The envelope had notations from the post office and it just got to me even though it seems to have been addressed correctly! While we have prepared the attached letter of the SBCCOG’s comments which was put into the mail yesterday, I notice that the April 20 letter asks for us to respond in writing that we accept designation as a participating agency no later than May 28, 2010. Can this e-mail serve as our acceptance? I have asked Don Camph, the SBCCOG transportation consultant, to represent the SBCCOG at meetings and other venues as appropriate. Based on the information you provided, it appears that the entire rail line would be in an urbanized area with almost no natural habitat. Given this, we are unaware of any issues that might trigger the need for section 7 consultation under the Endangered Species Act of 1973, as amended (ESA). According to Section 6002 of the Safe, Accountable, Flexible, Efficient, Transportation Equity Act: A Legacy for Users, we respectfully decline your invitation given that we have no authority or expertise with respect to your project, and we do not intend to submit comments. Scoping Meeting from the MTA Green Line Project. As we were unable to review the material

prior to the Scoping Meeting which was planned in May 2010, we would still like to be able to

provide comments on the EIR. Please let me know the schedule for the EIR review.
