BENEFIT SHARING - CONCEPT
“benefit” delineates an
advantage or a profitgained from something.
“To share” means to give a
portion of something toanother.
‘BENEFIT’ ‘SHARING’
Benefit sharing could therefore be that benefit sharing is the actionof giving a portion of advantages/profits to others.
In the legal field, benefit sharing is a technical term used in thecontext of access to and use of human and non-human genetic
resources.

The term arose from the Convention on Biological Diversity(CBD) adopted at the Earth Summit in Rio de Janeiro, Brazil.
This global convention has 188 parties and aims to achievethree objectives:I. the conservation of biological diversity;II. the sustainable use of its components; and
III. the fair and equitable sharing of benefits from the useof genetic resources.

OFFICIAL LANGUAGE (UNION)
Article 343 recognizes Hindi in
Devanagari script as the OfficialLanguage.
Article 351 considers it as the duty
of the Union to promote thespread of Hindi language

Article 120 provides for use ofHindi and English to transact
business in Parliament.

Article 345 empowers the Legislature of the State to adopt 'any one or more of the languages in use in the State or Hindi as the language or
languages to be used for all or any of the official purposes' of theconcerned State.
LANGUAGE USE IN LEGISLATURE
Article 210 provides for the use of the Official Language or language of theState or Hindi or English.
As per the Article 348(3), in cases where the State has prescribed anylanguage other than English for use in Bills or Acts passed by the
Legislature 'a translation of the same in the English language publishedunder the authority of the Governor of the State in the Official Gazette
of that shall be deemed to be the authoritative text ....' in English.

INTER-STATE COMMUNICATION
Article 346 stipulates that the language authorized for use in the Unionfor official purposes shall be the official language for communicationbetween the State and another State and between a State and the
Union.
LINGUISTIC MINORITIES
Article 30(1) provides them the 'right to establish and administer
educational institution of their choice'.Article 347 provides domestic language as official language, subject topresident consent.
Article 350 provides for people 'to submit a representation for theredress of any grievance to any officer or authority of the Union or
State in any of the languages used in the Union or in the State'.
