This could be one of the most importantcommentaries of my term as your president.It’s about the proposed Amendment 4. Nothing is more important in the Novemberelection than defeat of this measure.

A quick look at www.florida2010.org will tell you in two minutes why a statewideversion of something that happened in St.Pete Beach could cripple Florida’s economy.A few years ago, that tiny town adopted alocal version. It opened the door to endlesslawsuits, higher taxes and economic turmoil.

When voters in St. Pete Beach approvedsome pro-growth changes to create jobs and help their economy, Amendment 4lawyers took them to court and overturned

the election. If a small town of 10,000 people went broke responding to legal challenges, imagine what it could do toFlorida’s big cities where special electionscan cost millions of dollars each. Imagine the budgetary mess if Miami-Dade Countyhad to cough up millions of dollars they don’t have just to answer legal challenges in the proposed Amendment 4.

Our local economy has gone through itsworst nightmare in generations and we’rejust beginning to see some sunshine. Unless we defeat this amendment toFlorida’s constitution in November, we’ll be vulnerable to a situation that can pull the plug on our weak recovery. This is no

time for a shortsightedmeasure that will kill jobs andraise taxes. Especially the kind of jobs thathave helped our people and communitiessurvive and thrive through good times and bad.

Times will get better. But we don’t need a sucker punch in this economy. Spread theword. Tell friends to watch the short video at www.florida2010.org and stay on top ofthis potential time bomb. Your jobs and ourBASF are on the line.

OPPOSING AMENDMENT 4 CRUCIAL TO OUR COMMUNITY’S FUTURE

This is not thetime to be out of sight and out of mind – youcould be out of business if that is the tact youare taking. This is the time to sharpen yourbusiness development skills and NETWORK,NETWORK, NETWORK –it is not a time to keep a low profile.

See and be seen! Be sociable! Attend theBuilders Association of South Florida (BASF)networking events, even if things are slow. If people don’t see you out and about, theymay hesitate to call you for the work that theyhave. One reason for hesitating to contactyou is the embarrassment factor –what if you aren’t around because you no longerhave a job?

Even if you are “without portfolio” –thecurrent euphemism for being unemployed- Ican’t think of a better place to find out what ishappening, who is hiring, and get that networkworking for you than the events the BASF puts on for you! And if your absence at theseevents is sending the wrong signal becauseyou actually have a job and are looking forbusiness opportunities, but people aren’taware of it, then you are squandering the opportunity to do business with a member.That will cost you much more than the mere$25 -$35 for an evening with your peerslearning about the OPPORTUNITIES of the

State Legislative Session in full swing - FHBA pushes for key“do-able” issues – The Florida Legislature started its 2010 Session on March 2nd, 2010, vowing to hold the line on taxes, cut red tape and reduce job-killing regulations. FHBA’s legislativeagenda is, therefore, focused specifically on these issues. During Home Builder Days in Tallahassee, April 6-8 this year, these top five items will be on our Legislative Agenda:

1) lift the revenue cap on the Sadowksi Affordable Housing Trust Fund;

2) adopt legal protections for builders who relied on the permit extension provision in last year’s Growth Management bill;

3) stop unnecessary building coderequirements including fire sprinklers in single family homes;

4) stop job-killing red tape by evaluating all proposed regulations for their impact on future jobs; and

5) condo laws to allow bulk sales. The sixty-day Session will end on April 30, 2010.

Constitutional Amendment 4: Vote NO! Dade-Broward Efforts onAmendment 4 “Hometown Democracy”Although the November 2, 2010 GeneralElections seem far away today, BASF members have established a strong grassroots effort to build opposition to this badamendment with a warm and fuzzy name.“Hometown Democracy” – or the “Vote on Everything Amendment” would be ajobs-killer for our state. Members in bothcounties have been working with localelected officials to get all cities to adoptresolutions OPPOSING this bad ConstitutionAmendment. Thus far, the cities of Aventura,Hialeah and Homestead have adopted resolutions opposing Amendment 4. InBroward, Pembroke Pines has taken the lead in this effort, with the Pines’

Mayor leading this important effort. VOTE NO on NOVEMBER 2, 2010!

MIAMI-DADE LEGISLATIVE NEWS

Since the public school interlocal agreement was approved in July 2009 bythe State Department of Community Affairs(DCA), the County has been preparing its ordinance to implement now-mandatoryschool concurrency requirements. Briefly, school capacity requirements would nowbecome part of all plat approval review criteria. Thus, a plat approval would now include a school capacity reservation, too. Members reviewed the ordinance and submitted comments in January toCounty staff. Commission adoption will follow once an ordinance is finalized.

