The TWO BID PROPOSAL shall be submitted in Sealed Cover according to the terms and conditions enclosed. The technical bids shall be opened in our office at Noida/UP/India on 22.05.2003 at 15.30 Hrs. (IST) in presence of tenderers who would like to attend tender opening on this date. The price bids of those tenderers whose technical bids are found acceptable shall be opened later on and the date for price bid opening will be intimated by BHEL separately on scrutiny of technical bids. BHEL however reserves the right to select any crane from the offers available suiting to BHEL's site requirement at its sole discretion.

ANNEXURE I Technical Specification

LATTICE BOOM HIGH CAPACITY CRAWLER CRANE The crane offered should have various systems and accessories as described here under. The bidders should confirm / comment on each point. The bidders should offer crane to meet the technical Data enclosed.

1 CRAWLER CHASSIS

a Frame

It should be box type torsion resistant welded construction made of high tensile structural steel.

b Drive

Each crawler chain should be driven individually by one hydraulic drive system. Both crawler chains to be independently controlled for synchronous or counter rotation drive mode. Brakes for travel motion should be spring-applied hydraulically released disc type.

c Central Ballast

The central ballast to consist of base frame and counterweight plates of suitable sizes for easy transportation. Vendor to supply necessary drawing of counterweight plates for local procurement by BHEL.

d Central lubrication system

One central lubrication system per crawler carrier to be provided for crawler rollers and bearing.

2 SUPERSTRUCTURE

Superstructure to be connected with carrier by a 3-row roller slewing ring, 360° continuous rotation.

a Frame

It should be all-welded torsion-resistant construction made of high-tensile structural steel.

b Crane engine

Engine should be, turbo, water cooled ,diesel operated

c Electrical installation

24 Volt-DC, 2 batteries

d Crane drive

While lowering the load the braking energy should be used immediately as working energy for other crane movements just in progress for reduction of fuel consumption.

e Oil cooler

The oil cooler is to be hydraulically driven with thermostatic regulation.

f Control

All crane movements to be controlled by 2 nos. 4 way joystick hand levers and 2 nos. 2 way hand/foot levers.

g Hoist Winches

Hoist winch should consist of two winches for using double hook block with traverse. Each winch to consist of hydraulic motor, hoist drum with integrated planetary gear and spring-applied hydraulically released disc brake. Hoist rope should be of sufficient length to work with offered boom.

i Slewing Motion

This mechanism should have adequate number of slewing gears to have a provision of working in Superlift configuration also. Slewing gears are to consist hydraulic motor, planetary gear and spring-applied hydraulically released disc brake.

j Gantry frame

Gantry frame should be equipped with hydraulic cylinders for self-erection of the crane

k Crane cabin

It is to be all-steel construction fitted with safety glazing, heating, adjustable shock-absorbing seat, windscreen wipers for front and roof windows, control instruments and warning lights. The cab should be slewed -out laterally from its transport position and inclined to the rear for better view of the load.

3 Safety devices

Hoist limit switch, inclination indicator, safety valves against hose and pipe rupture, anemometer, drum limit switch at 3 rest rings.

4 Overload safety indicator

The operating configuration display on monitor in operator cabin should show the load charts of the crane, graphic symbols displaying safe working load, gross load, net load, working radii & angle, boom length, and sheave height. Initialization errors, system errors, and application errors should also be shown on the monitor by error number.

5 Aviation warning light with battery charger

24 V Double-flash light mounted on to lattice boom or jib head. Battery charger 220 V / 24 V.

6 Central lubrication system

Crane should be equipped with central lubrication system for slewing ring, winches, pivot section main boom, derrick, cabin folding arm, auxiliary reeving winch.

7 Superstructure Counterweight

The superstructure counterweight to consist of base frame and counter-weight plates of suitable sizes for easy transportation. Vendor to supply necessary drawing of counterweight plates for local procurement by BHEL.

8 Camera observation

2 cameras to be installed at superstructure (winch area) and 1 unit monitor in crane cabin for observation of winches.

9 Hookblocks

Vendor should supply Hook blocks of about 200t, 100t & 45t capacities.

10 Hydraulic jacks for assembly / disassembly of crawler carrier

It should consist of 4 support cylinders incl. support plates pinned to the crawler carrier. By means of the support cylinders, the assembled upper and lower section of the crane can be lifted on and off the transport trailer. During transport the cylinders should be stored at the center section.

