AMENDMENTS TO THE FAMILY LAW RULES:

BACKGROUND PAPER

1. INTRODUCTION

New rules of practice and procedure in the family law area have

been adopted to coincide wi th the coming into force of the new

federal divorce legislation and the new provincial enforcement

legislation.

Those lawyers who have lleen practicing in ~he Unified Family

Court in Saskatoon will notice a shift to rules more 1 ike the

general Queen I 5 Bench rules: for example, pleadings

requirements and personal service of the divorce petition.

Those lawyers who have been practicing elsewhere in Saskatchewan

will notice a shift to rules more like the Unified Family Court

rules: for example, service by ordinary mail of most documents

and all family law proceedings commenced by one document. All

Saskatchewan lawyers will be practicing under a new procedure,

which is now uniform throughout the province.

The Divorce Act, 1985 has had a significant impact on

procedure.

For example, there is now only one divorce judgment,

to the former decrees nisi and absolute; both

spouses may jointly petition for divorce; uncontested

proceedings under the Divorce Act. may be decided on the basis of

affidavit evidence without the appearance of counselor the

parties. Further, there is some Canada-wide uniformity evident

in the new rules: for example, the form of the divorce judgment

(which is neutral in terms) and the certificate of divorce, the

rules on variation proceedings.

Many of the new family law rules are drafted to be similar to

the general Queen's Bench rules, and the practitioner will be

familiar with the procedure. For example, the former notice of

petition is now included as a part of the Petition, just as the

former writ is included as a part of the Statement of Claim; ,

the times allowed for service and delivery of pleadings are the

same as those allowed in an action under the general rules.

Where the former family law rule was a mere repetition of the

general rule, it has been deleted, and the general rule will now

apply: for example, former rule 614 providing that costs are in

the discretion of the court has been deleted, and general rule

542 will now apply.

The reciprocal enforcement of maintenance order rules are

amended as we 11. Because of changes to the legislation

consequential to The Enforcement of Maintenance Orders Act,

amendments to these rules were necessary. Additionally, the

procedure for prOVisional orders and confirmation orders under

sections 18 and 19 of the Divorce Act, 1985 is very similar to

the procedure under The Reciprocal Enforcement of Maintenance

Orders Act, 1983. Both proceedings have been included in one

set of rules, rather than duplicating two similar sets of rules.

II. PART 48 - FAMILY LAW PROCEEDINGS

A. GENERAL

1. Application, of Rules: Rule 585

The rules in this Part will apply tQ all proceedings under the

Divorce Act, 1985, including a di.vor,ce proceeding (which may

include a claim for corollary relief), a corollary relief

proceeding (after divorce), and a variation proceeding. These

rules also apply to proceedings under The Matrimonial Property

Act; proceedings for custody, guardianship or maintenance of an

infant, whether under The Infants Act or under the parens

patriae jurisdiction of the Court of Queen's Bench; and

proceedings for a matrimonial cause, whether under The Queen's

Bench Act (e.g., judicial separation, alimony) or The

Matrimonial Causes Act, 1857, (U.K.) ,(e.g. nullity) or othenvise

(e.g., nullity proceedings under The Marriage Act).

The transitional ~rovision in this Part v{lries from the general

rule (see rule 1(2)), just as the tr~nsitional provision in

section 34 of tbe Divorce Act, 1985 varies from the, general

rule. Proceedings already commenced under the former rules

(Part 40: Matrimonial Causes, Part 40 A: Matrimonial Property,

Part 41 (rules 520-523): Infants, Part 48: The Divorce Act,

Part 49: The Di~orce Act - Unified Family Court, or the general

Queen's Bench or Unified Family Court rules) are to be completed

under those formet rules. (When the new release comes out for

your grey Rules of Court binder, perhaps you should retain the

old rules until all proceedings already commenced in you'r office

have been finally disposed of.) A corollary relief proceeding

or a variation proceeding commenced after 'the Divorce Act; 1985

is in force is commenced under the new legislation and rules,

even though the divorce decree or the custody or support order

on' whIch the proceeding is based was granted under the former

legislation and procedure.

