Staff Report:

The applicant has an offer in on the home conditioned upon approval of horses

being allowed on the property. They would be clearing the area in red on theattached plan around the existing pole shed. Code allows for a maximum of one horse per two acres or in this case 2 horses

could be approved.

There are a number of properties that appear to have horses in the area. Staff

would not see any issues created by horses being allowed on this property.

In the past we have had conditions relating to the shelter, containment & waste

disposal/ storage. Staff would recommend similar conditions if recommendingapproval.

Jeff Lepak, 2045 Susie Ct; came in to voice concerns about having the horses infront of his house (which is across the street). He feels it would be more

appropriate if the horses were boarded somewhere else, that the area is not right

for horses. The location is about 275 feet from his house. Feels that Mr.

Schomaker should come back once he takes ownership of the property. Inaddition, he had issues with how the letter was mailedout with the appearance

Exhibit B notes a May 14, 1962 Town Board meeting rezoning the Lyle LeGare property from residential to business. Staff believes this was the entireproperty outlined in Exhibit A. Exhibit C is a CSM which divided the property into what exists today. Themap was created in 1981. No additional rezoning' s were noted at this time. Exhibit D is the letter to, the then owner, Craig Braun reflecting a rezone fromeither EA or R-2 to Family Service & Entertainment, with conditions. The

minutes of that meeting are also included. Considering Exhibit B, not reallysure why this took place. We have no records indicating any change in zoningfrom the 1962 motion. The minutes of that meeting: indicate discussion about acondominium Plat which would lead me to :believe the rezone at that time was

to include the duplex that exists, which the.cuitOut map still shows asRS( Exhibit E).

There is also a conditional use on SU=569 which allowed the storage buildingon that parcel.

All things considered, staff believes, the all property' s associated with thisbusiness should, based on records; all be zoned B. The family Service & Entertainment no longer exists and staffhas ilotfound any records or whatthose said properties were changed to whenthat zoning was eliminated. The Village Attorney, PaiilUmentum has reviewed all of the attacheddocuments and is recommending a rezoning to-a,Highway Businessclassification to eliminate and consolidate all the zoning and conditional use

A representative of Shipyard Marine was present to explain the need for the show

room. Annual sales are` about $ 10 million, about 22 seasonal employees, a good

portion of their par is are purchased locally.

Joan Mutz, 830 Longtail Beach Rd; came and spoke regarding the history ofShipyard Marine. Wanted to know if anyone else has any knowledge of thismarina and the history. ( Commissioner Zastrow worked for Carver from 1979-

1998 and is aware of the history of the marina and Commissioner Magray hasbeen on the commission since 1993.) She is not in favor of the boats beingoutside as they were supposed to be stored inside. Feels there was misstepsalmost every step of the way. Wanted to know if the question mark at the end ofthe description was intentional.

Ricky Marto, 2544 Longtail Beach Ln; concerned about semis going down theroad with the road being so narrow. Doesn' t mind the business, but it is growing

and getting bigger. The boats are getting faster. Concerned with conditions thatwere in place and have been changed. Who will enforce the conditions? No one

enforces anything right now.

Richard Marto, 2584 Longtail Beach Ln; wanted to know if they pay taxes on thedocks and he had a couple of old minutes that he gave to us to add to the record

they are attached to the minutes).

Monica Mutz, 830 Longtail Beach Rd; wanted to know why they are asking for arezone. Basically the general requirements of highwaybusiness and business arethe same. It appears as if the zoning they have is vod enough. Feels they arerezoning to get more options in the future.

Discussion among the commissioners was held. Thirigs,have changed in the last35 years. They are trying to consolidate all the differentparcels and put a zoningdesignation that makes sense. They,determined that they want to do things rightand that it is the right time to create a marina ordinance.

Chairman Gary Rozmarynoski called the meeting to order. Present

approve the agenda-- Pat Chambers seconded the motion. Motion

Suamico Planning Commission

Minutes

September 13, 1989

The regular bimonthly meeting of the Suamico Planning Commission wascalled to order. at 7: 04 P - m. by Chairperson Donna Van Kauwenbergh. All members were present.

