RECOMMENDATION: That the Council decline the request from Laramba Community Store to be exempted from paying rates

SUMMARY: Laramba Community Store, a commercial enterprise owned by a benevolent organisation, has been advised that they are not entitled to a rates exemption as per the Local Government Act. They have asked that the decision be reviewed by Council.

BACKGROUND Council has received an email letter from Gwen Gouveia, representing the Laramba Community Store Aboriginal Corporation, asking for Council to review the decision that the Store was not entitled to an exemption from paying rates. Laramba Community Store Aboriginal Corporation are a benevolent organisation, but operate the store as commercial enterprise. When operating a property as a commercial enterprise, a benevolent institution is required to pay rates on that property. Clause 144 Exempt Land (3) of the Local Government Act states that in deciding whether land is used for a commercial or non-commercial purpose, the fact that the user is a public benevolent institution or a public charity is irrelevant: the question is to be decided according to the nature of the use and not the nature of the user. Another benevolent organisation operating a commercial enterprise similarly sought an exemption at the June 2016 Ordinary Meeting, but this was rejected by Council.

ISSUES, CONSEQUENCES AND OPTIONS Providing exemption for payment of rates impacts on the receivable rates income throughout the year.

Approval of this exemption would be a precedent that, under obligations of equity, would require Council to exempt all commercial enterprises owned by benevolent organisations from the payment of rates. RECOMMENDATION: That Council receive and note the report from the Director of Community Services.

SUMMARY: The Director Community Services reports to Council about matters of significance since the last Council meeting. BACKGROUND General Considerable focus has been on the finalisation of the Family Wellbeing Strategy, due for official public launch on Friday 14 October. This strategy will be a foundation document to guide our effort over the coming years. For a seven week period from early August, the Director of Community Services was on leave and the directorate was ably led by the Manager of Children’s Services for 5 weeks and Manager of CDP for 2 weeks as Acting Directors. Managers of Community Services have been undertaking the accelerated management program – The Applied Management Colloquium’. An outcome of this process has been an undertaking to lead a. Indigenous Workforce Strategy Best Practice project. This will likely have strong links to the CDP best practice project. Youth and Communities Family Wellbeing Strategy Amity Community Services has agreed to conduct gambling awareness campaigns across the Region, commencing in Willowra. Expansion to other communities will be premised on invitations form other communities. The Gambling Awareness Campaign is a key action of the Family Wellbeing Strategy.

The Willowra Gambling Awareness Campaign has the potential to develop into a three year gambling awareness research project, in conjunction with Australian National University, subject to community agreement, participation and ethics approval. Training Another key plank of the Family Wellbeing Strategy is support for communities to make informed decisions about alcohol management. Alcohol awareness training has been secured for Laramba with the potential to secure further training in other communities where a need has been identified. The Training and Development Coordinator has developed a training plan which will align itself with recognised needs and priorities across Youth and Communities as well as the goals and actions identified in the Family Well Being Strategy. Mental Health First Aid (MHFA) training has now been rolled out for most communities. Staff Movements The positions of Area Coordinator East and Area Coordinator for Yuendumu and Willowra have been filled. Community Coordinators in Ti Tree, Engawala, Atitjere have also been appointed. Children’s Services School Nutrition Program Negotiations are still ongoing regarding the breakfast program in Engawala. The program will run from the community centre. Consideration is being given to delivering healthy food and lifestyle events in some of the six SNP locations. Parental contributions have dropped over the past 12 months and Children Services Management team is working with Centrelink on the ground to increase community awareness of the importance of these contributions for running the program. Playgroups The Anmatjere playgroups in Wilora, Station, 6 Mile and Ti-Tree have recommenced, following the recruitment of the new Facilitator. All of the four shade structures have been erected by CDP. Children’s Services Program is currently organising family fun events to encourage further engagement. These events will be run with the support of remote health

