1.0 That, Hon'ble Commission have made CERC (Terms and Conditions of Tariff) Regulations, 2014 and issued vide notification dated 21.02.2014. These Regulations shall remain in force for a period of 5 years w.e.f. 01.04.2014, unless reviewed earlier or extended by the Hon'ble Commission.

2.0 The Petitioner herein, Power Grid Corporation of lndia Ltd. is a Government Company within the meaning of Companies Act, 1956. In exercise of powers under sub-section (1) of section 38 (1) the Electricity Act, 2003, the Government of lndia has declared the Petitioner herein as the Central

Transmission Utility (CTU). The petitioner being CTU. is deemed to be a transmission licensee under section 14 of the Electricity Act, 2003.

3.0 That the instant petition covers approval of transmission tariff for Asset I: 4*500 MVA, 7651400 kV ICT-2 with one spare unit at Jabalpur 7651400 kV PS (DOCO:01.04.2014), Asset 11: 3*80 MVAR, 765 kV Line Reactor to be used as Bus Reactor at Jabalpur PS for Dharamjaygarh ckt.#l (DOCO:01.04.2014), Asset 111: 765 kV, 3*110 MVAr, Bus Reactor-l at Dharamjaygarh SIS alongwith associated bays and LlLO of 765 kV SIC Ranchi - WR Pooling Station (near Sipat) TIL at Dharamjaygarh (DOCO:01.04.2014), Asset IV: 765kV, 3*110 MVAR Bus Reactor-2 at Dharamjaygarh SIS along with associated bays (DOCO:18.04.2014) Asset V: 765 kV DIC Jharsuguda Poolirlg Station - Dharamjaygarh (near Korba) Line (Ant. DOCO:25.07.2014) under "Transmission System for Phase-l Generation Projects in Orissa (Part-B)" in Western Region.

4.0 The tariff for the said transmission systems shall be determined by the Hon'ble Commission in accordance with the CERC (Terms and Conditions of Tariff) Regulations, 2014.

5.0 Approval cf the Scheme

That the petitioner has been entrusted with the implementation of "Transmission System for Phase-l IPP Generation Projects in Orissa-Part-B" in Western Region. Investment approval for the said system was accorded by Board of Directors of POWERGRID vide Memorandum CICPlOrissa Ph-l lPPs (Part-B) dtd. 15.12.2010 at an estimated cost of Rs. 2743.19 crore including IDC of Rs. 180.92 crs. (based on 3rd Quarter, 2010 price level). Encl.-l, p a g e . 3 ... tea$. ... 6.0 Implementation Schedule:

As per Investment Approval the project is scheduled to be commissioned by 15 '~ ~ec. '2013 i.e. DOCO as 01 .01.2014. The Assets I to Ill and Asset IV have been commissioned on 01.04.2014 & 18.04.2014 respectively with a delay o_f 3 & 3.5 months. DOCO letters are enclosed collectively as Encl.4, pag&..to page. .W To maintain the voltage profile at Jabalpur PS, Line reactor for Jabalpur- Dharamjaigarh at Jabalpur has been charged as Bus reactor as per the in- principle approval from CEA for commissioning of 765 kV, 240 MVAR Line Reactors as Bus Reactor in Western Region. Asset - V is anticipated to be put under commercial operation w.e.f. 25.07.2014 , with a delay in commissioning of about 7 months.

Reasons for Delav:

For Asset I

As per investment approval for the transmission system associated with Orissa Part- B, accorded on 15 December, 2010, Commissioning of ICT at Jabalpur pooling station was scheduled to be completed in 36 months i.e by Dec, 13. Delay of 3 months is mainly due to following reasons.

1) lCTs were dispatched in the month of Aug. 2013 from Vadodara.

2) As per directive of Ministry of Road transport & Highways, survey of several structures like bridges, tunnels etc. on national Highway was going on to ascertain load carrying capacity. Consignments with heavy loads were with held mid way till completion of the survey.

3) Authorities refused to allow the movement of consignment (ICTs) via Karjan, therefore the bank had to be diverted to an alternate route via Vadodara- Dahod-J habua-lndore-Bhopal-Jabalpur.

4) After considerable travel on this route i.e up to Dahod, it was learnt that the road ahead has got damaged due to heavy rain. Hence, in the month of Oct'13, ICT bank again came back to the works in Vadodara.

