CHAPTER 1PRELIMINARY PROVISIONS

Section 101. Shorttitle.ThisactshallbeknownandmaybecitedastheAthletic Code.

Section 102. Definitions.Thefollowingwordsandphraseswhenusedin Chapters1 through17 shall

have the meaningsgiven to them in this section unlessthe contextclearlyindicatesotherwise:

“Amateur.” A personwho has never receivednor competedfor anypurseor otherarticleof value,eitherfor participatingin anyboxingcontestor exhibition or for the expensesof training therefor, other thana prizewhich doesnotexceed$50invalue.

“Boxing.” Theact of attackand defensewith the fists, practicedasasport,subjecttorulesadoptedby thecommission.Thetermincludesall vari-ations of the sport permitting or usingother parts of the human body,including,butnot limited to, thefoot, knee,leg, elboworhead.

“Commission.” TheStateAthletic Commission.“Contest.” An engagementin which theboxersstriveearnestlyin good

faith to win.“Department.” TheDepartmentof Stateof theCommonwealth.“Executivedirector.” TheExecutiveDirectorof theStateAthletic Com-

mission.“Exhibition.” An engagementin which theboxersshowor displaytheir

skill withoutnecessarilystriving towin.“Foreigncopromoter.” A promoterwhohasno placeof businesswithin

this Commonwealth.“Judge.” A person,otherthana referee,who hasa vote in determining

thewinnerof anyboxingcontest.“Manager.” A personwho, directly or indirectly, controlsor adminis-

terstheaffairsof anyboxer.“Matchmaker.” A personwho brings togetherprofessionalboxersor

arrangesprofessionalboxingcontestsor exhibitions.“Participant.” A boxerwhotakespartin a boxingcontestor exhibition.“Physician.” An individual licensedto practicemedicineandsurgeryor

osteopathyor osteopathicsurgeryin this Commonwealth.“Professional.” A personwho has receivedor competedfor, or is

receivingor competingfor, any purseor otherarticleof value,otherthanaprize which doesnot exceed$50 in value, either for participatingin anyboxingcontestor exhibitionor for theexpensesof trainingtherefor.

“Promoter.” Any person,and in thecaseof a corporatepromoter,anyofficer, director,employeeor stockholderthereof,who produces,arrangesor stagesanyprofessionalboxingcontestor exhibition.

“Purse.” The financialguaranteeor any other remuneration,or partthereof,for which professionalboxersare participatingin a contestor exhi-bition.Thetermincludestheparticipant’sshareof anypaymentreceivedforradiobroadcasting,televisionandmotionpicturerights.

“Secretary.” TheSecretaryof theCommonwealth.Section103. Act not toapplyto schools.

No provisionof thisact noranyrule or regulationpromulgatedhereundershall apply to any boxing contestor exhibition conductedor sponsoredbyany university,college,secondaryschoolor groupof universities,collegesorsecondaryschoolsor the Departmentof Correctionswhenall the partici-pantsarestudentsregularlyenrolledin suchinstitutionsor inmatesconfinedwithin aStateor countycorrectionalfacility.

CHAPTER 3COMMISSION; STAFF; MEDICAL ADVISORY BOARD

Section301. StateAthletic Commission.(a) Composition.—The commission shall be comprised of three

membersappointedby theGovernorwith theadviceandconsentof amajor-ity of the memberselectedto the Senate,oneof whom shall be amedicaldoctor or doctor of osteopathylicensedto practicein this Commonwealth,with experiencein sportsmedicine.TheGovernorshalldesignateoneof themembersasa chairmanfor atermof two years.The secretaryshallbean exofficio memberof thecommission.

(b) Appointments.—Eachappointmentshall befor atermof two years.The termsof themembersof thecommissionappointedprior to theeffectivedateof thisactshallterminateon the effectivedateof this act.Any commis-sionerso terminatedshall continueto holdoffice until hissuccessorshallbeappointedpursuantto subsection(a).

(c) Compensation.—Eachcommissioner,exceptthesecretaryandchair-man,shallreceiveasalaryof $10,000annually.Thechairmanshallreceiveasalaryof $10,500annually.The commissionersshall alsoreceivereasonableandnecessarytravel expensesincurred as a direct result of their dutiesasmembersof the commission.The expensesincurredby the commissionersshallbeallowedandpaidon the presentationof itemizedvoucherstherefor,whichvouchersshallbesubjectto theapprovalof thesecretary.

(d) Removal.—Exceptas authorizedpursuantto this section,no com-missionermaybe removedfrom office duringhis term.The Governormay,upon clearandconvincingevidenceof misfeasanceor malfeasancein officeor neglectof duty, removea commissionerprior to the expirationof his orher term. The Governorshall thenprovide the commissionerso removedwith adetailedwritten statementof thereasonsfor hisremoval.

(e) Quorumrequirement.—Twomembersof the commissionshall con-stituteaquorum.Section302. Dutiesof commission.

(a) Meetings.—Thecommissionshall hold regularmonthly meetingstocarry out the requirementsof this act, whichshallinclude theconsiderationof any rules,regulationsor amendmentstheretowhichare recommendedbytheexecutivedirector.Themeetingsshall beopentothepublic. The meetingtimesshall bescheduledoneyearin advance,andbepublishedin thePenn-sylvaniaBulletin.

(b) Generalduties.—Exceptasprovided in section 103, the commissionis herebygrantedauthorityto establishpolicy and shallbe directedto pro-mulgaterules andregulationsregardingall the true sportsof professionalboxing and wrestlingcontests,as distinguishedfrom professionalwrestlingexhibitions,heldwithin thisCommonwealth,exceptsuchcontestsandexhi-bitionsasarespecificallyexemptedfromtheprovisionsof thisact.Section 303. Appointmentandqualificationsof executivedirector.

The secretaryshall appointan executivedirector of thecommission.Theexecutivedirector shall haveadministrativeexperienceand otherqualifica-tions indicating he is familiar with the activitiesto be regulatedby this actandshall serveatthepleasureof the secretary.The director’ssalaryshall befixed by the secretarywith the approvalof the Governor,andthe directorshallholdnootherpaidpublicposition.Section 304. Powersanddutiesof executivedirector.

Theexecutivedirector shall supervisetheadministrativework of the com-mission.Theexecutivedirectorshallhavethepowerandhisdutyshallbe:

(1) To attendmonthlymeetingsof thecommission.(2) Torecommendto thecommissionsuspensionor revocationof any

licenseor permit issuedpursuantto this act for violationsof any provi-sionsof thisact or therules andregulationsof the commission,or whensuchactionis necessaryto protectthepublicwelfare.

(3) To superviseanddirectstaffappointedby the secretaryengagedinwork directlyrelatedtotheimplementationof thisact.

(4) To prepareandrecommendto the commissionrules andregula-tionsandamendmentsthereto.