and other Council programs e.g. CDP participants and Community Safety Patrol teams. A range of resources have been purchased for the Playgroup Program and a motor vehicle for the Yuendumu Playgroup is on order. Childcare Centres Yuendumu and Laramba Childcare services have updated and submitted their Quality Improvement Plans (QIPS) as of August 2016. Yuendumu childcare had their assessment visit and we have received the full report. The team is going through the recommendations and suggested improvements to implement across all childcare centres where possible. The Children Services Policy and Procedure handbook, Induction handbook and Parent handbook are currently still being review by Local reference groups, Local Authorities and the full council. We have received a lot of feedback and will modify the documents to meet the needs of the communities. Community Development Program (formerly RJCP) The program has maintained a steady 65.5% participation rate for July and August which remains slightly below the PMC desired target of 75% but still above the Council budget target of 60%. Although the participation rate is satisfactory, the actual involvement level of job seekers in activities needs to improve. Our records show that the actual attendance rate for job seekers was 26.8 per cent – this means that only around a quarter of the caseload is regularly turning up to their assigned activities For further details please refer to the CDP Progress Report. Aged & Disability Care Services Enmark have been engaged to assist with a Service Delivery Unit Costing Project for aged care services. Its anticipated that costings for each type of service delivered by the Aged Care Program, i.e., meals, personal care, transport, will be finalised and in use by November. Training in relation to client information management system for all coordinators continues. Four Aged Care Coordinators are also completing a Cert IV in Ageing Support. Negotiations continue with Department of Health regarding the possible commencement of aged care services in Atitjere.

Program Report by Community Yuendumu

Youth and Communities

Mediation & Justice (M&J) The mediation program continues to operate well in Yuendumu. The Southern Tanami Kurdiji Aboriginal Corporation has engaged the Aboriginal Governance and Management Program of APONT to provide governance support, advice, coaching and mentoring as they move toward independence. Terms of Reference have been drawn up for the engagement of a business consultant.

CSP A new Area Coordinator has started. There has been some turn-over of patrol staff but recruitment is occurring. The CSP team are working to use mediators as CSP team members when there are not enough patrollers available.

Children’s Services Childcare Yuendumu Childcare is operating five days a week with an average of 12 kids a day although this average daily utilisation is increasing. Enrolments have slowed due to the cooler weather. Currently discussing an MOU with CFC stakeholders around supporting families using the CFC. Playgroup A sixth round of recruitment has begun for the Playgroup Facilitator position. Family Fun events are being planned for the 4 locations in August. Locations have been chosen and Council office is working with Department of Lands and Planning around the sites for the parks. Children Services Management are currently scoping for alternative locations for the playgroup while the parks are still

getting authorised.

Community Development Program

Number employed since last meeting - 9 With the income from the recycling program, the participants have begun their vegetable patch which has since grown some tomatoes and pumpkin. The ladies have also created hanging pots from recycled bottles to plant flowers in. Certificate II in Construction is ongoing. Certificate II in Business has been completed and participants are awaiting final results. The community held its Sports Carnival weekend - CDP participants cleaned up the football oval, softball diamond and basketball courts. The ladies got very innovative and made signs on car bonnets. The CSM has approached CDP to continue to make more for the community. Ongoing licence testing for participants wishing to obtain a licence. Participants will be beautifying the recyclable container and will be painting it in the very near future. CDP has begun a car washing activity for council and CDP vehicles. The ladies and men have been going through the CDRC basic maintenance check of a vehicle before use. Participants are still engaged with Host stakeholders such as the Women’s Centre, School, RSAS and Warlukurlangu Art Centre.

Lajamanu

Youth and Communities

CSP There has been a shortage of patrol staff recently in Lajamanu. The Community Coordinator took sudden bereavement leave resulting in the CSP team operating with less support and supervision.

The Area Coordinator has been visiting regularly to provide support and direction.

Library The vacant Library Officer position has been filled. The Library has received two new computers and shelving.

Aged & Disability Care Services

The Aged Care Coordinator has submitted her resignation effective as of 21 October. This position has been advertised along with a supervisors position and both closed on 30 September. Environmental health has completed a site visit and Lajamanu has successfully passed all environmental health requirements.

Yuelamu

Youth and Communities

YS&R The new Youth Communities Coordinator has been working well and there continues to be very good attendance and a good range of activities available on most afternoons.

CSP CSP is now operating well with new staff in place and support from the Area Coordinator. The team provided great community support during a period of heightened alcohol use in the community and received praise from the Yuendumu police.

