ABSENT: Mayor Baird Mayor Baird was absent. Deputy Mayor Schweller moved to excuse Mayor Baird. Mr. Edwards seconded the motion. The Clerk called the roll: Deputy Mayor Schweller, yes; Mr. Edwards, yes; Mr. Greenwood; Mrs. Middlestetter, yes; Mrs. Seger-Lawson, yes. The motion carried 5-0.

This is a summary of the City Council meeting held on Monday, August 8, 2016. Deputy Mayor Schweller called the meeting to order at 7:00 pm and the Clerk called the roll. After polling members of City Council, as there were no corrections or additions to the regular meeting minutes of July 11, 2016, Deputy Mayor Schweller declared the minutes approved as written.

MAYOR’S ANNOUNCEMENTS/SPECIAL GUEST

Marty Heide from Congressman Turners Office spoke to Council on the passport process and also the

legislation on the opioids/heroin epidemic.

PUBLIC HEARING OF ORDINANCES

Mr. Edwards read Ordinance 2016-8- An Ordinance Granting an Easement to the State of Ohio, Department of Transportation for Improvements to the State Route 725 Road Embankment along Sackett-Wright Park. ODOT has offered to pay $6,350 for the 0.635 acre easement. ODOT will also compensate the Park District $5,675 for improvements on the land in the easement. Being a public hearing, Deputy Mayor Schweller opened up for public comments. Seeing no comments from the public the Deputy Mayor closed the public hearing and asked for a motion. Mr. Edwards made a motion to adopt Ordinance 2016-8. Mr. Greenwood seconded the motion. The Clerk called the roll: Mr. Edwards, yes; Mr. Greenwood, yes; Mrs. Middlestetter, yes; Mrs. Seger-Lawson, yes; Deputy Mayor Schweller, yes. The motion carried 5-0.

Mrs. Middlestetter read Ordinance 2016-10. An Ordinance Amending Ordinance 2015-16 to Adjust the City of Bellbrook Appropriations to Reflect Additional Costs in some Line Items and Reduced Costs in other Line Items. This ordinance authorizes amendments to the 2016 appropriations. These amendments to the appropriations normally occur a couple of times throughout the year. Being a public hearing, Deputy Mayor Schweller opened up for public comments. Seeing no comments from the public the Deputy Mayor closed the public hearing and asked for a motion.

Mrs. Middlestetter made a motion to adopt Ordinance 2016-10. Mrs. Seger-Lawson seconded the motion. The Clerk called the roll: Mrs. Middlestetter yes; Mrs. Seger-Lawson, yes; Mr. Edwards, yes; Mr. Greenwood yes; Deputy Mayor Schweller, yes. The motion was carried 5-0. RESOLUTIONS Mrs. Seger-Lawson read Resolution 2016-W. A Resolution Approving the Replat of Lots #18,# 19,#20 and #21 into Lots #18A, #19A, #20A and #21A, Highview Terrace Subdivision Section II. The developer requested this replat that was reviewed and approved by the Planning Board on August 2nd. Mrs. Seger-Lawson made a motion to adopt Resolution 2016-W. Mrs. Middlestetter seconded the motion. The Clerk called the roll: Mrs. Seger-Lawson, yes; Mrs. Middlestetter, yes; Mr. Edwards, yes; Mr. Greenwood, yes; Deputy Mayor Schweller, yes. The motion carried 5-0. Mrs. Middlestetter read Resolution 2016-X. A Resolution Approving the Replat of Lots #35 and # 36 into Lots #35A and #36A, Shadowood Two-A Subdivision. The replat was requested by the two property owners and was reviewed and approved by the Planning Board on August 2nd. Mrs. Middlestetter made a motion to adopt Resolution 2016-X. Mr. Greenwood seconded the motion. The Clerk called the roll: Mrs. Middlestetter, yes; Mr. Greenwood, yes; Mr. Edwards, yes; Mrs. Seger-Lawson, yes; Deputy Mayor Schweller, yes. The motion carried 5-0. Mr. Greenwood read Resolution 2016-Y. A Resolution Directing the Greene County Auditor to Enter the Delinquent Cost of Weed and Grass Mowing on the Tax Duplicate for the Properties Attached Hereto. This resolution allows for the assessment of unpaid mowing charges to property taxes. There is only one property with unpaid charges of $175.00. Mr. Greenwood made a motion to adopt Resolution 2016-Y. Mrs. Middlestetter seconded the motion. The Clerk called the roll: Mr. Greenwood, yes; Mrs. Middlestetter, yes; Mr. Edwards, yes; Mrs. Seger-Lawson, yes; Deputy Mayor Schweller, yes. The motion carried 5-0. Mrs. Seger-Lawson read Resolution 2016-Z. A Resolution Directing the Greene County Auditor to Enter the Delinquent Cost of Unpaid Water Bills on the Tax Duplicate for the Properties Attached Hereto. This resolution allows for the assessment of unpaid water charges to property taxes. There are nine assessments totaling $1,453.58. Mrs. Seger-Lawson made a motion to adopt Resolution 2016-Z. Mr. Edwards seconded the motion. The Clerk called the roll: Mrs. Seger-Lawson, yes; Mr. Edwards, yes; Mr. Greenwood, yes; Mrs. Middlestetter, yes; Deputy Mayor Schweller, yes. The motion carried 5-0. Mr. Edwards read Resolution 2016-AA. A Resolution Declaring Specific Equipment No Longer Needed By the City of Bellbrook as Surplus Property and Authorizing the City Manager to Dispose of Said Surplus Property. This will declare the Fire Department van as surplus property. The van was replaced by a pickup truck for the Fire Department. The van will be auctioned on GovDeals.com.