(5) To implementandsuperviseadrugtestingprogramof all athleteslicensedunder this act, in consultationwith the MedicalAdvisory BoardandtheSecretaryof Healthor hisdesignee.

(6) To presentthestandingcommitteesof bothHousesof theGeneralAssemblywith an annual review of the commission’srules andregula-tions.

(7) To establishandmaintaina recordof all athleteslicensedunderthis act, showingfor eachlicenseethe following: the datelicensed,theresultsof prefightandpostfightphysicals,anyfictitious or assumednamesby whichthe licenseecompetes,thenumberanddatesof any suspensionsof theathlete,the dateswhentheathleteis knockedout andthe athlete’srecordfromotherstates.

(8) To administerandmakeeffectivetheprovisionsof thisactandtherulesmadethereunder.

(9) To conducta substantialportion of the activitiesrequiredby thisact atasingle centrallocation,whereinall recordsof thecommissionshallbemaintained.

(10) To preparean annualbudgetfor the considerationof the com-mission,showingthecostsof operationandrevenuesreceivedin theprevi-ous fiscalyearand the estimatedcostsof operationsand revenuesto bereceivedin the nextfiscalyear.Thebudgetshallbeapprovedby thecom-mission andforwardedto the secretaryin atimely fashionfor hisreviewandinclusioninthebudgetrequestof thedepartment.

(11) To aidthe commissionin thepromotionof boxing contestsin theCommonwealth.

Section305. MedicalAdvisoryBoard.Within 60 days of the effective date of this act, the commissionshall

appoint five physiciansto serveon a Medical AdvisoryBoardfor aterm oftwo years.Eachmembershallbepaidaperdiem ratetobeestablishedby thesecretary,but not in excessof $150 per day. The Medical AdvisoryBoardshallissueanannualreporttothecommissionwhichshallincludeareviewofthehealthstatusof eachboxer whoactuallycompetedduringtheprior fiscalyearto identify thosewho may beatrisk of seriousphysicalimpairmentandareviewof thehealthandsafetyregulationspromulgatedby-the-commissiontorecommendchangesor additionsthereto.

CHAPTER 5REGULATIONS OF BOXING CONTESTSAND EXHIBITIONS

Section501. Boxing regulated.Professionalboxing contestsor exhibitions, including kick boxing, shall

beheldwithin this Commonwealthonly in accordancewith theprovisionsofthis actandthe rulesand regulationspromulgatedhereunder.Thecontestsor exhibitionsmaybeheldon Sundays.Section502. Age of participants.

(a) Generalrule.—Nopersonunder theageof 18 shallbeaparticipantinanyboxingcontestorexhibition.

(b) Exception.—(1) Any personbetween12 and 17 years of age may participatein

amateurboxing contestsor exhibitionsundersuchrulesandregulationsasthecommissionshallprescribe.

(2) Any personbetween12 and 17 yearsof agemayparticipateafterobtainingwritten permissionfrom a parentor legal guardian,aswell asconsentby theexecutivedirector.

(3) Persons12 to 16 yearsof agemayonly participatein suchcon-testswith personsnot morethanoneyearolder.(c) JuniorOlympics.—Thelimitations setforth in subsections(a) and(b)

shall not apply to sanctionedboxing eventsfor the JuniorOlympicsunderthe directionof a nationalgoverningorganizationcertified by the commis-sion. For purposesof the Junior Olympic events,participants, with thewrittenpermissionof aparentor legalguardian,mayboxonly in the follow-ing agedivisions:

(1) Tenandelevenyearsof age.(2) Twelveandthirteenyearsof age.(3) Fourteenandfifteenyearsof age.

Underno circumstancesshallany participanttakepart in any eventoutsideof theapproveddivision for suchagegroup.Section503. Fictitiousnames.

No personshall participatein any amateurboxing contestor exhibitionunderafictitious or assumedname,unlesssuchfictitious or assumednamehasfirst beenregisteredwith thecommission.

Section504. Physicianto bein attendance.A physicianshall beassignedto everyboxingcontestor exhibition by the

executivedirector.The physicianshall observeandcontinueto observethephysicalconditionof theparticipantsandisauthorizedto stop~any-contest:orexhibitionatanytime to examineacontestantandtoterminate-aboutwhen,in thejudgmentof thephysician,severeinjury couldresultto a contestantifthecontestor exhibitionwereto continue.Thecommissionshallestablishbyrule or regulationa scheduleof feesto be paid to physiciansfor their ser-vices. The physician’sfee shall be paid by the promoterof the contestorexhibitionattendedby thephysician.Section 505. Medical trainingseminars.

Thecommissionshallconductfrequentmandatorymedicaltraining semi-narsat leastthreetimesa yearfor all ring personnel,commissionpersonnelandotherdesignatedpersonsemployedby thesecretary.Section 506. Register.

TheexecutivedirectorshallestablishandmaintainaregisterforalFprofes-sional boxers licensed in this Commonwealth.The registershall include aphotographof theboxer. In theregister,the executivedirector shallrecordthe resultsof each boxing contestor exhibition the boxer is involved in,including technicalknockouts,knockoutsandotherboxing-relatedinjuries,as wellas thedatesof eachcontestor exhibitionandtherecordof winsandlosses.Section 507. Medicalequipment.

No professionalboxing eventshallbe startedunlessthereis on theprem-ises:

(1) An ambulance,togetherwith emergencyequipment.(2) A portableresuscitatorwith oxygenandappropriateendotracheal

tubesandaqualifiedoperator.Section508. Suspension.

For soundmedicalreasonsandto protecttheindividual boxers,the com-missionshall establishmandatorylicensesuspensionsof thosepersonswhosustaincertaininjuries. The commissionmaysuspenda boxer’slicenseforup to:

(1) Sixty daysfor alacerationof theface.(2) Thirty daysforatechnicalknockoutwith minorinjuries.(3) Forty-fivedaysfor headinjuries.(4) Ninety daysfor a boxer receivinga knockout.Such boxer shall

recciveanEEGwithin 24hoursof theknockout.Section 509. Examinations.

(a) Prefightphysical.—(1) In addition to any other examinationrequiredby this actor the

rulesandregulationspromulgatedhereunder,eachboxer must beexam-inedby theattendingphysicianwithin two hoursbeforeheentersthering.If, in the opinion of the physician,any boxer is physically or mentallyunfit to proceed,thephysicianshallnotify thepersonin charge,who shallimmediatelycancelthecontestorexhibition.

(2) This requiredexaminationshall conformto the rules andregula-tionspromulgatedby thecommission.(b) Postfightphysical.—Inaddition to the examinationrequiredin this

act,everyboxer shallbeexaminedby aphysiciandesignatedby theexecutivedirector during the five days following everycontestor exhibition in whichhe wasaparticipant.Such examinationshall beperformedatthe expenseofthepromoter.