5) Meanwhile, clearance for the movement of heavy vehicle wass granted by Ministry on 30th Sept. 201 3 vide letter ref No.RT-11042/13/2008-MVL (Copy enclosed at Encl.-7 alongwith other delay documentation) and the consignment moved again via Vadodara-Karjan-Ankaleshwar-Sagbara- Nagpur-Seoni-Jabalpur route to reach Jabalpur finally in March 2014.

For Asset II

To maintain the voltage profile at Jabalpur PS, Line reactor for Jabalpur- Dharamjaigarh at Jabalpur has been charged as Bus reactor as per the in- principle approval from CEA for commissioning of 765 kV, 240 MVAR Line Reactors as Bus Reactor in Western Region. Copy of in-principle approval is enclosed as Encl.-6, page.%?..to page+.G. ..

For Assets Ill & IV

Dharamjaigarh SIS (near Korba) is a Green-field SIS. The above system could have been charged only when atleast one energisation source was available for its charging.

At the above SIS, the option for voltage source were either through LILO of 765kV Ranchi-Sipat TIL under DVC, or 765kV DIC Jharsuguda- Dharamjaigarh TIL or 765kV Dharamjaigarh-Jabalpur TIL.

However all the above transmission lines (including 765 kV Ranchi-Sipat SIC under DVC IRB project) were passing through considerable forest area and the first line to be energized was 765kV SIC Ranchi Sipat only on 31.03.2014. /

element, namely I-ILO of 765kV Ranch-Sipat l-L and 765kV Bus Reactor also got charged on 31.03.2014, and taken under regular operation w.e.f. 01.04.2014.

As such the charging of the subject asset before 31.03.2014 was beyond the control of Petitioner. The copy of DOCO of 765kV Ranchi-Sipat line, under DVC IRB Project is attached, as a reference please.

In addition to above explanation, delay of 17 days in the commissioning of the Asset-/V is mainly due to phased manner charging of various elements one by one, as the charging of all elements in one go is normally to be avoided and the Reactor was taken into service once the system got established after charging of previous elements.

For Asset V

The Transmission Line got delayed in commissioning by about 07 Months from scheduled completion as per lnvestment approval and it is expected to be ready for commissioning by 25th Jul 2014. There are two major factors for delay in commissioning of this Transmission line, as explained below:

1. Rerouting due to encountering of Coal Blocks:

Immediately after lnvestment approval contract was awarded for construction of this Transmission Line within a month's time i.e. on 18.01.201 1 and construction activities were taken on top priority on most feasible route.

However, during construction phase, ministry of Coal intimated e instant line under consideration was passing through Gare Palma

required to be rerouted. A first communication in this regard received from Secretary Coal dated 08.05.2012 is attached alongwith other communications regarding Approval for Forest Clearance.

Subsequently a detailed exercise with Coal Ministry1 CNIPDII with help of CEA was carried out. After various rounds of discussion and survey and field inspection another route was finalized in association with Coal ministry ICMPDllCEA.

Accordingly, in Aug 2012, in principle decision for alternate route was worked out and a letter from Chairman, CEA written to Secretary, Coal ministry dated 30.08.2012 is attached for ready reference alongwith delay documentation.

2. Forest Approval for Ministry of Environment and Forest

After change of route to avoid the coal blockslforest areas, the detailed survey of forest was again carried out and forest proposal was prepared with following major milestones:

Keeping in view the above explanation, since the delay in commissioning of the Assets was beyond the control of the Petitioner, Hon'ble Commission may kindly condone the delay.

7.0 Completion Cost:

7.1 That the application for determination of tariff is filed in line with provision 7 (2) of Tariff Regulation, 2014 applicable for 2014- 19 period. Further, that the present petition covers approval of tariff based on actual/ estimated expenditure incurred up to DOCO and additional capitalization projected to be incurred from DOCO to 31.03.2016 in respect of the subject asset as per detail given below. That the capital cost incurred upto ActualJAnt. DOCO and projected to be incurred during 2014-15 and certificate; copy whereof in respect of the assets enclosed herewith as Encl.- 8 (pagetb. to82.1.