Morning tea, lunch and afternoon tea is prepared from the Aged Care centre. Breakfast is prepared at the school kitchen

Community Development Program

attendance activity. Participants continue every Friday to assist with unloading the stores truck and delivering the supplies. Work has been done on the Council Boardroom where cladding was placed on the outside of the building. Other activities are the continual maintaining of grounds at the school and child care. The ladies painted a mural for the recreation centre. They have been collecting materials for bush craft as well as community clean-up. Health and nutrition continues daily and continual assisting of participants getting signed on to MyGov and their DHS accounts. Participants will begin painting the Aged Care facility.

Aged & Disability Care Services

Aged care building will be painted by CDP – materials have been ordered Aged Care Coordinator has been on leave for two weeks.

Nyirripi

Youth and Communities

CSP Nyirripi continues to provide a challenge for recruiting replacement team members. The Area Coordinator West has visited on many occasions and Y&C has worked closely with the CSM and the CDP provider to find new patrollers. Two new female patrollers have now been recruited.

Children’s Services SNP Nyirripi School Nutrition Program operational 5 days a week with up to 20 kids attending school during this period. Nyirripi provides Morning Tea, Lunch and

Afternoon Tea daily to students attending school. Breakfast is provided at the school for students as required.

Environmental Health has visited the service and we have passed all Environmental Health requirements.

Ti Tree

Youth and Communities

YS&R Ti Tree competed in the softball championships and were very competitive playing games in Ti Tree and Laramba. There were hockey and touch football workshops held. The Area Coordinator East, who resides in Ti Tree, and the Community Coordinator, both moved on during this period. This left Ti Tree with less support and supervision than normally required. Youth and Communities addressed this by sending staff including the Area Coordinator West and the Training and Development Officer to Ti Tree on several occasions to provide assistance to the CSRO’s and CSP teams. These positions now have replacements appointed.

CSP Once again, there has been some staff turnover during this period. This has now been addressed.

Library The Library Coordinator position has been filled. The library has received a new computer and more equipment.

Children’s Services Playgroup Playgroup positions have been readvertised. The Anmatjere playgroup started back up on 5th September with great enthusiasm. The communities are very happy to see the doors back open and utilising the shade structures.

New toys have been purchased for the set up of the 4 new playgroups Family Fun events are being planned for the four locations in late July.

SNP - Wilora Wilora School Nutrition Program is operational from the women’s centre 5 days a week with up to 13 kids attending school during this period. Wilora provides breakfast, morning tea, lunch and afternoon tea daily from the Aged Care Centre, also known as the Stirling Café to the local school children attending school. Food is ordered fortnightly with the assistance from Ti-Tree Aged Care and delivered to Wilora on a fortnightly basis.

Community Development Program

Participants have erected the playgroup/child care shade structures in Pmara Jutunta, Nturiya Station and Ti Tree town.

Engagement in Wilora is steady, and the tiling of the Women’s Centre bathroom has now been completed. General ground maintenance of the School, Aged Care, Church, Elderly of the community and sorting of the Waste Dump.

The school has engaged with CDP to start a veggie patch behind the school. Once the ground is prepped and ready to plant the school children will become involved.

One of our participants is teaching the men how to service and maintain the lawn mowers, whipper snippers and other small motor machines.

Ti Tree has had Certificate 1 in Visual Arts

commence in the town activity centre, which gathered good engagement and has given the ladies more scope to their art work.

Pmara Jutunta do a once a month cemetery clean up and are also making cemetery markers. Bush trips are ongoing to collect wood for clap-sticks and seeds for jewellery. Sewing is ongoing and is being enjoyed by the participants.

Nturiya Station does continual community clean ups and the maintaining the public laundry ensuring it is tidy for community members to use. Seedlings have gone into the garden and the gourds are growing.

In Ti Tree town the men have assisted in trenching and fixing a pipe. The vegetable patch is continually being tidied and prepped for planting.

Aged & Disability Care Services

Services at Ti Tree continue to operate smoothly. CHUBB have been to Ti Tree and plans are being developed for the installation of a fire sprinkler system.