11 Hydraulic lifting device for assembly / disassembly of crawler carrier Gantry frame should be fitted with the hydraulic lifting device in connection with the hydraulic support jacks to assemble / disassemble the crawler carriers to the center section.

12 Pin pulling device

Pin extracting portable hydraulic device for assembly / disassembly of the pins at intermediate sections of boom is to be a part of supply.

REF: E-826/PSNR/SCT&PUR/SCA Sealed tenders in Duplicate in two part bid system i.e. Part-I - Technical and Commercial bid (Terms & Conditions) along with EMD and Part-II - Price bid are invited for supply, supervision of installation and commissioning of one number Crawler crane as per technical specification so as to reach us before the date of opening for respective tenders. The tenders (Part I only) will be opened at 15.30 Hrs. (IST) on 22.05.2003 The tenderers are advised to submit the quotation in conformity with the following: 1. Separate Quotation should be sent for each item in two-part-bid-system as

under 1.1 Part - I Technical and Commercial bid (terms & condition) alongwith EMD.

It should include the following:

i) The supplier's are required to furnish EMD for an amount as per Annexure by Demand Draft / Bank Guarantee in favour of M/s Bharat Heavy Electricals Limited, Noida or Bank Guarantee on our prescribed proforma, failing of which the offer is liable to be rejected.

ii) Technical specifications and Technical particulars enclosing necessary

pamphlets, drawings, leaflets / technical literatures for engine, torque convertor, load moment device crane with load chart, Gear Box etc.

iii) Guarantee for 12 months from the date of commissioning of crane in

India or 2000 hours of operations, whichever is earlier.

iv) List of accessories and recommended spares for two years normal operation.

v) Documentary evidence of cranes manufactured, supplied and their

performance report.

vi) Questionnaire duly filled.

vii) Details of service facilities available in India for after sales service.

viii) Commercial terms and conditions.

ix) No deviation certificate from tender conditions.

SPECIAL TERMS AND CONDITIONS

1.2 Part II (Price bid): -

i) Price of crane including consumables for commissioning. ii) List of consumables item wise including its quantity & rate/price

required during warranty period. iii) Price of recommended spares and accessories item-wise.

2. Following should be superscribed on the envelope of the two parts bid. Part I Technical and Commercial Bid (Terms & Conditions) alongwith EMD – Tender Number, Name of item its serial number and due date.

Part II (Price bid)

Price Offer Tender No., Name of items, its serial number. Both Part I and Part II should be individually sealed and superscribed as indicated above and shall be enclosed in one main envelope duly sealed and superscribed as : Tender for Tender No. Item No. Due on Containing Part I and Part II of the offer.

3.0 The tenders should be sent sufficiently in advance so as to reach the purchaser before the due date and time.

4.0 Supervision of installation: -

Installation and commissioning of crane in India will be under supervision of competent engineer from the manufacturers. The load test and acceptance Test shall be carried out on assembly / commissioning of crane in India in presence of engineers from tenderers & purchasers and equipment will be taken over on successful completion of such test. The tenderers shall also offer load test/over load test of the crane at manufacturers works in presence of engineers from BHEL.

5.0 Three sets of operation and maintenance manual alongwith spare parts list for the crane should be supplied with the crane.

6.0 Supplier should indicate the best delivery period as our requirement is

immediate. 7.0 Offers should be valid for a period of 240 days from the date of Technical and

Commercial bid (Part-I) opening. 8.0 Service support of the equipment under purchase is of utmost concern.

Tenderers shall elaborate on the service networks and spare parts availability, which can be ensured to maintain the equipment after initial commissioning

and completion of warranty period. In case service/spare parts facilities are not available in India, tenderers shall indicate the maximum possible time in making such services available from places outside India.

9.0 The equipment being offered, should be of robust design and suitable for

operations in Indian climatic conditions such as saline atmosphere, ambient temperature of 500 C. The electrical and controls should be tropicalised to with stand such climatic conditions.

10.0 In case the equipment is offered from outside India, the tenderers shall also

submit following information along with technical bid: -

a) Gross / Net weight of Equipment along with options in Kgs. b) Vol. Of cargo in packed in conditions in CBM. c) No. of packages and their individual wt/vol. In MKS system, along with

tentative shipping list. d) Name of the nearest load port and its distance from works. e) Estimated inland freight from load port, & Port handling charges. f) Estimated ocean freight from load port to Mumbai and voyage time.

