Introduction by Janet Love Twentyyearsago,theCanonCollinsTrust(CCT),asitthenwas,offeredmeascholarshiptostudyZuluandEconomicsattheUniversityofSouthAfrica.AtthetimeIwasdeeplyinvolvedinthesuccessfulnegotiationstobringaboutSouthAfrica’stransitiontodemocracy.Afterspendingtimeinparliamentandtheningovernment,IbecameNationalDirectoroftheLegalResourcesCentre(LRC)in2006.

TheLRCisanot-for-profitpublicinterestlawfirmestablishedin1979.Weworktobuildafullydemocraticsocietyandtoensurethattheprinciples,rights,andresponsibilitiesenshrinedinournationalconstitutionarepromoted,protectedandfulfilled.

FormanyyearstheLRCwassupportedinthisworkbytheLegalAssistanceTrust(LAT)intheUK.TheLATraisedfunds,madefriendsanddeliveredsupportinkindininnumerablewaystotheLRC.WeweredelightedwhenJillWilliamson,whoworkedfortheLATfornearly3decades,wasrecognisedintheQueen’sBirthdayHonours.ShewasawardedtheOBEfor“servicestohumanrightsandtheruleoflawinSouthAfrica.”OurthankstoJillandallthesupportersandtrusteesofLATforalltheyhaveachieved.

ThemergerofCCTandtheLATtoformtheCanonCollinsEducationalandLegalAssistanceTrust(CCELAT)broughtnewstrengthstoourcollectiveendeavourandintheyearunderreviewourcollaborationhasbroadenedanddeepened.BothweandCCELATshareacommitmenttotheidealsdescribedabove.Iamdelightedthat,throughitsnetworksofscholars,itssupportforhigh-levelimpactresearch,itscommunicationsanditsfundraisingCCELAThascontinuedtheworkofbothCanonCollinsTrustandtheLegalAssistanceTrust.

Weliveininterestingtimes.Despiteourconstitution,inequalityremainsdeeplyentrenchedinSouthAfrica.AttheLRCweseektouselawasaninstrumentofjusticeandtherebytocontributetothesocio-economictransformationofourcountry.IlookforwardtocontinuingthisworkwithCCELATtoachievethethingsweallholddear.

Earlyin2013welaunchedanonlinesystemforthoseapplyingforourscholarships.Ithasbeenagreatsuccess.Itsaveswould-bescholarsconsiderableamountsofmoneyinpostageandcouriers,anditmakesouradministrationandassessmentprocessesquicker,moreefficientand,Ihope,fairer.

Thenumberofapplicantscontinuestointimidateandinspireinequalmeasure.WhenweinvitedapplicationsforscholarshipstostudyatpostgraduatelevelintheUKin2013-14,wereceivednearly400applications.Togetherwithourpartners,includingseveraluniversities,theCheveningprogramme

andtheGraçaMachelTrust,wewereabletomakeonly22fullawards.CompetitionforthosewishingtostudyinSouthAfricaisevenhigher.IamwellintomythirdyearatCanonCollinsandinthattimewehaveawardednearly200scholarships.Iamveryproudofthesescholarsandtheopportunitiesweareabletogivethem.ButIamalsoacutelyawarethatinthesameperiod,wehaverejectednearly5,000applications.

Thisisnocausefordespondency;ratheritisanopportunityforusandforotherstomeetthehungerforeducationthroughoutsouthernAfrica.AttheTrustweseethis,forexample,intheworkofEqualEducationwhichcontinuestomobilisecommunitiesacrossSouthAfricaindefenceoftherighttoagoodeducationforall.IwasparticularlypleasedthisyearthatwehavebeenabletocreatetheCanonCollinsEqualEducationScholarship.

Ouronlinesystemletsusunderstandthishungerbetter.Ofthe90,000peoplewhovisitedourscholarshipspagesinthefirstsixmonthsof2013,forexample,15%accessedthesiteontheirmobiledevices.Ofthese,nearlyone-fifthwereusingiPads.Wealsohaveaclearerpictureofthedemographics.20%ofourvisitors–but40%ofourapplicants–comefromSouthAfrica.Zimbabwe,MalawiandZambiaarenextandthisisreflectedintheprofileofourawards.Fortunatelytheinternetcannotyettelluswhetherourvisitorsaremenorwomen,butIamdelightedthatboththroughourownprogrammesandthroughourassociationwiththeGraçaMachelTrust,roughly60%ofourawardseachyeararetowomen.

