WATCH AND WIN SPECIFIC TERMS & CONDITIONS 1. The Paul Henry ‘Watch & Win’ Competition (“Competition”) is promoted by AMP Services (NZ) Limited (“AMP”) and the MediaWorks Group and is open from Monday, 19 October 2015 to 7:59am on Friday, 23 October 2015 (“Competition Period”). The winner will be announced live on Paul Henry between 8:00am and 9:00am on Friday 23 October 2015. 2. (d) all Disqualified Participants as set out in the Standard Competition Rules below. For the purposes of this clause, related company” has the same meaning as set out in section 2(3) of the Companies Act 1993. 5. During the Competition Period, the Word of the Day will be mentioned by Paul Henry during the Paul Henry Show and the Word of the Day will also be displayed on the Paul Henry WIN website page. To enter the Competition, persons must enter online via the Paul Henry WIN website page (http://www.3news.co.nz/TVShows/PaulHenry/Win) and submit the correct Word of the Day. A person can make only one entry per day and a maximum of five entries in total. 6. AMP assumes no responsibility for any failure to complete or receive an entry as a direct or indirect result of a technical problem or any kind of internet malfunction. 7. AMP reserves the right to assess the validity of a person’s participation in the Competition. AMP also reserves the right to remove any person from the Competition for any reason, including, but not limited to, where the conditions of entry to the Competition have not been met.

WATCH AND WIN SPECIFIC TERMS & CONDITIONS

1. The Paul Henry ‘Watch & Win’ Competition (“Competition”) is promoted by AMP Services (NZ) Limited (“AMP”) and the MediaWorks Group and is open from Monday, 19 October 2015 to 7:59am on Friday, 23 October 2015 (“Competition Period”). 8. The winner will be announced on air on Paul Henry on Friday 23 October 2015. The winner must be available on the phone between 8am- 9am on Friday 23 October 2015. If a winner does not answer their given phone number on the first call their chance to win is forfeited and MediaWorks will randomly draw a new winner. All entrants’ personal details must be valid and up to date.

9. By entering the Competition, AMP is authorised to use any information collected for the purpose of contacting the entrant about the Competition through electronic mail, phone or post. Where the entrant has ticked the box “I authorise AMP to contact me about information and promotions that are of interest to me” then AMP is authorised to provide the entrant with information about AMP’s products and services and other marketing and promotions. The information is collected by MediaWorks, 3 Flower Street, Eden Terrace, Auckland and held by AMP, Level 21, 29 Customs Street West, Auckland. The entrant has the rights of access to and correction of the information about him/her. The information will be held securely.

10. The $15,000 (GST incl.) Prize will cover:

(a) if the winner lives outside of Queenstown, return domestic flights for two adults and two children (1-18 years) to Queenstown. The winner and his/her travelling companions must travel together at all times.

(b) three nights’ accommodation at The Sofitel, Queenstown for two adults and two children (1-18 years).

(c) a tailored adventure package created by AMP for the winner and his/ her 3 family members using the remaining value of the Prize (after the flight and accommodation expenditure has been accounted for).

11. The following will not be included in the Prize:

(a) any additional flights, accommodation, meals and transport not included in the Prize set out in 10;

(b) any expenses not covered by the package in 10(c) above, including spending money, laundry charges, insurance, minibar, room service and incidentals; and

(c) if for any reason a tax or levy is applied to the Prize; it will be the responsibility of the recipient to pay that tax or levy.

12. The Prize and any component of the Prize are not refundable, transferable or redeemable for

cash. The recipient of the Prize may not nominate someone else to receive the Prize. If a recipient is unable or unwilling to accept the Prize, AMP may award it to an alternative recipient. Any attempt to resell or auction all or any part of the Prize will result in an immediate cancellation of the Prize.

13. The AMP Chief Customer Officer or his/ her delegate reserves the right to rule on any

interpretation or other extraordinary matters relating to the rules of the Competition. That decision will be final.

14. The winner takes the Prize entirely at his/her own risk. To the fullest extent permitted by law, AMP and its directors and employees will not be liable for any (direct or indirect) claim, loss, cost, damage, personal injury or liability whatsoever arising from or in conjunction with the Prize or this Competition.

15. AMP’s decision on the Prize and all other aspects of the Competition will be final and binding. No correspondence will be entered into.

16. AMP reserves the right to extend, change or terminate any aspect of the Competition, including altering the Prize or these terms and conditions of the Competition at any time. No claim may be made against AMP or any of its agents and employees in connection with any such extension, change or termination.

17. In the event that any aspect of the Prize is not available, AMP reserves the right to substitute it with another reward of approximately the same or similar value.

18. Participation in the Competition is deemed to be acceptance of these terms and conditions. The

Prize is subject to the terms, conditions and restrictions of the Prize’s service providers. The people who accompany the winner on this holiday are also subject to these terms and conditions.

19. By accepting the Prize, the winner agrees to participate in any publicity arrangements that AMP

may reasonably require in relation to the Competition. The entrant agrees that his/her identity and the identity of his/her family members may be disclosed in winner announcements and agree to have their images photographed and used for publicity purposes without any additional payment being made or additional permission required.

20. The laws of New Zealand apply to this Competition.

STANDARD PROMOTION OR COMPETITION RULES Definitions

“Disqualified Participants” means:

(a) all MediaWorks employees, all employees of participating sponsors or

promoters and/or advertising agencies and their Immediate Families;

(b) all people under the age of 18 years where the prize incorporates air

travel or any other element which would be illegal to supply to a

person under the age of 18 years;

(c) all people who have won a prize from the channel/station running this

promotion in the last 14 days. If the previously won prize was valued

at over $1000, the winner must stand-down from entering for a period

of 90 days.

