In layman’s terms, an option period is a negotiated amountof time, usually around 10-14 days, that is agreed uponbetween the buyer and seller.
●It’s important to note that option periods include ALLdays (Saturdays, Sundays, holidays, etc.).
● During this period, the buyer typically has the propertyinspected and may negotiate for repairs to the property.
● The buyer can back out of the contract for purchase forany reason with no repercussions other than the loss ofhis/her option money, (see below) which is nonrefundable.
Option Period & Option Money
In Texas, the buyer pays directly to the seller option money. This is money given inconsideration for the option period. The option money is negotiable between buyer andseller, but it is usually between $100 and $300. It is paid once both buyer and sellerhave signed a contract (this is also called an executed contract). If a buyer is asking foran unusually lengthy option period, sometimes the buyer’s option money paid is higher.
Basically, a buyer is paying the seller option money for the right to be able to back out ofa contract for any reason at all during the option period. After that certain period oftime, there are only a few very specific reasons that a buyer can back out of a contract.
