The real Matera and Basilicata

Afternoon, departure for Venosa, city of the poet Horace. Visit the archaeological site of the Abbey of the SS. Trinità and its Incompiuta (the church which was never finished), the old town and the castle. After the tour, return to Matera for dinner and overnight stay in the hotel.

Day 4

Morning: breakfast at the hotel, meet the gui-de, pick-up and transfer to Craco, nicknamed “the ghost town”. Following a number of tre-mors, and despite human intervention, the po-pulation had to be relocated elsewhere due to the imminent risk of subsidence. However, the town has become a tourist destination whose appeal continues to grow and it has become the ideal location for the filming of adverts, music videos and for the film industry tout court. Afterwards, transfer to Tursi.Lunch in a typical restaurant.Afternoon visit to the Arab-Norma district cal-led the Rabatana.Followed by a visit to the Sanctuary of Santa Maria di Anglona, considered a national monu-ment since 1931.After the tour, return to Matera for dinner and overnight stay in the hotel.

Morning: breakfast at the hotel, meet the guide, pick-up and transfer to the Parco della Murgia, set of numerous films including “The Gospel ac-cording to Matthew” by Pier Paolo Pasolini and “The Passion of the Christ” by Mel Gibson.Visit to the Crypt of the Original Sin, otherwise known as the “Sistine Chapel” of southern Italy, followed by lunch, tasting of typical local pro-duce and wines at an agriturism/working farm. Afternoon: back to Matera to admire the Rupe-stran Churches of San Pietro Barisano, San Ni-cola dei Greci and the Madonna delle Virtù. The tour continues through the ancient peasant ci-vilization of the Sasso Barisano and Sasso Cave-oso districts, UNESCO heritage sites since 1993.

Morning: breakfast at the hotel, meet the gui-de, pick-up and transfer to Melfi, city of Frede-rick II of Svevia which went down in history for the enactment of the Melfi Constitution, a legal code that in the Medieval era was ahead of its time in the West. Visit the majestic castle and the museum inside, the cathedral and the Me-dieval city walls.Lunch in a typical local restaurant.

Cross the bri-dge, viaduct and aqueduct Madonna della Stella over the Gravina canyon to the Pianoro del Pa-dreterno, visiting the gravina and its Rupestrian surroundings.

Here the history of the city is retold in a 16th Century dwelling carved out of the rock.Outside the city walls, more of the peasant life-style will be discovered in the Barisano district, stopping at private residences and listening to their direct experience of living there every day (visit Casa Grotta by Rizzi Eustachi in via Fioren-tini and “Matera in Miniature”).Lunch on typical produce and visit the Rupestrian complex of Madonna delle Virtù and San Nicola dei Greci, a splendid example of a church in the Latin style (Madonna delle Virtù) and Byzantine (San Nicola dei Greci) as well as the Rupestrian church San Pietro Barisano which, with its myste-rious catacombs, represents the most important and the largest Rupestrian church in the city of Matera, located in Sasso Barisano. once a settlement and dates back to the 8th Century B.C. Decorated ceramic grave goods, jewels moun-ted in gold and amber, and Grecian armour be-longing to the burial sites of the Basileis (king), mentioned in ancient sources, have been unear-thed in the necropolis. Transfer to Potenza.Lunch in a typical restaurant with produce from Lucania.Afternoon, visit to the National Archaeological Museum “Dinu Adamesteanu”.Established in 2005, the museum is dedicated to Dinu Adamesteanu, a Romanian scholar of absolute international importance and “foun-ding father” of archaeology in Lucania.The museum is mainly characterised by the in-tricate armour from warriors’s tombs and pre-cious jewellery that are testimony to a class of the elite, including the kings of the Peuketian-tes and the peoples that occupied the territory in ancient times.End of tour package.