(c) Filing of results of physicals.—Theresults of the examinationsrequiredby thissectionshallbe reducedto writing by the physician,signedby him andfiled with the commissionwithin 48 hours after theyhavebeenperformed.Section510. Weightsandclasses.

The commissionshall establishclassesof boxersby rules and regulationspromulgatedunderthisact. Suchclassesshallbebaseduponweights.Section511. Limitation on differenceinweights.

No contestor exhibition shallbe lawful in whichthe differencein weightof theparticipantsexceedstenpounds.This limitation shallnotapplyto con-tests or exhibitions betweenparticipants in the light-heavyweight andheavyweightclasses,as definedby the commission,nor to exhibitionsheldsolelyfor trainingpurposes.Section512. Gloves.

(a) Generalrule.—All boxerslicensedunderthis actshall berequiredtouse thumblessor thumb-attachedgloves. The appropriateweight boxingglovesshallbewornby boxersasfollows:

(1) One hundredthirty-five poundsor under,boxing glovesweighingnot lessthanfive ounceseach.

(2) Over 135 poundsbut not exceeding160 pounds,boxing glovesweighingnot lessthansix ounceseach.

(3) Over 160 pounds,boxingglovesweighingnot lessthanten ounceseach.(b) Violation.—A violation of this sectionmay subjectthe participant,

promoterand/ormanagerto suspensionof not lessthan30 daysor revoca-tion of their licenses,at the discretion of the commission,pursuanttosection 1504.Section513. Durationof boxingbouts;lengthof rounds.

(a) Length of contest.—Noboxing contestor exhibition shall be morethan 12 roundsin length, except for championshipcontestssanctionedbyrecognizedinternationalor national authorities,which may be up to 15roundsin length.

(b) Duration of round.—Noround shallbe morethanthreeminutesinduration.

(c) Mandatoryrest period.—-Thereshall be at leasta one minute restbetweenconsecutiverounds.

(d) Limitation on participation.—Noboxer shall participatein, norbescheduledto participatein, more than 15 roundswithin 72 consecutivehours.

(e) Limitation on rounds.—Thecommissionmay, in respect to anycontestor exhibition or in respect to any class of participants,limit thenumberof roundsin acontestor exhibition to lessthanthemaximumof 15rounds.Section 514. Attendanceof refereeandjudges;scoring.

(a) Referee.—Ateachprofessionalboxing contestor exhibition, exceptanexhibition held solely for trainingpurposes,thereshall bein attendance,at the expenseof the promoter,a duly licensed refereedesignatedby theexecutivedirector,whoshalldirectandcontrolthecontestor exhibition.

(b) Judges.—Thereshallalsobein attendanceateveryboxingcontest,atthe expenseof the promoter, two licensed judges,each of whom shall,togetherwith the referee,render his individual decision,in writing, on ascorecardsuppliedby the executive director at the end of every boxingcontestwhichcontinuesfor theschedulednumberof rounds.Eachjudgeandthe refereeshall haveonevote,anda majority of thevotescastshalldeter-minethewinner.

(c) Scoring.—Thecommissionshall by rule or regulationprescribethemethodsof scoring.Section 515. Seconds.

Beforethe startof anyboxingcontestor exhibition, therefereeshallascer-tain from eachparticipantthe nameof the chief second.The chiefsecondshallbe heldresponsiblefor theconductof hisassistantsduringthe contestor exhibition.Section 516. Duty of disclosure.

Every licenseeshall, immediately after learning thereof,discloseto theexecutivedirector or hisdesignee,or tothe official in chargeor theattendingphysicianor refereeif oneof thesepersonsis in attendanceatanycontestorexhibition, all knowledgeor information in his possessionconcerninganymentalor physicaldisability, injury, illnessor incapacityof anyboxer.Section517. Shamor collusivecontestprohibited.

(a) Generalrule.—No licenseeor otherpersonshallknowingly conduct,give, participatein or be in any way connectedwith any shamor collusiveboxingcontest.

(b) Reports.—Anylicenseewho knowsor hasreasonto suspectthat aboxingcontestis, wasor isgoing to beashamor collusivecontestshallhaveaduty to promptlyreportthisto theexecutivedirectoror hisdesignee.Suchareport shall bein writing or, if oral, shallbe reducedto writing andshallcontain all of the reporter’s reasonsfor the conclusionsset forth in hisreport.

(c) Definition.—A shamor collusivecontestis onein whichoneor bothof the participantsdoesnot usehis bestefforts and skill or doesnot striveearnestlyin good faith to win. It includes,but is not limited to, any pseudocontest,the resultof whichhasbeenprearrangedor any pseudocontestinwhicheitherparticipantdoesnot,is notgoing to or is unabletouseor is pre-ventedfrom usinghis bestefforts andskill as aresultof coercion,bribery,duress,threats,rewardor promisethereof,physicalincapacityor disability,suggestionor agreement,or anyotherimproperorunlawful means.

(d) Penalty.—Aviolation of this sectionshall constituteamisdemeanorof thethird degree.Section518. Minimum pursesfor boxers.

No purselessthan$50shall bepaid by the promoterto anyprofessionalboxerfor anycontestor exhibition, otherthanatrainingexhibition.Section 519. Distributionof pursesto boxers;statements.

(a) Promoterdistribution.—-Unlessotherwisedirectedby the executivedirector,all boxingpursesshall bedistributedby thepromoternotiaterthan24 hoursafterthe conclusionof the contestor exhibition forwhichthepurseis being paid. A written statementshowing the distribution of the purse,including eachitem of receiptandeachexpenditureor deduction,shall befurnishedto theboxerandhismanager,togetherwith hisshareof thepurse,andacopythereof,certifiedby thepromoterto betrueandcorrect,shall-befiled in the office of the executivedirector. Receiptedvouchersfor everyexpenditureor deductionshallbeattachedto the copyfiled with the depart-ment.

(b) Managerdistribution.—Unlessotherwisedirected by the executivedirector,everymanagershallfu:rnishastatementof distributionto theboxerhe manages,togetherwith the boxer’sshareof the purse,not laterthan24hoursafter he receivesthepurseandstatementfrom thepromoter.A copythereof,certified by the managerto betrueandcorrect,shallbe filed in theoffice of the department,andit shall haveattachedto it receiptedvouchersforeveryexpenditureor deductionmadeby themanager.Section520. Withholdingof moneys.

(a) Generalrule.—Thecommissionshall have the powerto order thepromotertowithhold anypurse,or anypart thereof,oranyreceiptsor otherfundsbelongingto or payableto anycontestantor for whichanycontestantis competingor of any manager’sshareof, if it shouldappearthatsuchcon-testantis not competinghonestlyor is intentionallynotcompeting-to-thebestof hisability andskill or if it shouldappearthatthe contestant,his manageror anyof his secondshasviolatedany provisionof this actor therules andregulationspromulgatedunderthisact.

(b) Escrow.—Thecommissionshall have the powerto order that thegrossreceiptsshall bewithheldandplacedin escrowif it shouldappearthattheacthasbeenviolated.Section521. Hearingregardingwithheldpurse.

