INTRODUCTION

TheUKisduetoleavetheEUon31stOctober2019.Itissaidbythegovernmentthatthisdatewillnotchange.Whatwedonotknowatpresentiswhetherwewillleaveonthatdatewithorwithoutadeal.Thetermsuponwhichweleavemaywellaffectthedatesbywhichapplicationsneedtobemade.

Asofthe1stSeptemberthesenotesarecorrect.

AppendixEUprovidesforthoseEUcitizensandtheirfamilymemberwhoareintheUKorwhoarrivebyaspecificdatetoobtaineitherlimitedleavetoremainorindefiniteleavetoremain.ItisvitalthatthoseEUcitizensandtheirfamilymemberssecuretheirstatusintheUKbymakinganapplicationunderthesettlementscheme

Myfocusinthislectureisgoingtobeonthesubstanceofwhattheyneedtoestablishinordertosecurethatstatus.Iwillbeconcentratingonwhatneedstobeshownforindefiniteleavetoenterorremain(alsoreferredtoassettledstatus),limitedleavetoenterorremain(alsoreferredtoaspresettledstatus)andthesuitabilityrequirement.

APPENDIXEU

EU1.ThisAppendixsetsoutthebasisonwhichanEEAcitizenandtheirfamilymembers,andthefamilymembersofaqualifyingBritishcitizen,will,iftheyapplyunderit,begrantedindefiniteleavetoenterorremainorlimitedleavetoenterorremain.

RequirementsandProcedure

EU2.Theapplicantwillbegrantedindefiniteleavetoenter(wheretheapplicationismadeoutsidetheUK)orindefiniteleavetoremain(wheretheapplicationismadewithintheUK)where:

·AvalidapplicationhasbeenmadeinaccordancewithparagraphEU9;

·TheapplicantmeetstheeligibilityrequirementsforindefiniteleavetoenterorremaininaccordancewithparagraphEU11orEU12;and

·TheapplicantisnottoberefusedongroundsofsuitabilityinaccordancewithparagraphEU15orEU16.

EU3.Theapplicantwillbegrantedfiveyears’limitedleavetoenter(wheretheapplicationismadeoutsidetheUK)orfiveyears’limitedleavetoremain(wheretheapplicationismadewithintheUK)where:

·AvalidapplicationhasbeenmadeinaccordancewithparagraphEU9;

·TheapplicantdoesnotmeettheeligibilityrequirementsforindefiniteleavetoenterorremaininaccordancewithparagraphEU11orEU12,butmeetstheeligibilityrequirementsforlimitedleavetoenterorremaininaccordancewithparagraphEU14;and

·TheapplicantisnottoberefusedongroundsofsuitabilityinaccordancewithparagraphEU15orEU16.

EU4.WhereapersonhasbeengrantedlimitedleavetoenterorremainunderthisAppendix:

·Theymustcontinuetomeettheeligibilityrequirementsforthatleavewhichtheymetatthedateofapplication(exceptforanywhichrelatedtotheirdependencyonanotherperson)ormeetothereligibilityrequirementsforlimitedleavetoenterorremaininaccordancewithparagraphEU14;and

·TheyremainabletoapplyforindefiniteleavetoenterorremainunderthisAppendixandwillbegrantedthiswheretherequirementsinparagraphEU2aremet.

EU5.WhereapersonhasbeengrantedindefiniteleavetoenterorremainorlimitedleavetoenterorremainunderthisAppendixandthatpersonalsohasarighttoenterorresideundertheEEARegulations,theleavedoesnothaveeffecttotheperson’sdetrimentinsofarastheleaveisincompatiblewiththatrighttoenterorresideforaslongasthatpersonhasthatright.

EU6.AvalidapplicationmadeunderthisAppendixwhichdoesnotmeettherequirementsforindefiniteleavetoenterorremainorlimitedleavetoenterorremainwillberefused.

EU7.Annex1setsoutdefinitionswhichapplytothisAppendix.AnyprovisionmadeelsewhereintheImmigrationRulesforthoseterms,orforothermattersforwhichthisAppendixmakesprovision,doesnotapplytoanapplicationmadeunderthisAppendix.

EU8.Annex2appliestotheconsiderationbytheSecretaryofStateofavalidapplicationmadeunderthisAppendix.

ValidApplication

EU9.AvalidapplicationhasbeenmadeunderthisAppendixwhere:

(a)Ithasbeenmadeusingtherequiredapplicationprocess;

(b)Therequiredproofofidentityandnationalityhasbeenprovided;(c)TherequiredproofofentitlementtoapplyfromoutsidetheUKhasbeenprovided,wheretheapplicationismadeoutsidetheUK;and(d)Therequiredbiometricshavebeenprovided.

EU10.AnapplicationwillberejectedasinvalidwhereitdoesnotmeettherequirementsinparagraphEU9.

