�005has afforded me the opportunity to consolidate my knowledge of the many aspects of theorganisation,andtogetherwithBoardandstaffimplementinpartthevisionIoutlinedinmy�004
Report,namely‘raisingtheprofileofthecompanyinthelegalandbusinesscommunities’.
Aspartof that initiative, inAugustCorrsChambersWestgarthhostedacocktail party forMelbournebasedlawyersandbarristers to introduceArtsLawand itsservices, tomake thoseattendingawareof the levelofserviceweprovideinVictoria,orhowtheymightassistusonaprobonobasis.MythanksmustgotoStephenSternandFiliaBouterakisofCorrs,WarwickRothnieoftheMelbourneBarandtheHonJusticePeterHeereyforarrangingthisverysuccessfulevening.
AsstatedelsewhereinthisReport,nearly�0%oftheadvicegivenannuallybyArtsLawistoVictorianartistsandorganisations.Tofurtherpromoteourservices,andtolobbytherelevantpartiesfortheresourcestocontinuetoprovidethislevelofservice,wehaveestablishedtheVictorianAdvisoryCouncil-consistingofhighprofilelegalpersonalitiesfromthejudiciary,professionandacademia-chairedbyArtsLawBoardmember,TheHon.JusticePeterHeerey.
Iwould like towelcomeJusticeAlanGoldbergof theFederalCourt,PeterChalk,MarkDreyfusQC,AndrewKenyon,StephenSternandKimberleeWeatherallasmembersoftheCouncil,andthoseVictorianlawyersandlawfirmswhohaveofferedtheirservicestoArtsLaw.
InJulyIwasfortunatetolaunchtheArtistsintheBlackComicsatafunctionhostedbyFreehills(Sydney).Thisveryimportant-andunique-servicewhichhascompleteditssecondyear,willseeitsfundingbytheAustraliaCouncilcontinueinto�006,withtheNSWMinistryfortheArtscomingonboardforthefirsttime.Wearegratefulforthevisionofthefundingbodiesintheirsupportofthisrapidlydevelopingservice.
�005broughtchangestotheBoardofArtsLaw.IwouldliketopaytributetoStuartPalmer(HonTreasurer)andRenaSofroniou,whohaveretired,fortheirdedication,theirenthusiasmandtheirprofessionalism.IwouldliketowelcomeStevenMiller(HonTreasurer)whoisnostrangertotheartsandculturalsector,andtoArtsLawitself,havingprovidedaccountingandtaxadvicetostaffandclientsalikeoften,onaprobonobasis.HeisavaluableadditiontotheCompany;thecurrentstrengthofourfinancesandreportingproceduresowemuchtohisoversight.
I welcome most warmly to the Board my colleague, the Hon Justice Peter Heerey of the Federal Court ofAustralia.Peteriskeenlyinterestedintheartsandisaninternationallyacknowledgedexpertoncopyrightlaw.HisexperienceandwisdomwillbeinvaluabletotheBoard.
ArtsLawisprivilegedtohaveasitsPatronssomeofthefinestlegalandartistictalentinAustralia.In�006IhopetoincreasethenumberofPatronsfromamongsttheranksofpractisingartistssothat,togetherwithourexistingPatrons,theymayassist,notonlyinfundraising,butinraisingtheprofileofArtsLawintheartscommunityitself.Despitethefactthatwehavebeenservingtheartscommunityformorethan�0years,Iamconstantlysurprisedathowmanyyoungandtalentedartistshaveneverheardofus.Theirinvariablereactionis‘IwishIhadknownofArtsLawbeforenow!’
Mysincere thanksgo tomy fellowBoardmembers,our inspirationalCEORobynAyres,ourwonderworkingAdministratorGareyCampbell,allthestaffofArtsLaw,ourvolunteerlawyers,andourstudentsandinternsfortheircontinueddedicationandhardwork.
Myhopesfor�006aretobuildtheresourcesoftheCentreandtoconsolidateitspositionasthepreeminentlegalcentreforartistsandartsorganisationsInAustralia.Atalltimes,butespeciallyintimesofconflictanduncertainty,asocietyneedstolistentothevoicesofitsartiststointerpretitsconscience–andartistsneedallthesupportwecangivethem.

