Answers to your most asked ADA questionsQ: Does my pool need a pool lift?A: Any commercial pool under 300 linear perimeter feet must have a sloped entry/zero depth entry or a pool lift. Any commercial pool with greater than 300 linear perimeter feet must have two forms of access, one of which must be a pool lift.
Q: Are there any tax credits or deductions to help me comply?A: Yes. Eligible small businesses may take a credit of up to $5,000 to offset their costs for access. Businesses of all sizes can take a business expense deduction of up to $15,000 per year for costs of removing barriers in facilities.
Q: What does the ADA law require you to do?A: 1) Modify policies and practices that discriminate against people with disabilities
2) Comply with accessible design standards when constructing or altering facilities3) Remove barriers to equal access in existing facilities when readily achievable
Q: I have multiple pools; do they all need an access point?A: Each pool is to be ADA compliant and readily accessible by people with disabilities. If multiple spas are in close proximity to each other and serve the same purpose, only 5% or no less than one would need to be compliant. Due to many variances in codes, we suggest that you check with your local code authorities for clarification.
Q: Who enforces the ADA?A: 1) For new construction, the plans should be drawn up according to local and federal requirements. Local code authorities will review, inspect, and enforce them.
2) For existing construction, enforcement will typically be through individualsworking with the U.S. Department of Justice.
Q: When is the deadline for meeting the new ADA standards?A: The ADA laws are now in full effect.