The agenda was read. The agenda was amended to include VickeryVillage. John Gilmet made. a motion to approve the agenda as amended:

Jack Robb seconded the motion. A vote was taken, motion carried.

The minutes of .the previous meeting were read. Jack Robb made a

motion to approve the minutes as read. John Gilmet seconded the

motion. A vote was taken, motion carried.

Robin Bradshaw appeared on behalf of Vickery Village. The Villabe

requested permission for the placement- of directional signs acrossfrom Pulaski State Bank and at the corner of Riverside Drive and VelpAvenue. Permission has been received from Walter Matuszewski for thePlacement of the sign on School Lane. The Village is awaitingPermission for the sign placement on Velp Avenue. The signs must be

40 feet from the intersection, if this condition can not be met, a

variance will be required. Jack Robb made a motion to approve the

placement of the new directinal signs provided the Village complieswith the sign ordinance. Donna Van- Kauwenbergh seconded the motion.

A vote was taken, motion carried.

CSMs were presented.

Calvin Gross has been given until October 1, 1989 to make arrangementsfor his home.

Robert Paulson did not attend the Planning Commission meeting asrequested. The issued will be discussed at the next meeting.

St. John the Baptist Board of Education requested copies of buildingpermits. The minutes of the meetings will be mailed to them:

Craig Braun of Shipyard Marine appeared with plans for a storagebuilding. The building would be placed at the rear of the land andall equipment and boats would be stored inside4.. The building would be100 X 200 feet. Mr. Braun felt this building could be constructedunder a conditional use. Questions were raised about the zoning. Mr.

Braun was told to apply for a rezoning of the land to CommunityBusiness,. as the storage of boats would be considered a business.

Dave LaCount appeared requesting information on removing ground fromhis land on the corner of Longview Lane and -Longtail Beach Road. A

discussion was held on the amount of dirt to be removed and the use ofthe land for a potential lake. Mr. LaCount will be sent a copy of theEarth Excavation and Lake Ordinancess along with a conditional useapplication.

The home was built in 1991 with the current owner purchasing in 2006. The platrequired only a 35ft set -back. Based on the air photo' s it appears the home is 42ft off the ROW. With the 8

addition to the front of the garage, the northeast corner of the garage wouldinfringe on the set -back about a foot. Most of the addition does appear to be with-

in the required set -back.

Typically the rural lots have a 45ft set -back, not sure why this one was reducedbut because it is on the plat, we would allow the reduced set -back.

Sue last stated for the record that a field review was held at the property at 3997 St. Francis Park Dr. on Saturday, June 11, 2016.

Tim Lindgren- 3997 St. Francis Park Dr., Suamico. Requesting variance for remodel onhome to include a mudroom within the space that is currently the garage. Expanding thegarage out to allow for parking cars.

Steve Dunks- property is zoned RR and the surrounding lands are RR all with singlefamily homes, it is just under a 1 acre site. The home was built in 1991. Typically inrural lots we do require a 45 foot building set -back, the plat does state a 35 foot buildingset back so that would be the governing set -back of 35 feet. It appears the home is 42feet off the right of way right now. With the 8 foot addition on the front we are lookingfor a 1 to 2 foot infringement on that required set back. With the angle of the addition,

most of the addition is within the required set back; there is only a corner of it that wouldnot be.

Sue Last- Any questions? Dan Schrader — Because the town accepted that plat 35 foot set -back that is the rule of the

land?

Steve Dunks — Yes, the least restrictive, the code or the plat, is what we allow for the set-

back.

Sue- Mr. Lindgrin, are you adding 7 or 8 feet to the front of your garage? Chris Kidd- based on our last decision you want a little more room for your cars on the

flat spot so you are asking for 5 inches of variance. 7' 5". Tim -7' 5"

Sue- Is this your builder?

Tim- Yes.

Sue- Would you state your name? And do you wish to make any comments? Chris Kidd- owner of Kidd Construction LLC, Green Bay, I am here for support. I will bedoing the work at the property. Sue- We are only concerned with the construction on the outside of the home; the garageis what board is considering. 7. 5 feet is what you are asking for. Dan- Approximately how far across the front of the garage do you go before it comes incompliance?