�005sawArtsLawcontinuetobuildrelationshipswiththeartsandlegalcommunitiesaroundAustraliatoincreaseartists’awarenessoftheirrightsandimproveourservicedelivery.TheArtsLawteam
workedextremelyhard tomake it all happenwith ahugepush toprovideour educationprogramacrossabroadgeographicareaandtoourdiverseaudience,theAustralianartscommunity.Bytheendof�005wehadpresentedover90seminarsorworkshopsin�7differentgeographicallocationsto�700participants.
NewinitiativessawworkshopsdeliveredtoawiderangeofIndigenousartists,artistsfromculturallyandlinguisticallydiverse communities, young people and local government. A key aspect in this work is the development ofrelationshipswithlocalartsorganisations,tertiaryinstitutionsandgovernmentagenciesastheyknowthelocalsceneandunderstandwhatisneeded.Ourthankstothehundredsoforganisationsweworkedwithovertheyear.
Inthesecondyearofoperation,ArtsLaw’sIndigenousservice,Artists in the Black (AITB)wentfromstrengthtostrength.SamanthaJoseph,theAboriginallawyer,andBlanchLake,theIndigenousinformationandliaisonofficer,tooktotheroad,oftenaccompaniedbyanotherArtsLawsolicitortoletIndigenouscommunitiesknowaboutourservicesand their rights.Notsurprisingly, theneed forbetterprotectionof Indigenouscultureandintellectualpropertywasamessagethatresoundedaroundthecountry.InJulywelaunchedtheAITBcomics,whichhavebeenahugesuccessandarenow intothesecondprint runof8000.WearealsodelightedtheAustraliaCouncilisprovidingfundingforAITBin�006,andtheNSWMinistryfortheArtswillfundtheIndigenousserviceforthefirsttime.
ArtsLawalsocoordinatedtheVictoriaArtsLawWeek(16-�3May),whichbroughttogetherninepeakartsandlegalorganisationstoputonaweekoffreeorlowcostseminarsandlegaladvicesessionsforthecreativepeopleofVictoria.600peoplefromcreativecommunitiesattendedthisweekwith�0locallawyersinvolvedinthesessions.
InviewofthefactthatArtsLawprovidesover�0%ofitsservicestoVictorianartistsandtheirorganisations,wehavedecidedtoestablishaVictorianAdvisoryCouncil,comprisedofhighprofilelegalluminaries,toassistArtsLawdevelopmuchneededresources.Themembersarelistedonpage13.
ArtsLawwasalsosuccessfulinobtaininganumberofgrantstocarryoutspecialprojects.Theseallowustoextendtheservicesintoareasorprojectsweotherwisewouldnotbeabletocarryoutgiventhecorelevelsoffunding.ExamplesincludetheAITBcomics,theIndigenouseducationprogram,theArtsInsuranceHandbook,to name but a few. However it must be noted that relying on numerous small project grants has a difficultsideasallofthesegrantsmustbeobtained,maintainedandacquitted.In�005,ArtsLawhadtomanage15differentgrants,somerequiringquarterlyreportingandmosthavingdifferentacquittalrequirements.ThisisanonerousrequirementonasmallorganisationsuchasArtsLawbutnecessaryinordertoprovidetheservicesandresourcesneededintheartscommunity.Thatsaid,westillacknowledgeandappreciatetheongoingsupportofourfunders,whomakeitallpossible.
Attheendof�005,ArtsLawforthe�ndyear,awardeda limitededitionprint tothe�4 lawyerswhomadeaimportantvolunteercontributiontoArtsLaw.ThissmalltokenofrecognitioninnowaydiminishesourappreciationofthecontributionofallofArtsLaw’svolunteerswhosignificantlyincreaseourserviceprovisioncapacityacrossAustralia.
Once again, we ended �005 with a never-ending “to do” list, with publications to write and update, officeequipmenttoreplace,lawyerstoaddtoourprobonopanel,policiesandprocedurestoimplement,newfundinginitiativestopursue,neweducationalpossibilitiesetc.
Soafteranothersuccessful(andmostlyfun)year,IsincerelythanktheveryhardworkingArtsLawstaff,theBoardwhocanalwaysberelieduponparticularlywhenthingsgettough,andtheeffortsofourvolunteers.

TheArtsLawCentreofAustralia(ArtsLaw)isthenationalcommunitylegalcentreforthearts.ArtsLawisanotforprofitcompanylimitedbyguarantee.ArtsLawwasestablishedwiththesupportoftheAustraliaCouncilin1983toprovidespecialisedlegalandbusinessadviceandreferralservices,professionaldevelopmentservicesandadvocacyforartistsandartsorganisations.
Arts Law provides legal advice and information on a wide range of arts related legal and business mattersincludingcontracts,copyright,businessstructures,defamation,insurance,employmentandtaxationtoartistsandartsorganisationsacrossallartforms.
ThemajorityofArtsLawsubscribersareindividualartspractitioners–includingvisualartists,authors,newmediaartists, performers, musicians, composers, writers, film and documentary makers, choreographers, graphicdesignersandsetdesigners.
Vision To fosterasocietywhichpromotes justice forartistsandvalues theircreativecontribution.
Mission Toprovidepractical,specialistlegalservicesandresources,(includingadvocacy,publicationsandeducation),toartistsandtheculturalsector.
Values Inachievingourvision,theworkofArtsLawisguidedbythevaluesofexcellence,accessibility,empowermentandintegrity.

