FINANCE BROKERS CONTROL ACT 1975 .

(Section 44 (1) and (2) .)

C.S.D. 13/81 .THE Finance Brokers Supervisory Board has fixed thefollowing schedule to be the maximum amounts ofremuneration for services rendered by persons carryingon the business of a Finance Broker . The schedule shallapply in the case of contracts made on or after 22 May1981 and replaces the schedule published in the Govern-ment Gazette on 11 August 1978 .

1 . Application Fee :$50 non-refundable fee for all loans . The Applica-

tion Fee is a payment against Broker's own inspec-tion fee and eventual Brokerage charge .

If an independent qualified valuation is requiredthis is chargeable separately at cost.

In the event of a loan not being arranged noBrokerage fees are chargeable. However, inspectionfees under section 2, plus miscellaneous charges

(i) For progress advances for residentialproperties within 30 kilometres radius$30 per inspection with a maximum of$120 per property .

(ii) For progress advances for residentialproperties beyond 30 kilometres radiusand commercial properties in thecourse of erection by negotiation withthe client .

(a) Local Money Loans :On the first $20 000-$130 plus 1 per cent .On the next $10 000-1 per cent .On the next $20 000-2 per cent .On the next $50 000-21- per cent .Over $100 000-as is mutually agreed

between the parties in writing .(b) Bridging Loans :

On loans of 6 months or less $100 plus 1 percent.

Over 6 months-normal rates .(c) Interstate and Overseas Loans :

Rates subject to prior written agreementbetween broker and client . If interimBridging Finance also arranged addi-tional brokerage of 1 per cent to becharged. Subject to loans in excess of$100 000 being by negotiation betweenparties .

(d) Conditions of Brokerage Charges :(1) Brokerage should NOT be charged by

a selling agent where a Contract of saleor Mortgage to Vendor is arranged . TheAgent Broker may, however, charge ona time basis for consultations and workdone (see miscellaneous charges) .

(2) Where the selling agent is also thebroker a separate written Loan Applica-tion is also required before brokeragecan be charged .

(3) Where a broker arranges a loan from aBank, Insurance Company or otherFinancial Institution except BuildingSocieties and where the applicant wouldnot otherwise have been able to obtainthat loan from that source, brokerageat two thirds normal rates may becharged. This applies whether the brokeris also the selling agent or not, and issubject to clause 3 (d) (2) hereof .

(4) No brokerage or other fees are applic-able to Building Society loans .

4 . Transfer of Mortgage between Investor Clients :Standard scale of fees plus out of pockets, payable

by the Transferor .5 . Extension of Mortgages :

Two-fifths standard brokerage inclusive of anyreinspection, but revaluations, solicitors costs, stampduty, and registration should be in addition.

6 . Finalisation Fee (discharges)Flat fee of $35 to include all services required

of a broker, in addition to legal costs, out ofpockets, and settlement fees .

7 . Commission on Interest Collections :(a) Interest Collections only-6% of interest col-

lections inclusive of portages, cheque duty andbank charges .

(b) Total Mortgage Management-including in-terest collection and supervision of mortgagors'compliance with all mortgage clauses-8% of interest collections, inclusive of

postages, cheque duty and bank chargesexcept where the broker is acting asan agent for an insurance company inwhich case a fee of 6% applies .

Miscellaneous Charges :(a) Production of Title-$20 .(b) Titles Office Searches $5 plus Titles Office fees .(c) Additional Interest Statements as provided in

the Finance Brokers Code of Conduct $4 foreach statement issued .

(d) Bank Cheques-$3 including costs .(e) Where no brokerage fees are payable consul-

tations, advice, investigations and negotiationson finance-standard charge of $35 per hourbased on the actual time spent.

(f) Disbursements directly and reasonably in-curred by the broker in the negotiations re-lating to a loan or a proposed loan andwithout limiting the generality of the fore-going would include-search fees, productionfees, telephone trunk calls, telex, telegrams,accommodation expenses, postages and courierservice .

The Broker shall at the request of the clientproduce to the client such evidence of dis-bursement that the client should reasonablyrequire.

(g) Where a broker is appointed as an Agent forthe mortgagee under the terms of mortgagecharge to be negotiated with the mortgageebut not to exceed $35 per hour .

THE Cottesloe Town Council under and by virtue ofthe powers conferred upon it in that behalf by theTown Planning and Development Act 1928 (as amended)and the Metropolitan Region Town Planning SchemeAct 1959 (as amended), hereby amends the aboveTown Planning Scheme by :

COUNTRY AREAS WATER SUPPLY ACT. 1947

COUNTRY AREAS WATER SUPPLY (CLEARING LICENCE)REGULATIONS 1981 .

MADE by His Excellency the Governor in Executive Council .

1 . These regulations may be cited as the Country Areas Water Supply (ClearingLicence) Regulations 1981 .

2 . The Country Areas Water Supply (Clearing Licence) Regulations 1976` arerepealed .

3 . These regulations apply to and in relation to the land referred to in subsection(1) of section 12A .

4 . In these regulations unless the contrary intention appears-"Form" means a form in the Schedule ;"licence" means a clearing licence issued under section 12C ;"section" means a section of the Act ;"the Act" means the Country Areas Water Supply Act 1947 .

5 . An application for a licence shall be in the form of Form 1 .

6 . A licence shall be in the form of Form 2 .

7 . An application for the transfer of a licence shall be in the form of Form 3 .

8 . A claim for compensation under section 12E shall be in the form of Form 4 .

9 . A memorial relating to unlawful clearing delivered pursuant to section 12BA (1)and (2) shall be in the form of Form 5 .

10 . A memorial relating to a restoration order delivered pursuant to section 12BB(1) shall be in the form of Form 6 .

11 . A memorial relating to compensation paid for injurious affection deliveredpursuant to section 12EA (1) shall be in the form of Form 7 .

12 . An appeal to the Minister pursuant to section 12D-(a) shall be addressed to the Minister and lodged with the Public Works Depart-

ment, 2 Havelock Street, West Perth within 30 days after the date of thedecision of the Under Secretary or within 30 days after the date on whichthe application is deemed to have been refused ;

(b) shall be in writing signed by the appellant ; and(c) shall set out the grounds of the appeal and such other particulars as are

necessary in support of the appeal .

13 . In accordance with section 12C (1) (d), a clearing licence is not required-

(a) where the land in question has an area of less than 0 .2 hectare ;

(b) for the removal of suckers or regrowth less than 3 years old where theland in question was cleared of indigenous trees and vegetation as verifiedby Lands Department photography-

(i) in the case of the Wellington Dam Catchment Area, by the date of theproclamation of the Country Areas Water Supply Act AmendmentAct 1976 (i .e . 15 November 1976) ; or

(ii) in the case of the Mundaring Weir Catchment Area, Denmark RiverCatchment Area, Kent River Water Reserve and Warren River WaterReserve by the date of the proclamation of the Country Areas WaterSupply Act Amendment Act 1978 (i .e. 15 December 1978),

or has subsequently been cleared as a result of a licence being issued ;

(c) for the removal of individual trees suitable for cutting for fencing and farm,materials if used for maintaining existing improvements on the holding,where-

(i) those trees are cut from bush areas in random manner with not morethan two trees removed per hectare ; and

(ii) no action is taken that would be deleterious to the regrowth of stumps ;

(d) for the removal of regrowth and suckers not more than 10 metres beyondeither side of existing fencelines ;

(e) for the removal or destruction of poison plants included in the toxic speciesof the genera Gastrolobium and Oxylobium .
