(b) under Patent Claims infringed by themaking, using, or selling of Modifications made by thatContributor either alone and/or in combination with its Contributor Version (or portions of suchcombination), to make, use, sell, offer for sale, havemade, and/or otherwise dispose of: (1)Modifications made by that Contributor (or portions thereof); and (2) the combination of Modificationsmade by that Contributor with its Contributor Version (or portions of such combination).

(c) The licenses granted in Sections 2.2(a) and 2.2(b) are effective on the date Contributor firstdistributes or otherwisemakes theModifications available to a third party.

3. Distribution Obligations.

2. GRANT OF RIGHTS

a) Subject to the terms of this Agreement, each Contributor hereby grants Recipient a non-exclusive,worldwide, royalty-free copyright license to reproduce, prepare derivative works of, publicly display,publicly perform, distribute and sublicense the Contribution of such Contributor, if any, and suchderivative works, in source code and object code form.

b) Subject to the terms of this Agreement, each Contributor hereby grants Recipient a non-exclusive,worldwide, royalty-free patent license under Licensed Patents to make, use, sell, offer to sell, importand otherwise transfer the Contribution of such Contributor, if any, in source code and object codeform. This patent license shall apply to the combination of the Contribution and the Program if, at thetime the Contribution is added by the Contributor, such addition of the Contribution causes suchcombination to be covered by the Licensed Patents. The patent license shall not apply to any othercombinations which include the Contribution. No hardware per se is licensed hereunder.

c) Recipient understands that although each Contributor grants the licenses to its Contributions setforth herein, no assurances are provided by any Contributor that the Program does not infringe thepatent or other intellectual property rights of any other entity. Each Contributor disclaims any liability toRecipient for claims brought by any other entity based on infringement of intellectual property rights orotherwise. Forexample, if a third party patent license is required to allow Recipient to distribute the Program, it isRecipient's responsibility to acquire that license before distributing the Program.

3. REQUIREMENTS

A Contributor may choose to distribute the Program in object code form under its own licenseagreement, provided that:

iii) states that any provisions which differ from this Agreement are offered by that Contributor alone andnot by any other party; and

iv) states that source code for the Program is available from such Contributor, and informs licenseeshow to obtain it in a reasonablemanner on or through amedium customarily used for softwareexchange.

When the Program is made available in source code form:

a) it must bemade available under this Agreement; and

b) a copy of this Agreement must be included with each copy of the Program.

Contributors may not remove or alter any copyright notices contained within the Program.

Each Contributor must identify itself as the originator of its Contribution, if any, in amanner thatreasonably allows subsequent Recipients to identify the originator of the Contribution.

4. COMMERCIAL DISTRIBUTION

Commercial distributors of softwaremay accept certain responsibilities with respect to end users,business partners and the like. While this license is intended to facilitate the commercial use of theProgram, the Contributor who includes the Program in a commercial product offering should do so in amanner which does not create potential liability for other Contributors. Commercial Contributor's responsibility alone. EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, THE PROGRAM IS PROVIDEDON AN "AS IS" BASIS, WITHOUTWARRANTIES OR CONDITIONS OF ANY KIND, EITHEREXPRESS OR IMPLIED INCLUDING, WITHOUT LIMITATION, ANYWARRANTIES ORCONDITIONS OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR APARTICULAR PURPOSE. Each Recipient is solely responsible for determining the appropriatenessof using and distributing the Program and assumes all risks associated with its exercise of rights underthis Agreement, including but not limited to the risks and costs of program errors, compliance withapplicable laws, damage to or loss of data, programs or equipment, and unavailability or interruption ofoperations.

6. DISCLAIMER OF LIABILITY

EXCEPT AS EXPRESSLY SET FORTH IN THIS AGREEMENT, NEITHER RECIPIENT NOR ANYCONTRIBUTORS SHALLHAVE ANY LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL,SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDINGWITHOUTLIMITATION LOST PROFITS), HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY,WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDINGNEGLIGENCE OROTHERWISE) ARISING IN ANYWAY OUTOF THE USE OR DISTRIBUTION OF THE PROGRAMOR THE EXERCISE OF ANY RIGHTS GRANTED HEREUNDER, EVEN IF ADVISED OF THEPOSSIBILITY OF SUCH DAMAGES.

7. GENERAL

If any provision of this Agreement is invalid or unenforceable under applicable law, it shall not affect thevalidity or enforceability of the remainder of the terms of this Agreement, and without further action bythe parties hereto, such provision shall be reformed to theminimum extent necessary tomake suchprovision valid and enforceable.

