“Once the trial court enters an order thatdecides all substantive claims, the right toappeal commences. Failure to appeal from thatorder forfeits the right. Because attorney’s feesand costs are collateral to a final judgment onthe merits, an unresolved request for attorney’sfees and costs does not render interlocutory anappeal from the trial court’s order.”‐‐ Duncan v. Thisdoes not mean, of course, that defendant had to pursue anappeal from the order at that time; he could have preserved hisexception for determination later as G.S. 1‐277(b) permits. First,a mistake in designating the judgment . . . should not resultin loss of the appeal as long as the intent to appeal from aspecific judgment can be fairly inferred from the notice andthe appellee is not misled by the mistake.