(a) Delivery to commission.—Anypurse,or portionthereof,sowithheldshall be deliveredby the promoterto the commissionwithin 48 hours aftertheendof thecontest.

(b) Requestfor hearing.—Withinten daysafter the endof the contest,the licenseefromwhomthesumwaswithheldshallhavetheright-to-apply-inwriting to thecommissionfor a hearing.Upon receiptof suchapplication,thecommissionshallfix adatefor ahearing.Section 522. Hearing,dispositionof withheldpurse.

(a) Generalrule.—Withinareasonabletimeafter thehearingor after theexpirationof tendaysfollowing thecontest,if no applicationfor ahearingisfiled, the commissionshalldeterminethedispositionto bemadeof-thewith-heldpurse.

(b) Withholding.—If the commissionfinds thechargeor chargesuponwhichthe withholdingorderwasbasedto betrueandto besufficient lawfulreasonuponwhichto basesuchanorder,it may,in its discretion,declarethefundswithheld,or anypartthereof,forfeited.

(c) Distribution.—If the commissionfinds the chargeor chargesto beuntrueor nottobesufficientlawful reasonuponwhichtobase~rwithholdingorder,it shalldistributethewithheldfundstothepersonsentitledthereto.Section523. Paymentsregulated.

(a) Generalrule.—Nopromoteror foreigncopromotershallpay,lendorgive any moneyto a contestantbefore any boxing contestas an advanceagainsthis purseor for a similar purpose.A promotermay, with the priorwrittenpermissionof thecommission,payor advanceto a contestantneces-sary expensesfor transportationand maintenancein preparationfor acontest.

(b) Forfeitureof purse.—Ifacontestant’spurseis forfeited,thecommis-sionmayincludesuchpaymentsor advancesas partof theforfeiture, and,ifhedoesnot forward suchamountto thedepartment,it mayberecoveredinthesamemannerasadebtduetheCommonwealth.Section524. Insurance.

Thecommissionmay,by rulesandregulations,requirelicensedboxerstobecoveredby insurancefor:

(1) Medical, surgical and hospital care resulting from injuries sus-tainedwhile preparingfor or engagedin boxing contestsor exhibitionswith theinsuredbeingthebeneficiaryof suchpolicies.

(2) Life, providing for paymentsto the estatesor beneficiariesofdeceasedboxerswheredeathwas causedby injuriesreceivedwhile prepar-ing for or engagedin boxingcontestsor exhibitions.

Thepremiumsfor suchinsuranceshallbepaidby theinsured’smanager.

CHAPTER 7

SAFETY REGULATIONSSection701. Mandatoryeightcount.

Whenevera boxeris knockeddown, theboxer shallberequiredto takeacountof eight. Therefereeshall not permit the contestor exhibition to beresumeduntil thecountof eighthasactuallybeenreached,exceptinprofes-sionalchampionshipboxingcontestsandexhibitions.Section702. Knockout.

When aboxer is actuallyknockedout,the refereeshall count to ten andshallnot stopthecountearlierandrecordatechnicalknockout.Section 703. Physicianatknockout.

Whenaboxer hasbeenknockedout, no oneshall touchhim, except toremovehis mouthprotector,until after the attendingphysicianhasenteredtheringandissuedsuchinstructionsashedeemsnecessary.Section704. Ringpadding.

All ring paddingshall be subject to approval of the commission.Allpaddingshallbeof soft felt, foamrubberor similar materialandshallbeatleasttwo inchesthick.

Section705. Boxerknockedunconscious.A boxerwho hasbeenknockedunconsciousor who hasreceiveda con-

cussionshall not be allowedto box againfor 90 days,andthenonly afterhavingbeenpronouncedfit after athoroughphysicalexaminatio-irbya-phy-sician.Section706. Boxerrepeatedlyknockedout.

A boxer whohasbeenknockedout or severelybeatenshallberetiredandnot permittedto boxagainif, after subjectinghim to a thoroughexamina-tion by aphysician,thecommissiondecidessuchactionisnecessaryin orderto protectthehealthandwelfareof theboxer.Section707. Sixconsecutivedefeats.

A boxerwho hassufferedsix consecutivedefeatsshall be investigatedbythecommissionandexaminedbyaphysician.

CHAPTER 9LICENSES AND PERMITS

Section901. Powerof commissionto issue,withhold, suspendor revokelicensesandpermits.

Thecommissionis herebygrantedsolecontrol,authorityandjurisdictionto issue,withhold, suspendor revokeany licenseor permit providedfor inthisact.Section902. Promoters’licenses..

No promotershall, eitherdirectly or indirectly,conduct,hold or promoteany professionalboxing contestor exhibitionunlesshe hasfirst procuredapromoter’s license from the commission.A violation of this section maysubjectthe promoterto suspensionof not lessthan30daysor revocationofhislicenseatthediscretionof thecommissionpursuantto section 1504.Section903. Representativemanagers’licenses.

(a) Generalrule.—Beforeactingas such,every representativemanagershallprocureamanager’slicense.Heshall file with thedepartmentthenameof eachboxer whomherepresents.,togetherwith awritten consentfromeachsuchboxer andhis managerauthorizinghim to transactbusinessfor suchmanageror boxeror toactasor for themanagerof suchboxer.

~b) Presumption.—Everypersonother thanthe managerof aprofes-sionalboxerwho performsanyof theactsusuallyperformed-by-the-manageror who aids,assistsor substitutesfor the manageror whousesa licensedmanagerto concealhisownactionsasamanagershallbeconsidered-arepre-sentativemanager.

(c) Penalty.—Aviolationof thissectionmaysubjectthemanagerto sus-pensionof not lessthan30 daysor revocationof his licenseatthe discretionof thecommissionpursuantto section1504.Section904. Foreigncopromoterstoprocurepermits.

(a) Generalrule.—Noforeigncopromotershalldirectlyor indirectly par-ticipate in the promotionof or receiveanyremunerationfrom or render-anyservicesin connectionwith any professionalboxing contestor exhibitionheld within this Commonwealthunlesshe hasfirst beengranteda permitthereforby the commission.No promotershall be associatedwith any

foreigncopromoterin promotinganycontestor exhibitionunlesstheforeigncopromoterhasfirst securedapermit.A foreigncopromoterby acceptingapermitagreesto be subjectto all the provisionsof this actandthe rulesandregulationspromulgatedunderthisact.

(b) Penalty.—Aviolation of this sectionmaysubjectthepromoterand/or foreigncopromoterto suspensionof notlessthan30daysor revocationofhis license or permit at the discretion of the commissionpursuanttosection 1504.Section905. Otherlicensesrequired.

