    10 County Court fo r a number of years , u n t i l 2000, when I11 became elevated - - j u s t f loa t r igh t up to the top - - to12 the Circui t Court bench by Governor Bush, worked a13 couple of years in cr iminal , and in 2008 I came to14 c iv i l j u s t in time fo r forec losures . Yeah.15 Complaints .     10 What other fac ts can you th ink of tha t would11 t r igger a defaul t?12 Well, i f it's not a PIP, nonpayment of taxes ,13 or not paying insurance or a couple other small facts14 tha t could t r igger a defaul t - - i f they weren ' t par t of15 the pr inc ipa l , in te res t , taxes and insurance, a PITI16 payment.17 Accelerat ion.18 Some - - most notes have a clause in it for an19 accelera t ion . This should be al leged in the complaint .20 I 've seen maybe 10 percent of the notes tha t21 corne across my desk don ' t have an accelerct t ion clause .22 And i f yours doesn ' t have an accelera t ion23 clause, then tha t would be one of the few ones in which24 you would not need to al lege the acce le ra t ion .25 What else?

    ver i f i ca t ion of the factoids in the complaint .This i s appl icable to a l l complaints tha t are

    f i l ed a f te r February 11th of 2010. It's - - th i s i ssupported by Rule 1.10(b) , and it's also referenced inFlor ida Rule of Civi l Procedure 2010.

    One of the primary purposes of th i s amendmentwas to ensure tha t p la in t i f f s and counsels do the i r duedil igence and appropria te ly inves t iga te and ver i fyownership of the note before the complaint i s f i l ed .

    I t was also to conserve jud ic ia l resourcestha t were being wasted on inappropria te ly p led of lossnote counts and inconsis ten t a l lega t ions , as well as toprevent the wasting of jud ic ia l resources and harm todefendants resul t ing from su i t s brought by p l a i n t i f f snot ent i t l ed to enforce a note .

    I imagine I 'm not the only judge in t h i s roomwho has had the d i s t inc t disp leasure of having twolawsuits regarding one piece of proper ty .

"5 Well, the attachment of the assignment i s not6 required s ince the cause of act ion i s based on the7 mortgage i t s e l f , not the assignment.8 And what case should we see fo r tha t9 proposit ion?

    10 WM Special ty . Of course.11 But from a judge 's perspect ive , p la in t i f f12 counsel al leges and at taches the assignment in the13 f i r s t place, and then there are no motions to dismiss14 for fa i lu re to at tach the assignment.15 I 'm thinking t ha t ' s a win-win, from my po in t16 of view. I don ' t know about you.17 So from - - i f you have the assignment, it18 would be real ly swel l i f you at tach i t . I t el iminates19 the motions to dismiss tha t are f i led and usual ly held20 about seven and a ha l f months l a t e r on the f i r s t21 ea r l i e s t docket we can get you in .22 So tha t builds a blend In the case.23 Not to mention a l l the b i l l ab le hours for24 discovery disputes over, "Judge, we f i led a reques t fo r25 product ion of the assignment, and they d idn ' t mail it

I f you j u s t have the6 assignment, I 'm saying it would be nice i f you f i l ed7 i t .8 On the other hand, i f you look a t Ahem, they9 indica te tha t some of the things tha t absolu te ly ,

    10 posi t ively have to be at tached to the complaint are thei l note and the mortgage.12 We can look a t Flor ida Rule of Civi l13 Procedure 1.130(a) , and Ivan versus the FDIC out of the14 Second Dis t r ic t to support tha t proposi t ion of law.15 Defendants.16 What was I was thinking here?17 Oh. A complaint should as se r t tha t the18 defendant i s a proper par ty to the case, and the19 complaint should also asse r t and ra i se the in te re s t of20 jun ior l ienholders whose l i en accrued subsequent to the21 mortgage.     10 I see f i l ed where the bank has sued the wrong - - where11 the wrong person or ent i ty i s suing.12 For example, Bank A f i l e s a lawsui t when they13 rea l i ze they had t ransferred tha t par t i cu la r mortgage14 out of t he i r por t fo l io long before the f i l ing of the1516