OthershavediscussedelsewhereinthisReviewtheimpactofthemergerofCanonCollinsTrustandtheLegalAssistanceTrusttoformtheCanonCollinsEducationalandLegalAssistanceTrust.Iwanttosaythankyoutoallthosewhomadetheprocessofthemergersosmoothandwhohavecontinuedtoworkwiththeneworganisationtofurtheralltheobjectivesweholddear.JillWilliamsondeservesspecialmention.IwasthrilledwhenJill,whogavesomanyyears’servicetotheLAT,wasrecognisedintheQueen’sBirthdayHonours.

ThemergerenabledtheTrusttoexpandtherangeofitswork.Webecameclosepartners,forexample,withComicReliefwhoformanyyearshavesupportedtheworkoftheLegalResourcesCentre.ButIamparticularlypleasedthatwehavebeenabletostartsupportingspecificpiecesoflegalresearchtounderpinlitigationandadvocacybytheLRC.

FormethehighlightoftheyearinreviewwasourconferenceinJohannesburginMay.AttheTrustwebelievethatpeopleactmosteffectivelywhentheyacttogether.TheconferencewasthebestexampleoftheTrustcontinuingtoinvest inourscholarsandtheir–andbyextensionallofour–futures.

Noneofthiswouldbepossiblewithoutoursupporters.TheTrustcontinuesbecauseweareheirstooneofBritain’sgreatpost-warsocialmovements.Wehavenoassetsandnoinvestmentincometospeakof.ButwhatwedohaveiswhatIcalla“people’sendowment”,averyspecialpieceofmoneyprovidedbythousandsofpeoplegivingsmallamountseverymonth.Wehopeweuseitwisely,andwethankyouforit.

PatriciaJillWilliamsonwasawardedtheOBEintheQueen’s2013BirthdayHonourslistfor“servicestopromotinghumanrightsandtheruleoflawinSouthAfrica”.JillisoriginallyfromSouthAfrica,wheresheworkedasajournalistbeforeemigratingtotheUK35yearsago.ShewashonouredforherservicesaschairandtrusteeoftheLegalAssistanceTrust(LAT),whichsupportedtheworkoftheLegalResourcesCentre(LRC)inSouthAfricafor25years.SirSydneyKentridge,bestknownforhisroleastheBikofamilylawyer,andLordJoelJoffe,theattorneyinstructingthelegalteamthatdefendedNelsonMandelaandcolleaguesintheRivoniaTrial,werefoundingtrusteesoftheLAT.JillhadbeenitsDirectorandtookovertheexecutiverolewhenSirSydneysteppeddowntenyearsago.TheLegalResourcesCentrebenefittedfrommorethan£8millionraisedbytheLATover25years,largelythroughtheeffortsofJillherselfandherassistantsfromhersmallofficeinhergarden.Inrecentyears,theLAThasbeentherecipientofsignificantfundingfromComicRelief,todefendtherightsofthosesufferingfromHIVandAIDSaswellassupportingcampaignstoeliminateviolenceagainstwomenandchildrenandprotectingtherightsofslum-dwellers.Lastyear,theLATmergedwiththeCanonCollinsTrusttoformtheCanonCollinsEducationalandLegalAssistanceTrust(CCELAT),whichJillcontinuestoserveasaBoardmember.

WebelievethatsouthernAfrica’sdevelopmentdependsonstrongleadershipinkeyfields.Ourscholarsareoutstandingacademicsandprofessionalswhoarededicatedtothedevelopmentoftheircountries.Weseektoinvestinthosewhoshareourcommitmenttosocialjusticeandwhocandemonstratetheirintentiontoreturntotheirhomecountriesaftertheirstudy. In2012wewelcomed56newscholarsacrossallofourpriorityareas,expandingournetworkofvisionaryleadersacrosssouthernAfrica.WealsoincreasedourpresenceinLusophoneAfrica,withtennewscholarsfromMozambiqueandourfirstAngolanscholarsince2004.

WewereproudtoseethefirstscholarsstartonthreenewschemesintheUK:theGreenMatterFellowships,theSOASScholarships,andtheQueenMaryPublicHealthScholarships.

Wealsoestablishedseveralnewpartnershipswhichwillstartsupportingscholarsfromnextacademicyear:

OurfirstscholarunderournewpartnershipwithSOASwasKeithMudadi,whostudiedforanMScinFinanceandDevelopment.Keith,whoworksatZimbabwe’sMinistryofMiningDevelopment,seesminingaskeytohiscountry’seconomicrecovery.Heisinterestedinworkingonwaystointegratecommunitiesaroundminesintotheeconomy.