(a) Other licenses.—Noprofessionalboxer, manager,second,trainer,matchmaker,timekeeper,referee, judge, announcer,physician, bookingagentor agencyor representativeof abookingagentor agencyshalldirectlyor indirectlyact in suchcapacityin connectionwith anyprofessionalboxingcontestor exhibition unlesshe hasfirst procuredalicenseto act in suchacapacityfromthecommission.

(b) Penalty.—A violation of this section may subject the boxer,manager, second, trainer, matchmaker, timekeeper, referee, judge,announcer,physician, booking agent or agency or representativeof abookingagentor agencyto suspensionof not lessthan30 daysor revocationof their licensesatthediscretionof thecommissionpursuantto section 1504.Section906. Permitsrequired.

In addition to the promoter’slicense,eachpromotershallbe requiredtoprocureapermit for eachprogramof contestsor exhibitionsbeforepresent-ing thatprogram.Eachapplicationfor a permitshall specify the premiseswhereandtimewhentheprogramis tobeheld.Section907. Permitsforamateurs.

(a) Permit required.—Exceptas otherwise provided in this act, noamateurboxing contestor exhibition shallbe held without apermit havingbeenfirst securedfromthedepartment.

(b) Eligibility.—Permits for amateurboxingcontestsor exhibitionsshallbe issuedonly to bonafide recognizedamateurathleticassociations,non-profit organizationsor othergroupsor individualsapprovedby thecommis-sion.

(c) Miscellaneous.—Permitsunderthissectionmaybeissuedfor asinglecontestor exhibition, a seriesof contestsor exhibitions,or for aperiod notexceedingone year. The commissionmay issue amateurpermits withoutcharginganyfeeor forafeeof $5 perpermit.Section908. Restrictions.

No officer, director,stockholderor employeeof alicensedpromotershallhaveanyother interestin anyprofessionalboxer or professionalcontestsorexhibitionsexceptasamatchmaker.Section909. Permitsnot to beissued.

No permit shallbeissuedfor theholding of anyboxingcontestor exhibi-tion within any political subdivision of this Commonwealthwhich hasadopted,or whichadopts,anylocal ordinanceor resolutionprohibitingsuchcontestsor exhibitionswithin its limits.

Section910. Standardsfor theissuanceof licensesandpermits.(a) Consideration.—Indeterminingwhetherto issueor renewanylicense

or permit,the commissionshallconsiderthe bestinterestandwelfareof thepublic, the preservationof the safetyandhealthof participantsandthebestinterestsof boxinggenerally.

(b) Prerequisites.—Beforebeinggrantedanypermitor license,theappli-cantmustestablishthattheapplicantis:

(1) Ofagoodmoralcharacter.(2) Ofgoodreputation.(3) Physicallyfit andmentallysound.(4) Skilledinhisprofession.(5) Of requisiteageandexperience.(6) Notaddictedto theintemperateuseof alcoholor to theuseof nar-

coticdrugs.In the caseof a corporateapplicant,thesefactorsshall be consideredwithreferenceto its officers,directors,employeesandprincipalstockholders.Section911. Durationof license.

Eachlicenseissuedunderthisact shallexpireon December31 next follow-ing thedateon whichit wasissued.Section912. Applicationsfor licensesandpermits.

Everyapplicationforalicenseor apermitshall:.(1) Beinwriting on aformsuppliedby thecommission.(2) Be verified by theapplicant.(3) Set forth suchinformationandhaveattachedtheretosuchphoto-

graphsandotherexhibitsas arerequiredby this act, therulesandregula-tionspromulgatedunderthisact, andtheformof application.

Section913. Oralexaminations.Thecommissionshallhavetheright to requireany applicantfor alicense

or permit, or in the caseof a corporateapplicant,any officer, director,employeeor stockholderthereof,to appearbeforethe commissionfor anoral examination,underoath, as to qualificationsof the applicantbeforetakingactionson thatapplication.Section914. Licensefees.

The annual licensefees which shall accompanyeach applicationfor alicenseor therenewalof alicenseshallbefixedby commission-regulation.Section915. Permit fees.

(a) Generalrule.—Therequiredfees,baseduponthe seatingcapacityofthe premiseswherethe programis to be presented,shall accompanyeachapplicationfor apermitto presentaprogramof contestsor exhibitions. Theamountof thefeeshallbefixedby commissionregulation.

(b) Foreigncopromoterpermit.—Thefee for the issuanceof a fqreigncopromoter’spermit for eachprogramof contestsor exhibitionsshall befixed by commissionregulation.Section916. Additional licensefees;penalties.

(a) Grossreceipts fees.—Inaddition to the paymentof any other feesand moneys due under this act, every promotershall pay an additionallicensefee of 5% of thetotal grossreceiptsof anyboxing contestor exhibi-

tion, exclusiveof anyFederaltax oranytax imposedby anypolitical subdivi-sionof this Commonwealthwhich waspaidthereon.For thepurposesof thissection,total gross receiptsof everypromoterupon whichthe 5% is to becomputedshallincludethe grossprice chargeablefor thesale,leaseor otherexploitationof broadcasting,televisionand motion picture rights of suchcontestor exhibition without any deductionswhatsoeverfor commissions,brokeragefees,distributionfees,advertisingor otherexpensesor chargesinrespectthereto.Grossreceipts,for the purposesof this section,shall alsoincludethefacevalueof all ticketssoldandcomplimentarytickets-issued.

(b) Timeperiodfor payment.—Thepaymentof theadditionallicensefeeprovidedfor in thissectionshallbemadewithin 48 hoursafter thecontestorexhibitionandshallbeaccompaniedby aform prescribedby the Departmentof Revenuesettingforth thegrossreceiptsreceivedfromthecontestor exhi-bition, togetherwith suchotherinformationastheDepartmentof Revenuemayrequire.

(c) Collection of fee.—Theadditional license fee provided for in thissectionshall be collectedby the departmentandtransmittedto the Depart-mentof Revenue,togetherwith thereportsfiled therewith.

(d) Penalties.—(1) Any promoterwho willfully makesa falseand fraudulentreport

underthis sectioncommitsperjuryandshall, uponconviction,be subjectto punishmentasprovidedby law. Suchpenaltyshallbein additionto anyotherpenaltiesimposedbythisact.

(2) Any promoterwho willfully fails, neglectsor refusesto make areport, or to pay the licensefeesas hereinprescribed,or who refusestopermit the departmentto examinethe books,papersandrecordsof anypromotioncommitsamisdemeanorof thethird degreeandmay-besubjecttosuspensionor lossof hislicenseatthediscretionof thecommissio-n.

CHAPTER 11CONTRACTS, ADVERTISING, TICKETS AND SPECTATORS

Section 1101. Commissioncontrolof contracts.Thecommission,with the approvalof thedepartment,is requiredto pro-

mulgate rules andregulationsgoverningthe form andcontentof all con-tractsenteredinto betweenor amongpromotersand foreigncopromotersandprofessionalboxersandmanagersandall contractsbetweenmanagersand professionalboxers.All contractsrequiredunder the provisionsof thisactshallbein writing.Section 1102. Contractssubjectto law.

