Approval of this Certificate of Appropriateness does not release the recipient from compliance with all other pertinent county, state, and federal regulations.

Before making any changes to your approved plans, contact the preservation planner (404/371- 2155). Some changes may fall within the scope of the existing approval, but others will require review by the preservation commission. If work is performed which is not in accordance with your certificate, a Stop Work Order may be issued.

If your project requires that the county issue a Certificate of Occupancy at the end of construction, an inspection may be made to verify that the work has been completed in accord with the Certificate of Appropriateness. If the work as completed is not the same as that approved in the Certificate of Appropriateness you will not receive a Certificate of Occupancy. You may also be subject to other penalties including fines and/or required demolition of the non-conforming work.

If you do not commence construction within twelve months of the date of approval, your Certificate of Appropriateness will become void and you will need to apply for a new certificate if you still intend to do the work.

Below please find additional information per page 1 of the COA. 

415 Emory Drive is a historic house built in 1926 located in the Druid Hills Historic District.  The 

existing house has a partial second story and an unfinished partial basement that were added 

by the owners during a renovation in 2016.  A proposed two‐story rear, deck, rear driveway 

modifications and lot coverage were approved by the HPC on May 17, 2021 as well as by the 

ZBOA on July 14, 2021.  This application is to propose window modifications to the previously 

approved Certificate of Appropriateness as well as approval to make repairs to an existing, non‐

historic garage. 

The window modifications and roof rear overhang modification are marked on the drawings 

with a cloud as changes to the previously approved application from May 17, 2021, application 

#1244876. The previous Certificate of Appropriateness letter is attached.  In this previous 

application the garage design was approved but in a different location.   

The property has a variance approval from July 14, 2021, case # A‐21‐1244915, to increase the 

lot coverage to 40.2% based on the provided site plan dated 04/27/21.  The variance indicates 

that any new accessory structure needs to be within the 7.5’ building line from the south 

property line.  The owners have decided not to build an accessory structure on the south side of 

the property but to keep their existing garage instead.  The approval letter with referenced site 

plans are attached.  

The existing garage is in poor condition and can be seen from the street in a minimal capacity. 

The proposal includes repairing the existing garage as the siding and roof are rotting and in 

need of repair.  The proposed repairs include making the front portion of the garage open‐air.

Dan Wright moved to approve the application to increase the maximum lot coverage to 40.2% with staff conditions 1 and 3 and with a revision to condition 2: the accessory structure be at least 7.5-feet from the southern side property line. Mark Goldman seconded the motion. Motion passed 6-0-0.