Day 2

Morning, breakfast at the hotel.Pick-up and transfer to Neolithic villages of Murgecchia, Murgia Timone and Tirlecchia near Matera. The Murgia near Matera has been populated since ancient times and some sites have in fact been identified as dating back to the Paleolithic times (Grotta dei Pipistrelli) and Neolithic times (fortified villages in the districts of Murgecchia, Murgia Timone and Tirlecchia).Lunch in a typical restaurant with local produce. Afternoon, visit the National Archaeological Museum “Domenico Ridola”.In the prehistoric section the most significant findings concern the trenched villages from the Neolithic age, from the 6th Millennium B.C., the introduction of agriculture and consequently the beginning of stable settlements, according to the Eastern Mediterranean model.As regards the more recent eras than prehistory and in particular the 6th to the 4th Century B.C., the most important documentation concerns the Timmari, a site which is not far from Matera.Return to hotel.Dinner and overnight stay.

Lucano, an unmissable destination for tourists in Basilicata. The site in Grumentum represents one of the few cases in Italy where you can admi-re the ruins of an extraordinary archaeological historical heritage, with the layout of a typical Roman city abandoned and never re-inhabited.Packed lunch.Afternoon, visit the National Archaeological Museum where the first section is dedicated to Prehistory and preserves an elephas antiquus and equidae dating back 120,000 years. The exhibition continues with an illustration of how the city evolved, in particular ranging from the Roman Republic to the whole Empire. Return to the hotel in Matera.Dinner and overnight stay.

Laurenzana, the holy paths and medieval drovers’ tracks

The itinerary that is proposed here is a trip back to the past to discover the splendid me-dieval village of Laurenzana. It is also a mystical journey aimed at discovering our spiritual ro-ots. These are places in which a poor saint, the blessed Egidio, of the minor order of Franciscan monks, was born and preached. Itinerary

Arrival and meeting with the local guide, who, with a touch of authenticity and together with a lady from Laurenzana, will welcome you and tell you all about the history, art and folklore of the town. A few steps from Via Trono, with the at-mospheric background of the feudal castle a ta-sty breakfast will also be ready to welcome you, served by locals dressed in period costume.Breakfast will be made up of little tasters of typical local produce: fresh fruit, bread and su-gar, sweet and savoury taralli, jams, honey and eggs...) We will also take a look inside the rooms and gardens of the feudal castle.

Over the road that marks the boundary of the castle, we will stop for a moment at, what is known as “Paradise Rock”. We will be able to ad-mire the wood and the old path that connected the town and the convent. This area is full of stories and legends, and we will travel along the same road that the Blessed Egidio walked to re-ach the village and where he often stopped to in the middle of the wildlife. Church where the body of the Blessed Egidio rests, born in 1443 in Laurenzana. Bernandino’s holy path starts here. It was here that at the age of approximately 30, he entered a Franciscan Convent and demonstrated an ex-traordinary holiness, due to his acute sense of ascetic and contemplative spirituality. The fame regarding his holiness, in life as in death, grew and grew over the years and inspi-red pilgrims to travel from Apulia, Calabria and Campania. In the years following his death innu-merable miracles and healings associated with his intercession were recorded arousing his pro-clamation as a “Saint” in popular piety.Even today, the worship of the Blessed Egidio is very much alive for the people in the northern part of Basilicata keeping the memory vivid of a fellow citizen who still today demonstrates his spirit of charity.After the visit of the Main Church, we will stroll down the streets of the ancient village where history, tradition and even the flavours of the ancient town of Laurenzana are intertwined. We will arrive at the main high street and we will stop off at the bakery “La Rinascita del Ca-mastra” which has chosen to use a recipe dating back to when the monks were present in the Laurenzana territory to refresh pilgrims and passers-by, and coining the Biscotto del Beato (the Biscuit of the Blessed one).As according to the program, here we will enjoy baking this famous biscuit ourselves, learning the ancient techniques needed to transform the flour.