“Being a Canon Collins scholar is a privilege that few people are lucky enough to get. There are a lot of other deserving students out there whose choices are very limited. There are hundreds of millions of young people in Africa living under the age of 25 who yearn for an opportunity like this. So many students feel hopeless at the thought of not being able to come to Europe and do a Masters degree, and many give up looking for sources of funding despite meeting the academic requirements to be admitted to some of the top universities here in Europe. Canon Collins has made quality education possible for hard-working, ambitious students such as me.

This scholarship has given an opportunity to learn, an opportunity to be part of a success story in Africa. I think I now have a voice and some kind of authority to contribute to developmental issues in my country.

Profile:LindelaResearchGrant

Towardstheendof2012theTrustmadeagranttotheLRCforresearchattheLindelaRepatriationCentrenorthofJohannesburg.LindelaisthemainfacilityforthedetentionofmigrantspendingdeportationandismanagedbyaprivatecompanyundercontractfromtheDepartmentforHomeAffairs.

Thereweretwopartstotheresearch.Thefirstwasanimmediateresponsetoindividualcasesofpeoplewhohadbeensubjectedtounlawfuldetention. Thesecondwasanattempttoaddressthesystemicissuesraisedbytheindividualcases.

TheLRCwasabletogainaccesstothefacilityand56casesofunlawfuldetentionwereidentified.39ofthesepeoplewererepresentedbytheLRCinanapplicationbroughtagainsttheDepartmentofHomeAffairson2November2012.Ofthese,26werereleasedby9November.

ThesecondpartoftheapplicationrelatedtothesystemicissuesatLindelawillbeheardintheSouthGautengHighCourtinlateAugust2013.

Law in Action at the LRC

TheLRCisaSouthAfricanpublicinterestnotforprofitlawfirmthatusesthelawasaninstrumentofsocialjustice.Foundedin1979,itworkswiththoseingreatestneed,providingfreelegalservicestopoorandmarginalizedcommunitiestosecureanddefendtheirrightsandovercometheirvulnerabilitiesaswellasadvocatingforlegalandpolicyreform.Itsfocusareasincludelandrights,socialsecurity,housing&planning,womenandchildren,environment,civilsociety,refugees,accesstojusticeandconstitutionallaw.CCELATworkstosupporttheLRCthroughprojectwork,researchandappliedscholarship.

LegalActionResearchFellowships

Ournew“ActionResearch”fellowshipswerelaunchedin2012inpartnershipwiththeLRC.Thesehaveprovedtobeapowerfulwaytouseourscholars’academicexpertisetoinfluencerealchangeinSouthAfrica.

The LRC is part of the Commission of Enquiry into the tragic events at the Lonmin mine at

Marikana in August 2012. The LRC represents the family of one of the victims and the

Bench Marks Foundation, which monitors corporate responsibility performance against

an international measuring instrument.

AccessingtheRightsofPeopleInfectedandAffected by HIV and AIDS

TheLRCactsassectorleaderintheSouthAfricanNationalAIDSCouncil’sLegalandHumanRightsWorkingGroup,whichisthemainbodyholdingthestatetoaccountfortheimplementationoftheNationalStrategicPlan(NSP).ActivitiesincludemonitoringprogressagainsttheNationalStrategicPlantargetsrelatingtoviolenceandstigma,particularlyagainstwomen;assessingchallengesandproposalsregardingaccesstolegalservicesforHIV-relatedcases,andexpandingtrainingprogrammesrelatedtoHIVandthelaw. ComicReliefiscurrentlysupportingathreeyearprogrammeattheLRCtoscaleupaccesstojusticeforpeopleaffectedbyHIVinSouthAfrica.InadditiontoitsworkwithSANAC,theLRC’sactivitiesunderthisgranthaveincludedassistingpeopleinfectedandaffectedbyHIVtoaccessresourcessuchasdisabilitygrants,childsupportandfostercaregrantsforchildrenorphanedbytheepidemic.TheLRChasalsoassistedpeopletoaccesstheirrightstomunicipallandallotmentsinordertostrengthenfoodsecurity,participatedinasurveyofhome-basedcareworkers,defendedpeoplelivingwithHIV/AIDSagainstdiscriminationintheworkplace,andworkedtowardssecuringARVprovisionforrefugeesandasylumseekers.