Mr. Edwards made a motion to adopt Resolution 2016-AA. Mrs. Seger-Lawson seconded the motion. The Clerk called the roll: Mr. Edwards, yes; Mrs. Seger-Lawson, yes; Mr. Greenwood, yes; Mrs. Middlestetter, yes; Deputy Mayor Schweller, yes. The motion carried 5-0. Mr. Greenwood read Resolution 2016-BB. A Resolution Authorizing the City Manager to Enter into an Agreement with the Bellbrook-Sugarcreek Local School District for Security at Home Football Games. This authorizes an agreement with the schools for police officers at home football games. This agreement includes a slight increase in fees paid by the schools to the City ($115 per officer per game to $120 per officer per game). Mr. Greenwood made a motion to adopt Resolution 2016-BB. Mr. Edwards seconded the motion. The Clerk called the roll: Mr. Greenwood, yes; Mr. Edwards, yes; Mrs. Middlestetter, yes; Mrs. Seger-Lawson, yes; Deputy Mayor Schweller, yes. The motion carried 5-0. CITY MANAGER REPORT Mr. Schlagheck said the Lions Club Festival will begin on Thursday August 18th and run through Saturday August 20th. The festival will operate from 6-11 pm on Thursday and Friday and from 5-11 pm on Saturday. The parade will be Saturday at 4:00. Fireworks will be on display behind the old Sugarcreek Elementary School on Saturday evening. This will wrap up the City’s Bicentennial Celebrations. The annual paving program was completed last week in the areas of Stephen Bell Elementary and Green Meadow Ranch. The water tower repainting project is complete. The project finished in a very short period of time. The logo and the eagle on the exterior of the tank are excellent. The interior of the tank has been repainted too and should last another 20 years. Mr. Schlagheck asked Council if they still wanted to cancel the Council meeting scheduled for Monday, September 26th. Council agreed at the last meeting to cancel this because of the Presidential debate that was to be held at Wright State University. Council agreed not to meet on September 26th. Lastly, Mr. Schlagheck discussed with Council on how they would like to proceed in the process of filling the vacancy on Council. Mr. Edwards said he has reviewed each resume and would like to see the entire Council interview the candidates. Deputy Mayor Schweller proposed each candidate come before the entire Council. Council would ask each candidate a few standard questions. This first phase of the process would eliminate some candidates and then Council would proceed interviewing the finalist in more depth. The vacancy needs to be filled by October 1st. COMMITTEE REPORTS Service: Mrs. Seger-Lawson said she was pleased with the paving that was done in her neighborhood.

Safety: Mr. Greenwood talked about Police training requirements. He spoke with Mary Davis, State of Ohio Police Training Coordinator. The legislation has not passed but it looks like the Police will be required to have 20 hours of training. Mr. Greenwood also spoke about the Fire Departments auto pulse resuscitation system. Mr. Schlagheck said the City only had to pay 25% of the cost of those machines due to grants from the Ohio Bureau of Workers Compensation. Finance/Audit: No Report. Community Affairs: Mrs. Middlestetter mentioned on Tuesday August 16th there will be a presentation of “Drones in Dayton”. It will be held at 7:00 at the Bellbrook United Methodist Church’s community room. OLD BUSINESS- NEW BUSINESS- A motion was made by Mrs. Middlestetter to accept the resignation of Jon Martin from Council, effective, July 31, 2016. Mr. Edwards seconded the motion. The Clerk called the roll: Mrs. Middlestetter, yes; Mr. Edwards, yes; Mr. Greenwood, yes; Mrs. Seger-Lawson, yes; Deputy Mayor Schweller, yes. The motion carried 5-0.