Atitjere

Youth and Communities

YS&R Atitjere competed in the regional softball competition for the first time. There were hockey and touch football workshops held. A new Community Coordinator is still required. Interim arrangements are being put in place to backfill the vacancy until a permanent recruitment solution is found.

CSP Immediately prior to the Harts Range Picnic Race, the CSP team attended an unfortunate fatal motor

vehicle accident in Atitjere where they responded well and provided support to one survivor. The team is receiving ongoing support from Y&C Management.

Laramba

Youth and Communities

YSR For the second year in a row, Laramba won the inter-community softball competition on their new softball field. Touch Rugby training was successfully conducted. The program continues to have excellent attendance rates.

CSP The CSP tram in Laramba continues to work well CSP continues to support the morning school attendance program.

Children’s Services Childcare Laramba Childcare is operating 5 day a week with an average of 12 Children a day. Staff meeting and tool box talks held. Staff attended training session at BIITE in Alice Springs. New Programing App implemented and all IT equipment has been upgraded including internet and printer.

SNP Laramba School Nutrition Program is operational 5 days a week with up to 52 kids attending school during this period. Laramba provides breakfast, morning tea, lunch and afternoon tea daily to student attending school from the school kitchen

Community Development Program

Number employed since last meeting - 0 Centre for Appropriate Technology commenced and completed White Card training, which saw 11 participants gain competency in this unit. Job Seekers have decided to make cement Head Stones. Participants then paint the headstones for the cemetery. Ongoing progress is being made in erecting a shed at the child Care. The shade structure over the Activity Centre has been completed. Vegetables and fruit (Tomatoes, Rockmelon and Watermelon) are being planted in the designated patch behind the Council Depot Continual whipper-snipping, mowing and rubbish collection is being undertaken around the Community. The female CDP participants are continuing with their artwork

Mediation and Justice The newly appointed Mediators have received induction and training in mediation, community justice and mental health first aid.

Children’s Services SNP Willowra School Nutrition Program is operational 5 days a week with up to 30 kids attending school during this period. Willowra provides breakfast, morning tea, lunch and afternoon tea daily from the school kitchen to student attending school. Food is ordered and purchased fortnightly from the local store. Cost of food is currently being discussed with outback stores. We have been given a 10% discount on all orders.

Community Development Program

Number employed since last meeting - 3 The male participants have been engaged in the Course of Certificate II in Construction Pathways. Although this course had very poor attendance to begin with, with the engagement of a new trainer we have seen a rise in participation. This training has also been able to tie into the building of the CDP flat pack accommodation. Thus far the wall structure has been erected, installed perimeter walls on the internal as well as the wall insulation. Men were busy constructing fire pits, collecting wood for the elderly and assisting people to move out of their houses due to the housing upgrades. A trailer load of recyclable tyre rims and batteries were collected from the tip and exchanged at Alice Springs. Beverage containers continue to be recycled. At the end of the financial year, $1000 was exchanged for approximately

80,000 beverage containers which would otherwise be found littering the streets or end up in landfill. A kitchen garden was initiated through the planting of the first crop, cauliflower, at the school garden. Health and Nutrition continues to be a daily activity. Development of the kitchen garden at the school continued with weeding and germination of seeds. More equipment ordered for Spring expansion. Mid year school holidays in the NT. Many of our participants were looking after their school aged children at this time so CDP issued participants with LLN holidays packs. Including photocopies of word searches, crosswords, multiplication tasks and recipes, the packs could keep parents busy with their children at home. Participation picked up again during August where some men and women returned to volunteering at the school and playgroup.

CDP assisted with Bachelor Learning Centre in identifying participants who could enrol in an 'education' activity, which would be executed by Centrelink. CDP assisted with the WYDAC /NT Health "hygiene party" by catering for over 80 people. Healthy beef and vegetable patties were made as well as healthy salads. CDP also assisted with catering for the Youth Mental Health First Aid course which was presented by the Community Safety Patrol.

Aged & Disability Care Services

The building of the aged care facility is currently on hold due to the withdrawal of the building contractor from the procurement process. Care Services continue to be delivered as normal..

Communities Engawala competed in the softball championships losing to Ti Tree.

There has been hockey and touch rugby training conducted.