“FESTA MARIA S.S. DELLA BRUNA”

The century old festival of Madonna della Bruna, Protector of the city of Matera, starts off with the “Procession of the shepherds”. The ancient districts of the city wake at dawn to greet the Painting of the Virgin. At the same time escorting the processional float the horsemen gather in the streets and neighbourhoods. The soul of the city rejoices in a mass cele-bration and later that evening, after months of work by skilled papier mâché craftsmen, the float is attacked and destroyed by the crowd. Finally the fireworks light up the ancient di-stricts of the Sassi in a unique spectacle.

THE SHOW “LA STORIA BANDITA”PARCO DELLA GRANCIA

“La storia bandita” is the largest popular theatre show in Italy and its main character is Carmine Crocco, whose voice is provided by director-actor Michele Placido. “NOTTE DELLA TARANTA”

Taranta Night is one of the biggest festivals in Italy and it is one of the most significant demonstrations of popular culture in Euro-pe. It takes place Salento  and in particular it is dedicated to the rediscovery and valori-sation of traditional Salentina music and its fusion with other musical languages from world music to jazz, to symphony music. Born in 1998  as an initiative of the United Municipalities of Grecìa Salentina and the “Diego Carpitella” institute, over the last 15 years the festival has grown enormously in size, popularity and cultural prestige.

THE FESTIVAL OF SAN NICOLA

The festivities for San Nicola on the 6th De-cember (for the religious traditions) and on the 9th May (for the transfer of the remains from Mira, in Turkey to Bari) represent im-portant moments of faith and piety for the thousands of pilgrims from all over Apulia and southern Italy, as well as orthodox wor-shippers who come predominantly from Russia to celebrate San Nicola, the most powerful intercessor with God.

CARNEVAL OF PUTIGNANO

The carneval of Putignano goes back to 1394 when the Apulian coastline was prey for Saracen raids. During the first half of the 1900s the local craftsmen started contribu-ting to the Carneval of Putignano putting art, passion and skill into play for the festi-vities. Over time the small floats laden with puppets made of straw and rags have had to make room for story-telling floats built in iron and coated in paper mâché.

FOCARA OF NOVOLI

La Focara is a dialectal term in Salento mea-ning a bonfire.The bonfire of Novoli is the largest of all and it is built for the celebrations in honour of the patron saint Sant’Antonio Abate. On the 16th January the bonfire is lit with a fireword di-splay that lights up the town even by day. The event is renowned throughout Apulia and attracts thousands from all over southern Italy. It was also reported on by National Geo-graphic. Every year the bonfire builders amu-se themselves by changing the shape of the “focara” sometimes extraordinarily leaving a hole in the middle.

“THE MYSTERIES” OF TARANTO

The rituals of the Holy Week in Taranto start in the city on Palm Sunday. These sacred tra-ditions go back to the age of Spanish domi-nation. They were introduced to the city by a Tarantino aristocrat Don Diego Calò, who had the statues of Jesus’ body and the Addolora-ta Madonna made in  1703. In 1765  another aristocrat Francesco Antonio Calò, heir and guardian of the Mysteries of Good Friday procession, donated the two statues to the Confraternity of Carmine. They became part of this procession on Good Friday 4th April 1765 conferring the honour and costs of or-ganising and continuing the tradition that had been started around a century earlier.

FEDERICUS

Federicus is enchanting: a city goes to sle-ep in the 21st century and wakes up in Me-dieval times. The event Federicus is a great Medieval festival now at its 8th edition in honour of the Emperor Frederick II of Sve-via, everyone dresses up and the old town of Altamura is transformed for 4 intense and colourful days. The experience, the commit-ment of the volunteers and the draw it has created for visitors and the media alike has meant the festival has grown to become one of the most important cultural events, nationally and internationally.