Chris- Only about 6 feet that will be part of the variance infringement. It got smaller andsmaller as we investigated because the owner wanted the flat spot for the vehicles; theydo not want the wheels starting to go down the slope. Sue- any questions. Jack- no questions.

Sharon- I don' t have any questions. Sue- Have you had any conversations with or comments from your surroundingneighbors?

Tim- Nobody has come to me. Sue- Steve, have you heard from anyone?

Steve- I have heard from no one.

Chris- I have noticed neighbors since the posting and they are very friendly walking by.

Sue- Any thoughts? I am thinking this will infringe very little on the set -back; itprobably will not be noticeable. Dan- It is only a corner. Sue- It' s just a small area; the entire front of the garage will not infringe on the set -back.

If we don' t have any discussion on it then I will entertain a motion to approve or deny thevariance request.

Background

A home already exists on this proposed lot. The required road frontage comesfrom the western end of the parent parcel which fronts on Mulligan Way. Thisfrontage remains on the parent parcel keeping it conforming. Because the parent is larger than 10 acres, we do not require it to be shown on the

CSM. Although Brown County is likely going to ask that it is shown because it islocated with -in the sewer service area.

The building set -back in this area is 35ft, not 40. This needs to be corrected. Staff believes the western part of Mulligan Way has already been dedicated andshould not be labeled " Future".

The eastern dedication of Mulligan Way does not seem to serve any purpose. Eastof that is entirely wetlands and will not be developed under today' s regulations. The southern property owner does not have room for a home on that parcelwithout a variance as the wetlands impact the buildable area. They also would notsee any land division in the future. Bar Harbor Lane is a road with questionable use in the future. The wetlands will

make any development heading north difficult. Any development of the propertiesto the northwest will likely have their access from Velp Ave. and not useMulligan as an access. Without a wetland delineation it is difficult to determine

the number of lots for future development, but as it appears, it may take 75 Oft ofroad to gain 2 lots. The approved ADP for Chambers Hill Farms is showingconnection of this road to the rest of the development.

Approval of the " Bar Harbor" road name has not been given by DEOKowalkowski yet.

Fiscal Impact

A parkland fee of $300 for the one lot created is required.

A developers agreement will be required for construction of any additional dedicatedroads

Suggested Motion

To recommend approval of a'.one' lot CSM for William Chambers III, as prepared byMike Soletski, on parcel SU -633 with the following conditions;

1. Correct the building set -back to 35ft2. Correct/eliminate " Future" on the western part of Mulligan Way3. Payment of a $300 parkland dedication fee

4. A signed Developers .agreement for the construction of any additional dedicatedroads

5. Meet the requirements of all other applicable ordinances, regulations and

reviewing agencies

Background

A conditional use permit was issued in 2014 for Non-metallic mining operationsThe operation was approved to be seasonal running from April 1st to November20th

Dust control has be an issue this spring. The site was also found to be larger thanthe 5 acres. The applicant did work with staff to limit the exposed areas as much

as possible and will re -seed areas as soon as they are complete.

Staff did receive letters from 3 area contractors expressing their desire to have thepit open year round. Last year, because of lack of frost, the pit was operational

thru the winter. We did not appear to have issues because of that other than

equipment running through the night to avoid the issues with starting up in thecold. Staff does not foresee any other issues from year round operations. The hours of operation being altered to a 6: 30am start does concern staff. Wehave had complaints about equipment running as early as 6: 15am. Mr. Nelson hassaid that this was to water the site prior to the lam start and, in colder weather, to

warm the equipment up for proper operations. By rolling back the start time 1/ 2hour will we then see the prep work beginning as early as 5: 45?

Recommendation Staff is not making any recommendations at this time.

I would like to request to make two modification to the Lee Nelson Sand permit.

1.) Because of all the home and commercial construction in the area now, Lee has a high demand for sand year

round and even had to turn many customers away due to the pit being closed during the winter months. Wewould like to change the permit to be able to operate all year round.