(2) Total quantity of Conductor (ACSR Zebra) decreased by 499.5 kms due to reduction in line length. However, the positive side variation in cost is mainly on following accounts.

a) During the implementation stage Entry tax in Chhattisgarh State got increased 1% to 5% by C.G. Government.

b) As per rates obtained in award / LOA rates / PV, etc.

(3) Due to increase in the nos. of angle towers, quantity of insulators got increased by 27030nos. (160KN and 210KN both considered).due to this basic cost of insulator increased.

Accordingly, the positive side variation in cost is mainly due to LOA rates and increase in total qty. of insulators.

Further, cost increased due to inclusion of 35% Safeguard duty by Government of India.

(4) Due to increase in Angle Tower nos. required Hardware fittings also got increased. Thus cost of hardware fittings increased. Further, awarded LoA rates for Hardware fittings is more than that in FR.

On account of above explained reasons, higher rates received in competitive bidding ,PV and Taxes etc .the overall cost under this head got increased.

It is submitted that most of the assets covered under the project are yet to be commissioned. The comparison of actual cost with the approved cost of the project is to be seen in totality for the project as whole and not separately for each element. Therefore, the Hon'ble Commission may kindly approve the capital cost of the elements covered under instant petition & allow following tariff as claimed.

The details of underlying assumptions for additional capitalization for this asset are summarized below:

The admissibility of additional capital expenditure (Add. Cap.) incurred after DOCO is to be dealt in accordance with the provisions of Regulation: 14, the extract of Regulation: 14 of the Regulations, 2014 is reproduced as under:

"Additional Capitalization"

(1) The capital expenditure incurred or projected to be incurred, on the following co~lnts within the original scope of work, after the date of commercial operation and upto the cut-off Commission, subject to prudence check:

(i) Undischarged liabilities recognized to be payable at a future date; (ii) Works deferred for execution; (iii) Procurement of initial capital spares within the original scope of

work, in accordance with the provisions of Regulation: 13; (iv) Liabilities to meet award of arbitration or for compliance of the order

or decree of a court of law; and (v) Change in law or compliance of any existing law:

Provided that the details of works asset wise1 work wise included in the original scope of work along with estimates of expenditure, liabilities recognized to be payable at a future date and the works deferred for execution shall be submitted along with the application for determination of tariff.

7.3 The Additional Capitalisation incurred1 projected to be incurred in the contextual asset is mainly on account of Balance1 Retention Payments and hence the same may be allowed by Hon'ble Commission. The details of underlying reasons for additional capitalization 765 kV DIC Jharsuguda Pooling Station - Dharamjaygarh (near Korba) Line under "Transmission System for Phase-l Generation Projects in Orissa (Part-B)" in Western Region are given in Form- 7.

That the present petition for determination of tariff is being filed in line with Regulation- 7 under Chapter- 3 of Tariff Regulation, 2014 applicable for 2014-1 9 period.

8.0 TRANSMISSION TARIFF for 2014 - 19 BLOCK:

8.1 The tariff for block 2014- 2019 has been worked out as per CERC (Terms and Conditions of Tariff) Regulations, 2014. In the present petition the transmission tariff has been calculated taking estimated expenditure upto DOCO and estimated expenditure from DOCO to 31.03.2016. Calculations for working out the tariff along with supporting documentation are attached hereto as Encl.- 9 (page$!?. to?31..) .

8.2 The annual transmission tariff for the tariff period 2014- 19 is summarized as below:

# - While calculating Annual fixed charges, rates as specified in the Tariff RegulationJ2014 have been considered. However, the petitioner is approaching the Hon'ble Commission through review petition for revision. Thus the Annual Fixed Cost is subject to the outcome of the said review petition.

8.3 That, it is subrr~itted that .the petitioner being liable to pay income tax at MAT rate, the ROE has been calculated @ 19.610% after grossing up the ROE with MAT rate of 20.961% based on the rate prescribed by the Hon'ble Commission as per illustration under Regulation: 25 (2) (i) of the Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014. That as per clause: 25 (3) of the above Regulation, the grossed up rate of ROE at the end of every financial year shall be trued up based on actual tax paid together with any additional tax demand including interest thereon duly adjusted for any refund of tax including interest received from the IT authorities pertaining to the tariff period 2014- 15 to 2018- 19 on actual gross income of any financial year. Any under-recovery or over- recovery of grossed up rate on ROE after truiqg up shall be recovered or refunded to beneficiaries on year to year basis. It is further submitted that adjustment due to any additional tax demand including interest duly adjusted for any refund of tax including interest received from IT authorities shall be recoverable1 adjustable during/ after completion of income tax assessment of the financial year.