City of Miami Update – Wrapping up Miami 21 Amendments before BudgetReality Hits - BASF members and staffhave now met with all City Commissionersand the Mayor’s staff. They have presentedsix industry amendments to the code, in the hope of modifying the now-adopted –but not yet effective – new form-based zoning code. The BASF amendment package includes revisions to the non-conforming section, green buildings andtime extension provisions. While the codewas adopted in October 22, 2009, it doesnot become effective until May 10, 2010. A public hearing to adopt Miami 21 amendments will have been conducted on March 25, which could be one of thelast opportunities to amend the code beforeits May effective date.

BIPAC kicks off fundraising efforts –joins with BASF member law firms – For our State legislative and County Commission races, BASF’s political action arm, the Building Industry PoliticalAction Committee (BIPAC) will be joiningforces with member law firms as bothgroups seek to raise funds and support

for key elected officials. BIPACChair, Mr. AshleyBosch and Co-chair RichardGomez, will be seeking Board memberparticipation at selected events.

Omnibus Development Approvals ordinance becomes law – With the constant vigilance of the Legislative Committee and with the cooperation of County staff, this ordinance was adopted at the February 2, 2010 CountyCommission. It became effective on February 12, 2010. It provides a two-year extension, by applicant request, for select administrative approvals, some environmental permits, various departmentally approved plans (exceptbuilding permits) or similar agreements. A list of approvals included for extension is listed in the final ordinance.Please contact staff for a copy at: [email protected].

Climate Change, Green and SustainableDevelopment Issues – emerging regulatory initiatives relating to green development continue being developed by County staff and several citizen panels.Each of them will have some impact construction and development. These simultaneous efforts are on-going in several venues, so our members and the BASF Green Buildings Committee isparticipating and monitoring all of them.

They are: > Mayor’s Panel on Sustainability – this group, with two BASF members seatedon it, is working with County staff and Commissioner Sorenson, as chair, to implement numerous county-wide greenpolicy changes for land-use, transportationand water and energy conservation in both the private and public sectors.

Look for some of these requirements to be included in a master plan amendment at some point in the future.

> Climate Change Advisory Task Force –The County Commission appointed thisgroup about two years ago. They have numerous committees with far-reachingrecommendations, including a ScienceCommittee that is preparing a sea-level rise map that could impact the location of future development. Their full Task force recommendations will be sent to the County Commission for their consideration in the coming months.

> BASF’s Green Buildings Committee is preparing a seminar entitled, “Smartand Easy Green Building” for an earlySeptember event including a productdisplay evening. The event is open to all members who are interested!

BROWARD LEGISLATIVE REPORT

Broward Growth Management staff holdsEAR scoping meeting – last month, seniorCounty planning staff held its first publicmeeting to discuss the issues they will include in the County’s Evaluation and Appraisal Report. The included five areas

of concern: climate change, transportationand mobility; housing challenges in a downeconomy, population changes and newservice requirements and water supplyplanning. Staff outlined the time-frames for adoption with a February 2011 final CountyCommission adopting hearing.

School Impact Fees will increase – third phase of three-part fee increasegoing into effect – while this is the worsttime to increase any fees, this particularschool impact fee increase was adopted in2007. During negotiations, BASF pressedfor a three-part fee increase. The third-stepincrease of this total fee hike is now beingimplemented in June 2010.

School Interlocal Agreement being revised - The Broward County School’sBoard Growth Management staff is in theprocess of revising its Interlocal Agreement(ILA) for school concurrency. The FloridaDepartment of Education rejected their new facilities request because the districthas excess capacity. However, the emptystudent stations are in eastern parts of thecounty, while the student needs continueunabated in the western part of the county.Thus, staff is proposing to revise its ILA, to calculate its level of service similar to the Miami-Dade model. The proposal is touse 110% capacity and include portable facilities in the LOS count, on a temporarybasis, until 2018-19. The School Board’spublic hearing on the proposed ILA change

was held in early February and the CountyCommission public hearing was held inearly March. Only after twenty-one of 28 cities also approve the ILA changes,will these changes become effective.

Broward League of Cities and CountyCommission adopt anti-Amendment 4 Resolutions – at variousmeetings over the past several months, theLeague of Cities, and most recently theBroward County Commission, have adoptedresolutions opposing Amendment 4. Theyare now realizing the crippling effect this“vote on everything” amendment will haveon their ability to plan for the future of theirresidents. BASF members are supportive ofthis effort and have been actively engagingthe cities and counties in this regard.

BASF Represented on the City of Hollywood’s Green Advisory Team – Jay Huebner, President of HSQ Consulting has been representing BASF on this important committee. This committee will be meeting monthly to discuss ideas on how the city can work toward becoming greener “friendly”. These meetings will occur at the HollywoodCity Hall on the fourth Thursday of eachmonth from 6PM-8PM.