Everycontractsubjectto the provisionsof this chaptershall containthefollowing clause:

This agreementis subjectto the provisionsof this act andto the rulesandregulationsof the Departmentof State,andto any future amend-mentsof eitherof them.

Section 1103. Provisionsin contractsbetweenmanagersandprofessionalboxers.

(a) Generalprovisions.—Everycontractbetweena manageranda pro-fessionalboxer shall containprovisionsgoverningits duration,division ofthe boxer’s pursesandthe minimum sum to be guaranteedannuallyto theboxerby themanager.

(b) Terminationof contract.—Eachcontractshall further providethatthecontractshallbeautomaticallyterminatedif the licenseof eitherparty isrevokedby thecommissionor if themanagerfails to renewhis licensewithin30 daysafter its expiration.If the licenseof either partyis suspended,thecontractshallnot be bindingupon theotherpartyduringthe periodof suchsuspension.Section 1104. Approvalof contracts.

No contractbetweena manageranda professionalboxer shall be legallyvalidandbindinguntil both partiesto thecontracthaveappearedbeforethecommissionandhave receivedits approvalwhich shall be endorsedon thecontract.Section 1105. Tickets.

(a) Scheduleddate and price.—-Every ticket of admissionto a boxingcontestor exhibition shallclearly show on its facethe scheduleddateof thecontestor exhibitionandits purchaseprice,includinganytaxesthereon.

(b) Pricelimitation.—Noticket shallbesoldby any promoteror foreigncopromoterfor morethantheprice printedthereon.

(c) Anti-scalpingprovision.—Nootherpersonshall sell any ticket formorethan504 in excessof theprice printedon theticket. No licenseeunderthisactshalldirectlyor indirectly receiveanypartof anyexcessprice.

(d) Numberingof tickets.—Ticketsin eachpricerangeshall beconsecu-tively numbered,andthe numberof eachticket shall be clearlyprintedonboththestubandmainportionof theticket.

(e) Scheduleof tickets.—Ascheduleof thenumbersof all ticketsin eachpricerangeshallbefurnishedtothedepartment.Section1106. Misdemeanortodestroytickets.

Exceptuponreceiptof prior written authorizationfromthedepartment,itshall be a misdemeanorof the seconddegreefor any promoteror personassociatedwith or employedby any promoterto destroyany ticketor ticketstub, whethersoldor unsold,within six monthsafter thedateof anycontestorexhibition.Section1107. Ticket refunds.

(a) Full refund.—Uponpostponementor cancellationof the maineventor the entireprogramof contestsor exhibitions, thepromotershall refundthe full purchaseprice of eachticket to any personwhopresentssuchticketfor a refundwithin 30 daysafter the scheduleddateof theevent.Within 10daysafter the expiration of this 30-day period, the promotershall pay allunclaimedticket receiptstothe department.Thedepartmentshallhold thesefundsfor aperiodof oneyearfor thepurposeof makingadditionalrefunds.Thereafter,the departmentshallpay all remainingmoneysfrom suchticketsale to the State Treasurerfor depositinto the GeneralFund, withoutescheat.

(b) Forfeiture of security.—Failure of any promoter or foreigncopromoterto comply with the provisionsof subsection(a) shall be suffi-cient causeto warranta forfeiture of his bond, or other security, andanimposition of a penalty or suspensionor revocationof his licenseby thedepartmentasprovidedin thisact.

(c) Pro rata refunds.—Fromthe fund producedby the forfeiture, prorata refundsshall be madeby the departmentto personswho purchasedtickets,in accordancewith theprovisionsof subsection(a).Section 1108. Advertisingmatterto stateadmissionprice.

Eachshowcard,bill, poster,newspaperor anyotheradvertisementof anycontestor exhibition shallcontaina scheduleof admissionpricesandacon-spicuousstatementof whethera contestor exhibition is being presented.Failureto comply with theprovisionsof thissectionshall constitutegroundsfor thesuspensionor revocationof thepromoter’slicense.Section1109. Admissionsnotto exceedseatingcapacity.

It shallbeamisdemeanorof thethird degreeforanypromotertoadmit-toanycontestorexhibitionmorepersonsthanthereareseatsin-theplacewherethecontestor exhibitionis beingheld.Section1110. Age of spectators.

No minor 16 yearsof ageor undershallbepermittedto attendanyboxingcontestorexhibitionunlessaccompaniedby anadult.

CHAPTER 13BONDS

Section1301. Promotersandforeigncopromotersrequiredto file bonds.(a) Generalrule.—Beforeanylicenseor renewalof alicenseis issuedto a

promoterandbeforeany permit is issuedto a foreign copromoter,he shallberequiredto executeandfile asuretybondwith thedepartmentin suchrea-sonableamount,but not lessthan$3,000,asthedepartmentshalldetermine.

(b) Formof bond.—All suchbondsshall beupon forms suppliedby thedepartment,which shall havefirst adoptedthem with the approvalof theOfficeof AttorneyGeneral.

(c) Approvalof sureties.—Thesufficiencyof thesuretiesshallbesubjecttoapprovalof thedepartmentandtheOfficeof AttorneyGeneral.

(d) Conditions.—Thesuretybond shallbeconditioneduponthe faithfulperformanceby thepromoteror foreigncopromoterof his obligationsunderthis act andthe rules andregulationspromulgatedpursuanthereto,includ-ing, but not limited to, the fulfillment of his contractualobligationsto con-testants,managersandother licensees,andthe paymentof all licenseandpermit fees provided for in this act. The aggregateannual liability of thesuretyfor all obligationsandfeesshall in no eventexceedtheamou-ntof-thebond.Section 1302. Depositin lieu of suretybond.

In lieu of the surety bond requiredby section 1101,the promotermaydepositwith the departmentcash,a certified checkor direct obligationsofthe United Statesor the Commonwealthof Pennsylvaniaacceptableto thedepartment,in an equivalentamount and subjectto the sameconditions.

Suchsecurityshall not be returnedto the promoteruntil oneyearafter thedateon which it was depositedwith the department,unlessasuretybond issubstitutedfor thesecurity.After theexpirationof oneyearfrom thedateonwhichthe securitywasdeposited,if no claimagainstthedepositis outstand-ing,it shallbereturnedtothedepositor.Section 1303. Filing fee.

A filing fee fixed by the departmentshall accompanyeachbond filed orcashor securitydepositedin lieuof thebondundertheprovisionsof thisact.Section 1304. Recoveryon bond.

Recoverymaybehadon suchbondor againstsuchdepositof-cashorsecu-rity in thesamemanneraspenaltiesarerecoverableatlaw.Section 1305. Applicationandfees.