2. Commencement and Joinder: Rules 586' & 587

Proceedings under this Part are commenced by Petition" in form

61. The form is in effect a consolidated petition including

paragraphs relating to all of the claims which may be made 'under

this Part," and only the paragraphs applicable to the actual

claims being made are to be included in the Petition issued. On

the other hand, all claims being made are to be intluded in the

one Peti tion. It is no longer necessary to issue a Peti tion to

comme-n'ce the divorce, sta'rt 'a separate application for division

1 3. Parties: Rule 588

There are substantial changes from the former procedure in the

parties rule. The former cOMrespondent (person alleged to have

committed adultery with the respondent spouse) is not, made a

party to the proceeding, and in fact is n6t even named in the

Petition or affidavit admitting adultery. Damages for adultery

aTe not recoverable in Saskatchewan due to a 1977 M 78 amendment

to The Queen's Bench Act, and there seems to be no reason to

name that person - even though a petitioner may express moral

indignation and a desire to expose the name in a public trial as

an immoral person. Where the person is not named, ,the procedure

is simplified, because it is not necessary to serve that person

) or to give him an opportunity to dispute the allegation of

adultery. If it appears to the court that the act of adultery

and the person are fictitious, the court will likely order that

the person be named,. served and given an opportunity to dispute

the Petition.

4. Service: Rules 590 - 592

Personal service is required for a Petition claiming divorce.

However', any other Petition or application may be served by

ordinary mail. This rule is permissive regarding service by

ordinary mail, not mandatory, and the general service, rules may

be used for alternative modes of service. Any commencement or

other document may be served personally under rule 18, or by

registered mail' where rule 19 applies, or by the terms of an

order for substituted service under rule 23, etc.

The rule for service by ordinary mail includes some built in

safewguards for the respondent, chief of which is the provision

that the final judgment or order will not-be granted unless the

court is satisfied that the respondent' received the commencement

document. In most cases it 'will be simple to satisfy the court

on this point, because generally the respondent will react to

the service of the Petition by delivery of an Answ~r or

) Financial Statement, or will at least contact the petitioner's

lawyer. If there is no response, it would be prudent to attempt

personal service on the respondent before applying to ,the court

for a judgment.

All affidavits of service are to include the postal address of

the respondent, together with the means of knowledge of. the

person serving regarding that address. It is no longer

necess~ry to ,have the respondent complete and sign an

acknowledgment of service, eve~ where personal service is

required.

Service of the notice of motion commencing a corollary relief

was granted. There is to be at least 11 days (shades of the

originating notice!) between service of these documents and the

served in the usual manner with 3 days notice.

5. Pleadings: Rules 594 - 597

The pleadings in this Part are similar to those in any action ,in

the court, and the pleadings rules in Part 10 will apply, The

Pe ti t i on .( rule 586) cOIfImences the proceed i ng (campa re to

Statement of Claim). The Answer takes the place of the

Statement of Defence, and rule 594 is comparable to rule 100

regarding response times, Notice of Intent to Answer, etc. Rule

595 provides for commencement of a counter-petition by service

on the petitioner of an Answer and Counter-Petition (compare to

counterclaim). Rule 596 provides for a Demand for Notice (see

rule 9B). Rule 597 provides for a Reply (see rule 108).

Pursuant to rule 595( 4) there may also be pleadings called an

Answer to Counter-Petition, or Reply and Answer to

Counter-Petition, or Reply to Answer to Counter-Petition.

The style of cause in all these pleadings is the same (see form

61). "Between" has been omitted from the style of cause, in

keeping with the non-idversarlal policy revealed in the Divorce

Ac t. When a coun ter'·pet i t i on is commenced it iss impl y requi red

to de~ignate the p~titioner and respondent by counter-petition,

rather than requiring a second style of cause (see form 65).