“BACCO DELLE GNOSTRE”

Over time, this event has grown from being a small food festival to being one of the most eagerly awaited enogastronomic fixtures in the Apulia calendar. Bacco delle Gnostre – new wine and roasted chestnuts warm the autumn air with wholesome flavours and popular festivities in Noci, in the province of Bari, to the sound of music, street artists and other cultural initiatives.Le Gnostre are little courtyards in the old town that are shared betweeen households making them an ideal place to socialise and make merry. The event is organised by the Parco Letterario Formiche di Puglia and has an ancient flavour and magical atmosphere.

Italian popular music is still alive and kicking at the Carpino Folk Festival. This is obvious from its growing popularity in Europe and the palpable satisfaction of those who take part on the stage or in the audience, all come together in the spirit that revives tradition, passion and territorial identity.Every year in the month of August Carpino turns itself into a city-stage and the Gargano welcomes thousands of traditional music-lo-vers of all ages. LOCUS FESTIVAL

Ever since 2005 in Locorotondo, in the magi-cal corner of Apulia called the Valle d’Itria, the Locus festival has distinguished itself in Italy for its perfect balance of quality and popula-rity of its events, becoming one of the most up-to-date music festivals in the country.A solid fan-base of loyal followers knows that at the Locus festival there is always so-mething new and interesting to discover. Often over the years we have invited artists just before they have made it big in the me-dia (Aloe Blacc, Fat Freddy’s Drop, Luca Sapio, Raphael Gualazzi, Robert Glasper, Laura Mvu-la, Jacob Collier…) without detracting from quality pop guests at Locus (Battiato, Malika Ayane, Sergio Cammariere, Nina Zilli, Negra-maro, Niccolò Fabi…).

1. LEGISLATIVE SOURCESThe sale of tourist packages having as object services to provide in Italy or abroad, is governed – until its abroga-tion – art. 3  of the Legislative Decree no. 79 of May 23, 2011 (the “Tourism Code”) – by Law 27/12/1977 no.1084 for ratification and execution of the International Con-vention on travel contracts (CCV), signed in Brussels on 23.4.1970 – as applicable – as well as by the Italian Tourism Code (articles 32-51) and its subsequent amend-ments.

2. ADMINISTRATIVE ARRANGEMENTS.The organiser and the intermediary of the tourist packa-ges, to whom the customer applies, must be enabled to perform their tasks in accordance with the applicable ad-ministrative regulations, including regional regulations. According to the art. 18, VI paragraph, of the Italian Tou-rism Code, the use in company name of the words “tra-vel agency”, tourism agency”, “tour operator”, “travel mediator” or other similar words and phrases, in foreign language too, is allowed only to  licensed companies re-ferred to the 1st paragraph.

3. DEFINITIONSFor purposes of this contract, the following terms shall have the following meanings:1. a) Travel organiser: someone who undertakes, in their own name and with a flat-rate payment, to supply third parties with tourist packages, combining the elements referred to in art.4, or offering to customers, even by means of a remote communication system, the possibi-lity to independently carry out and purchase that com-bination;2. b) Seller: someone who, even non-professionally and non-profit, sells or undertakes to supply tourist packa-ges created in accordance with art.4, with a flat-rate payment;3. c) Tourist: the purchaser, the assignee of a tourist package or any other person even to be named, provided that this person satisfies all the conditions required for the use of the service, on whose behalf the main contrac-tor undertakes to purchase a tourist package without re-muneration.