(a) Fee.—Anapplicationforapermitor licenseshallbeaccompaniedbyanonrefundableapplicationfeein anamountestablishedby thecommissionby regulation,whichfeeshall besubjectto reviewin accordancewith theactof June25, 1982(P.L.633,No.181),knownastheRegulatoryReviewAct. Ifthe revenuesgeneratedby fees,fines andcivil penaltiesimposedin accor-dancewith theprovisionsof thisactarenot sufficientto matchexpendituresover atwo-yearperiod, thecommissionshall increasethosefeesby regula-tion, subjectto reviewin accordancewith the RegulatoryReviewAct, suchthattheprojectedrevenueswill meetor exceedprojectedexpenditures-.If thedepartmentdeterminesthatfeesand/orfinesestablishedby thecommissionare Inadequateto meetthe minimum enforcementefforts requiredby thisact, then the department,after consultationwith the commission,shallincreasethefeesand/orfinesby regulations,subjectto reviewin accordancewith the RegulatoryReviewAct, such that adequaterevenuesareraisedtomeettheminimumenforcementeffortsrequiredunderthisact.

(b) Affidavit.—Eachapplicationshallbeaccompaniedby anaffidavitoraffirmationof theapplicantastoits verity.

(c) Dispositionanduseof fees.—Feesshall becollectedby the commis-sionandshallbepaidinto theAthleticCommissionAugmentationAccount.

CHAPTER 15HEARINGS AND TE:MPORARY SUSPENSIONS

Section1501. Commissionhearings.The commissionshall conductall hearingsunder theprovisionsof Title 2

of the PennsylvaniaConsolidatedStatutes(relating to administrativelawandprocedure)andmustconducta hearingwithin ten businessdaysfromthetimeanyrecommendationis madeby theexecutivedirectorthatapermitor licensebesuspendedor revoked.Section 1502. Subpoenas.

The commissionmay issuesubpoenasin connectionwith the investiga-tions, requiringthe attendanceandtestimonyof or theproduction:of:booksandpapersby anylicenseeor otherpersonwhomthecommissionbelievestohaveinformation,booksor papersof importanceto it in makingtheinvesti-gation.

Section1503. Temporarysuspensionof licensesor permits.(a) Generalrule.—Thecommissionshall havethe power,upon its own

motion or upon the verified written complaint of any personchargingalicenseeor permitteewith violating any provisionof thisactor therules andregulationspromulgatedunder thisact, to suspendtemporarilyany licenseor permit until final determinationby the commission,whensuchaction isnecessaryto protectthepublicwelfareandthebestinterestsof buxin~.

(b) Meetings.—Uponthe oral or written agreementof two membersofthecommission,thecommissionmayconductmeetingsundersubsection(a)by voice or video electronicmeans,if thesubjectmatterof themeetingis socompellingor timely that consideringthe matterat the commission’snextregularmeetingwould renderany decisionmoot, adverselyaffect the rightsof the aggrievedpartiesunder this act or threatenthe safety or physicalhealthof participants.A stenographicrecordof suchmeetingsshallbemadeandmaintainedby thecommissionandbemadeavailabletothepartiesuponrequest.Thesubjectmatterof anysuchmeetingshall thenbecomethe firstitemon thecommission’sagendafor itsnextregularlyscheduledmeeting.

(c) Hearingdate.—Thecommissionshallholdahearingwithin tenbusi-nessdaysafterthe dateon whichthelicenseor permitwassuspendedtempo-rarily, atwhichtimereasonableeffortsshallbemadefor theaffectedpartiesandthecommissionto bephysicallypresent.Section 1504. Suspensionor revocationof licenses.

(a) Generalrule.—Thecommissionshall havethe power to suspendorrevokealicenseor permit in any casewherethe commissionfinds that thelicenseeor permittee:

(I) Isguiltyof grossimmorality.(2) Isunfitor incompetentby reasonof negligenceor habits.(3) Isguilty of violating any provision of this act or of the rules and

regulationsof thedepartment.(4) Hascommittedfraud or deceitin securinghisor another’slicense

or permit.(5) Hasbeenconvictedof, or pleadedguilty or enteredaplea of nob

contendereto, or hasbeenfound guilty by ajudgeor jury of, acrime inanyjurisdictionwithin tendaysprecedingthesuspensionor revocation.

(6) Is an habitualdrunkard,or is addictedto the useof morphine,cocaineor otherdrugshavingasimilareffect.

(7) Isor hasbecomementallyincompetent.(8) Hasbeenguilty of unprofessionalor unethicalconduct,or such

conductasto requireasuspensionor revocationin thepublicinterest.(9) Hasmadea misstatementof a materialfact or fraudulentlycon-

cealedamaterialfact,or hasinduced,aidedor abettedanyotherpersoninmisstatingor concealinganymaterialfact in anyapplicationor otherpro-ceedingunderthisact.

(10) Hasfailed to accountfor or pay overmoneysbelongingto otherswhichhavecomeintohispossessionin connectionwith aboxingcontestorexhibition.

(11) Hasfailed to furnishtothe properpartyacopyof anycontractorstatementrequiredby this act or the rules and regulationspromulgatedunderthisact,or hasbreachedsuchacontract.

(12) Haspaid or agreedto pay any moneyor article of valueto anypersonnot having a license or a permit for soliciting or for businesssecuredor for renderingof anyserviceor thedoingof anyof theacts for-biddenby this act andthe rulesandregulationspromulgatedunder thisact.

(13) Has loanedhis licenseor permit to anotherpersonor hasbor-rowedorusedthelicenseorpermitof another.

(14) Is guilty of anyformof pretensewhich mightinducethepublicorcitizensto becomeapreyto professionalexploitation.

(15) Has employeda personwho hasnot beenissued a licenseorpermitwhensorequiredby law.

(16) Has failed to maintainin force the bond requiredby this actorhasfailed to depositwith thedepartmenttherequiredcash,checkorsecu-rities requiredin lieu of thebond.

(17) Has by act or omissionconductedhimself in a mannerdetri-mentalto thebestinterestsof boxinggenerallyor to thepublicinterestandgeneralwelfare.

(18) Is associating or consorting with criminals, bookmakers,gamblersor personsof similar ill repute,or with personsof no knownorvisible meansof livelihood, or is himselfengagedor engagingin similarpursuitsor conduct.

(19) Hasbeendisciplinedin anymannerby the departmentor similaragencyor bodyof anyjurisdiction.

(20) Hasfailed to payafinecr anypart thereofimposedby thisact.(b) Hearings.—Anylicenseeor permitteewhoselicenseor permit is sus-

pendedor revokedpursuantto the provisionsof this section shall have aright to a hearingbeforethe commissionwithin ten businessdaysafter thedateon whichthelicenseor permitwassuspendedor revoked.

CHAPTER 17PENALTIES

Section 1701. Misdemeanors.Any personconvictedof anymisdemeanorunderChapters1 through19 of

thisactshallbesentencedtopayafine of not morethan$5,000,or to-impris-onmentfor not morethanthreeyears,or both.Section 1702. Fines.