8.7 The transmission charges at Para: 8.2 above is inclusive of O&M expenses for the project derived based on the norms for O&M expenditure for Transmission System as specified under Regulation: 29 (3) (a) of the tariff Regulations for block 2014- 19. It is the understanding of the petitioner that these norms for O&M expenditure been arrived by the Hon'ble Commission after considering (i) Normalized actual O&M expenses of the petitioner on its various projects in various regions during the year 2008- 09, 2009- 10, 2010- 11, 201 1- 12 and 2012- 13. It is submitted that the wage revision of the employees of the petitioner company is due during 2014-19 and actual impact of wage hike which will be effective from a future date lias also not been factored in fixation of the normative 0&IM rates prescribed for the tariff block 2014- 19. The scheme of wage revision applicable to CPSUs being binding on the petitioner, the petitioner reserves the right to approach the Hon'ble Commission for suitable revision in the norms for O&M expenditure for claiming the impact of wage hike during 2014-19 onwards.

8.8 The application filing fee, expenses incurred on publication of Notices in News papers and License fee may be allowed to be recovered separately from the respondents in terms of Regulation: 52 of Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regiilations, 20A4. The fees aiid charges to be paid by ,the petitioner as ISTS licensee (deemed ISTS licensee) under CERC (Fees and Charges of RLDC and other matters) Regulations, as amended from time to time, shall also be recoverable from the DlCs as provided under clause: 52 (2) (a).

8.9 The Transmission Charges and other related Charges indicated at Para: 8.2 above, is exclusive of incentive, late payment surcharge, FERV, any statutory taxes, levies, duties, cess, filing fees, license fee, RLDC fees and charges or any other kind of imposition(s) and1 or other surcharges etc., whatsoever imposed1 charged by any Government (Central1 State) and1 or any other local bodies1 authorities1 regulatory authorities in relation to transmission of electricity, environmental protection, and1 or in respect of any of its illstallation associated with the Transmission System and the same shall be borne and additionally paid by the respondent(s) to the petitioner and the same shall be charged, billed separately by the petitioner on the respondents.

9.0 Sharing of Transmission Charges:

The Tariff for Transmission of Electricity (Annual Fixed Cost) as per Para: 8.2 of petition shall be shared as per Regulation: 43 of CERC (Terms and Conditions of Tariff) Regulations, 2014. 'These charges shall be recovered on monthly basis and the billing collection and disbursement of Transmission Charges shall be governed by provision of CERC (sharing of interstate Transmission Charges and Losses) Regulations,

transmission tariff for the assets covered under this petition be allowed to be charged from the Respondents on the basis set out above.

The Petitioner submits that the Encl.- 1 to Encl.- 10 may please be treated as integral part of this petition.

PRAYER

It is respectfully prayed that the Hon'ble Commission may be pleased to:

1) Approve the Transrnission Tariff for the tariff block 2014- 19 block for the assets covered under this petition, as per Para: 8.2 above.

2) Admit the capital cost as claimed in the petition and approve the Additional Capitalisation incurred1 projected to be incurred.

3) Tariff may be allowed on the estimated completion cost, since few elements of the project are yet to be completed, the completion cost for the assets covered under instant Petition are within the overall project cost.

4) Allow the Petitioner to approach Hon'ble Commission for suitable revision in the norms for 0&IM expenditure for claiming the impact of wage hike, if any, du r i~g period 201 4-1 9.

5) Allow the petitioner to recover the shortfall or refund the excess Annual Fixed Charges on account of Return on Equity due to change in applicable Minimum Alternate1 Corporate Income Tax rate as per the Income Tax Act, 1961 (as amended from time to time) of the respective financial year directly without making any application before the Commission as provided under clause: 25 of the Tariff Regulations, 2014.

6) Approve the reirr~bursement of expenditure by the beneficiaries towards petition filing fee, expenditure on publishing of notices in newspapers in terms of Regulation: 52 of Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014 and other expenditure (if any) in relation to the filing of petition.

