Roberts, Jr. Members of the Joint Budget Oversight Committee Dear Governor Corzine, Senate President Codey, Speaker Roberts, Senator Bryant, Assemblyman Greenwald, Senator Kenny, Senator Lance, Assemblyman Malone, Assemblywoman Pou: The report that follows complies with the requirements of the Educational Facilities Construction and Financing Act (EFCFA or Act) for an annual report for the fiscal year ended June 30, 2006. The report has been prepared with the cooperation of, and the information supplied by, our colleagues at the Schools Construction Corporation, the Economic Development Authority and the Department of the Treasury. The content of this annual report confirms that FY 2006 was very much a year of transition in the life of New Jersey’s school construction program, still one of the nation’s most ambitious. First, Governor Corzine has confronted the visible challenges of the program with a pledge to reauthorize new funds only after the governance, management, and financial control issues widely discussed are fixed. To this end, his Executive Order #3 created an interagency working group to review these issues and the status of efforts under way to correct them, and to make concrete recommendations for revising EFCFA and for new funding. The group will report to the Governor shortly. In this year of transition, DOE and the SCC are reviewing their processes to improve upon and re-enforce the foundation of the school construction program. EFCFA needs to be revised to reflect the experience of the last six years and to introduce additional means for undertaking school construction in the most densely populated cities in the nation’s most densely populated state. Moreover, the Department is pledged to implement the educational priorities set forth by the New Jersey Supreme Court and the Legislature in its enactment of EFCFA: healthy and safe facilities, expanded preschool opportunities and a reduction in overcrowded classrooms.

I. Background The Educational Facilities Construction and Financing Act (EFCFA or Act), P.L. 2000, c.

72, authorized $8.6 billion to school districts to initiate the largest, most comprehensive school construction program in the nation. The Act established a new Preschool-12 school facilities construction and financing program through the Department of Education (DOE) and the New Jersey Schools Construction Corporation (SCC) (established pursuant to N.J.S.A. 34:1B-159 and by executive order as a subsidiary of the New Jersey Economic Development Authority (EDA)).

Under EFCFA, the Office of School Facilities (OSF) of the DOE is charged with ensuring that proposed facilities are designed to provide for the delivery of a “Thorough and Efficient” education, as defined by the Core Curriculum Content Standards (CCCS).

The OSF must approve each district’s five-year Long Range Facilities Plan, and the individual projects in that plan. As each district’s plan is implemented, the OSF has approval authority for schematic and final designs, site acquisitions and temporary facilities (swing spaces) associated with individual projects.

The SCC manages the predevelopment services, design and construction for all Abbott districts, Level II monitoring districts and districts having a district aid percentage (DAP) of 55% or over in State aid for education. However, these districts themselves may manage projects with final eligible costs of less than $500,000 pursuant to N.J.S.A. 18A:7G-13(a) (“Section 13A Grants”).

The SCC funds one hundred percent of the eligible costs for approved school facilities projects in the Abbott districts, and funds the State share of such school facilities projects in the over 55% DAP districts and Level II monitoring districts.

The SCC also administers grants for school facilities projects in districts receiving less than 55% State aid for education pursuant to N.J.S.A. 18A:7G-15 (“Section 15 Grants”). These districts manage their own construction unless they elect to have the SCC undertake the construction pursuant to N.J.S.A. 18A:7G-5(b).

II. Requirements of the Annual Report The Act requires the Commissioner of Education to prepare an annual report on the

school facilities construction program, as set forth below:

N.J.S.A. 18A:7G-24 Annual report on school facilities construction program.

The commissioner, in consultation with the State Treasurer, shall annually submit to the Governor, the Joint Budget Oversight Committee, the President of the Senate and the Speaker of the General Assembly a report on the school facilities construction program established pursuant to the provisions of this act. The report shall be submitted no later than August 1 of each year and shall include, but not be limited to, the following information for the prior fiscal year: the number of school facilities projects approved by the commissioner pursuant to section 5 of this act; the number of projects constructed by the authority and the amount of time that it has taken the authority to complete those projects; the aggregate principal amount of bonds, notes or other obligations issued by the authority for the State share of construction and renovation of school facilities and whether there is a need to adjust the aggregate principal amount of bonds, notes or other obligations authorized for issuance pursuant to subsection a. of section 14 of this act; the number of projects constructed by districts; the number of demonstration projects

approved; the number of approved projects which exceeded the facilities efficiency standards, the components of those projects which exceeded the standards, and the amount of construction by individual districts and Statewide estimated to have exceeded the standards; and recommendations for changes in the school facilities construction program established pursuant to this act.