BASF’s leadership met with the new Homestead Mayor, Steve Bateman, followinghis successful election campaign. BASF representatives discussed Mayor Bateman’sproposals to retain business in the City andrevise the current, expensive design reviewfees and onerous planning and zoning policies. Since his election, Mayor Batemanhas begun to make policy changes that are helping Homestead move toward economic stability.

It is refreshing to be able to report some good news, and a moreoptimistic outlook. I believe that most people reading this column will have a better year this year than they did last year. That alone iscause for celebration. Between 2006 and 2009, a lot of homebuildingcompanies (and allied businesses) failed or contracted to a fraction of what they had been. Now, those who are still standing are finding themselves with fewer competitors, and they are finding thatconsumers are responding to good value in good locations. Evenmore significant, builders have finally gotten their inventories backdown to normal levels, such that “when they sell a house, they haveto start a house.” Housing starts will pick up throughout this year, and that will help the general economy, and will provide a real boostfor those businesses that provide materials and services to the homebuilding companies.

As builders step up their lot purchases, not only here, but allaround the country, many of them insist on only “A” locations, or atleast “B.” In some markets, builders have told us that they grade any other lots “F,” giving no value to the middling “C” locations orbelow-average “D” locations.

The battle cry of “A, B, or F” may hold in some areas, for some period of time, but in the land-constrained markets, including Southeast and Southwest Florida, some “grade inflation”is inevitable. Locations that were previously written off with failing grades will start to be upgraded as the very best locationsget claimed.

A case in point is Avatar’s purchase of Seasons at Tradition in St. Lucie County. Certainly, St. Lucie presents near-term challenges in terms of absorption. Part of that can be overcomewith price. I remember hearing another battle cry when I firststarted out in the real estate economics business: “price is the ultimate amenity.” Of course, that was back when you could get a new condo in St. Lucie West for $95,000. Tesoro is another example of a deal that has changed hands, and it will be very interesting to watch to see if re-pricing it can re-energize it.

Even within the “core counties” of southeast Florida, Miami-Dade, Broward, and Palm Beach, there are locations that are considered remote in the immediate term that will become viable, and even vital sources of lots supply in the years ahead. In Palm Beach County, the Agricultural Reserve and the WesternCommunities will once again become active. In Miami-Dade,there is still some potential for moving the urban development line farther west, and at some point, Homestead itself will see another surge of demand. In Broward, the main opportunities will be infill from here on out.

Lately, builders have been out-bidding institutional investors for all but the very largest lot deals (such as the Starwood/Tousaportfolio). Builders have been willing to pay higher prices for lots

than in the past as a percentage of the home price (often 30%,compared with the old norm of20%-25%). Builders are pushing for volume as well as market share, and new-found efficiencies are allowing them to make moneyat lower price points. Value engineering and lower labor/materialscosts are helping a great deal in this regard.

We are expecting this trend of more lot-buying to continuethroughout this year, and well into next year. Metrostudy’s businesstends to be a leading indicator for the construction industry, and ourbusiness is picking up significantly. Our phone is ringing more, andprobably so is yours, or it will be soon.

The Therapeutics Program is based in the Edgar J. Hall Special Populations Center at Bucky Dent Park. It is home to the largest Special Olympicsdelegation in Miami-Dade County.

In desperate need of a makeover, Comcast Cares Day is expected to bring eco-balance of native plants, plot and begin a “Good Food Garden” and increaseaccessibility for community members by providing greatly needed ADA (American Disabilities Act) upgrades to the facility.

What should participating members expect? Upon arrival at 8:30 a.m.,

volunteers will be treated to a hot breakfast, followed by

an inspiring opening ceremony by local

officials and organizers. Teams will then be

transported to their assigned project site to complete an array

of services including landscape beautification, interior and

exterior painting activities, recreational area construction, furniture move-in and assembly

and general facility enhancement.Following service completion

On Friday, March 26, BASFmembers and friends didn’t let a little rain dampen theirspirits as they gathered for the annual golf outing on thechallenging par 72 Senator Golf Course at Shula’s Golf Club. The course, one of South Florida’s most popular and endearing, is knownfor its lush tropical landscape, treacherous bunkersand numerous water hazards. But on this day, golfersalso had to fight strong winds and scattered showersearly in their rounds.

While BASF’s big hitters admittedly had their full of sand and water during the round, the foursomesthoroughly enjoyed a Friday on the links in spite of an occasional shower.