7 ) Allow the petitioner to bill and recover Licensee fee and RLDC fees and charges, separately from the respondents in terms of Regulation: 52 of Central Electricity Regulatory Commission (Terms and Conditions of Tariff) Regulations, 2014.

8) Allow the petitioner to bill and adjust impact on lnterest on Loan due to change in Interest rate on account of floating rate of interest applicable during 2014- 19 period, if any, from the respondents.

11) Allow the petitioner to bill Tariff from actual DOCO and also the petitioner may be allowed to subrr~it revised Management Certificate and Tariff Forms (as per the Relevant Regulation) based on actual DOCO.

M (PS) stated that in view of the possibility of the IPP generations being stranded

on account of delay in implementation of ATS, LlLO of one circuit of 400kV

Rourkella- Raigarh D/C line at Sterlite and LlLO of the other circuit at Ind-Barath

would be made as temporary arrangement to avoid such situation. These LlLO

would be removed when the project specific transmission system as decided

would be in place.

In respect of Sterlite project, M(PS) stated that out of the total installed capacity of

2400MW , the generation developer sought LTA for only 400MW, 600 MW share

for Orissa, about 1000MW would be utilized for meeting its own typical captive

load and there was no strategy indicated for utilization of balanced 400MW. In

view of the plant to be connected to the grid, grid security and stability could be a

concern. M (PS) stated that the generation developer would be required to carry

out detailed exercise about typicai cnaracterisiics oi iheir ioad and derive the pian

for entire utilization of Plant capacity. In this context, M(PS) stated that the

generation developer should submit its switchyard drawirlgs, load characteristics

etc. to CEA/PGCIL for study and analysis

POWERGRID has furnished the hourly voltage profile of Gwal~or 765 kL1 bus for t h e period 01.01.2014 to 15.02.2014. Aurangabad 400 k\/ bus for t h e period 18.01 2014 to 17.02.2014, Jabalpur 765 kV bus for the 1.02 2014 to 15.02.2014 and (jay wise maxiniumlminimum of the voltages occurred at Wardha 765kV bus for the :)c+riod 01 11 201 3 to 11.02.2014. The voltage profile shows that at Jabalpur voltage aljove 800 kV has prevailed for about 14% of the time during the period 1.02.2014 to i 5 02.2014, at Gv~alior voltage above 800 kV has prevailed for about 6% of the time during the pkriod 01 01,2014. to 15.02 2014 and at Aurangabad voltage above 420 k 'J has prevailed for- about 13% of the time during the period 18.01.2014 to 17 02.20'4

Similarly, the maximum voltage of 815 kV and minimum voltage of 737 kV has been observed at Wardha 765 kV bus during the period 01.l1.20?3 to 11.02.2014.

Commissioning of line reactors into bus reactors as proposecj above would help in controlling the high voltages being observed at Jabalpur. Gwalior. VVardha and Aurangabad. Therefore the propcsal of commissioning of line reactors as bus reactor till :he associated !Ines are commissioned is agreed in principle. The line reactors commissioned as bus reactors should be restored as line reactors along with the conimissicniny of the associated iines.

'The proposal would be formalized in Ihe next WR Standing Committee Meeting on Power System Planning.

involved in movement of Over Weight and Over Dimensional Consignments (0V~rCsf0DCs) on the National Highways, a letter No.RT-ii042/13/2008-MVC was lssued on 16% September, 201 3 by Mlnlstry of Road Twnsport & Highway6 far further shamlining the process of grant of permission for movement of OWCslODCs. In pursuance thereof, this Ministry is in the process of getting such stmctures surveyed, so that a considered decision may be taken on the movement of OWCslODCs.

2. It has been brought to the notice of this Minfstry that several consignments are withheld in want of sunrey report of critical stnrcturas like bridges, tunnels etc. on the National Highways. In order to prevent delay in grant of permission for movement of OWCslODCs on the National Highway, it has been. decided that the implementation of Circular No, RT-11042/13/2008-MWL dated 16" September, 2013 be kept in abeyance until completion of survey and examination by this Ministry. In the interim, all requests for grant of prmlsslon will be processed as per Circular No. RT-11042r13/20O&MVL dated 22 January, 201 0 and Clradar No. RT-11042/13/2QO&MVL dated 3fd September, 2008. The Transport Commissioners are requested to process the grant of permission expeditiously.