III. Annual Report of the School Facilities Construction Program for Fiscal Year 2006 As required by N.J.S.A. 18A:7G-24, the Commissioner issues the following report for

fiscal year 2006:

A. The number of school facilities projects approved by the Commissioner pursuant to section 5 of this Act. The OSF reviews and approves both educational and non-educational school facilities

projects. A non-educational project typically involves the rehabilitation of existing building systems such as the repair or replacement of roofs, windows or HVAC, electrical or plumbing systems. An educational project is one that affects the number, size, configuration, location or use of educational spaces, such as a new school or an addition to an existing school.

For purposes of the project approval process, the main distinction between an educational project and a non-educational project is that OSF must review educational projects for educational adequacy, by making a determination as to whether the project is consistent with the facilities efficiency standards (FES) or the applicable programmatic model in the approved Long Range Facilities Plan.

A project may contain components which are wholly or partially ineligible for State funding pursuant to N.J.S.A. 18A:7G-5g and N.J.A.C. 6A:26-3.3. If all or part of a project is not eligible for State funding, the district may either modify its submission so that the project meets the eligibility requirements, or locally fund any ineligible components. The projects contained in this report include projects which are either fully, partially or non-funded projects.

The DOE has issued the following school facilities project approvals for fiscal year 2006:

A district that is required to have the SCC manage its projects may request that the SCC conduct predevelopment activities, which could include feasibility studies, site development, demolition, design work, the acquisition of and design work for temporary facilities, the review of demonstration projects for preliminary approval, and the acquisition and remediation of land. In FY 2006, no predevelopment approvals were issued for projects in the Abbott districts or in 55% DAP and over districts, due to a lack of funding to advance new school facilities projects.

The number of school facilities actually built in any year will vary from the number approved. School facilities projects in a non-Abbott district must secure local funding for the project prior to construction, usually through a voter approved referendum. If local funding is not secured, the school district may redesign or cancel the school facilities project. If the project is redesigned, a new project number and project approval are issued. The project bidding and construction process for SCC-managed facilities will frequently result in construction concluding in a later fiscal year than the one in which approval is given.

B. The number of projects constructed by the SCC and the amount of time that it has taken the SCC to complete those projects. The following is a summary of the number of school facilities projects completed by SCC

for fiscal year 2006:

The time for completing these projects, as measured from the date of execution of the design contract to the date SCC received the temporary certificate of occupancy, ranged from 21 to 47 months depending largely upon the type and size of the project.

The data in this section of the report have been provided to the DOE by the SCC.

C. The aggregate principal amount of bonds, notes or other obligations issued by the authority for the State share of construction and renovation of school facilities and whether there is a need to adjust the aggregate principal amount of bonds, notes or other obligations authorized for issuance pursuant to subsection a. of section 14 of this Act.

EFCFA provides for a total of $8.6 billion of State-Contract bonds to be issued by the

EDA to fund all of the school facilities projects. Of the $8.6 billion, $6 billion is allocated for the Abbott districts, $100 million is for county vocational schools and $2.5 billion is for the projects in under-55% DAP districts, 55% DAP-and-over districts, and Level II monitoring districts. The $2.5 billion is further allocated for grants to the under-55% DAP districts who undertake their projects and to pay for the State share of projects in the 55% DAP and over districts which, by law, must be undertaken by the SCC.

By the middle of 2005, the SCC committed most of the monies allocated to the Abbott districts. In order to determine how to commit any remaining monies, the Board of the SCC conducted a review of the portfolio of projects and selected 59 projects to be completed. The SCC suspended work on any project that was not in construction or on this list of 59. A detailed discussion of suspended projects was set forth in the Addendum to the FY 2005 Annual Report published in February 2006. With respect to the $2.5 billion, the SCC also determined that most of such monies had already been committed either to grants for the under-55% DAP districts or as the State share for the 55% DAP-and-over districts. As a result, in July 2005, the DOE informed the under-55% DAP districts that in presenting projects for voter approval, they should request that such projects either be funded by a State grant, if such monies became available, or by State debt service aid pursuant to EFCFA. Districts which have received voter approval since September 2005 have not been able to

obtain a grant as these allocated funds have been previously committed to projects. All monies available for county vocational schools have been committed. Thus, all funds under the statutory bonding cap have been committed and no new projects can be undertaken by the SCC nor grants approved to the under-55% DAP districts until there is an increase in statutory funding authorization.