“The rainy weather made the course a littletougher but the skies cleared after the first few holes and from then on we could not have asked for a better day of golf,” said Rob Duffy, tournamentchairman and president of Foundation InsuranceGroup LLC. “It was an enthusiastic group and everyone had a great time. We appreciate the support of our sponsors who made the tournament a hugesuccess. The golfers especially appreciated the barstations and carts as they ducked out of the rain.”

Without question the event’s biggest winner was His House Children’s Charity which received a donation of $1,500 from the golf tournament’s proceeds.

Taking the team title was the foursome from Paramount Drywall, Inc. which included Juan Marin, Eduardo Robelo, Michael Robelo and Mauricio Valencia. Finishing a close second wasthe team of Julian David Gonzalez of C.P.S. Security,

It was barely standing room only inside the BASF Conference Room on Wednesday, March 24 as Pedro J. Garcia, the county’s first elected Property Appraiser, was invited to speak to BASF members in this much anticipated forum. BASF thanks BASF board members Alex Castellanos and BB&T for sponsoring this informative event.

“What Are Your Properties Really Worth?” This most widely-asked question was appropriately the lead title of Garcia’s morning presentation.Joined by his two deputy property appraisers, Marcus Saiz del la Moraand Lazaro Solis, Garcia covered a variety of topics. Of note, Garciaindicated that Miami-Dade County’s property value dropped $31 billion dollars, or about 13.9 percent, during 2009. A pressing problem for theCounty has been the backlog of scheduled hearings to assess values in adjustment cases. In response, Garcia’s office is strategically hiring new staff to take on more hearings.

Yet, the most enlightening points came during the question and answer portion – when BASF members were able to have those issues most related to their individual businesses addressed. Key concerns presented included the process of raw land valuing, reasons for tax increases vs. appraised value decreases, foreclosures assessment in relation to adjacent properties and examples where price stabilization was actually occurring.

“This is just another example of the types of ‘smart’ events BASF is hosting,” said Truly Burton, government affairs director for BASF. “BASF keeps its members at the cutting edge of this spontaneous and ever-changing market!”

Attention all contractors! Beginning April 22,2010, contractors performing renovation, repair and painting projects that disturb lead-based paint in homes, child care facilities, and schools built before 1978 must be certified and must follow specific work practices to prevent lead contamination.

To serve the South Florida construction community, BASF offered a Lead Renovation,Repair & Painting Training at the BASF offices in early February.

This one day course, led by Dawn Jenkinsand Buster Heape of the University of Florida’sCenter for Training, Research and Education for Environmental Occupations (UF TREEO), was granted accreditation by the US-EPA Lead to engage in lead-based paint training for the Renovation, Repair and Painting Program pursuant to 40 CFR Part 745, Subpart L (73 FR 21691, April 22, 2008). This new EPA rule is aimed at protecting

children from lead-based paint hazards inplaces they frequent

The Rule is Effective April 22, 2010• Renovation firms must be certified.• Renovators must be trained and certified.• Renovators must educate owners/

occupants.• Non-certified workers must work under and be

trained on-the-job by a Certified Renovator.• Work practices must be followed for work

covered by the rule.

Following the career-oriented seminar, home improvement/renovation contractors,maintenance workers in multi-family housing,painters and other workshop attendees obtained EPA certification, met EPA and HUD requirements and developed a marketing advantage to distinguish their companies from the competition – one of the many perks of your BASF membership!

CURRENT AND PREVIOUS BASF LEADERSHIPENJOY SPECIAL RECEPTION

While the new generation of leadershiptakes on a challenging environment, it doesn’t hurt to have mentors, or better yet, friends to guide them along the way.

At a very special reception, the BASF Hall of Fame Board of Governors hosted the current Executive Committee, as well as former BASF presidents and vice-presidents for one simple goal – to get to know each other.

The home of Hall of Fame member Jon Fels served as a perfect setting for BASF leaders to get to know each other onan informal level. Guests exchanged ideas on strategies in moving the organization forward with an emphasis placed on attracting new members while also takingadvantage of the close and dedicated core group of existing board members.

The current leadership also discussed its vision and direction for the upcomingmonths. This unofficial brainstorming sessionallowed the Board of Governors to provide insight, serving current leadership in an advisory capacity.

“This one-on-one approach will only benefit the organization,” said DeborahReyes, chair of the BASF Housing Hall ofFame Board of Governors. “It was a successful event that enabled us to offersuggestions on how BASF has faced similarchallenges during the years and was able to overcome and become stronger.”

FHBA President Chuck Fowke arrivedfrom Tampa to bring the BASF leadership up to date on legislative priorities for bothNAHB and FHBA. With such key issues asAmendment 4 on the ballot, the eveningserved to re-enforce how very important thebuilding Industry is to the local economy.