Reasons for Delay

Proiect Details Prior approval of Government under section 68 of Indian Electricity Act, 2003: Dated 15.02.2010

Date of Investment approval : 15.12.2010 Schedule completion : 14.12.2013 Expected Completion : 25.07.2014

' Expected Delay : About 7 Months

Reasons o f Dela-vs: The Transmission Line got delayed in commissioning by about 07 Months from scheduled completion as per Investment approval and it is expected to be ready for commissioning by 25th Jul 2014. There are two major factors for delay in commissioning of this Transmission line, being explained below

1. Rerouting due to encountering of Coal Blocks:

Immediately after Investment approval contract was awarded for construction of this Transmission Line within a month's time i.e. on 18.01.2011 and construction activities were taken on top priority on most feasible route, with advance action taken for forest proposal.

However, during construction phase, ministry of Coal intimated that the instant line under consideration was passing through Care Palma Coal block and was required to be rerouted. A first communication in this regard received from Secretary Coal dated 08.05.2012 is attached alongwith other communications regarding Approval for Forest Clearance.

Subsequently a detailed exercise with Coal Ministry/ CMPDI/ with help of CEA was carried out. After various rounds of discussion and survey and field inspection another route was finalized in association with Coal ministry /CMPDI/CEA.

Accordingly, in Aug 2012, in principle decision for alternate route was worked out and a letter from Chairman, CEA written to Secretary, Coal ministry dated 30.08.2012 is attached for ready reference alongwith delay documentation.

2. Forest Approval for Ministry of Environment and Forest

After change of route to avoid the coal blocks/forest areas, the detailed survey offores t was again carried out and forest proposal was prepared with following major milestones:

As we have informed, the said Jharsuy uda --Dharamjaygarh Transmission line is very critical element of the Transmission System for evacuating appr3ximatety 10,000 MW of power from upcoming lPPs in the state of Odisha, which are likely to be operational within the next 1-2 years, ARcil. perniission from various authorities, lhe construction of transmission line started mo'a that) a year back. Subsequently, it was observed that a particular stretch of the transmis:.,ion lirie was passirlg through Gare- Palma Coal bloc'c. In this respect, the refereice from ycrur offix, as aforesaid suggesting rerouting to avoid the coal block was al:;o recolved.

Accordingly, the matter has been e x i ~ ~ i n e c : by POWEFlGRlD and an extensive exercise has been carried out for possible r!!terna ive routes along wi:h CMPDl and a11 affected coal companies including M/s IJlaFa Ta nil Cctllieriee Ltd. After a series of meetings and deliberations with CMPOl and affectc?d coal companies, revised route (2 X

765 kV DIC Transmission Line), avoiding Gare Palma Coat 13lock and other identifiedlexisting coal block has been fitialized. 4 wpy of the map depicting old and revised route is enclosed.

Although the revised route mlecils some additional forest stretches, POWERGRID is willing to go ahead wkh the implementation of the line through the revised route to avoid further delay in evaccrition 1-1f power from various upcomir~g lPPs in the state of Odisha.

I thank you very rntrch for in-prirlci~la cle:~rance for rerouting the transmisekn lines (2 X 765 kV D/C) depicted as Alternative-l, I have advised POWE,RGI-IID to go ahead with the construction of the transmission line along the revlsed route to avoid further delay, However, as discussed during the neeting, in case a need arises due to future coal blocks, dkrersion of line for a given stretch can always be taken up by relocating a few towers at a later date.

I am directed to refer to the Govt. of Chhattisgarh's letter no. F-5-3/2013/10-2 dated 20.04.2013 on above mentioned subject seeking prior approval of the Centra! Government under Section-:! of the Forest (Conservation) Act, 1980 and to say that the proposal has been examined by the Forest Advisory Committee constituted by the Central Government under Section-3 of the said Act.

2. ' After careful examination of the proposal of the State Government and on the basis of the recommendations of the Forest Advisory Committee, the Central Government hereby conveys the 'in-principle' approval for diversion of 130.792 ha of forest land for construction of Jharsugada-Dharamjaigarh 765 KV Transmission Line in favour of M/s Power Grid Corporation Limited in Raigarh District in Chhattisgarh subject to fulfilment of the following conditions:-

(i) Legal status of the diverted forest land shall remain unchanged

(ii) Compensatory afforestation over the degraded forest land twice in extent to the forest area being diverted shall be raised and maintained by the State Forest Department at the cost of the User Agency.