A motion was made by Mrs. Seger-Lawson to accept the resignation of Brady Harding from the Village Review Board, effective 7-31-16. Mrs. Middlestetter seconded the motion. The Clerk called the roll: Mrs. Seger-Lawson, yes; Mrs. Middlestetter, yes; Mr. Edwards, yes; Mr. Greenwood, yes; Deputy Mayor Schweller, yes. The motion carried 5-0.

OPEN DISCUSSION Mr. Edwards said he attended the Police Departments National Night Out on Tuesday, August 2. It was a good evening and he hopes that the Police Department will continue to participate. Mr. Greenwood also attended National Night and enjoyed it too. Mr. Schlagheck said Chief Doherty has re-introduced this event. It is a good way for residents to meet the officers. Mr. Edwards said that the Police Department is also doing foot patrol and bike patrols. The Police are visible in our community and very proactive. Jared Duckro-1648 Bledsoe Dr. - He is from Boy Scout Troop 375. He attended the meeting tonight to earn two merit badges. Darryl McGill-3846 West Franklin St-He also attended National Night Out. He said it was well attended and he enjoyed it. It was a chance for the Community to meet the Police in a non-threatening way. Mr. McGill said that Chief Doherty and Lt. Carmin along with the department did a good job. Shannon Hollingsworth-2191 Shadowood Circle- She is concerned because she just learned today that the family of Brock Turner lives in Sugarcreek Township. Brock Turner is a convicted rapist and is currently serving time in a California prison. He is scheduled to be released on September 2nd to his family. Mrs. Hollingsworth wants to request a measurement from the stadium to the Turner’s address in Kables Mill. If it is less than 500 feet, Brock Turner would not be allowed to be released to his parents due to an ordinance that the City of Bellbrook has that says a sexual predator cannot live within 500 feet of a school. Mr. Schlagheck said he will be in contact with the Police Chief in the

morning. Mr. Schlagheck said that he also knows that the Sugarcreek Township Police are aware of this. Mr. Schlagheck said he would get the results to her once he has the information. A Resolution Authorizing the City Manager to Prepare and Submit an Application

To Participate in the Ohio Public Works Commission State Capital Improvement

and/or Local Transportation Improvement Programs and to Execute Contracts as

Required.

WHEREAS, the City of Bellbrook is applying for a grant and loan to help finance the cost of a

capital improvement known as the Upper Hillside Water Main Improvement Project pursuant to the

programs administered by the Ohio Public Works Commission (OPWC); and

WHEREAS, the Ohio Public Works Commission is authorized to provide financial assistance for

capital improvements to public infrastructure; and

WHEREAS, the Upper Hillside Water Main Improvement Project is considered to be a priority

need for the community and is a qualified project under the OPWC.

Now, Therefore, the City of Bellbrook Hereby Resolves:

Section 1. That the City Manager is authorized prepare and submit an application to the

OPWC for grant funding in the amount of $600,000 and loan funding in the amount of $290,000 for the

Upper Hillside Water Main Improvement Project.

Section 2. That the City Manager is authorized to execute any agreements as may be

necessary and appropriate to obtain this grant and loan funding from the OPWC.

Section 3. That this resolution shall take effect and be in force forthwith.

Resolution No. 2016-DD

A Resolution Accepting the Amounts and Rates as Determined by the Budget

Commission and Authorizing the Necessary Tax Levies and Certifying Them to the

County Auditor.

WHEREAS, this Council, in accordance with the provisions of law, has previously adopted a

Tax Budget for the next succeeding fiscal year commencing January 1st, 2017; and

WHEREAS, the Budget Commission of Greene County, Ohio, has certified its action thereon to

this Council together with an estimate by the County Auditor of the rate of each tax necessary to be

levied by this Council, and what part thereof is without, and what part within the ten mill tax limitation.

Now, Therefore, the City of Bellbrook Hereby Resolves:

Section 1. That the amounts and rates, as determined by the Budget Commission in its

certification, be and the same are hereby accepted.

Section 2. That there be and is hereby levied on the tax duplicate of said City the rate of each

tax necessary to be levied within and without the ten mill limitation as attached hereto.

Section 3. That the Clerk of this Council be, and she is hereby directed to certify a copy of

this Resolution to the County Auditor of said County.

Section 4. That this resolution shall take effect and be in force forthwith.