11.0 Crane shall be inspected at suppliers’ works before despatch. 12.0 PAYMENT TERMS: Tenderer shall adhere to the following payment terms: -

a) 70% of ex-works/FOB value payable against documents through bank or through LC (in case of overseas suppliers)

b) 20% of value of equipment payable on installation and commissioning at site and

c) balance 10% of value of equipment payable within 30 days of commissioning/acceptance test in India against the performance bond/Bank Guarantee equivalent to 10% of contract price to remain value till the warranty period. Tenderers are requested to specifically confirm these payment terms in their technical offer.

NOTE:- NO ADVANCE WILL BE PAID ALONG WITH ORDER.

13.0 WARRANTY REQUIREMENT: -

The crane quoted shall be under warranty for a period of 12 months from the date of installation in India or 2000 hrs. of operations whichever occurs earlier. Rectification/replacement required during the warranty period will be arranged by the suppliers free of cost including the freight and import duty payable on such replacement items. The tenderer shall also provide free service calls by competent service engineer from manufacturer during the warranty period.

16. Manufacturer shall provide free of cost two weeks training at their works to BHEL Engineers and two weeks training at our job site after successful commissioning of crane.

17. No separate Indian agents commission will be payable whatsoever. In case quoted price is inclusive of Indian agents commission, payable in Indian equivalent rupees, the extent of such agency commission and the services considered in the scope of Indian agent along with name, address of the Indian agent should be clearly mentioned in the offer.

18. On acceptance of technical and price bids, BHEL reserves the right to conclude

the contract either on FAS load port/FOT works or C & F Mumbai basis at its sole discretion.

GENERAL TERMS & CONDITIONS 1. Manufacturer’s name, their trade mark and brand, if any should invariably be

mentioned in the tender and illustrative leaflets in duplicate giving technical particulars etc. should be attached to the tender, to facilitate consideration of the offer.

2. Materials should be best quality and correct to our specifications, relevant

DIN/ISO standard or any other equivalent international standard specification. 3. Correct date of effecting supplies in the event of an order from this office

should also be recorded in the tender. 4. Please note that our terms of payment are as per clause 14 of "SPECIAL

TERMS OF CONDITION ( ENCLOSED)."

No advance will be paid along with the order. Bank charges of your bank will be to your account and that of our will be of our account.

5. Bharat Heavy Electricals Limited does not bind itself to accept the lowest of any tender, but reserves to itself the right to accept or reject all or part of any tender at its discretion.

6. No enhancement of rate, whatsoever the cause will be allowed once the

quotation is accepted and the order is placed. Withdrawal from the quotation after it is accepted or failure to make the supply within the schedule period will entail cancellation of purchase order and forfeiture of earnest money if any and or purchase at the risk and cost of supplier.

7. The successful tender should, if so required by us, furnish a security deposit or

bank guarantee from Bank as per list enclosed or from scheduled Bank for an amount of 10% of the total value of the order in the form and manner desired by us for the satisfactory execution of the same in accordance with the terms and conditions and delivery specified in the order, within 15 days from the date of P.O./ L.O.I.

8. The quantities of each item to be purchased may vary according to actual

requirement at the time of placement of order. 9. Supply against orders will be subject to the General Conditions of contract

prevailing in Bharat Heavy Electricals Limited . 10. Where there a provision of payment of Sales Tax extra it will only be paid if

registration numbers both under local sales tax and Central Sales Tax are specifically mentioned on the invoice. Tenderers should invariably quote their sales tax Registration No. in the quotation.

11. LIQUIDATED DAMAGES: It is clearly understood among the parties to the

contract that the delivery of the goods specified in the purchase order should

be made within the time limit prescribed. Where the seller supplies or dispatches the goods beyond the delivery period specified, the purchaser will have no obligation to accept the goods. If accepted liquidated damages at the rate of ½% (half percent) of the value of goods in arrears per week at the discretion of the purchaser, subject to a maximum of 10% (ten percent), will be levied without prejudice to any other relief or compensation due to the purchase under any other condition to the contract.