(iii) The Iand identified for the. purpose of CA shall be clearly depicted on a Survey of India toposheet of 1:50,000 scale.

(iv) The User Agency shall transfer the cost of raising and maintaining the compensatory afforestation, at the current wage rate, to the State Forest Department. The scheme may include appropriate provision for anticipated cost increase for works scheduled for subsequent years.

(v) The State Government shall charge the Net Present Value (NPV) of the forest land being diverted under this proposal from the User Agency as per the orders of the Hon'ble Supreme Court of India dated 28.03.2008, 24.04.2008 and 09.05.2008 in Writ Petition (Civil) No. 202/1995 and the guidelines issued by this Ministry regard.

At the time of payment of the Net Present Value (NPV) at the then prevailing rate, the User Agency shall furnish an undertaking to pay the additional amount of NPV, if so determined, as per the final decision of the Hon'ble Supreme Court of India. All the funds received from the user agency under the project, except the funds realized for regeneration / demarcation of safety zone, shall be transferred to Ad-hoc CAMPA in the Saving Bank Account pertaining to the State concerned. The User Agency shall obtain the Environment Clearance as per the provisions of the Environmental (Protection) Act, 1986, if required. No labour camp shall be established on the forest land. The User Agency shall provide firewood preferably alternate fuels to the labourers and the staff working at the site so as to avoid any damage and pressure on the nearby forest areas. The boundary of the diverted forest land shall be demarcated on ground at the project cost, by erecting four feet high reinforced cement concrete pillars, each inscribed with its serial number, forward and back bearing and distance from pillar to pillar. The forest land shall not be used for any purpose other than that specified in the proposal. The User Agency shall ensure that because of this project, no damage is caused to the wildlife available in the area. The user agency in consultation with the State Government shall create and maintain alternate habitat/home for the avifauna, whose nesting trees are to be cleared in this project. Birds nests artificially made out of eco-friendly material shall be used in the area, including forest area and human settlements, adjoining the forest area being diverted for the project. Width of right of way for the transmission line shall be limited to sixty seven meters. To minimize the felling for construction of transmission line, user agency shall comply with the following guidelines:-

(a) Below each conductor, width clearance of 3 mts. would be permitted for carrying the tension stringing equipment. The trees on such strips may be felled but after stringing work is completed, the natural regeneration will be allowed to come up.

(b) One outer strip may be left clear to permit maintenance of the transmission line.

(c) In the remaining width the right of way felling / pollarding / pruning of trees will be done with the permission of the local forest officer whenever necessary to maintain the electricai clearance, trees shall be allowed to be felled or lopped to the extent required, for preventing electrical hazards by maintaining the minimum 5.5 meter clearance between conductors and trees. The sag and swing of the conductors are to be kept in view while working out the minimum clearance mentioned as above.

(d) User agency in consultation with the State Forest Department prepare a detailed scheme for creation and maintenance of plantation of dwarf species (preferably medicinal plants) in right of way under the transmission line, and provide funds for execution of the said scheme/..tq;the.,.,,State Forest

(e) In case a portion of the transmission lines to be constructed is located in hilly areas, where adequate clearance is already available, trees shall not be cut:

(xvii) The State Government shall complete settlement of rights, in terms of the Scheduled Tribes and Other Traditional Forest Dwellers (Recognition of Forest Rights) Act, 2006, if any, on the forest land to be diverted in accordance with the relevant guidelines issued by the MoEF.

(xviii) Any other condition that the concerned Regional Office of this Ministry may stipulate, from time to time, in the interest of conservation, protection and development of forests & wildlife.

(xix) The User Agency shall submit the annual self-compliance report in respect of the above conditions to the State Government and to the concerned Regional Office of the Ministry regularly; and

(xx) The User Agency and the State Government shall ensure compliance to provisions of the all Acts, Rules, Regulations and Guidelines, for the time being in force, as applicable to the project.

3. After receipt of the compliance report on fulfilment of the conditions mentioned above, the proposal shall be considered for final approval under Section- 2 of the Forest (Conservation) Act, 1980. Till receipt of the said final/Stage-I1 approval of the Central Government from this Ministry, transfer of the said forest land to the User Agency shall not be affected by the State C-over;~~cn:.