“MediaWorks” means all companies in the MediaWorks Group including but not

limited to MediaWorks TV Limited, MediaWorks Radio Limited and all

brands and operating companies controlled by or associated with

those entities;

“Promoter” is AMP Services (NZ) Limited;

“Immediate Families” include spouses, Grandparents, Parents, Children, and

Grandchildren whether by marriage, past marriages, remarriage,

adoption, co-habitation or other family extension.

Entry

1. These Promotion or Competition Rules (‘the Rules’) apply to all MediaWorks Promotions or

Competitions (collectively ‘the Promotion’) conducted on or off air and by means of any

medium – radio, television, print, telephone or computer. The Rules may change from time to

time.

2. If a particular Promotion has specific rules or terms (‘the Specific Rules’) those Specific Rules

will apply if there is any inconsistency with the Rules.

3. Unless otherwise stated in the abovementioned specific rules or terms, registration, entry or

vote is limited to 1 per person. Where multiple registrations, entries or votes are acceptable,

each must be made separately.

4. Entry into the Promotion is deemed to be acceptance of the Rules and confirmation that the

entrant has the necessary authority (for example from the bill payer or owner of a telephone)

to enter the Promotion.

5. The Promotion is open to New Zealand Residents only. Disqualified Participants may not enter

in the Promotion.

6. MediaWorks reserves the right to exclude any person from participating in the Promotion on

reasonable grounds.

7. MediaWorks reserves the right to refuse to award any prize to an entrant who MediaWorks

decides (in its sole discretion) has violated the Rules, gained unfair advantage in participating

in the Promotion or won using fraudulent means.

8. By participating, entrants grant MediaWorks exclusive permission to use their names,

characters, photographs, videos, voices and likeness in connection with the Promotion and for

future promotion and marketing purposes and waive any claims to royalty, right or

remuneration for such use.

9. All entrant personal details must be valid and up to date and will be held by MediaWorks and

may be used for the purpose of the Promotion and for future promotion and marketing

purposes in accordance with MediaWorks Privacy Policy (see www.mediaworks.co.nz) unless

otherwise directed by contestants at the time of entry.

10. Personal information provided at the time of entry is presumed to be true and, in the case of

text or email notification – active, through to and beyond the date of the Promotion’s

completion.

11. Where the promotion involves texting, the following apply:

a. standard sms text charges will apply, unless otherwise stated in the Specific Rules and

will depend on the entrant’s particular plan or agreement with their phone service

provider;

b. any form of automated text message is invalid;

c. the telephone number from which the entry was made will be stored in a database. The

entrant has a two-business-day period from the time of entry to request removal from

the database.

d. if no request is made it is deemed acceptance that the information can be used for

future promotion and marketing purposes; and

e. MediaWorks takes no responsibility for text costs incurred after the Promotion has

closed as stipulated in the Specific Rules.

Winning the Prize

12. Only the person who originally entered the Promotion can be awarded the prize (‘the

Winner’).

13. The Winner will be determined in the manner set out in the Rules or the Specific Rules – if not

specified then as determined by the Promoter who shall for this purpose be deemed the

Judge.

14. The Judge’s determination of the Winner will be final and no correspondence will be entered

into.

15. The Winner will be notified by email, phone (voice or text), social media notification (by way

of private message, tagging or commenting on a post or image), posted mail or in person and

must be available for the preparation of all publicity that may be required by MediaWorks.

Where attempts to contact the Winner fail (eg when the Winner cannot be contacted by

phone after three attempts; or mail sent is returned; or when the Winner fails to respond to

social media notification within 48 hours) the Judge will select another winner. For social

media promotions, the Judge will select a maximum of 3 winners. If the prize is not claimed

48 hours after the third winner is notified, the prize will be regarded as forfeit and will not be

redrawn. For all promotions, if after successful notification, the prize is not collected within

two months of being announced it will be regarded as forfeit. (Note: 3 attempts to contact the

Winner will include individual calls to any numbers provided at the time of entry. However,

should the prize’s total worth equal less than NZD$250 and be a live-to-air draw, only one

failed attempt at contact will be acceptable before the Judge selects another winner.)

16. The prize is not redeemable for cash or transferable. No other family members, friends, office

associates or any other person will be able to participate on the Winner’s behalf. In the event

that the prize specified in the Competition becomes unavailable for any reason the Promoter

may substitute a prize of like or equal value.

17. Where the Winner is required to claim the prize in person, they must provide proper

identification (eg driver’s licence, passport, birth certificate). If the Winner is under the age of

18 years their parent or legal guardian must accompany the Winner or give their prior written

consent to the award of the prize.

18. The Winner takes the prize entirely at his/her own risk and indemnifies MediaWorks in

respect of any claim for any accident, injury, property damage or loss of life that may occur in

connection with the prize. The Winner is responsible for all insurance, tax or other costs that

may be associated with the prize.

MediaWorks Responsibility

19. MediaWorks reserves the right to amend, vary, extend or discontinue a Promotion at any

stage, for any reason.

20. MediaWorks takes no responsibility for any inability to enter, complete, continue or conclude

the Promotion due to equipment or technical malfunction, busy lines, inadvertent

disconnection, texts with a misspelt keyword, texts to an incorrect shortcode, Acts of God or

otherwise.

21. To the fullest extent permitted by law MediaWorks will not be liable for any loss or damage

whatsoever (including but not limited to direct or consequential loss) or for personal injury as

a result of Promotion entry or winning the prize.

22. Where the prize is to be supplied by an entity outside MediaWorks control and that entity

fails, for whatever reason, to supply the prize, MediaWorks has no responsibility for

the provision of the prize and is not obliged to provide an alternative prize or to take legal

action to require the prize supplier to provide the prize.

Acceptance

23. Participation in the Promotion is deemed acceptance of these Terms and Conditions.