Unfortunately, the Community Coordinator appointed at the time of previously reporting, eventually declined the position. A new Community Coordinator has been appointed and commenced on 26 September 2016.

CSP CSP in Engawala continues to operate well.

Children’s Services SNP Breakfast will be provided in the Women's Centre once building upgrades have been completed Program operational 5 days a week with up to 20 kids attending school during this period. Playgroup opened on 1 August 2016. It begun with the open day of the building celebrating the start of the playgroup, the new mural on the building and the operations of Aged Care and School Nutrition all working together. Discussion with local Educators and families about the removal of outdoor play equipment and the purchase of more toys are underway.

Aged & Disability Care Services

Clients at aged care are increasing and a position for an aged care support worker has been advertised and interviews will be held later this week.

1. The current situation regarding S19 leases for aged care service delivery in Atitjere.

2. That lot 118 Atitjere is the most practical site and expedient and preferred choice for the Councils proposed aged care service.

ALTERNATIVE RECOMMENDATION That the Council:

1. Support the current application for a lease over lot 84 as the preferred site for the Council’s proposed aged care service.

2. Note this will result in a significant delay in the delivery of a full suite of aged care services in Atitjere.

SUMMARY: Council is in negotiations with the Department of Health to deliver aged care services in Atitjere. Council needs a Section 19 lease on an appropriate block from which we can deliver the services. The Atitjere Land Aboriginal Corporation has requested that Council submit an application for lot 118.

BACKGROUNDCurrent Aged Care Service Provider In Atitjere aged care services are currently being delivered by Marle Ingkherekenhe Arndaritjika Aboriginal Corporation (Marle). Marle no longer wish to operate the aged care services. Marle also operate the School Nutrition Program and a community takeaway. The Commonwealth Department of Health has approached Council to request that they take over the aged care services from Marle. Council is currently in negotiations with the department regarding funding for the service including funding to upgrade/renovate buildings. This includes

delivery of services to 10 lower level care clients (CHSP) clients and five higher level care clients (Home Care Package). Marle currently operate services from lot 118 at Atitjere and applied for a section 19 lease on this site. Council applied for a section 19 lease on the adjoining block at lot 84 (the former childcare site). At the Atitjere Land Aboriginal Corporation (ALAC) general meeting on 24 June 2016, ALAC instructed the Central Land Council (CLC) that they did not wish to grant a section 19 application to Marle for lot 118, as ALAC wished to see lot 118 being used for aged care services. The CLC advised that there is no right of review for Marle. Change of Lease Application ALAC also considered Council’s section 19 lease application over lot 84. ALAC did not make a decision about Council’s application, however instructed CLC to request that Council change their application and make a lease application over lot 118. ALAC held another meeting on 9 September 2016 and requested that both Marle and Council make a presentation regarding their applications. ALAC were not able to reach quorum at that meeting, and therefore a decision about Council’s lease application for lot 84 was not able to be made. ALAC has again requested that Council change their lease application to provide aged care services from lot 118 rather than lot 84. If Council does this, a decision will be made immediately on our lease application. If Council does not change the lease application then ALAC will make a decision on lot 84 at the next available meeting which is expected to be 25 November 2016. Subject to the outcome of ALAC’s consideration of our application for lot 84, the result of this action may result in a delay of more than four months to secure an aged care site. Cessation of Marle’s Services Note that Marle ceased services to their 10 CHSP clients on Friday, 16 September 2016. On 22 September 2016 Council commenced a hamper delivery service to these clients at the request of the Department. Clients will receive only meal hampers and hygiene packs and no other service until the aged care site is secured. ISSUES, CONSEQUENCES AND OPTIONS Council commenced providing aged care services to low care old people in Atitjere on 22 September following Marle’s advice to the

