2017 ALC Supply Chain Safety & Compliance Summit

Welcome to the 2017 ALC Supply Chain Safety & Compliance Summit.

The Summit is integral to ALC’s commitment to raising awareness about Chain of Responsibility (CoR), which impacts on all parts of the supply chain, as well as advising industry participants on practical steps they can take to ensure high levels of safety and compliance.

This year’s Summit will focus on the significant extension to CoR, due to commence operation in 2018, which extends the legal obligations and liabilities of executive officers and company directors, and will include heavy vehicle standards and maintenance.

The Summit will also consider how supply chain safety will be covered under the National Freight and Supply Chain Strategy, announced by the Prime Minister in his Annual Infrastructure Statement last year. A draft report on the Inquiry into National Freight and Supply Chain Priorities will be released for industry comment in December 2017, with the Final Report due in the early months of 2018.

Day two of the Summit will see your opportunity to have a say on the future of supply chain and heavy vehicle safety through consultation on an industry-wide Master Code for supply chain and heavy vehicle safety, which is being jointly developed by ALC and the Australian Trucking Association.

The proposed Master Code will establish a common set of agreed safety practices for the broader transport industry, including for ancillary operators and off road parties.

Despite some encouraging trends, offi cial government fi gures show that there needs to be a greater effort by everyone in the supply chain to improve safety and compliance.

The Australian Work Health and Safety Strategy 2012-20221 identifi ed supply chains and networks as one of seven Action Areas.

Data indicates that notifi able worker deaths in the transport, postal and warehousing industry were higher between January - October 2016 than January - December 2015.

HEAVY VEHICLE SAFETY IS IMPROVING

Statistics from the Bureau of Infrastructure, Transport and Regional Economics (BITRE) also show safety in the heavy vehicle industry is generally improving. BITRE’s latest report (Fatal Heavy Vehicle Crashes - Quarterly Bulletins - June Quarter) shows fatal crashes involving articulated trucks increased by 7.3 per cent compared with the corresponding period one year earlier, but decreased by an average of 1.0 per cent per year over the three years to June 20173.

It needs to be noted that while heavy vehicles are over represented in crashes, studies have found that in fatal crashes involving other vehicles, the other driver was at fault in 84% of the accidents4.

The workshops on day two of the Summit will be held in four adjacent rooms (E3.1, E3.2, E3.3, E3.4) on Level 3 of ICC Sydney. The workshops will be held in the corresponding room number. For example, Workshop A:1 will be held in E3.1, and Workshop D:4 will be held in E3.4. There will be signage outside each room to help delegates find their way.

TRAVELICC Sydney is easily accessible by public transport, including light rail, ferry and train and is only a 10 minute walk from Central and Town Hall train stations. Secure car parking is available and conveniently located within the Darling Harbour precinct.

11.00 Minister’s addressMinister Pavey will address delegates on the NSW Government’s approach to improving road safety and how the Government is working with industry to improve freight productivity across the supply chain.

Freight is worth nearly $60 billion a year to the NSW and national economies, and employs almost half a million people, directly or indirectly. The scale of the transport task is already formidable and by 2031, freight volumes in NSW are forecast to almost double to 794 million tonnes. Therefore, a safe and effi cient supply chain is critical to the state’s continued economic growth.

National Logistics Safety Code of Practice

Chain of Responsibility (CoR) means all parties in a supply chain are required to implement positive actions to prevent breaches of the law relating to speeding, fatigue, mass limits and load securing. The aim of CoR is to make sure everyone in the supply chain takes their fair share of responsibility for ensuring breaches of the road transport laws do not occur.

If you consign, pack, load or receive goods as part of your business, you could be held legally liable for breaches of road transport laws. At stake are civil and criminal liabilities, as well as reputational damage. Companies cannot ‘contract out’ their CoR obligations, no matter what their industry sector or part of the supply chain.

CoR is embedded in the Heavy Vehicle National Law (HVNL), a uniform heavy vehicle code which applies in all states (with the exception of Western Australia and the Northern Territory).

It describes a series of obligations relating to heavy vehicle road transport and the people who are responsible for ensuring those obligations are met, and who will be liable for breaches.

WHAT IS THE NLSC?

The ALC National Logistics Safety Code of Practice (NLSC) provides industry with a simple, equitable and effective way to maintain and improve safety and compliance across the entire supply chain. The Code sets out participants’ responsibilities when they control or infl uence the movement of freight, and applies to a range of Chain of Responsibility obligations such as fatigue, safe loads, speed management and equipment.

HOW DOES THE NLSC APPLY TO COR?

NLSC assists participants to manage their obligations under CoR laws across the entire supply chain. Compliance with the NLSC may assist participants to meet their CoR obligations and could be evidence that ‘all reasonable steps’ were taken to prevent a contravention of CoR laws.

CHAIN OF RESPONSIBILITY IN THE FUTURE

Amendments to the HVNL have been approved that will impose:• a primary duty of care on operators, prime contractors

and employers to ensure, so far as is reasonably practicable, the safety of ‘road transport operations’; and

• a ‘positive due diligence’ obligation similar to that imposed by WHS law on executive offi cers such as directors.

These changes should commence operation in 2018. ALC will be working with members to ensure that guidance is in place to assist industry participants in satisfying these new obligations once they commence operation.

UPDATE ON CURRENT STATUS

In early 2017, NHVR released the Guidelines for Registered Industry Codes of Practice. The new process takes a more risk-based approach to compliance and safety management and will comply with the amendments to HVNL due in 2018.

The existing NLSC codes registration will continue for a further 12 months during which time they will be updated to the new standards.

This will assist parties in the chain of responsibility to identify, analyse, evaluate, and treat risks associated with meeting HVNL obligations. The Codes will require adopters to use ISO 31000 Risk Management Process methodology.