Sub: Diversion of 130.792 Ila of forest land for construction of Jharsugsda/Uhararnjaigarh 765 KV Transmission Line in favour of M/s Power Grid Corporation Limited in RaigarhJDharamjaigarh Districts in thc State of Ch hattisgarh.

Sir,

T am dirscted to refer to the State Government's letter no. F-5-3/20 131 10-2 dated 20.04.2013 oli the abovc subject seeking prior approval of the Central Government under Section- 2 of the Forest (Conservation) Act, 1980. After careful corisideration of the proposal by the Forest Advisory C:ommittee constituted under section-3 of the said Act 'in-principle' approval was granted vide this Ministry's letter of even number dated 19.08.2013 sul?ject to fulfillment of certain conditions prescribed tlzercin. The State Governrnent has furnished compliance report in respect of the conditions stipulated in tlie in-principle approval and has requested the Central Government to grant final approval.

I l n this connection. I am directed to say that on the basis of' thc complia~ice report t'ilrnished by the State Government vide letter no, Bhu-PrabhundiVidhuf/479-109/2,06! dated 04.12.201 3, titial approval of he Central Government is hereby granted under section-2 of the Forest (Conservation) Act, 1980 for diversiori of' 130.792 ha of forest land for construction of .IIlarsugada/l>haramjaigarh 765 KV Transmission Linc in ihvour 01' M/s Power Grid Corporation Limited in RaigarhIUharamjaigarh Districts in the Statc of Chhattisgarh subject to fulfillment of the followi~ig conditions:

( I . Legal status of the diverted forest land shall reinnin unchanged:

2. Compensa~ory afforestation ovcr the degraded forest land, double in extent to the forest land being diverted, sliall be raised and maintained by the State Forcst llepartment froin the funds already provided by the User Agency:

3. The User Agency shall pay the additional aniount of N W , if so determined, 2s; pcr tlie final dccision of the Hon'ble Suprcme Court of India;

4. No labour camp shall be established on the Ibrcst Innd;

Thc User Agency shall provide firewood preferably alternate fuels to tlic labourers and the staff working at the site so as to avoid any damage and pressure on thc nearby forest areas;

The boundary of the divcrted forest land shall be demarcated on ground at the projecl cost, by erecting four feet high reinforced cement concrete pillars, each inscribcd with its serial number, forward and back bearing and distancc froin pillar to pillar;

The forest land shall not be used for any purpose other than that specified in thc proposal:

The User Agency shall ensure that because of this projcct, no damage is caused to the wildlife available in the area;

The irscr agency in co~isultation with the State Governlnent shall create and maintain alternate habitat/home for the avifauna. whose nesting trees are to be cleared in this pro-ject. Bird's nests artificially made out of eco-friendly matcrial shall be used in the area, including Forest area and human settlements, adjoining the forcst area being diverted for the project;

To miniliiize the felling for construction of transmission line, user agency shall comply with the Following guidelines:

A) BCIOW each conductor, width clearance of 3 mts. would bc permitted Tor carrying the tension stringing equipment. The trccs on sucli strips Inay be felled hilt alter s~ringing work is completed, the nati~ral regcncration will be allowed to come up;

b) One o~lter strip may be left clear to permit maintenance ol'the transmission line;

C) ln the remaining width the right of way felling/pollardinl/pruning of trees will be done with the permission of the local forcst ofticer whenever necessary to maintain the electrical clearance, trees shall be allowed to be l'elled or loppcd to the extent ~.equired. for preventing electrical hazards by maintaining the minimum 5.5 mctcr clearance between conductors and trees. The sag and suing of the conductors arc to be kept in view whilc working out the niinitnum clearance mentioned as above:

d) User agency in consultation wilh the State Forest Dcpart~melil prepare a detailed schemc for creation and maintenance of' planlalion of dwarf spccies (prel'erably medicinal plants) in right of way undcr the transmission line, and provide funds l'or exec~tlion of the said schcme to the State Forest Depanmcnt; and

c) In case a portion of the. transmission lines to be constructcd is located i n hilly areas. where adequale clearancc is already available, trees shall not be cut.

Any other co~idition that the concerned Regional Office of this Ministry may stipulate.