Commonwealth Department of Health on 19 September that they were withdrawing their services for that cohort. In addition, the Commonwealth is negotiating with Marle to relinquish their contract for delivery of aged care services to the five old people that require higher level care although at the time of writing this report, those negotiations had not been finalized. ALAC has advised Council, through CLC, that lot 118 is the preferred lot for the delivery of aged care services. ALAC assert that they have made significant investment in that facility over time specifically for the delivery of aged care services. They have requested Council apply for a lease over Lot 118. Marle does not have a S19 lease on Lot 118. Their application to ALAC was rejected, and as a result, Marle is effectively squatting at lot 118. While they have ceased providing aged care services to the Commonwealth Home Support Clients, a total of 10 old people,. at the time of writing this report they were still contractually responsible for providing care to five old people with higher level care needs. Marle also continue to use the kitchen at lot 118 to provide school nutrition meals and run their take away business. These are the only income streams for Marle. While Marle occupy lot 118 they continue to be able to operate their take away and school nutrition program. If Council applies for a lease over lot 118 , Marle will need to vacate in order for Council to operate aged care services. This will remove any capacity of Marle to operate to meet their aged care obligations to the five old people, to provide a school nutrition program, or to run their take away business. This will effectively limit Marle’s ability to generate any income and will likely result in the loss of their school nutrition program. There is no capacity for Council to sublet the facilities to Marle as this will have operational and environmental health implications. Council will not operate the take away business. Council has a current application for lot 84. While ALAC has postponed making a decision on our application, they have requested that we apply for lot 118 instead. CLC has indicated to Aged and Disability Services Management that they are prepared to make an immediate decision on lot118. Both lot 84 and lot 118 require reasonably substantial refurbishment although Lot 118 is better suited to the immediate delivery of a full suite

of services. The required upgrade to Lot 84, should Council gain an S19 lease, would delay the delivery of a full suite of services to the old people in Atitjere by at least six months. FINANCIAL IMPLICATIONS Council is funding the delivery of meal hampers to Atitjere using the Council 2015-16 CHSP underspend. Negotiations with the Department of Health regarding ongoing funding for the service and building upgrades / renovations is continuing. CLC cannot advise on the cost of the lease at this stage as lot 118 has not had an unimproved capital value assessment. The cost of the lease will be incorporated into the aged care operational budget.

ADVICE FROM EXECUTIVE MANAGEMENT TEAM There is a risk that Council’s application for the S19 lease over lot 118 will create disharmony amongst community members. If Marle is served with an eviction notice for lot 118, there is a possibility that their employees may refuse to vacate which might then commence a forced eviction administered by CLC on behalf of ALAC. Council is working to ensure that whatever outcome occurs it is done with the support of the community and Marle.

SUMMARY: The development of the Family Wellbeing Strategy is complete and ready to be officially launched and distributed to the public and stakeholders. A communication plan is attached.

BACKGROUND The Family Wellbeing Strategy was developed as a response to key priorities being identified by Councillors, Local Authority members, staff, residents and other Government agencies. The Strategy brings together all the actions and initiatives currently undertaken by Council and combines them with planned and future initiatives. This will provide Council with a roadmap to prevent and reduce family and community violence, improve the safety of children, raise awareness of the impact that drugs, alcohol and gambling can have on community and improve the health and fitness of community members. At the May Council meeting the Draft Family Wellbeing Strategy was tabled for review. Following changes, the final script for the strategy was approved in August with publication and launch due to correspond with the October Council meeting. ISSUES, CONSEQUENCES AND OPTIONS The outcomes of the Family Wellbeing Strategy will be continually tracked through a set of Key Performance Indicators. Existing resources to maintain and improve family wellbeing are already committed within Council’s various departments. FINANCIAL IMPLICATIONS Nil

Staff Training and Awards

Cert II Rural Operations training was completed by field staff at Lajamanu including plant operator competency assessments.

Chainsaw training was completed at Laramba.

Essential Services Officer (ESO) training was completed in Alice Springs in early September for several ESOs and back-up staff.

Fire Management All firebreaks are up to standard and there are no reports of uncontrolled fires occurring. Rain in August and September has meant the summer grass growing season is likely to be vigorous. Waste Management Landfill upgrades

Upgrades to community drop off areas are being planned at all sites, including improvement to separation bays, new signage and bunded storage pallets.

Nyirripi and Yuendumu landfill sites require refurbishment after heavy use in recent months, and this is underway.