4. DEFINITION OF TOURIST PACKAGEThe definition of tourist package is the following:“ The tourist packages include trips, holidays and “all inclusive” packages, tourist cruises, resulting from the combination, by anyone and in anyway realized, of at least two of the following elements, sold or offered as a flat rate price: 1. a) transportation; b) accommodation; c) additional tourism services not included in the transportation or accommodation costs, according to the art.36, that constitute a significant part of the “tourist package” to guarantee the satisfaction of the tourist’s recreational needs (art.34 of the Italian Tourism Code).The Tourist has the right to receive the copy of the sa-les contract of the tourist package (according to art.35 of the Italian Tourism Code). The contract is entitled to access to the National Guarantee Fund referred to the subsequent art.21. 5. INFORMATION TO TOURIST – TECHNICAL DATA SHEETThe organiser is obliged to arrange a technical data sheet in the catalogue or in the programme out of the catalogue, even in electronic format or by electronic transmission. The elements required to be included in the technical data sheet of the catalogue or of the pro-gramme out of the catalogue are:-details of the administrative authorization or, as appli-cable, the Commencement Notice or Certified notice of construction works commencement of the organiser;– details of public liability insurance policy;– validity period of the catalogue or the programme out of the catalogue;– terms and conditions for replacement of the traveller (Art. 39 of the Tourism Code.);– parameters and criteria for adjustment of the travel price (Art. 40 of the Tourism Code.).The organiser shall also include any additional condi-tions in the technical data sheet, as well as the identity of the carrier, according to art.11 of (EC) Regulation no. 2111/2005, and regarding its possible inclusion in the so-called “black list” as per the same Regulation.

6. RESERVATIONSThe reservation proposal must be drafted on specific

contract forms, including the electronic form, filled in each part and signed by the tourist, who will receive a copy of it. The acceptance of the reservations is consi-dered completed, with consequent closure of contract, only when the organiser sends relative confirmation, even by means of a telematics system, to the tourist through the intermediary travel agency.Before the departure, the organiser will provide indica-tions related to the tourist package, not contained in the contractual documents, in the brochures or in any other means of written communication, as set forth in the art. 37, paragraph 2 of the Tourism Code.According to art. 32, paragraph 2 of the Tourism Code, in case of distance contracts or outside the commercial premises (as defined in the articles 50 and 45 of the Legi-slative Decree 206/2005), the organiser reserve its right to communicate in writing form the non-existence of the right of withdrawal pursuant to articles 64 et seq. Legi-slative Decree 206/2005.

7. PAYMENTSThe deposit amounts to 25% of the total amount of the tourist package, to be paid at the time of booking or at the time of the binding request and the date in which the payment must be effected, before the departure, are included in the catalogue, brochure or in any other documents.

8. PRICEThe price of the tourist package is determined with reference to what is stated in the catalogue or in the programme out of the catalogue and in other possible updating of the same catalogues or programmes out of the catalogue subsequently added. The price may vary up to 20 days before the departure and only due to the variations of:– transportation costs, including fuel prices;– rights and taxes on some typologies of tourist services, such as landing fees, embarkation or disembarkation fees at ports and airports;– exchange rates applied to the tourist package in que-stion.For these variations, reference should be made to the changes in exchange rates and the costs mentioned abo-ve at the time of programme’s issue as reported in the catalogue technical sheet, or at the date shown in the eventual updating mentioned above.Fluctuations will weigh upon the tourist package flat rate price in the percentage clearly indicated in the ca-talogue technical data sheet or in the programme out of the catalogue.

9. MODIFICATION OR CANCELLATION OF THE ORGANI-ZED TOURIST PACKAGE BEFORE DEPARTUREBefore the departure, the organiser or travel agency that needs to modify significantly one or more elemen-ts of the contract will immediately notify the tourist in written form indicating the type of change and the con-sequent price variation.If tourist does not accept the proposal change referred to in the previous paragraph, s/he may alternatively exercise the right to reacquire the amount already paid or to enjoy the offer of an alternative tourist package in accordance with the paragraphs 2° and 3° of the article 10.The tourist may exercise any of the rights listed above also when the cancellation depends on the failure to achieve the minimum number of participants, as indi-cated in the Catalogue or in the Programme out of the catalogue or in case of cancellations caused by force majeure and unforeseeable circumstance, related to the purchased tourist package.In case of cancellations not due to the circumstances beyond the organiser’s control, fortuitous cases, failure to achieve the minimum number of participants, or in case the tourist does not accept an alternative tourist package, the organiser, responsible for the cancellation (art. 33 lett. and Cod. Cons.), will refund tourist of twice the sum s/he had paid and the organiser received, throu-gh the travel agent. The refunded sum will never exceed twice the amount already paid by the client in accordan-ce with article 10, 4th paragraph, in case the client is re-sponsible for the withdrawal.