12. RISK PURCHASE: - Alternatively, the purchaser at his option, will be entitled

to terminate the contract and to purchase elsewhere at the risk and cost of the seller either the whole of the goods or any part which the supplier has failed to deliver or despatch within the time stipulated as aforesaid or if the same were not available, the best and the nearest available substitute therefore. The seller shall be liable for any loss which the purchaser may sustain by reason of such risk purchase in addition of L.D. at the rate mentioned in clause 11 above.

13. INSPECTION: All goods and work are subject to our inspection and where

stipulated by our client’s inspection either at your works or after delivery as may be agreed. The decision of client or any of the officers’ nominated/authorized by him/us in final. Rejected goods will be returned to the supplier at his cost including freight on original shipment.

14. Performance Bank Guarantee: - Store will be guaranteed by you against

any manufacturing defect, bad workmanship, bad material used etc., for a period of 12 months from the date of installation in India or 2000 hrs from of operation whichever occur earlier. Any material found defective or fails within the guarantee period due any of the above reasons within this period will have to be replaced by you free of cost and any other charges including to and fro transportation charges will also be borne by the supplier. A B/G from bank as per list enclosed or any scheduled bank equal to 10% of the order value and valid upto 18 months from the date of last despatch for the satisfactory performance of the store is to be furnished at the time of claiming balance 10% payment.

15. Insurance: - Wherever specially agreed to an directed, the supplier will insure

at his cost the goods for all transit risks including 60 days storage risk from the date of delivery of the goods at the final destination.

In all other cases, supplier must furnish particulars of despatch i.e. station of despatch and destination, name of the store, number of cases and their weights, value of the store including all taxes, duties, levies and freight etc. for each consignment immediately after the despatch of stores, failure to do this will make the supplier responsible for making goods any loss which might have been recovered from insurers.

N.B.: Supplier still remain responsible for defective parts or short supply and

defective packing.

16. Metric System: - Suppliers are requested to give metric measurements while quoting.

17. Any disputes arising out of this, shall be referred to the sole arbitration of

General Manager, Bharat Heavy Electricals Limited, Power Sector – Northern Region, Noida or any other person nominated by him, and his award shall be final binding on the parties. The venue of the arbitration in all cases shall be New Delhi.

18. Any suites in respect of this shall lie in the courts of New Delhi only.

PROFORMA FOR BANK GUARANTEE FOR EARNEST MONEY DEPOSIT

This Deed of Guarantee made this ------------- day ---------- of ------ by ------------ Bank Limited in favour of Bharat Heavy Electricals Limited, Power Sector - NR New Delhi having its registered office at New Delhi.

Whereas M/s ---------------- (hereinafter called the tenderer) have submitted a tender -------------- in response to tender specification No.-------------------- (herein after called the said tender documents) of M/s Bharat Heavy Electricals Limited having its Registered office at BHEL House, Siri Fort, New Delhi - 110 019 (hereinafter called the Company).

The aforesaid guarantee will remain in force and we shall be liable under the same irrespective of any concession for the time being granted by the said Company to the tenderer in or for fulfilling conditions of the tender documents and the guarantee will remain in full force irrespective of any damage of terms, conditions or stipulation or any variation in the terms of the said tender documents irrespective of whether notice of such damage and /or variation is given to us or not and claim to receive such notice of any change and/or variation of the terms and/or conditions of the said tender documents is hereby specifically waived by us. Further we shall not be released from this guarantee by any for bearance for the exercise or non-exercise of any of the

powers or rights under the said tender documents by the said company against the tenderer irrespective of whether notice of such forbearance, enforcement of non-enforcement of any power or rights, modifications or changes made in the said tender documents or concessions shown to the tender by the Company is given to us or not.

The guarantee herein contained shall not be determined or affected by the liquidation of winding up or insolvency or change in the constitution of the tenderer but shall in all respects and for all purposes be binding and operative until all payments of all moneys due or that may hereafter become due to the said company in respect of any liability or obligation of the tender under the said tender documents.

We the said Bank further agree that the guarantee hereinafter contained shall remain in full force and effect during the period that would be taken for the finalisation of the tender and executions of agreement therefore, and that it shall continue to the enforceable till the required security deposit is deposited by the successful tender, as stipulated in the said tender documents have been fully and properly carried out by the said tenderer shall have no rights under this guarantee after the expiry of 180 days from the date of its execution.

Any claim or dispute arising under the terms of this document shall only be enforced or settled in the Courts at Delhi only.