If Recipient institutes patent litigation against a Contributor with respect to a patent applicable tosoftware (including a cross-claim or counterclaim in a lawsuit), then any patent licenses granted by thatContributor to such Recipient under this Agreement shall terminate as of the date such litigation is filed.In addition, if Recipient institutes patent litigation against any entity (including a cross-claim orcounterclaim in a lawsuit) alleging that the Program itself (excluding combinations of the Program withother software or hardware) infringes such Recipient's patent(s), then such Recipient's rights grantedunder Section 2(b) shall terminate as of the date such litigation is filed.

All Recipient's rights under this Agreement shall terminate if it fails to comply with any of thematerialterms or conditions of this Agreement and does not cure such failure in a reasonable period of time after

Everyone is permitted to copy and distribute copies of this Agreement, but in order to avoidinconsistency the Agreement is copyrighted andmay only bemodified in the followingmanner. TheAgreement Steward reserves the right to publish new versions (including revisions) of this Agreementfrom time to time. No one other than the Agreement Steward has the right to modify this Agreement.IBM is the initial Agreement Steward. IBMmay assign the responsibility to serve as the AgreementSteward to a suitable separate entity. Each new version of the Agreement will be given a distinguishingversion number. The Program (including Contributions) may always be distributed subject to theversion of the Agreement under which it was received. In addition, after a new version of the Agreementis published, Contributor may elect to distribute the Program (including its Contributions) under the newversion. Except as expressly stated in Sections 2(a) and 2(b) above, Recipient receives no rights orlicenses to the intellectual property of any Contributor under this Agreement, whether expressly, byimplication, estoppel or otherwise. When a program is linked with a library, whether statically or using a shared library, the combination ofthe two is legally speaking a combined work, a derivative of the original library. Also, no right, title, or interest in or to any

5. LIMITATION OF LIABILITY. Either party may terminatethis Agreement immediately should any Software become, or in either party's opinion be likely tobecome, the subject of a claim of infringement of any intellectual property right. Upon termination, youmust destroy all copies of Software.

7. EXPORT REGULATIONS. You agree that U.S. export control laws and other applicable export andimport laws govern your use of the Software, including technical data; additional information can befound onOracle's Global Trade Compliance web site (http://www.oracle.com/us/products/export). Youagree that neither the Software nor any direct product thereof will be exported, directly, or indirectly, inviolation of these laws, or will be used for any purpose prohibited by these laws including, withoutlimitation, nuclear, chemical, or biological weapons proliferation.

8. TRADEMARKS AND LOGOS. You acknowledge and agree as between you

9. U.S. GOVERNMENT LICENSE RIGHTS. If Software is being acquired by or on behalf of the U.S.Government or by a U.S. Government prime contractor or subcontractor (at any tier), then theGovernment's rights in Software and accompanying documentation shall be only those set forth in thisAgreement.

10. GOVERNING LAW. This agreement is governed by the substantive and procedural laws ofCalifornia. You andOracle agree to submit to the exclusive jurisdiction of, and venue in, the courts ofSan Francisco, or Santa Clara counties in California in any dispute arising out of or relating to thisagreement.

11. SEVERABILITY. If any provision of this Agreement is held to be unenforceable, this Agreement willremain in effect with the provision omitted, unless omission would frustrate the intent of the parties, inwhich case this Agreement will immediately terminate.

12. INTEGRATION. This Agreement is the entire agreement between you andOracle relating to itssubject matter. It supersedes all prior or contemporaneous oral or written communications, proposals,representations and warranties and prevails over any conflicting or additional terms of any quote, order,acknowledgment, or other communication between the parties relating to its subject matter during theterm of this Agreement. Nomodification of this Agreement will be binding, unless in writing and signedby an authorized representative of each party.

SUPPLEMENTAL LICENSE TERMS

These Supplemental License Terms add to or modify the terms of the Binary Code License Agreement.Capitalized terms not defined in these Supplemental Terms shall have the samemeanings ascribed tothem in the Binary Code License Agreement. These Supplemental Terms shall supersede anyinconsistent or conflicting terms in the Binary Code License Agreement, or in any license containedwithin the Software.

A. COMMERCIAL FEATURES. Youmay not use the Commercial Features for running Programs,Java applets or applications in your internal business operations or for any commercial or productionpurpose, or for any purpose other than as set forth in Sections B, C, D and E of these SupplementalTerms. If You want to use the Commercial Features for any purpose other than as permitted in thisAgreement, Youmust obtain a separate license from Oracle.

B. SOFTWARE INTERNALUSE FOR DEVELOPMENT LICENSE GRANT. Subject to the terms andconditions of this Agreement and restrictions and exceptions set forth in the README Fileincorporated herein by reference, including, but not limited to the Java Technology Restrictions of theseSupplemental Terms, Oracle grants you a non-exclusive, non-transferable, limited license without feesto reproduce internally and use internally the Software complete and unmodified for the purpose ofdesigning, developing, and testing your Programs.