The HIV/AIDS grant is one of three current grants during the year in review from Comic Relief

to the LRC via CCELAT. The other two programmes are targeted at fighting gender-based

violence and securing access to justice for urban slum dwellers. The approach combines legal

advice & training, legal representation in court for individuals and civil society organisations,

and policy/advocacy work.

for residents of Joe Slovo settlement, which

used to be a squatter camp.

Ioftenaskmyundergraduatestudentstoexplainwhatis“common”intheCommonwealthnations,togetthemtothinkaboutthehistoryofAfrica,thechallengesitfaces,anditspossiblefuturesinthetwentyfirstcentury.Theideaofa“commonwealth”IrefertohereisnotthatofJeffreySachswhoseconcerniswiththeeconomicsystemandprinciplesforourplanet.Rather,itisaboutacrowdofscholarswhoarethetorch-bearersofAfricaintheworldofnations.

InhisinaugurallectureasLSE’sChairinAfricanDevelopment,entitled“RunningWhileOthersWalk:KnowledgeandtheChallengeofAfrica’sDevelopment*”,ThandikaMkandawirenotedtheintersectionbetweenknowledgeanddevelopmentinAfricainawaythatchimeswiththevisionandactivitiesoftheTrust.HeremarkedthattheenhancementandutilizationofAfricanresearchareintheself-interestoftheAfricanistcommunity,andthatAfricanistscholarsmustsupporttheircounterpartsintheiracademicpursuitandstrugglesinthecontinent.Thiswouldbepossible,hesuggested,ifuniversitiesinAfricaweretocreateautonomousspacesforinteractingwitheachothertocreatea“commonwealthofscholars”.

WhileAfricanuniversitieshavetheirroletoplayinfosteringAfricanscholarship,Ibelievethatweshouldfindotherinnovativewaysforcreatingthespacesnecessaryforsucha“commonwealthofscholars”.FormetheTrust’s“ScholarshipinAction”ConferenceinMaywasthefirststeptowardscreatingaproductivespacein

whichourscholarsfromsouthernAfricastudyingatdifferentuniversitiescouldmeet,exchangeideasandreflectonthecurrentstateoftheircountriesandcommunitiesinordertoputscholarshipintoaction.TheConferenceofferedyoungscholarstheopportunitytofindanddeepentheirplaceintheproductionofknowledge.Thepowerofknowledgedoesnotonlyrestintheoreticalgroundingorempiricalmaterialbutislargelydependentonhowthesearetranslatedintohumanthoughtandpractice.EveryCanonCollinsScholar’sworkshouldfeedintothesethoughtsandpracticesbyintentionratherthandefault,andshouldhelptoshiftthebalanceofpowerinsociety.

Inadditiontothecreationofspacesofengagement,thecreationofa“commonwealthofscholars”inandforAfricarequirestwootherconditions:thefundingtodotheresearchandtheclarityofthepurposeforwhichknowledgeisproduced.CCELATdevotesmuchofitstimeandenergyraisingfundsforscholarshipstosupportpostgraduatestudiesin10southernAfricancountries.Theperceptionthatpostgraduatestudiesisaluxuryinthefaceofhugedemandsforpreparatoryandprimaryschoolingismisplaced:postgraduatestudiesprovidehighlevelskillswithoutwhichnocountryintheworldisabletodevelop.Providingbetterinfrastructurewithoutengineers,betterhealthcarewithoutmedicalspecialists,andbettereducationwithoutqualifiedteachersissimplynotpossible.CCELATisbuildingacommonwealthofAfricanscholarswhoseknowledgeandexpertise

AreviewpublishedbytheAssociationofCommonwealthUniversities† earlierthisyearhighlightstheneedtosupportdoctoralstudiesinAfricatoachievethetwingoalsofupgradingthequalificationofexistinguniversitystaffandtrainingandretainingnewresearchers.TheTrustcontributestoimprovingthequalificationofteachingstaffbyofferingscholarshipsatPhDlevel,butthisisadropintheocean.Post-secondaryeducationisentirelydependentontheavailabilityofteachingstaffholdingpostgraduatequalifications.ItisunthinkablehowracializeduniversitiesinacountrysuchasSouthAfricawillundergomeaningfultransformationiftherearenocrediblepostgraduatestudentstotakeupacademicpositionsandcompetenationallyandinternationally.OpeningupuniversitiestotheunderprivilegedinSouthAfricaorelsewherewillfailtocontributetosocialequalityifthestudentsendupinthehandsofunder-qualifiedlecturers.

and then started working within the human rights movement. In 2002 I was given a scholarship under the auspices of the Canon Collins Nelson Mandela Scholarship. This allowed me to further my legal studies and a career in international human rights by enabling me to do an LLM in International Human Rights at the University of London. For a black woman like me this was a critical game-changer in my life and I remain committed to supporting other students who come from disadvantaged backgrounds in order to allow them to pursue their studies.”