The commissionshall havethe right to imposea fine of not morethan$5,000for anyviolation of Chapters1 through19 of thisactor the rulesandregulationspromulgatedunderChapters1 through19 of thisact, or in addi-tion to any other punishmentherein provided for such violation. Anylicenseeor permitteeupon whom afine is imposedunder this sectionshallhavearight to ahearingbeforethecommissionwithin tendaysafterthedateon whichthefine wasimposed.

CHAPTER 19FINANCIAL INTERESTS

Section1901. Financialinterestinboxerprohibited.No licensedphysician,referee,judgeor promotershall haveanydirect or

indirect financial or pecuniaryinterest in any boxer. A violation of thissectionshallconstituteamisdemeanorof thethirddegree.Section1902. Financialinterestin opponentprohibited.

No manager,traineror secondof any boxershall haveanydirect or indi-rectfinancial or pecuniaryinterestin the opponentin anycontestin whichhisown boxerparticipates.No boxer shallhaveanydirect or indirect finan-cial or pecuniaryinterestin hisopponentin any contest.A violation of thissectionshallconstituteamisdemeanor.Section 1903. Financialinterestof matchmaker.

No matchmakeror promotershallhaveanydirect or indirectfinancialorpecuniaryinterestin anyboxerwho is engagingin acontestarrangedby thatmatchmakeror promoter.A violation of thissectionshallconstituteamisde-meanor.Section 1904. Fees,finesandforfeitures.

All fees, fines,forfeituresandothermoneyscollectedundertheprovisionsof this act andtherules andregulationspromulgatedunderthisact shallbecollectedby thecommissionandtransmittedto theDepartmentof Revenue.Section 1905. Rulesandregulations.

Thecommissionis herebygrantedthepowerto promulgaterulesandregu-lationsgoverningthepresentationof professionalboxingandallmatters-per-tainingthereto.Suchrulesandregulationsshallincludethoserulesandregu-lationsspecificallyrequiredby thisact, togetherwith suchothersasthecom-mission shall considernecessaryin order to carry out the provisionsof thisact.

CHAPTER 21PROHIBITED COMPETITIONS

Section2101. Prohibitedcompetitions.(a) Offensedefined.—A personcommitsa misdemeanorof the first

degreeif hepromotes,sponsorsor participatesin anymannerin thestagingof, or theconductof, anytough guy contestor battleof the brawlersor inanysimilar competition.

(b) Applicationof section.—(1) This sectionshallnot applyto thenewsmedia,including,but not

limited to, television,radio, newspapersandperiodicals,for their report-ing activitiesrelatingto toughguycontestsor battlesofthebrawlers.

(2) Thissectionshallnot applyto amateuror professionalcontestsorexhibitionsfor whichapermithasbeenissuedunderChapter7 norto pro-fessionalwrestling exhibitionsnor to contestsstagedin connectionwithathletic training programsnorto amateuror professionalcontestsof themartialartsnor to anycollegiateor scholasticboxing, wrestlingor martialartscontests.

(c) Definition.—Asusedin thissection,theterm “toughguy contest”or“battle of thebrawlers”meansanycompetitionwhich involvesanyphysicalcontactbout betweentwo or more individuals who attempt to knock outtheir opponentby employing boxing, wrestling, martial artstactics or anycombinationthereofandby usingtechniques,including, but not limited to,punches,kicks andchoking.

CHAPTER 31MISCELLANEOUS PROVISIONS

Section 3101. Repeals.(a) Specificrepeals.—Thefollowing actsandpartsof actsarerepealed:

(1) Sections427 and 2503 of the act of April 9, 1929 (P.L.177,No.175),knownasTheAdministrativeCodeof 1929.

(2) Act of August31, 1955(P.L.531,No.131),known asthe Pennsyl-vaniaAthleticCode.(b) Partial repeals.—Sections202 and 207.1(d) of the act of April 9,

1929 (P.L.177, No.175), known as The Administrative Codeof 1929, arerepealedinsofarastheyrelatetotheStateAthletic Commission.Section 3102. Statusof existinglicenses.

All licensesandpermits issuedpursuantto any act repealedby this act,except with respectto professionaland amateurwrestling, shall continuewith the sameforce andeffect asif suchacthadnot beenrepealed,subject,however,to the powerof thedepartment,asprovidedin thisact, to suspendor revokethe licenseor permit of any suchpersonfor any of the causesorreasonsset forth in this act andsubjectto the powerof the commissiontorequireanysuchpersonto obtainalicenseor permitpursuanttothisact.Section 3103. Effectof priorrulesandregulations.

All rules andregulationsmadepursuantto any act repealedby this act,exceptwith respectto professionaland amateurwrestling,shall continueinfull forceandeffect.Section 3104. Savingclause.

Theprovisionsof this act, so far as theyarethe sameasthoseof existinglaw, exceptwith respectto professionalandamateurwrestling,areintendedto be acontinuationof suchexisting law andnot as newenactments.Theprovisionsof this actshall not affectany act done,liability incurred, rightaccruedor vestedor suit or prosecutionpendingas of the effective dateofthis act, or any actionto enforceany right or penaltyor punishany offenseunderauthorityof suchrepealedlaws.Section3105. Reestablishmentof commission.

This act, with respectto the StateAthletic Commission,constitutesthelegislationrequiredto reestablishan agencyunderthe act of December22,1981(P.L.508,No.142),knownastheSunsetAct.Section3106. Athletic CommissionAugmentationAccount.

BeginningJuly 1, 1989,andthereafter,all fundscollectedby thecommis-sion shall be paid into the Athletic CommissionAugmentationAccount,which is herebycreatedand which shall be a special restrictedreceiptsaccountwithin the GeneralFund.This accountshall be usedonly for the

supportandoperationof the commissionunlessa surplusarisesafter twoconsecutiveyears,at whichtime thesecretaryshalltransferany amountinexcessof thecommission’sbudgetinto theGeneralFund.Section3107. Appropriation.

The sum of $350,000,or as muchthereofasmaybe necessary,is herebyappropriatedfrom theProfessionalLicensureAugmentationAccountto theStateAthletic Commissionfor the paymentof costsof processingpermits,licensesandrenewals,for the operationof the commissionand for othergeneralcostsof the commission’soperationsrelatingto thisact. Theappro-priationgrantedshall berepaidby the commissionwithin threeyearsof thebeginningof issuanceof licensesandpermitsunderthisact.Section3108. JointStateGovernmentCommission.

The Joint StateGovernmentCommissionshall establisha taskforce toconductastudyon boxingin this Commonwealthandshallcommunicate-itsfindings andrecommendationsto the GeneralAssembly,the Governorandthecommissiononor beforeApril 1, 1990.Section3109. Retroactivity.

Section 3105of thisactshallberetroactivetoDecember31, 1988.Section3110. Effectivedate.

Thisactshalltakeeffectimmediately.