EligibilityforIndefiniteLeavetoEnterorRemain

PersonseligibleforindefiniteleavetoenterorremainasarelevantEEAcitizenortheirfamilymember,orasapersonwithaderivativerighttoresideorwithaZambranorighttoresideEU11.TheapplicantmeetstheeligibilityrequirementsforindefiniteleavetoenterorremainasarelevantEEAcitizenortheirfamilymember(orasapersonwithaderivativerighttoresideorapersonwithaZambranorighttoreside)wheretheSecretaryofStateissatisfied,including(whereapplicable)bytherequiredevidenceoffamilyrelationship,that,atthedateofapplication,oneofconditions1to7setoutinthefollowingtableismet:

EEAcitizenwasresidentintheUKasaworkerorself-employedpersonatthetimeoftheirdeath;and(b)TherelevantEEAcitizenwasresidentintheUKandIslandsforacontinuousqualifyingperiodofatleasttwoyearsbeforedying,orthedeathwastheresultofanaccidentatworkoranoccupationaldisease;and(c)TheapplicantwasresidentintheUKwiththerelevantEEAcitizenimmediatelybeforetheirdeathandsincethennosuperveningeventhasoccurred

7. (a)Theapplicantisachildundertheageof21yearsofarelevantEEAcitizen,oroftheirspouseorcivilpartner,andeither:(i)Themarriagewascontractedorthecivilpartnershipwasformedbeforethespecifieddate;or(ii)ThepersonwhoisnowtheirspouseorcivilpartnerwasthedurablepartneroftherelevantEEAcitizenbeforethespecifieddate(thedefinitionofdurablepartnerinAnnex1beingmetbeforethatdateratherthanatthedateofapplication)andthepartnershipremaineddurableatthespecifieddate;and(b)TherelevantEEAcitizen(or,asthecasemaybe,theirspouseorcivilpartner):(i)HasbeenorisbeinggrantedindefiniteleavetoenterorremainunderthisAppendix(orunderitsequivalentintheIslands);or(ii)(InthecaseofapersonwhoisanIrishcitizenasamatterofIrishlawandwhohasnotmadeavalidapplicationunderthisAppendix)wouldbegrantedthatleaveiftheymadesuchanapplication

EU12.TheapplicantmeetstheeligibilityrequirementsforindefiniteleavetoenterorremainasafamilymemberofaqualifyingBritishcitizen,orasafamilymemberwhohasretainedtherightofresidencebyvirtueofarelationshipwithaqualifyingBritishcitizen,wheretheSecretaryofStateissatisfied,includingbytherequiredevidenceoffamilyrelationship,that,atthedateofapplication,oneofconditions1to4setoutinthefollowingtableismet:

4. (a)Theapplicantisachildundertheageof21yearsofthespouseorcivilpartnerofthequalifyingBritishcitizen(andthemarriageorcivilpartnershipwasformedbeforethespecifieddate);and

EU14.TheapplicantmeetstheeligibilityrequirementsforlimitedleavetoenterorremainwheretheSecretaryofStateissatisfied,including(whereapplicable)bytherequiredevidenceoffamilyrelationship,that,atthedateofapplication,condition1or2setoutinthefollowingtableismet:

B. (a)Theapplicantischildundertheageof21yearsofthespouseorcivilpartnerofthequalifyingBritishcitizen(andthemarriageorcivilpartnershipwasformedbeforethespecifieddate);and(b)Theapplicantis(or,asthecasemaybe,fortherelevantperiodwas)intheUKlawfullybyvirtueofregulation9(1)to(6)oftheEEARegulations,regardlessofwhetherintheUKthequalifyingBritishcitizenis(or,asthecasemaybe,fortherelevantperiodwas)aqualifiedpersonunderregulation6oftheEEARegulations;and(c)ThespouseorcivilpartnerhasbeenorisbeinggrantedlimitedleavetoenterorremainunderthisAppendix

Suitability

EU15.(1)AnapplicationmadeunderthisAppendixwillberefusedongroundsofsuitabilitywhereanyofthefollowingapplyatthedateofdecision:

(a)Theapplicantissubjecttoadeportationorderortoadecisiontomakeadeportationorder;or(b)Theapplicantissubjecttoanexclusionorderorexclusiondecision.

(2)AnapplicationmadeunderthisAppendixmayberefusedongroundsofsuitabilitywhereanyofthefollowingapplyatthedateofdecision:

(a)TheapplicantissubjecttoanIslandsdeportationorder;or(b)TheapplicantissubjecttoanIslandsexclusiondecision.

EU16.AnapplicationmadeunderthisAppendixmayberefusedongroundsofsuitabilitywhere,atthedateofdecision,theSecretaryofStateissatisfiedthatitisproportionatetorefusetheapplicationwhere:

(a)Inrelationtotheapplicationandwhetherornottotheapplicant’sknowledge,falseormisleadinginformation,representationsordocumentshavebeensubmitted(includingfalseormisleadinginformationsubmittedtoanypersontoobtainadocumentusedinsupportoftheapplication);andtheinformation,representationordocumentationismaterialtothedecisionwhetherornottogranttheapplicantindefiniteleavetoenterorremainorlimitedleavetoenterorremainunderthisAppendix;or

(b)TheapplicantissubjecttoaremovaldecisionundertheEEARegulationsonthegroundsoftheirnon-exerciseormisuseofrightsunderDirective2004/38/EC.

EU17.ThereferencesinparagraphsEU15andEU16toanorderordecisiontowhichtheapplicantissubjectdonotincludeanorderordecisionwhich,atthedateofdecisionontheirapplicationunderthisAppendix,hasbeensetasideornolongerhaseffectinrespectoftheapplicant.