The forms for pleadings also tend to use explanatory words in

place of legal terminology. With the 'use of' these words, a

lay-person may better understand what he is saying. For

example, see paragraph 8 under "Collusion, Condonation and

Connivance" in the Petition. The forms are also updated in

other ways; for example, the "Declaration of Petitioner" is no

longer requi red on a divorce pet i t i on (i t was a re tent ion of a

pre-1968 requirement for a declaration or affidavit of

6. Fin'ancial Statements: Rule 599

Financial statements are required in any proceeding under this

Part in which support, maintenance, alimony, custody or division

of -property is claimed. That 1's, financial statements will not

be':'required where o'nly divorce (wi'thout custody or support) is

claimed, or where only judicial separation or nullity (without

alimony) is claimed.

The inform~tio~ required in 'the form for d Financial Statement

is quite extensive. :Part I deals with income and expenses, Part

) II deals with' assets 'and debt's. Only Part II need be 'completed

where division of property' alone is 'claimed. This part of the

statement contains the information required in the forms

)

provid~d under' the former matrimonial property rules. Both

parts are to be' compl'eted' where support, maintenance, alimony or

custody are claimed.

It is not necessary to have all the receipts for expenses, 'real

estate appraisal reports, income tax returns, etc. on hand in

order to co~plete the Financial Statement and commence the

action. Those items' are evidentiar'y and will be required befo're

judgment -(if a settlement has not been reached). When applying

for jUdgment in an uncontested proceeding, the petitioner' is

required to note corrections or subsequent changes to his

Financial Statement in his affidavit, and he should have the

evidence available then to ensure that the statement is

accurate. (A similar affidavit is required when setting a

matrimonial proper,ty, dispute down f.or trial.)

Where there is a matter of ,ur,gency, the pe:t~tioner may apply (ex

parte - see rule 441( 3)) fo~' leave to issu,e the Petition without

the Financial Statement.

The respondent is required to deliver a Financial Statement

whether or nQt he intends to contest the claim., He is ,required

to deliver the F.inancial Statement with his Answer where he

contests the claim, and to delLver, it ,within the time limited , , ,

for delivery of th~ Answer where he does not contest the claim.

Financial Statements are not required if the parties have agreed

on the relief to be granted and have filed a waiv~r.

Most of the provisions on Financial Statements clearly state

"unless ordered otherwise". Application may be mad~, to the

court for more time to fi1,e a Financial S.tat~ment where it is

necessary. Financ~al statements at this early stage of the

proceeding serve the purpos~ of disclosure, and that purpose

would not be fulfilled if they were not required until the time

of trial or application for judgment.

7. Default: Rule 600

Noting for default is done in the usual manner. The only

variation on rule 114 is that after default has been noted the

respondent may deli,ver an ans\,'Ier with t\1e consent of the

petitioner, in addition to delivery with leave of the court.

8. Setting Down for Hearing: Rule 601

Proceedrngs under this Part are, set down for trial in the same

manner as any other action in the court. However, a pre-trial

conference is necessary in every case and not only where the

estimated trial time .exceeds one day as provided in rule 196C(I).

Where the respondent has delivered a Demand for Notice, he is to

,be served with a Notice of Application for .Judgment and the

uncontested proceeding will be set down on the chambers list.

The format of the Notice of Application ~or Judgment i,s that pf

a Notice, of Motion, ,and the service requirements will be the

same. It is anticipated that in chambers the judge will

indicate the relief he is prepared to grant, and if the

respondent raises an objection, the matter will be set down for

trial as a contested proceeding. That is, the judge will not

hear representations from the respondent in chambers.

9. Uncontested Proceedings: Rule 602

The neW Divorce Act makes provision for granting a divorce

without an oral hearing (s.25(2)). This rule extends that to

any uncontested proceeding under this Part. In effect, a

defaul t judgment may be gra'nted in a manner similar to rule

122. Rule 346 on setting aside default judgments will apply to

whichever is appropriate. An application to set aside a default

judgment will likely be ma'de most frequently where the claim was

for division of the matrimonial property.

