Board of Inquiry Board of Inquiry On 8 September 2015 the Minister for Planning and Local Government (the Minister) established a Board of Inquiry pursuant to the Act at the Huon Valley Council.

The Board of Inquiry was established in response to: • complaintsbycouncillorsagainsttheMayor,allegingnon-compliancewiththe functions of mayor under the Act; • complaintsbyratepayersagainstcouncillors,raisingcodeofconductandfinancial governance issues; • complaintsbytheMayoragainsttheGeneralManagerrelatingtofailuretofulfil functions under the Act; • complaintsbytheGeneralManageragainsttheMayoraboutnon-compliancewith the Act and other issues, and • complaintsbytheMayorandanothercouncilloragainsttheCouncil,raising governance and operational issues.

The Board of Inquiry under took a process of investigation and on 15 June 2016 a repor t to the Minister was released which included 55 Recommendations.http://www.dpac.tas.gov.au/__data/assets/pdf_file/0008/292535/Huon_Valley_Council_Board_of_Inquir y_Report_to_the_Minister_-_JUNE_2016.pdf

The Minister, pursuant to section 225 considered the Repor t and chose to make 7 Ministerial Directions dated 15 June 2016.http://www.dpac.tas.gov.au/__data/assets/pdf_file/0007/292534/Ministerial_Directions_to_the_Huon_Valley_Council_June_2016.pdf

Work commenced immediately on implementation of the Ministerial Directions however not all Directions were met within the required time frames.

On 6 October 2018 the Minister advised that he had recommended to the Governor that the Huon Valley Council be dismissed.

The Huon Valley Councillors were dismissed, effective 10 October 2016.

The Governer appointed Ms Adriana Taylor as Commissioner for the Huon Valley Coun-cil for a period of 12 months.

The General Manager’s contract was terminated on 14 November 2016 and a recruitment process for a new General Manager commenced.

Council at its Ordinary Meeting of 14 December 2016 approved a process and template (using tables) to be used for the finalisation of the Implementation of the Ministerial Directions and the review of the Board of Inquiry Recommendations.

Work has continued throughout the financial year on implementing both the Ministerial Directions and the recommendations from the Board of Inquiry Repor t.

The Local Government Division, on 14 June 2017, confirmed its overarching statement in relation to the comments provided in the tables: • TheLocalGovernmentDivisionismonitoringprogresstowardsthe implementation of the Ministerial Directions and Board of Inquiry recommendations which remain relevant after the dismissal of the councillors on 10 October 2016. The Division is satisfied that the Council is under taking appropriate steps and will continue to liaise with senior management on items still to be actioned. • WorkhascontinuedonthereviewoftheCouncil’sCommunityEngagement Framework.

Consultation has been completed on the Draft Community Engagement Policy and Framework and a Repor t is to be presented to Council at the September 2018 ordinary meeting.

Commissioner Taylor was reappointed for a fur ther 12 months on 17 July 2017.

The Minister required the Council to pay the total costs of the Inquiry in the amount of $336,230. This cost is being paid in three equal instalments over three years.

From the CommissionerFrom the Commissioner Ms Adriana TaylorI am pleased to be able to repor t another productive year for the Huon Valley Council.

The General Manager’s Repor t gives a good overview of both the renewal works that have been carried out in our infrastructure and also the many new facilities that have been established and built.

A fast growing population in all our townships means that the Infrastructure Depar tment will have to continue to be an impor tant par t of Council’s work and budget for the foreseeable future.

Residential development, tourism and business development growth are all strong. The co-operation of the Tasmanian and Australian Governments has been very welcome. The whole or par t funding of major projects for road and storm water improvement, recreational facilities and community services continues to be vital.

Our focus has, however, been on much more than infrastructure. We have listened to the community’s call for better communication, for facilitation of business and community projects and for caring for our environment.

The series of township forums held early in 2018, where Council’s senior staff and I had the oppor tunity to listen to your wishes and hopes were very valuable. We were given a long list of projects. Some have already been completed and some are in progress. They will all be considered and regularly repor ted on.

Innovation and ideas from staff as well as members of the community have also been welcomed.Theexcellentworkbeingdoneonminimisingwasteandresourcerecoveryisjustoneexample.

The last two years have been both challenging and rewarding. I have learnt to love the Valleyandappreciatethedeeprelationshipsthatexistherewithinourcommunity.Thisis a rare and precious quality not found in many places.

I commend the work done by the General Manager Mr Emilio Reale, the management team, the staff and community volunteers over the past year.

I look forward to the Huon Valley once again having an elected Council after Local Government elections in October

From the General Manager From the General Manager The Huon Valley Council has had a very productive year.

The organisational restructure we began last year has been completed and staff have settled into the new structure well.

Council under took to develop a Master Plan for the Huonville Ranelagh areas. This Master Plan helps set up the strategic basis for planning matters into the future and was formed from consultation and feedback received from the community.

Council has completed the successful development of Heritage Park in Geeveston. There has been increased visitation to Geeveston through the provision of an adventure playground, new toilet block, off lead dog area and barbecue and seating facilities.

Council also completed the Cygnet Skate Park refurbishment. This was funded par tly from Grant and Council funds and has created a great recreational facility in Cygnet. Council receives great feedback from the local skaters and people who visit this park from other regions.

Council moved the Visitor Information Centre from the Huon Highway to 23-25 Main Street, Huonville. The purchase of the building and land was a strategic decision to enable the move of the Visitor Centre into the CBD of Huonville and the land allows for the much needed expansionoftheMainStreetcarpark.Thisdecisionhasseenanincreaseinvisitornumbersandretail sales from the past location. There is also a significant saving to the community in the difference of paying a lease cost and owning an asset that will appreciate in value for the community.

With the State Government election held this year, Council identified a number of key priorities where financial assistance and advocacy for project suppor t was required. The key projects for the Huon Valley were identified as: • ChannelHighwayDiversion-Councilsecuredacommitmentof$7.5milliondollarsfor this diversion; • HuonvilleFloodMitigationProject(overlandflooding)–CouncilsecuredaFederal Government grant of $1.64 million and a $1 million interest free loan from the state; • FranklinForeshoreandRehabilitationDevelopment–Councilhassecured$750,000for this project; • RoadSafetyHuonHighway–TheDepar tmentofStateGrowth(DSG)hasallocated $1.5 million for road safety improvements; • FarSouthTouristRoute–DSGhasallocated$12.5millionforsealingofHastingsCaves Road; • ArveRoad$2.0millionforsafetyimprovements; • MountainBikeTrailFeasibilityStudy–Councilhassecured$80,000forafeasibilitystudy, and • HuonRiverForeshoreSharedPathway-Councilhassecured$80,000forafeasibilitystudy.

From the General Manager From the General Manager TheCommissioner’stermwasextendedbyoneyearbytheGovernertoandprovidestabilityand consistency whist I under took the restructure. This is Commissioner Taylor’s last Annual Repor t before elections are held in October this year.

OnbehalfoftheExecutiveLeadershipTeamandallCouncilstaffIwouldliketothank Commissioner Taylor for her work over the last 2 years. Commissioner Taylor has been acknowledged by the community for bringing people together and listening to community concerns. Her professionalism and diligence have left the Council in a better position as we look forward to the upcoming Council elections.

I would also like to thank all of the Council’s workforce for their commitment and enthusiasm as they delivered services and infrastructure to the communities in the Huon Valley.

Special Committees of Council

The Huon Valley Council has the following special committees of Council established under Section 24 of the Local Government Act 1993:

Advisory CommitteesThe Council operates a suite of advisory committees that are usually program area focused. These committees are chaired by a Councillor and consist of community members or representatives of identified bodies. These committees are strategic in nature and are involved in either the development of a specific strategy or the implementation of a Council approved strategy. These committees are charged with the responsibility of formalising recommendations to Council and have no specific delegation in their own right.

Special Committees of Council Facility Management CommitteesThe Council established management committees to assume responsibility for specific community facilities. These committees consist solely of community members and work with a high degree of autonomy. The Council has developed specific terms of reference for each of the committees and provides them with an annual financial allocation to assist with the operational costs of the facility. The Council under takes an annual audit of the accounts of each committee and a summary of their financial situation is included in the Council’s annual financial statement. Each of the committees are required to hold an Annual General Meeting (AGM). Council CommitteesThese committees have been established by the Council and consist of Councillors. The committee meetings are not open to the public, however the committees have no delegation in their own right and are charged with providing recommendations to the Council. The minutes from the committee meetings are publicly available as an attachment to the Council agenda when considered at an ordinary meeting of Council. The Governance Committee is currently in abeyance until a new Council is elected.

Audit PanelConstituted in accordance with section 85 of the Local Government Act 1993 the Audit Panel meets on a regular basis and is structured to assist the Huon Valley Council in fulfilling its corporate governance and oversight responsibilities in relation to financial repor ts and financial repor ting processes, internal control structures, risk management systems (financial and non- financial)andinternalandexternalauditprocesses.AkeybenefitofanAuditPanelisthatitprovides independent assurance on key council activities in these areas.

Geeveston Town HallIn 2015/2016, the Huon Valley Council established the Geeveston Town Hall Co Ltd. The purpose of the Company is to promote the Town Hall as an entity for the specific purpose of managing and controlling the present and future use of the Town Hall. The financial performance of this entity is repor ted in the set of Financial Statements.

Donated Land StatementThis repor t is made pursuant to Section 72 of the Local Government Act 1993. No donations of land were made by Council during the 2017-18 financial year.

Routine and required disclosuresAs soon as practicable after the end of each financial year, the General Manager is to provide details on information published as required disclosures or routine disclosures by the public authority.

Public Health StatementEnvironmental Health Statement for 2017-2018 Council’sEnvironmentalHealthUnitisresponsibleforthemonitoringandregulationof environmentally relevant activities whilst working to maintain healthy communities through public health programs such as the school based immunisation program.

OneoftherolesoftheEnvironmentalHealthUnitandanareaobjectiveofCouncilisto ensure food prepared and sold within the municipal area is safe for human consumption, meets food standards and complies with the Australian Food Standards Code. This objective is achieved through the regular inspection of food premises.

There were 205 registered food businesses in the municipal area during the 2017/2018 financial year which included permanent food premises and annually registered mobile food businesses. Additionally 38 temporary food business registrations were produced for specific events. Council’s environmental health unit conduct food premises inspections in accordance with the Australian Food Safety Assessment model for food business risk classification and inspection frequency.

A total of 121 inspections of permanent food premises were conducted during the financial year. Council’s Environmental Health Officers attended and regulated the larger events including the Taste of the Huon, the Huon Show, Cygnet Folk Festival and the Mid Winter Festival, where 125 inspections of mobile food businesses, including food vans and food stalls were conducted for compliance.

The Environmental Health Officer is also required to under take assessments for plumbing permit applications that incorporate an on-site waste water system. 132 assessments were under taken. There are three swimming pools within the Huon Valley municipal area that are offered for public use. A total of 29 swimming pool samples were submitted for analysis during the year. The results of the recreational water sampling will be compiled into the annual Recreational Water Repor t that is required to be submitted to the Director of Public Health each year.

These include businesses that are not connected to a reticulated potable water supply and offer water to the public from sources including rain water tanks, dams and bores. There were 20 businesses registered with Council under the Public Health Act 1997 as a supplier of private waterandsixregisteredcommercialwatercarriersoperatinginthemunicipalarea.Theactivities and inspections of registered private water suppliers will be compiled into the annualDrinkingWaterQualityRepor tandsubmittedtotheDirectorofPublicHealth.

The environmental health unit coordinates the School Based Immunisation Program (SBIP) in accordance with requirements of the Public Health Act 1997. Vaccination of Grade 7 students was conducted with two sessions throughout the financial year. The vaccinations included Diptheria, tetanus and per tusis (whooping cough) dTpa and the HumanPapillomavirus(Gardasil)vaccine.Meningococcal(ACWY)wasprovidedin October 2017 as well as May 2018 to Grade 10 students as well as students attending the Huon Valley Trade Training centre. The activities conducted throughout the financial year were completed in accordance with the 2017/2018 Annual Plan. Huon Valley Council Audit Panel Report The Huon Valley Council Audit Panel is pleased to be able to present its Repor t for the period ended 30 June 2018. This Audit Panel is established pursuant to Section 85 of the Local Government Act 1993 and the Local Government (Audit Panels) Order 2014.

The purpose of the Audit Panel is to facilitate: • Theenhancementofthecredibilityandobjectivityofinternalandexternalfinancial repor ting • EffectivemanagementoffinancialandotherrisksandtheprotectionofCouncilassets • Compliancewithlawsandregulationsaswellasuseofotherbestpracticeguidelines • Theprovisionofaneffectivemeansofcommunicationbetweentheexternalauditor, management and the Council.

The Char ter used by the Audit Panel to guide its activities was originally adopted by Council in June 2014. The Audit Panel reviews the Char ter periodically, as and when appropriate, and make recommendations to Council for any resultant changes for the effective operation of the Audit Panel.

On 28 January 2015 Council approved the membership structure of the Audit Panel. There were four members comprising two independent members, Alison Flakemore and David Sales, and two Councillors. From 10 October 2016, when the Council was dismissed, Commissioner Adriana Taylor replaced the Councillors on the Audit Panel.

In terms of the Order, the Panel is required to determine: • WhethertheannualfinancialstatementsoftheCouncilaccuratelyrepresentthestateof affairs of the Council; • WhetherandhowthePar t7plansareintegratedandtheprocessesbywhich,and assumptions under which those plans are prepared; • Theaccounting,internalcontrol,anti-fraud,anti-corruptionandriskmanagement policies, systems and controls that the Council has in relation to safeguarding its long term financial position; • WhethertheCounciliscomplyingwithprovisionsoftheActandanyotherrelevant legislation: and • WhethertheCouncilhastakenanyactioninrelationtopreviousrecommendations provided by the Audit Panel to the Council and, if it has taken action, what that action was and it effectiveness.

The Order requires that an Audit Panel prepare an annual work plan which it has done. In determining its work plan, the Panel takes into account the par ticular circumstances of the Council.

The Audit Panel will continue to consider matters within the purview of the Char ter with a view to assisting the Council to fulfil its responsibilities with respect to financial and risk management matters.

One matter was referred to and considered by the Audit Panel and the recommendations to Council were adopted without alteration.