The EDA issued the following School Facilities Construction Bonds during FY 2006.

By the end of FY 2006, the EDA had issued $5,520,929,000 of the $8,600,000,000 originally authorized by EFCFA. Additional series of bonds will be issued at such time as additional cash flow is required for already committed projects.

No refunding bonds were issued by the EDA in the 2006 Fiscal Year.

The aggregate principal amount of bonds, notes or other obligations authorized for issuance needs to be adjusted pursuant to subsection a. of section 14 of the Act, or other sources of funding must be identified, for the School Construction Program to move forward. The future funding of the School Construction Program is being considered by the Governor’s Interagency Working Group.

The data in this section of the report have been provided to the DOE by the SCC.

D. The number of projects constructed by districts. A total of 377 school facilities projects were constructed by school districts in FY 2006.

Of these, 364 were constructed by under-55% DAP and vocational school districts. These numbers are based on the districts’ close-out filings of their section 15 grant with the SCC during FY 2006.

School facilities projects under $500,000 that are undertaken by 55% DAP-and-over districts and Abbott districts are funded by Section 13A grants. In FY 2006, Section 13A close-out reports were received for 3 projects from non-Abbott 55% DAP-and-over districts and for 10 projects from Abbott districts.

The projects identified in this section typically received a school facilities project approval from the OSF in a prior fiscal year. Due to the time required to design and construct a school facilities project, the numbers in this section do not correspond to the project approvals in Section III-A.

The data in this section of the report have been provided to the DOE by the SCC.

E. The number of demonstration projects approved. N.J.S.A. 18A:7G-6 permits the State Treasurer to designate up to six school facilities

projects as demonstration projects in the first three years following EFCFA’s enactment. As of June 30, 2004, all six demonstration projects had been approved by the DOE, SCC and the State Treasurer. The projects are located in the following districts:

No new demonstration projects have been approved after FY 2004 since the statutory limit had been attained.

*Non-educational projects were not used in calculating the percentage of school facilities projects that exceed the FES, although they are included in the total of school facilities projects approved.

As part of the approval process for all school facilities projects requiring educational adequacy review, whether Abbott or non-Abbott districts, OSF reviews the project for compliance with the FES. Where a project exceeds the FES, OSF must determine whether the excess spaces are eligible for State funding pursuant to N.J.S.A. 18A:7G-5g and N.J.A.C. 6A:26-3.3. If the excess spaces are not eligible for State funding, the district may either

modify its submission so that the school facilities project meets the FES, or locally fund any ineligible spaces.

The major reasons that the spaces in a school facilities project exceeding the FES may be ineligible for State funding include:

1 The spaces are of a type that are specifically identified as ineligible for State funding. These include, but are not limited to, swimming pools, greenhouses, athletic stadiums, garages, any building used for non-instructional or non-educational purposes and any facility, building, or structure used solely for administrative purposes.

2 The spaces are greater in size or number than the FES would support, such as a larger gymnasium, auditorium, or library/media center, or the project contains additional specialized spaces that cannot be justified as being necessary to support the CCCS, such as additional art, music, and science labs, yet these spaces are not justified by the school enrollment or scheduling requirements.

The OSF may approve spaces for State funding that are in excess of the FES when the district demonstrates that the additional or inconsistent space that exceeds the FES is eligible for State support for one of the following reasons:

1 The district has demonstrated a particularized need in that school facility needs related to required programs cannot be addressed within the FES and all other proposed spaces are consistent with those standards;

2 Such spaces are necessary to comply with Federal or State laws for students with disabilities who are to be educated, to the greatest extent possible, in the same building or classes with their non-disabled peers and the requirements of N.J.A.C. 6A:26-3.3(e)(2) are met;

3 Such spaces are necessary to house the district's central administration, and the requirements of N.J.A.C. 6A:26-3.3(e)(3) are met; or

4 For SCC-managed projects, such spaces represent excess grossing factor which was approved based on a determination by the SCC that it was necessary for code compliance, constructability, site conditions, etc.

A broad review of the FES is currently being undertaken by the DOE.

G. Recommendations for changes in the school facilities construction program established pursuant to this Act. A comprehensive review of the school facilities construction program along with any

recommended changes is being undertaken. Additional information regarding this review can be found in the two reports issued by the Governor’s Interagency Working Group on School Construction, issued in February and May of 2006. Shortly the Working Group will be issuing additional recommendations on funding and statutory changes to enhance the program.
