm which will govern.

44. MECH-03 44: Still on insulation, if fiberglass insulation will govern, kindly confirm if this will be used on both airconditioning and kitchen exhaust duct. If not, kindly clarify what will be used for the two of them respectively.

Use Styropore Insulation on both Air-Conditioning Supply and Return Duct. Fiberglass Insulation shall be used on Kitchen Exhaust Duct due to high surface temperature.