2.) Again because of all the activity with home and commercial construction projects, contractors are needing toget material earlier in the morning. We would like to request to change the AM hours from a start time of7: 00 am to 6: 30 am

Can you please review this request and place me on the proper agendas to get that process going ASAP.

I am writing to ask that you allow Nelson Sand & Stone to continue operations on a year round basis.

As a local excavating contractor, Nelson Sand & Stone has been a company we obtain our sand materials from for many

years. We use the Flintville Rd Sand Pit for many residential and commercial projects. Some of our projects require work

to be done after December 15t, and we have been relying on the Flintville Rd Sand Pit to obtain our sand and fill

materials during that time.

I am also a Village of Suamico resident, living one mile away from the Flintville Rd Sand Pit on Mardon Lane. As a village

resident, I do not have any issues with Nelson Sand & Stone operating on a year round basis. I' ve always noticed on my

daily commutes to and from work, that the section of Flintville Rd/ County Rd M in front of the entrance to the pit is

always kept clean from any materials on the roadway.

Steve,

It has been brought to my attention, that the Village of Suamico will be holding a hearing about the Nelson Sand Pitstaying open year round. I would like you to consider the impact and how it would affect the Town of Suamico if it isforced to close during the winter months. We purchase a large portion of the fill and sand material we use in theSuamico area from this pit. Because of the close proximity to our job sites. But if this pit closes during the winter monthswe will be forced to haul from a much farther location. We will then have to pass that cost onto the customer. If theyare unwilling to pay that additional cost we will end up having to put that work off until spring. And be forced to lay offemployees who would normally work in the winter. (many who are Suamico residence) By putting off the hauling untilthe spring months you will be putting undo stress on the Village of Suamico roads. If the material could be hauled in thewinter it would be easier on the roads while there is frost in the roads. Also I would think that the property owners nearthe pit would rather have the fill hauled out during the winter months, because most of the time their windows wouldbe closed and not spending as much time out side. Any of the fill that is hauled out during the winter will not be there tohaul out in the summer. Nelson Sand and Gravel does a great job maintaining this pit. I would go as far as to say it is thebest maintained pit in this area! There are many other reasons that I would like to bring up at the hearing and I wouldlike to be informed when this hearing is going to be held. Thanks again for considering my concerns.

Peters Concrete Company is in support of extending the dates of access to the Nelson Sand & Stone Pit on Flintville Road

for sand and fill material. The demand for sand and fill continues to grow with the growth of the communities in the

Suamico area. At the same time the availability of sand and fill continues to diminish putting a greater demand on thesites that have this material or requiring that material be hauled from a longer distance away to the Suamico area. Thedemand for sand and fill material is year around and extending the dates of access to the Nelson Sand & Stone Pit would

help address this demand from the local area.

Background

At the June 8th meeting the Commission asked staff to look into creation of aMarina zoning to cover the operations of private/public marinas and sailing clubs. Staff looked at what Green Bay, Ashwaubenon and other area communities havefor zoning for their marina type operations. The area communities use theConditional Use permits for their locations. Sturgeon Bay is the only one foundthat actually has it as an allowable use in multiple Business zonings. Taking that into consideration, staff is suggesting working with Mr. Howitt dooutline the expectations of the future of Shipyard and developing a PDD toencompass the operation including possible future buildings, vegetative bufferrequirements, building materials/elevations and decorative fencing to allow thisbusiness to continue to prosper yet address some ofthe neighborhood concerns.

Staff has not received any additional information to consider on the history of thissite.

Background

18. 09 ( 12) ( e) reads " There shall be a common wall. Wherever improvements abut

on the common boundary line between adjoining units, there shall be a one ( 1) hourfire wall running from the lowest floor level, including the basement if it is thecommon wall, to the underside of the roof sheathing. Such basement wall, if any, shall be waterproofed masonry." The State Uniform Building Code (UDC) does not allow a municipality to be morerestrictive in their code than that of the UDC unless we petition and are granted

approval for such.

e) is more restrictive than the UDC. Staff does not believe we could prove any goodreason to be granted any exception to allow us to be more restrictive, therefore staff isrecommending removal of that section of the code.