It is required that an uncontested proceeding be determined on

the basis of affiaaVit 'evidence, but where it appears that would

not be appropriate, an order for an ofal hearing may be given on

the application of the petitioner prior to filing an Application

for Judgment Of on the court's own motion where an Application

for Judgment has been presented to it.

The Application for 'Judgment is formatted like a checklist.

Hopefully, this will make the requirements apparent to the

petitioner and very few applications will be rejected because

one document is missing. A certified copy of pleadings is not

necessary, but the court file should be checked to ensure all

pleadings are on file. All applications for judgment must, be

accompanied by the petitioner's affidavit, the contents of which

are set out in subrule 602(4) (general) and rules 607 (divorce),

621 (matrimonial cause) and 624 (infants). (An example has been

prepared of the affidavits required in an uncontested divorce.)

There is not a rule specifically relating to the contents of an

. affidavit where division of the matrimonial property is

claimed: The Matrimonial Property Act seems clear regarding the

evidentiary requirements; the parties are unlikely to let a

property application go undefended (unless it has been agreed

to); and the court is likely to generally require an oral

hearing.

This rule also requires the appropriate Maintenance Enforcement

Office form to be filed with the Application:. for Judgment.

Hopefully, this will prevent a support, alimony or maintenance

order entering a state of limbo (that is, being granted with a

provision requiring payment through the Maintenance Enforcement

Office but wi thout the petitioner having registered it in that

office).

10. Evidence: Rule 603

This rule is generally a retention of the former evidentiary

rules (see former rule 60SA for the derivation of subrules (1) -

viva voce or affidavit evidence ~ and (2) ~ proof of foreign

marriagej see former rule 509(3) for the derivation of subrule

(4) use of financial statement as evidence). Subrule (3),

however, is a departure from the former rules' (see former rules

495, 617 and 641 which retained the "adultery privilege",

although substantially curtailing it). The abolition of the

privilege relating to adult'ery is in keeping with the

recommendations of The Federal/Provincial Task Force on Uniform

Rules of Evidence (1982), and recent repealing legislation in

Mani toba a:rid Newfoundland. (The privilege never appeared in

Quebec or British Columbia.)

Perhaps it should be noted that there is not a new rule similar

to the former divorce rules 619 (Q.B.) and 643 (U.F.C), allowing

a committee to swear an affidavit required of a mental

incompetent on: infotmation and belief. These rules were

apparently derived from the 1933 Ontario Matrimonial Rules, and

do n'ot appear to be necessary. (Most other provInces do not

have an equivalent rule.) Rule 47 allows a litigation guardian

to do anything required of a mental incompetent on his behalf,

and that rule should be sufficient to cover affidavits required

of the mental incompetent.

11. Judgment: Rule 604

This rule provides that one judgment shall issue in respect of

all relief claimed, even though the claims are made under ~ore

than one statute. This is modified by rule 609(2), making it

optional to grant one judgment for divorce and a separate one

for any other relief. This will be useful where the right to a

divorce is clear and an early divorce is desired, but some other

claim (e.g., matrimonial property) either requires an oral

hear ing (e. g., where it was an uncon tes ted proceed i ng) or

requires several drafts of the judgment before the appropriate

wording is reached (yet the parties want the divorce judgment

issued, served and finalized as quickly as possible).

The general rules on a judgment ,appearing' in Part 29 will apply

to judgments under this Part.

12. Costs: Rule 605

As noted in the introductory comments, the general costs rules

will apply to a proceeding under this Part. Rule 549(6) has

been amended, and coSts will now be taxed on column 4 (rather

than column 3) in default of direction by the court.

Rule 605 on payment of or security for- costs is derived from the

former rules 494 (matrimonial ,cause) and 615 (divorce), and

applies to any proceeding under this Part.

B. DIVORCE ACT PROCEEDINGS

1. Divorce Proceedings: Rules 606:- 613

The Act defines a divorce proceeding as "a proceeding in a court

in which either or both spouses seek a divorce alone ,or together

with a support order or custody order or both such orders."

Where a divorce proceeding is commenced, a certificate of the

marriage is to be filed at the time of issuing the Petition (see

rule 586(4)). If proof of registration of the marriage is not

easily available and it is a matter of some urgency, the

peti tioner may make an ex parte application for leave to issue

the Petition without the marriage certificate.

(appearing under "General II) requires that the divorce Petition

set out the name and birthdate of every child of the marriage.

ROle 606 requires the Central Registry report before the. court

will grant a divorce judgment. It is derived from former

divorce rules 605(3) (Q.B.) and 634 (U.F.C.).

Rule 607 sets out ,additional requirements for an uncontested

divorce proceeding. The evidentiary requirements in the

petitioner's affidavit are derived from the Divorce _Act.

(Examples of a petitioner I 5 affidavit and a respondent I 5

affidavit admitting adultery have been prepared for use as a

) guide and will be distributed as part of a Practice Direction -

included with these material's.) The reference to other

supporting materials and affidavits includes such thing$ as a

medical report or an affidavit giving details of any acts of

cruelty 'or evidence of cruelty witnessed by the affiant. The

)

'rute also requires that a draft judgment and a draft

certificate,' if desired, accompany the application. The

envelopes are required :to simplify the mailin.g of the divor~e

judgm~nts. and certificate by the local registrar.

Rule 608 deals with the entirely new procedure. of a joint

petition provided for by the Divorce Act ("both spouses ll). This

allows a 'non-adversarial divorce in those situations where both

spouses desire the divorce but neither wants to be designated as

the "guiltyrt party. Query if it can apply to a divorce where

the marriage breakdown is establ ished by. adultery or cruelty,

or if it is limited to a divorce where the marriage breakdown is

establ ished by separation. It will be interesting to see how

the court will interpret these provisions of the Act. Section

8(1) clearly states ~ court may, on application by both spouses,

grant a divorce on the ground there has been a breakdown of the

marriage (i.e.~ no limitation). However, s.8(2)(b) says

breakdown of a marriage is established only if, the spouse

against whom the divorce pro'ceeding is brought has committed

adultery or treated the other spouse with cruelty (emphasis

added) .

Where the facts establishing the breakdown of the marriage are

not in dispute, a joint petition is allowed, even though there

may be a dispute regarding the corollary relief. However, joint

peti tions are not permitted where the proceeding is; under The

Infants Act, The Matrimonial Property Act or The Queen's Bench

Act. Therefore, a joint petition for divorce could not include

claims under those Acts. The rule makes provision for those

cases where the claims for corollary relief are not settled.

Rule 610 allows for a certificate of divorce pursuant to section

12(7) of the Act. (Although the form for this certificate

is to be served on the respondent (not his lawyer), by ordinary

Statements are required (unless the parties agree to the relief

pursuant to the Act ("both former spouses").

3. Variation Proceedings: Rules 615 ~ 619

A variation proceeding is defined by the Act as "a proceeding in

a court in which either or both former spouses seek a variation

order". A variation order may vary, rescind or suspend,

prospectively or retroactively, a support or custody order or

any provision thereof. Section 5 of the Act gives a court

jurisdiction to hear and determine a variation proceeding if

ei ther former spouse is ordinarily resident in the province or

both former spouses accept the jurisdiction of the court.

Rule 615 provides that a variation proceeding be commenced by an

application in form 73. The form may be adapted to an

application with or without notice. Only applications to vary

support orders may be commenced without notice: see 5.18(2) of

the Act.

This rule sets up a procedure for transfer of a proceeding to or

from the court in another province pursuant to s.6 of the Act.