ThefocusofalloftheworkofArtsLawistoensurethatthecreativeandculturalsectorofAustraliahaveaccesstopractical,specialistlegalservicesandresources.
ArtsLawprovides legaladviceonawiderangeof legalandbusiness issuesaffectingartistsandtheculturalsectorincludingcopyright,contract,moralrights,performersrights,trademarks,passingoff,tradepractices,confidentiality,employment,defamation,businessstructures,privacy,insurance,censorshipandtaxation.
ArtsLawprovidesafreenationaltelephonelegaladviceservicetotheartscommunityand,toArtsLawsubscribers,extendedlegaladviceservice,nationalface-to-facelegaladviceLegalAdviceNightsandprobonoreferrals.ArtsLawalsoprovidesreferralstoourpanelofmediatorsonafeeforservicebasis.

In�004ArtsLawreceivedfundingfromtheAustraliaCounciltotrialanIndigenousProjecttoimproveservicedeliverytoIndigenousartistsandtheirorganisationsacrossAustralia.TheserviceiscalledArtists in the Black (AITB). AITBhashadcompletedasuccessful�yearpilotphaseandnowcontinuestoprovideanimportantroleinprovidinglegaladvice;informationandeducationtoAboriginalartists,communitiesandtheirorganisations.
Arts Law employs � Aboriginal staff, Samantha Joseph, in the lawyer’s position and Blanch Lake, as theinformation/liaisonofficer toprovideservices tailored to the Indigenouscommunity.Todate the focusof theservicehasbeen

Legal Service Provision
TheAboriginalstaffworkwiththeotherArtsLawstafftoprovideenhancedservicestotheIndigenouscommunity.In�005AITBincreaseditslegaladviceservicesandprovided114legaladvices,face-to-faceconsultationsandcaseworkservices.Inordertoprovideanappropriateservice,itisnotedthatmanyoftheadvicesprovidedtoIndigenousclientsaresignificantlymoreresourceintensivethanotherlegaladvices.Thisisinviewofnumberofcontactsaswellastimespentwiththeclient.Thelegaladvicecoversgeneralaswellasspecificadvice(mostlyinrelationtocontracts).
Casework assistance
AuniqueaspectofAITBistheabilitytoprovidelimitedcaseworktoclientswheretheirmatterinvolvesapublicinterestaspect.Mostofthecasesrelatetotheunauthorizedreproductionofindividualartistswork.Caseworkenablesustoensureweareachievingthecoreobjectives–ofensuringaccesstolegalservicesandeducatingartistsoftheirrights.Caseworkalsogivesusthechancetoformsolidworkingrelationshipswithlawfirmswhohaveprovidedtheirservicesonaprobonobasis.ArtsLawwouldnotbeabletooffercaseworkassistancewithoutthissupport.Caseworkalsogivesustheopportunitytoaddressparticularissuesofpublicconcernandadvocateforimprovedchange.

ThedirectorsoftheCompanyareresponsibleforthepreparationandtrueandfairpresentationofthefinancialreportinaccordancewiththeCorporations Act 2001.Thisincludesresponsibilityforthemaintenanceofadequateaccountingrecordsandinternalcontrolsthataredesignedtopreventanddetectfraudanderror,andfortheaccountingpoliciesandaccountingestimatesinherentinthefinancialreport.
Audit Approach
WeconductedanindependentauditinordertoexpressanopiniontothemembersoftheCompany.OurauditwasconductedinaccordancewithAustralianAuditingStandards,inordertoprovidereasonableassuranceastowhetherthefinancialreportisfreeofmaterialmisstatement.Thenatureofanauditisinfluencedbyfactorssuchastheuseofprofessionaljudgement,selectivetesting,theinherentlimitationsofinternalcontrol,andtheavailabilityofpersuasiveratherthanconclusiveevidence.Therefore,anauditcannotguaranteethatallmaterialmisstatementshavebeendetected.
We performed procedures to assess whether in all material respects the financial report presents fairly,in accordance with the Corporations Act 2001, including compliance with Accounting Standards and othermandatoryfinancialreportingrequirementsinAustralia,aviewwhichisconsistentwithourunderstandingoftheCompany’sfinancialposition,andofitsperformanceasrepresentedbytheresultsoftheiroperationsandcashflows.
Weformedourauditopiniononthebasisoftheseprocedures,whichincluded:
• examining,onatestbasis,informationtoprovideevidencesupportingtheamountsanddisclosuresinthefinancialreport;and
• assessingtheappropriatenessoftheaccountingpoliciesanddisclosuresusedandthereasonablenessofsignificantaccountingestimatesmadebythedirectors.