Subject to the terms and conditions of this Agreementand restrictions and exceptions set forth in the README File, including, but not limited to the JavaTechnology Restrictions and Limitations on Redistribution of these Supplemental Terms, Oracle grantsyou a non-exclusive, non-transferable, limited license without fees to reproduce and distribute theSoftware, provided that (i) you distribute the Software complete and unmodified and only bundled aspart of, and for the sole purpose of running, your Programs, (ii) the Programs add significant and primaryfunctionality to the Software, (iii) you do not distribute additional software intended to replace anycomponent(s) of the Software, (iv) you do not remove or alter any proprietary legends or noticescontained in the Software, (v) you only distribute the Software subject to a license agreement that: (a)is a complete, unmodified reproduction of this Agreement; or (b) protects Oracle's interests consistentwith the terms contained in this Agreement and that includes the notice set forth in Section H, and (vi)you agree to defend and indemnify Oracle and its licensors from and against any damages, costs,liabilities, settlement amounts and/or expenses (including attorneys' fees) incurred in connection withany claim, lawsuit or action by any third party that arises or results from the use or distribution of anyand all Programs and/or Software. The license set forth in this Section C does not extend to theSoftware identified in Section G.

D. LICENSE TODISTRIBUTE REDISTRIBUTABLES. Subject to the terms and conditions of thisAgreement and restrictions and exceptions set forth in the README File, including but not limited tothe Java Technology Restrictions and Limitations on Redistribution of these Supplemental Terms,Oracle grants you a non-exclusive, non-transferable, limited license without fees to reproduce anddistribute those files specifically identified as redistributable in the README File ("Redistributables")provided that: (i) you distribute the Redistributables complete and unmodified, and only bundled as partof Programs, (ii) the Programs add significant and primary functionality to the Redistributables, (iii) youdo not distribute additional software intended to supersede any component(s) of the Redistributables(unless otherwise specified in the applicable README File), (iv) you do not remove or alter anyproprietary legends or notices contained in or on the Redistributables, (v) you only distribute theRedistributables pursuant to a license agreement that: (a) is a complete, unmodified reproduction ofthis Agreement; or (b) protects Oracle's interests consistent with the terms contained in the Agreementand includes the notice set forth in Section H, (vi) you agree to defend and indemnify Oracle and itslicensors from and against any damages, costs, liabilities, settlement amounts and/or expenses(including attorneys' fees) incurred in connection with any claim, lawsuit or action by any third party thatarises or results from the use or distribution of any and all Programs and/or Software. This section pertains to your distribution of the JavaTM SEDevelopment Kit Software (“JDK”) with your printed book or magazine (as those terms are commonlyused in the industry) relating to Java technology ("Publication"). Subject to and conditioned upon yourcompliance with the restrictions and obligations contained in the Agreement, Oracle hereby grants toyou a non-exclusive, nontransferable limited right to reproduce complete and unmodified copies of theJDK on electronic media (the "Media") for the sole purpose of inclusion and distribution with yourPublication(s), subject to the following terms: (i) Youmay not distribute the JDK on a stand-alone

This informationmust beplaced on theMedia label in such amanner as to only apply to the JDK; (vi) Youmust clearly identifythe JDK as Oracle's product on theMedia holder or Media label, and youmay not state or imply thatOracle is responsible for any third-party software contained on theMedia; (vii) Youmay not include anythird party software on theMedia which is intended to be a replacement or substitute for the JDK; (viii)You agree to defend and indemnify Oracle and its licensors from and against any damages, costs,liabilities, settlement amounts and/or expenses (including attorneys' fees) incurred in connection withany claim, lawsuit or action by any third party that arises or results from the use or distribution of theJDK and/or the Publication; ; and (ix) You shall provide Oracle with a written notice for eachPublication; such notice shall include the following information: (1) title of Publication, (2) author(s), (3)date of Publication, and (4) ISBN or ISSN numbers. F. JAVA TECHNOLOGY RESTRICTIONS. Youmay not create, modify, or change the behavior of, orauthorize your licensees to create, modify, or change the behavior of, classes, interfaces, orsubpackages that are in any way identified as "java", "javax", "sun", “oracle” or similar convention asspecified by Oracle in any naming convention designation.

G. LIMITATIONS ON REDISTRIBUTION. Youmay not redistribute or otherwise transfer patches, bugfixes or updates made available by Oracle throughOracle Premier Support, including thosemadeavailable under Oracle's Java SE Support program.

The Software's installation and auto-update processestransmit a limited amount of data to Oracle (or its service provider) about those specific processes tohelp Oracle understand and optimize them. Oracle does not associate the data with personallyidentifiable information.