Asbestos Legacy asbestos continues to be identified at various sites including at Laramba, Willowra, Yuendumu and Lajamanu. Plans to isolate the sites are progressing well, although long-term rehabilitation requires substantial funding which is not yet secured as well as logistics and engagement with traditional owners, through the Central Land Council (CLC), as the land holders. Capital Projects The directorate continues to manage over 100 projects in communities. A current Project Tracker Report will be tabled at the meeting. A Project Management Template has been developed to assist CSMs and other managers with planning, delivery and acquittal of minor capital projects (below $50,000). Roadworks Yuendumu region

Road repair works under the NDRRA program is progressing according to planned timelines and budgets.

Works are now complete on the Yuelamu to Pulardi Rd, and the work camp has been shifted to the start of the Nyirripi Rd.

Reinstatement of the first 7km of the Nyirripi Rd has commenced, and the crew will then move up to the 70km area. Upgrades to Nyirripi Rd will take around 3-4 months.

The contractor BJT Construction is working well with Council’s local Indigenous plant operators.

Engawala

Road shoulder upgrades and new corner kerbing is virtually complete. The team will then relocate to Atitjere to complete similar upgrades.

Repair of damage to the Engawala creek crossing is in final planning phases, with necessary approvals being finalised.

Road kerbing being installed at Engawala

Nyirripi The Nyirripi Road was closed to heavy vehicles for approximately six weeks in June and July due to persistent rains that maintained boggy conditions on several sections, particularly around the 70-80km mark. Upgrades to those sections are planned as part of the NDRRA program, pending discovery of adequate water by drilling in August. Yuendumu CBD Site surveying and planning for the major CBD upgrade is now complete and the works have ben put out to tender, closing mid-October. Works should commence in November. Lajamanu CBD GHD Consulting has completed a detailed analysis of stormwater flows into the town from the old and new airports. This confirms that the old airstrip sheds substantial water into the middle of town, and the new airport apron adds considerably to this load. Both are the major cause for the high flooding risk along the main street of town. Council is preparing a report to the NT Government asking them to divert these waters directly west into Hooker Creek. Yuelamu The Power Water Corporation (PWC) has completed modifications to its hilltop water compound so vehicles can park more safely inside the compound instead of along the road edge/crest. This is a suitable

arrangement until the new dual reticulation water supply system is completed. Council is working with PWC to ensure pipe installations along road reserves are done and reinstated to appropriate standards. Atitjere Council has sought funding from the Regional Economic Development Fund to construct a tourist vehicle ring road and parking area between the oval and store/art centre precinct. This will facilitate safer tourist access to the town. Council and the Local Authority are working together to ensure the design addresses community aspirations and concerns. Laramba, Willowra, Wilora Traffic Management Plans (TMPs) have been presented to Local Authorities for their input and installation works are progressing. TMPs for other communities are being rolled out. Fleet and Plant No major developments to report. The new rubbish compactor truck has arrived at Yuendumu. Properties and Facilities Section 19 leases are now mostly obtained for all Council properties, including licences to maintain ovals, cemeteries and parks. Various anomalies have been identified that require negotiations with the CLC. This includes unallocated Land Trust areas in and around communities where Council currently maintains firebreaks, slashing and rubbish clean up. The presence of old, legacy asbestos on unallocated Land Trust land is also a concern that Council is seeking the CLC’s consideration on how they intend to safely manage it. Lot 97 Laramba contractors’ accommodation Contractors are using the new facility and are supplying their own water and power via a water tank and onsite generator. PWC has confirmed that a power transformer upgrade and water pressure booster pump are needed for that street and Council is in negotiations to achieve that. Lot 96 Laramba CDP flat-pack house Council is completing planning for the construction of this house, particularly relating to power and water provision as per Lot 97 above. Yuelamu contractors’ accommodation Refurbishment of the accommodation is now complete including perimeter fencing, and it is now at a suitable standard for ongoing use. Willowra CDP flat-pack house

Cemeteries & Morgues Morgues Council’s formal role with morgues at Yuendumu, Nyirripi and Lajamanu has now ended. Cemeteries A new Cemeteries Act is out for comment at present, including consideration whether Local Authorities should become the official cemetery management board for each site. Council will remain the management body for each, and some legal tenure issues need to be resolved. In particular, the Lajamanu and Atitjere cemeteries are on neighbouring pastoral properties and long-term use agreements need to be negotiated for these sites. ESO and Airstrip Contracts Formal training for several ESOs and backup staff was done in Alice Springs in September to ensure Council has the appropriate stable of accredited staff to meet contractual obligations. The Essential Services contract is being retendered in early 2017 and Council is most-likely interested to bid for this again. Dog Management