ThefinancialreportcoverstheArtLawCentreofAustraliaLimited(the“Company”)whichisapubliccompanylimitedbyguarantee,incorporatedanddomiciledinAustralia.
The financial report of the Company as an individual Company complies with all Australian equivalents toInternationalFinancialReportingStandards(AEIFRS)intheirentirety.

Basis of Preparation
First-time Adoption of Australian Equivalents to International Financial Reporting Standards
TheCompanyhaspreparedfinancialstatementsinaccordancewiththeAustralianequivalentstoInternationalFinancialReportingStandards(AEIFRS)from1January�005.
InaccordancewiththerequirementsofAASB1: First-time Adoption of Australian Equivalents to International Financial Reporting Standards, adjustments resulting from the introduction of AEIFRS have been appliedretrospectivelyto�004comparativefiguresexcludingcaseswhereoptionalexemptionsavailableunderAASB1havebeenapplied.TheseaccountsarethefirstfinancialstatementsoftheArtsLawCentreofAustraliaLimitedtobepreparedinaccordancewithAEIFRS.
Theaccountingpoliciessetoutbelowhavebeenconsistentlyappliedtoallyearspresented.
ReconciliationsofthetransitionfrompreviousAustralianGAAPtoAEIFRShavebeenincludedinNote�tothisreport.
Reporting Basis and Conventions
Thefinancial reporthasbeenpreparedonanaccrualbasisand isbasedonhistoricalcostsmodifiedby therevaluationofselectednon-currentassets,andfinancialassetsandfinancial liabilities forwhich the fairvaluebasisofaccountinghasbeenapplied.
(a) Income Tax
The Company is exempt from the payment of income tax under Section 50-40 of the Income Tax Assessment Act 1997.
(b) Inventories
Inventoriesaremeasuredatthelowerofcostandnetrealisablevalue.
(c) Plant and Equipment
Eachclassofplantandequipmentiscarriedatcostorfairvalueless,whereapplicable,anyamountofaccumulateddepreciation.

Thecarryingamountofplantandequipmentisreviewedannuallybythedirectorstoensureitisnotinexcessoftherecoverableamountfromtheseassets.Therecoverableamountisassessedonthebasisofitsdepreciatedreplacementcost.
Subsequentcostsare included in theasset’scarryingamountor recognisedasa separateasset, asappropriate,onlywhenitisprobablethatfutureeconomicbenefitsassociatedwiththeitemwillflowtothegroupandthecostoftheitemcanbemeasuredreliably.Allotherrepairsandmaintenancearechargedtotheincomestatementduringthefinancialperiodinwhichtheyareincurred.
Depreciation
Thedepreciableamountofallfixedassetsincludingcapitalisedleaseassets,isdepreciatedonastraightlinebasisovertheirusefullivestotheCompanycommencingfromthetimetheassetisheldreadyforuse.Thedepreciationratesusedforeachclassofdepreciableassetsare:

(d) Intangibles

(e) Employee Benefits
Provision is made for the Company’s liability for employee benefits arising from services renderedby employees to balance date.Employee benefits expected to be settled within one year have beenmeasuredatamountsexpectedtobepaidwhentheliabilityissettled,plusrelatedon-costs.Employeebenefitspayablelaterthanoneyearhavebeenmeasuredatthepresentvalueoftheestimatedfuturecashoutflowstobemadeforthosebenefits.
(e) Cash and Cash Equivalents
Cashandcashequivalentsincludecashonhand,depositsheldatcallwithbanks,othershort-termhighlyliquidinvestmentswithoriginalmaturitiesofthreemonthsorless,andbankoverdrafts.Bankoverdraftsareshownwithinshort-termborrowingsincurrentliabilitiesonthebalancesheet.
(f) Specific Purpose Funds
TheCompanyreceivesfundsforspecificpurposesandisobligatedundertheconditionsofthefundingtoaccounttosuchfundsseparately.Thesemoniesmayonlybespentforthespecificpurposeforwhichtheyarereceived.Anyinterestrevenueearnedonthesemoniesmustalsobeallocatedtothespecificfund.Thesefundsaredisclosedinliabilitiesasunexpendedfunds,andanyincomeorexpenditureinthesefundsisdisclosedasamovementintheunexpendedbalanceofthesefunds.
(g) Revenue
Governmentgrants,memberships,andsponsorshipsarerecognisedasrevenueintheperiodtowhichtheyrelate.Amountsreceivedinthecurrentyear,butrelatedtofutureyearsarecarriedinthebalancesheetasunearnedincome.
