LOOP HOLES IN THE EXISTING LEGAL SYSTEM
JUSTICE DELAYED IS JUSTICE DENIED
Getting involved in judicial systems i.e. Fighting any case for justice is very time consuming.
System is not efficient.
CONSEQUENCES-
1. Because of system being time consuming, expenditure also increases.
2. Citizens don’t trust judiciary, that’s why they try to solve issues at their level which increases problems.
IT’S ALL ABOUT POWER
The power arising out of status, contacts or wealth is above all. The omnipotent people has
strong impact on decision of the court.
CONSEQUENCES-
1. Judgement is not accurate.
2. It gives way for corruption to generate.
3. Poor and middle class people hesitates to go to court for justice and are left hopeless.
NO WITNESS PROTECTION
Witness of cases like rape, murder, violence etc. are not given any witness protection. They are threatened
and pressurized to switch their statement.
CONSEQUENCES-
1. It effects the decision making procedure of court.
2. The witnesses are forced to change their statement because speaking truth can even cost their lives.
OLD IS NOT ALWAYS GOLD
CONSEQUENCES-
1. Lower level decision making bodies like khap panchayats are still working on religious and orthodox sentiments not on laws mentioned.
2. The laws take too much time to meet the present generation’s needs.
Laws are made in order to suit society and situation, but our law system is not amended
periodically in order to keep it upgraded. And it takes too much time to amend a law.
SOLUTIONS FOR MAKING JUDICIAL SYSTEM EFFECIENT
AND PRODUCTIVE
TIME LIMIT
There is no legal time limit for a particular case to be solved. On an average it takes 15
years to solve any case. Amendments should be introduced to divide cases in different
categories with a prescribed period of time in which they should be solved.
FAST-TRACK COURTS There are 1734 fast track courts in India currently
which have solved 32.34 lakh cases. Although, 6.56 lakh cases are pending in courts, which shows that
more fast track courts is the need of hour. The budget for the fast track court should be increased.
More recruitments for law authorities should be made corresponding to rate of increase in
population.
AMMENDMENTS AT RIGHT TIME
Laws should be regularly amended to keep them upgraded. The procedure for amending law should
be changed. Citizens should also be asked about their favour, what actually they want. People who amend laws should be those who are intellectual and who has studied law rather than those who are sitting in the Lok Sabha. A committee of such
persons should be made to keep watch on the legal system.
AN EYE FOR AN EYE
Laws in our country should be made so strict that people fear to commit any crime. And apart from making law a body should be made to govern the
implementation of laws made. For example, In Delhi gang rape case, a rapist who was found guilty
for rape and murder both was given to juvenile court and was sentenced to 3 years imprisonment
even for such a grave crime.
TRUE INDEPENDENCE
India can never be truly independent if citizens can’t live freely. People are afraid to claim for their own rights. Witness protection should be given to witnesses of cases like murder, rape etc. So that people will not be afraid to speak truth. People should be made aware about basic laws from
initial stages of their lives. VIPs should not interfere in making and implementation of laws. VIPs should
not be given priority in making decision.