Routine vet visits are planned to all communities in October and November. Council advertised twice between June and September for a replacement Animal Management Coordinator with veterinary qualifications. The aim was for the AMC to undertake de-sexing of the small proportion of dogs that are currently not de-sexed. There were no suitable applicants (we are told there is a national shortage of vets at present) and the role will not be filled for the remainder of 2016/17. Council is re-negotiating its existing contract vet arrangements, including with Warlukurlangu Artists, and is confident in delivering suitable ongoing dog assistance services to all communities. Outstation Services The NT Government has announced a continuation of the Homelands Extra Allowance program for 2016/17. This will provide $10,000 per house for upgrades, although only 580 houses will be funded across the NT, first-in first-served. Council provides assistance to 78 outstation houses and is working to sign up house occupants now. Irrelirre A major upgrade to the Bushlight solar power system has just been completed by Ogden Electrical, including battery replacement, additional solar panels and a greater daily quota of power to households. This is a major outcome for Irrelirre residents. Woods Camp The water main to houses was recently replaced, improving water pressure significantly.

BACKGROUND The Works Matrix shows all capital works that Council seeks to achieve in the Municipal Services area over time. It shows completed works (green C), work in progress (%), works done in the last six months (yellow cells) and works planned for the next six months (red borders). RECOMMENDATION: That the Council pre-approve entry into contract with a conforming tenderer to upgrade Yuendumu CBD roads to the value of $777,375.

SUMMARY: Council is releasing the tender for upgrade of roads and roads infrastructure in Yuendumu’s CBD in late September. Pre-approval to enter into contract with the most suitable tenderer is sought, so works can proceed with minimal delay. Roads upgrades will provide a safer environment for road users and support tourism increases and experiences.

BACKGROUND Council has been awarded an Indigenous Strategic Local Roads Infrastructure grant of $646,244 from the Northern Territory Government Department of Roads and Transport to upgrade roads and roads infrastructure in the Yuendumu CBD. Payment of the grant will be made in stages (40% upon completion of the preliminary design, 90% upon completion of detailed design and documentation and !00% when 70% of the construction). Council has also been allocated a further $170,000 from Roads to Recover (R2R) funds for upgrading roads in Yuendumu’s CBD to support tourism increases. A public tender was issued on 23 September 2016 and will close on 24 October. Conforming tenders will be evaluated according to Council’s standard evaluation criteria listed in the tender documents. The most suitable contractor will be selected to enter into contract to accomplish the construction work. ISSUES, CONSEQUENCES AND OPTIONS Staff will follow the standard procedure for evaluating and awarding the contract, overseen by the CEO.

SUMMARY: The Finance Committee convenes on a bimonthly basis to carry out the financial functions of the Council. The minutes of the Finance Committee meeting held on 2 September 2016 are attached for Council’s consideration.

BACKGROUND Under Section 11 of the Local Government (Accounting) Regulations 2008 the Council has appointed its Finance Committee to undertake the financial functions of the Council in the months that the Council does not hold an ordinary meeting. The Finance Committee met on 2 September 2016 and made the following decision under delegation:

Approve the entry into contract with Maloney Contractors for the contract sum of $119,193.00 (ex GST) for the construction of 2,010 metres of fencing around community houses at Lajamanu.

SUMMARY: The Audit and Risk Committee meets at least three times a year to carry out the audit and risk functions of the Council. The minutes of the meeting held on 11 July 2016 are attached for the Council’s information.

BACKGROUND Council is required as per the NT Local Government Accounting Regulations (Part 4, Section 10) to create an Audit Committee which was approved by Council in February 2014. In essence Part 4, Section .10 (3) of the regulations state as follows: (3) Without limiting sub-regulation (1), the CEO must establish and maintain an audit committee to monitor:

(i) compliance by the council with proper standards of financial management; and

(ii) compliance by the council with these regulations and the Accounting Standards;

The decisions made under delegation were as follows:
