Director’sreportTheNationalChildren’sandYouthLawCentre’s(NCYLC’s)missionistoworkforandinsupportofchildrenandyoungpeople,theirrightsandaccesstojustice.Weadvancethismissionbyprovidinglegalservicestargetedatchildrenandyoungpeople.Specifically,weprovide:

• Lawstuff:theleadingnational,plainlanguagecommunitylegalinformationwebsiteforyoungAustralians;and

• Lawmail:thefree,onlinelegaladviceserviceforyoungAustralians.

Inaddition,wesupportandadvocatesforchildrenandyoungpeople’srights,includingthrough:

• collaborationwithleadingnon-legalandlegalserviceagenciestogenerateintegratedresponsestolegalandnon-legalproblems;and

• contributionstotheevidencebase:leadingresearchanddevelopmentintheareasofyouthlawandpolicy,andchildren'shumanrights.

Inbrief,weprovidetheonlypracticalandlegalproblem-solvingserviceforallAustralianyoungpeopleunder25andtheiradvocates.YoungpeoplefindusattheirtimeofneedbysearchingabouttheirproblemsorconcernsviaGoogleandothersearchengines.Whentheydothis,aclientwillbedirectedtoourlegalinformationwebsite,Lawstuff(www.lawstuff.org.au).Here,clientswillreceiveaccurate,usefulandplainEnglishlegalinformation.Iftheywish,aclientmaythenself-selectpersonalisedinformation,advice,assistanceorreferralsatLawmail:https://www.lawmail.org.auInNovember2016,welaunchedournewLawmailICTplatformaftermanymonthsofcollaborativework.Thenewsystemhasenhancedusabilityforboththeclientandtheserviceandhasresultedinamuchsmootherprocessforsubmittingandrespondingtoclientcontacts.

Theclientcontactformisaguidedprocesswithclearandhelpfulinstructionsandopportunitiestore-directpartiesthatwecannotassisttoamoreappropriatelegalservice.Theformappearanceitselfhasalsobeenupdated.Inaddition,clientscannowuploaddocuments.Thefinaladvicethatissenttoclientsisinrichtextformatting,beingamoreviewer-friendlyformat.

Wereceivedthefollowingcommentsaboutthenewsystemfromourstaffandvolunteers:

“ThenewLawmailsystemisgreat–Ilovethetrackchangede-mailIgetthatcompareswhatIdraftedtothefinalresponse.ThisletsmeseewhereIcanimprove.Otherhelpfulfeaturesincludethefootnotingandcommentsfeatures.Theymakereviewingmucheasierasyoucanseethedrafter’slegalresearch,anditreducesthetimeittakesyoutoreviewaresponse.IfeellikethenewsystemhashelpedourCentretochurnoutmorehighqualityadvices,atamuchfasterrate.”(On-sitevolunteer,2017)

“ThenewLawmailsystemhasmadeahugedifferencetomyexperienceasacyber-volunteer.Thesystemissignificantlymoreintuitiveandreliablethanitspredecessor,whichhasallowednewvolunteerstopickitupmuchmorequicklyandhasreducedtimeineachsessionspentsolvingtechnologicalissues.ThefeedbackfeaturehasmadeabigdifferencetoallthevolunteersbecausewenowgetamuchclearerpictureofhowourdraftsarechangedbytheCentre.IknowthatIhavebenefitedgreatlyfromseeingcertainerrorshighlightedandIhopenottokeepmakingthem!Thechecklistandreferencingfeatureshavealsomadeitmucheasiertodraftandcheckworkandensurethetechnicalaspectsoftheworkareright.Allinall,Ithinkthenewsystemhasbeenahugesuccess–ithascertainlymadevolunteeringmucheasier!”(Cyber-volunteer,2017)

TheperiodhasbeenaveryproductiveonefortheCentre.LegalassistanceWereceivedoverwhelminglypositiveandgratefulfeedbackfromourclients.Inparticular,ourfeedbackdemonstrateshighlevelsofsatisfactionwithourcapacitytohelpclientsunderstandtheirlegalproblems,andassistthemtoknowwheretogethelpinthefuture.ThedataevidencesthatLawmailis,inparticular,animportantsourceofcivillawadvice.LawmailisalsoanimportantnationalsourceofadviceonareasofCommonwealthlaw,includingfamilylaw,workplacelaw,consumerlaw,andCommonwealthcriminaloffences.CommunitylegaleducationandinformationLawstuffhasgrowntobecomeanincrediblyvaluablesourceoffreelegalinformation,particularlyinareassuchassexualassault(includingageofconsentlaws),drugoffences,cyber-safety,andpolicepowers.WecontinuedtoimproveLawstuffbyconstantlyreviewingandupdatingpagesforaccuracy.WealsointegratednewfeaturesontoanumberofLawstuffpages,suchasvideosandinteractivequizzes.Lawstuff’sendofyearresultswerethestrongestever.Justover1.4millionuniquevisitorsvisitedLawstuffin2016-2017toobtaintheirplainlanguagelegalinformation,amassinganincredible2.5millionpageviews.Intheperiod,wealsocommenceddevelopmentofaNSW-basedpilotofanew,nationalcommunitylegaleducationproject,TeachLaw.

ByFebruary2017webegangenerallytomeetanaspirationaltargetof50writtenadvicesandinformation/referralsperweek,roughlyequatingtoanextraordinary1.33writtenlegaladvicesorinformationsperservicehour.Ultimatelythetargetprovedunsustainablefromaresourcingandworkplacesafetyperspectiveandwasreducedto30to40advicesperweek,meaningthatsomeadviceseekerscannotbeassistedeachweek.

NGOReportontheInternationalCovenantonCivilandPoliticalRights(ICCPR)Wepreparedthe“Children’sRights”sectionoftheNGOReportforthe6thperiodicreportoftheICCPR.

The purpose of this report was to assess the implementation of the ICCPR in Australia(whichwasimplementedinAustraliaon13August1980).

Inundertakingthisreport,thefollowingissueswereaddressed:

● TheTreatmentofChildreninImmigrationDetention● TheTreatmentofChildrenintheJuvenileJusticeSystem● HomelessChildren● FreedomofMovement● BirthRegistration

Wemade10recommendationstobeincludedinthereportwithreferencetoArticles7,9,10,12,14,17and24.

TeachLawWecommenceddevelopmentofanewcommunitylegaleducationproject,TeachLaw.TeachLawwillbeanational,onlineplatformtoassistteachersineducatingchildrenandyoungpeopleaboutthelaw.ThroughTeachLaw,wehopetoenhanceyoungpeople’slegalliteracyandunderstandingoftheirlegalrightsandresponsibilitiesandtoplaceparticularemphasisonensuringthatdisadvantagedstudents,andstudentsinrural,regionalandremotelocationsareabletobenefitfromahigh-quality,legallyaccurateeducationalresource.WewouldliketothankSlaterandGordonfortheirgrantof$10,000tobeusedin2017-2018tobuildaprototypefortheNSWpilotofTeachLaw.

AustralianProBonoCentre’s‘WhatWorks’GuideOuronlineservicemodelwashighlightedin“ProBonoPartnershipsandModels-APracticalGuidetoWhatWorks”,publishedbytheAustralianProBonoCentreinOctober2016.Thisisdesignedasaguideforprovidersofprobonolegalassistance.LawmailandLawstuffwereincludedinchapter26,‘Technology-BasedServices:Telephone,VideoConferencing,OnlineandMobileTechnology,’ as case studiesofeffective technology-based services in theprobonosector.