10. TOURIST’S WITHDRAWALThe tourist may withdraw from the contract, without paying penalties, in the following cases:–  price increase (see art. 8) of more than 10%;– significant modification of one or more elements of the

contract objectively defined as fundamental for the use of the whole tourist package and suggested by the orga-niser after the closure of the same contract, but before the departure and rejected by the tourist.In the cases listed above, the tourist has alternatively the right to:– make use of an alternative tourist package, without additional costs or with the refund of the excess sum, in case the sum of the second tourist package is less than the first one;– the refund of the fees already paid that must be exe-cuted within 7 business days of receipt of the refund request.The tourist must notify his/her decision (accepting or rejecting the above-mentioned change) no later than two business days from the moment s/he received the notice of price increase or change in the terms of con-tract. In the absence of such notification within such pe-riod, the proposal made by the organiser is considered accepted.Al turista che receda dal contratto prima della partenza al di fuori delle ipotesi elencate al primo comma, o nel caso previsto dall’art. 7, comma 2, saranno addebitati – indipendentemente dal pagamento dell’acconto di cui all’art. 7 comma 1 – il costo individuale di gestione pra-tica, la penale nella misura indicata nella scheda tecnica del Catalogo o Programma fuori catalogo o viaggio su misura, l’eventuale corrispettivo di coperture assicura-tive già richieste al momento della conclusione del con-tratto o per altri servizi già resi.If the tourist withdraws from the contract before the departure and is not entitled to what listed in the first paragraph, or in the case provided by art. 7, paragraph 2, the cost of the procedure, any insurance requested at the time of the closure of the contract or other services already rendered, as well as the penalty in the amount indicated in the technical data sheet of the catalogue or the programme out of the catalogue or tailor-made tra-vels, will be charged.In the case of organized groups, such payments will be agreed from time to time when the contract is signed.

11. MODIFICATION AFTER DEPARTUREIf the organiser is not able, after the departure, to ren-der an essential part of the services mentioned in the contract for whatever reason, excluding a problem of the tourist, will arrange alternative solutions, without additional costs at the expense of the contractor. Alter-natively, the organiser will have to refund the tourist the difference between the services originally planned and the services rendered, unless damages.If it is not possible to make such arrangements, or the so-lution offered by the organiser is refused by the tourist for proven and justified reasons, the organiser will provi-de the tourist, without additional charge, with a means of transport equivalent to that originally planned for the return to the starting point or to any other agreed place, consistent with the availability of means and places, and reimburse the difference between the cost of the plan-ned services and the cost of the services rendered up to the time of anticipated return

12. SUBSTITUTIONSThe tourist who withdraws from the contract may repla-ce himself/herself with a third person if:1. a) the transferor communicates in writing to the orga-niser or intermediary, no later than four working days be-fore departure, to be in the inability to take advantage of the package and notifies the transferee’s personal details;2. b) the transferee meets all the conditions for the use of the service (ex art. 39 of the Tourism Code) and in par-ticular, the requirements related to the passport, visas, health certificates;3. c) the same services or other substitute services can be provided following the substitution;4. d) The transferee refunds to organiser all the extra costs incurred to proceed with the substitution, as quan-tified before the cession.The transferor and the transferee are jointly and seve-rally liable for payment of the balance, as well as of any additional expenses resulting from the assignment, spe-cified in the letter d) of this article.Further modalities and substitutions terms and condi-tions are mentioned in the technical data sheet.

13. TOURIST’S OBLIGATIONSDuring the negotiations and, in any case, before the clo-sure of the contract, Italian citizens are provided with

written general information – updated to the date of printing of the catalogue and related to the health obli-gations and the documentation required to travel abro-ad. Foreign citizens will collect the corresponding infor-mation through their diplomatic missions in Italy and/or their official government information channels.In any case, before the departure, the tourists will verify that this information is updated through the competent authorities (for the Italian citizens the local police head-quarters or the Ministry of Foreign Affairs at www.viaggia-resicuri.it or the helpline phone number 06.491115) and they will put the information into practice before depar-ture. In the absence of such verification, no liability for the failure departure of one or more tourists can be attributed to the organiser or intermediary. The tourists will  have to inform the organiser or intermediary of their citizenship and, upon departure, must definitively be sure to have the certificates of vaccination, the individual passport and any other type of document valid for all the Countries involved in the itinerary, as well as travel visas, transit visas and he-alth certificates, which may be required.In addition, in order to assess the health and security of the countries of destination and, therefore, the objecti-ve usability of the services purchased or to be purchased, the tourist will retrieve, making use of the above infor-mation, the official general information at the Ministry of Foreign Affairs that expressly indicates if the destina-tions are or are not subject to formal discourage.The tourists will also have to follow the rules of pruden-ce and diligence and those specifications in force in the countries of destination of the trip, all the information provided by the organiser or intermediary, as well as regulations, administrative or legislative provisions rela-ting to the tourist package.The tourists will be liable for all damages that the orga-niser and/or the intermediary may suffer, also because of the failure to comply with the above-mentioned obli-gations, including the costs necessary for their return.The tourist must provide the organiser with all the do-cuments, information and evidence in her/his possession relevant to the exercise the right of subrogation of the organiser against third parties who are responsible for damage. The tourist is responsible towards the organiser for prejudice to the right of subrogation.The tourist will also communicate in writing to the or-ganiser or the intermediary, at the time of booking, the special personal requests that may be the subject of spe-cific agreements on the travel arrangements, provided that it is possible to implement them.The tourist is obliged to inform the organiser or interme-diary of any needs or special conditions (pregnancy, food allergies, disabilities, etc.….) and to explicitly specify the request for personalized services.

14. HOTEL CLASSIFICATIONThe official classification of the hotels facility is provided in the catalogue or in other information material only by the express and formal request of the competent autho-rities of the Country also members of the EU where the service is provided. If there are no official classifications recognized by the competent authorities of the coun-tries, also EU member countries, where the service is provided, the organiser reserves the right to provide its own description of the accommodation, so to allow the tourist to evaluate and subsequently accept it.

15. LIABILITY REGULATIONThe organiser is responsible for damages caused to the tourist because of the total or partial failure to render the services due according to the contract, both if these are provided personally by the organiser and if they are provided by third parties, unless it can be proven that, the event was caused by customer (including actions ta-ken by the customer during the execution of the tourist services) or by a third party in an unpredictable or una-voidable way, by circumstances extraneous to the sup-ply of services under the contract, by accident, by force majeure, or by circumstances that the organiser could not reasonably foresee or solve with professional dili-gence. The intermediary from whom the tourist package was reserved is not liable under any circumstances for the obligations arising from the travel organization, but only for the obligations arising from his/her role as inter-mediary and, in any case, in accordance with the rules in force concerning this liability, except for the exemption provided for in art. 46 of the Tourism Code.

16. COMPENSATION LIMITSThe compensation stipulated in the articles 44, 45 and 47 of the Tourism Code and related provision terms,, are regulated by that regulation and, however, within the limits set by the C.C.V (travel agreements), by the Inter-national Conventions that regulate the services part of the tourist package as well as by articles 1783 and 1784 of the Civil Code.