Dr Kwalombota Kwalombota from Zambia runs the London Marathon in April 2013 in support of

the Scholars’ Scholar Campaign. Kwalombota studied on a Canon Collins Scholarship at Queen

Margaret University in 2007-2008 and is now a public health consultant.

AGLITwasestablishedtoincreaseaccesstoeducation,healthawarenessandincomegenerationopportunitiesforyouthwhohavedroppedoutofschoolinruralMalawi.Manyyoungergirlshavebeenabletore-jointheschoolsystemasaresultoftheirparticipationinAGLITliteracyandnumeracylearningprogrammesestablishedintheChikwawadistrict.

In2012anewgrantfromtheUKDepartmentforInternationalDevelopment(DfID)toCanonCollinsTrustenabledAGLITtoextenditsreachtotwomoredistrictsseverelyaffectedbyschooldrop-out–NenoandMwanza.60LearningCentreshavebeensetup,andareprovidingastructuredlearningprogrammethatoffersout-of-schoolgirlsandboysanopportunitytoattainbasicskillsandeitherreturntoupperprimaryschool,orifthisisnotpossible,bettersupportthemselvestherebyendingthecycleofpovertyintheircommunities.Overthecourseofthethreeyearprogramme,thisprojectwilldirectlybenefit2700youthin90communities.

Aspecialemphasishasbeenplacedonaddressingtheneedsoflearnerswithdisabilities–agroupoflearnerswhoareoftenmarginalisedanddropoutasaresultoftheirdisability.Facilitatorshavebeentrainedtoaddresstheseneedssothattheselearnersalsoenjoythebenefitsofeducation.

SmallProjectsFoundation,EasternCape,SouthAfrica

IntheEasternCape,wecontinuetoworkwiththeSmallProjectsFoundation(SPF)toenablecapacitybuildingofeightcommunity-basedorganisations.Thesegroupsofcommunityhealthworkersareonthefrontlineofenormouspublichealthchallenges,linkingpeopleinremoteruralareaswithclinicsandotherservices.Theeightorganisationswearetrainingareeachreachingupto2000orphansandvulnerablechildren,600HIVpatientsand500tuberculosispatientsin1500households.Theyreceivetailoredcapacity-buildingandtrainingfromSPF,includingspecialisedmodulesonpreventionofmother-to-childtransmissionofHIV,careoforphansandvulnerablechildren,andvoluntarycounsellingandtesting.Asaresultoftheseenhancedprogrammes,oneorganisationhasreporteda300%increaseinpeoplecomingforcounsellingandtestingforHIVinthepastyear.

GiyaniScience&CareersCentre,Limpopo,SouthAfrica

Attheendof2012weweregratefultoreceiveagrantfromJPMorganforsupporttotheGiyaniCareersCentre.TheCareersCentreoffersimportantadviceandinformationtostudentsastheymakekeysubjectchoicesinhighschoolwhichaffecttheireligibilityforfurtherwork,studyandtraining.Sinceitopenedin2011,abouttenthousandlearnersatoverahundredschoolshavepassedthroughitsdynamictrainingprogramme.JPMorgan’snewgrantwillenabletheCentretoextenditsservicestothreenewtargetgroups:primaryschools,teachers,andthegeneralpublic.AnintensiveteachertrainingprogrammeiscurrentlyunderwayinpartnershipwiththeprovincialDepartmentofEducation,andnewservicesareopeningsoonforunemployedyouthandprimaryschools.Inadditiontoexpandingitsworkinthecommunity,theJPMorgangranthasalsoenabledtheGiyaniCareersCentreteamtorolloutaMonitoringandEvaluationProgrammeandtwosustainabilityinitiatives:aNetworkingandPartnershipsProgrammeandaCapacityBuildingProgramme.Thesenewprogrammeshaveenabledstafftotraveltoconferencesandtrainings,takepartinaparticipatorySkillsAudit,anddesignacapacitybuildingprogrammetailoredtotheirneeds.