17. MANDATORY ASSISTANCEThe organiser must provide the tourist with the assi-

Therefore, the terminology of the mentioned clauses relating to the tourist package contract (organiser, tra-vel, etc…) must be understood with reference to the cor-responding actors of the contract of sale of single tourist services (vendor, stay, etc.…).

stance measures required by the professional diligence, exclusively with reference to the obligations s/he is re-sponsible for legal or contractual disposition.The organiser and the intermediary are exempted from their responsibilities (articles 15 and 16 of these General Term and Conditions) if the failure or improper perfor-mance of the contract is due to the tourist or depends on a third party and is unforeseeable or unavoidable or is caused by accident or force majeure.

18. CLAIMS AND COMPLAINTSAny failure in the execution of the contract must be con-tested by the tourist during the use of the tourist packa-ge by timely submitting a complaint, so that the organi-ser, his/her local representative or guide can remedy the situation promptly Failure to present the claim can be evaluated for the purposes of art. 1227 of the Civil Code.The tourist shall also complaint – under penalty of inva-lidation – by sending a registered letter with return re-ceipt, or other means that provide proof of the receipt, to the organiser or intermediary, within and no later than ten working days from the date of return to the place of departure.

19. INSURANCE AGAINST THE CANCELLATION AND RE-PATRIATION COSTSIf not expressly included in the price, it is possible, or rather recommended, to stipulate, at the time of reser-vation, at the offices of the organiser and vendor, spe-cial insurance policies against the costs deriving from the cancellation of the tourist package, from possible accidents and events related to the luggages. It will be also possible to stipulate a service contract that covers the repatriation expenses in case of accidents, illness, unforeseeable circumstances and/or force majeure. The tourist will exercise the rights arising from these contracts exclusively towards the contractor Insurance Companies, at the conditions and modalities provided by these policies.

20. ALTERNATIVE DISPUTE RESOLUTIONPursuant to and in accordance with art. 67 of Tourism Code, the organiser may propose tourist – on the catalo-gue, on its own website or in other ways – an alternative solution to the arising disputes. In this case, the organi-ser will indicate the type of the alternative solution and the impact that this acceptance involves.

21. GUARANTEE FUND (art. 51 of Tourism Code.)The National Guarantee Fund established to protect tourists who signed a travel contract, shall provide the following needs in case of insolvency or bankruptcy de-clared by the organiser or intermediary:1. a) refund of the amount paid; 2. b) repatriation in case of travels abroad.The Fund shall also provide immediate financial resour-ces in case of forced return of tourists from non-Europe-an Countries on occasion of emergencies attributable or not to the conduct of the organiser.The methods of intervention of the Fund are established with the Prime Ministerial Decree dated 23/07/99 n. 349. Claims for refund to the Fund are not subject to any expiration but the right to reimbursement is subject to a limitation period.The organiser and intermediary shall contribute to such Fund to the extent set forth in paragraph 3 of the abo-ve-mentioned art. 51 of the Tourism Code, through the payment of the compulsory insurance premium to be stipulated, a share of which is deposited in the Fund with the methods stated in the art. 6 of the Ministerial Decree 349/99. ADDENDUMGENERAL TERMS AND CONDITIONS OF SALE OF SINGLE TOURIST SERVICES

A) LEGISLATIVE PROVISIONSThe contracts having as object only the offer of the transportation and accommodation service or any other separate tourist service that cannot be considered as a travel organization or tourist package, are regulated by the following provisions of the Convention on Travel Contracts (CCV): art. 1, n. 3 and n. 6; articles from 17 to 23; articles from 24 to 31 (only the parts that do not relate to the organization contract) as well as by other agreements specifically concerning the sale of a single service which is the subject of the contract. The seller who must provide third parties, even electronically, with a disaggregated tourist service is required to issue to the tourist the documents relating to this service that indicate the amount paid for the service and cannot be considered, in any way,  travel organiser.

B) TERMS AND CONDITIONSThe clauses of these general conditions of sale of tou-rist packages can also be applied to the contracts of sale of single tourist services: art. 6 paragraph 1; art. 7 para-graph 2; art. 13; art.18.