This section, in effect, alters the jurisdictional provisions of

sections 3, 4 and,S to give the court to which a divor~e,

corollary relief, or variation pro<;:.eeding (in which custody is

in issue) has been transferred exclusive jurisdiction to hear

and determine tne proceeding.

C. OTHER PROCEEDINGS: RULES 621 - 625

1. Matrimonial Causes: Rule 621

This r~le sets' out additional requirements for the petitioner's

affidavit, in an uncontested ptbceeding for a matrimonial- cause.

These evidentiary requirements are mainly derived from The

Queen's Bench Act. It seems a trial will generally be ordered

in a uncontested nullity proceeding: where the proceeding is

under The Marriage Act, 55.45 and 46 require a trial,. and where

the proceeding is under The Matri~bnial Causes Act, 1857, 'it is

unclear if a judge in chambers would have jurisdiction to grant

the judgment.

2. Matrimonial Property: Rules 622 - 623

Although at first glance it appears 85 if 21 matrimonial

property rules and 8 forms hav~ been deleted with only two short

rules substituted therefor, in fact the same subject matter is

still covered by the new rules and forms. (Refer to the Table

of Concordance to see what happened to the rules and to the

Practice Direction to find the comparable forms.)

Rule 622 provides that an affidavit of each party confirming and

updating the Financial Statement is to be filed before a trial

date will be aSSigned to a proceeding for the division of

former rule 510A on interim orders for distribution.

3. Infants: Rule 624

This,rule sets out additional requirements on an application for

judgment in an uncontested proceeding under The Infants Act.

Although there is no longer a rule ,equivalent to former rule

523, orders respecting custody and mainteoance of infants may

still be enforced by contempt proceedings: see rule 372 (re

custody) and s.44 of The Enforcement of Maintenance Orders A<,:t

(re maintenance).

4. Enforcement: Rule 625

III. PART 49 - RECIPROCAL ENFORCEMENT

the Divorce Act t 1985. (Compare 5.18 of the Divorce Act with

5.4 of the REMO'Act, and 5.19 of the Divorce Act with 5.6 of the

REMO Act.) The amendments made to these rules do not

substantially change the REMO procedure practitioners have been

using. Some rules and forms have been deleted due to changes in

the REMO Act: for example, the Certificate of Equivalent

Canadian Currency has been deleted because of ' 'amendments to s.14

of the Act. Other rules and forms have been amended in

recognition of differences' in wording in the two pieces of

legislation these rules now cover: for example, the reference

to 'show causel! hearing no longer appears.

B. RULES

1. General: Rules 626 - 630

The de'fini tions iIi rule 627 include those necess'ary to enable

the application of one set of rules to the two statutes.

Service under this Part is service by ordinary mail, similar to

Part 48. As in Part 48, there is still the option of using the

general service rules for 'alternative ~odes of service.

Rule 630 on translation is basically a retention 'of former rule

658 (the converse of 5.15 of the REMO Act).

2. Registration of Final Orders: Rule 631

This rule covers "final orders" under the REMO Act, ~hether made

in Saskatchewan or in a reciprocating state: the equivalent

orders under the Divorce Act are dealt with in Part 48, rule

611. The reference to the notice in former rule 648(l)(b) has

been deleted because the minister sends this notice under the

amendments to the Act.

3. Provisional Order Made in Saskatchewan: Rules 632 . 634

The application for a provisional order is to be made by filing

the initiating document required by the rules or by the statute

) under which maintenance is claimed. That Jis, where the

application is for a provisional order under the Divorce Act it

will be in form 73, where the application is for a provisional

order under The Infants Act it will be by Petition in form 61,

where the' application is for a provisional order under The

summons (in Q.B., or by Petition in U.F.C.) - both the later

applications being pursuant to the REMO Act.

identification, location, income and assets of the respondent

will be encompassed in the Maintenance Enforcement Regist.ration

Form, where that is required. Therefore, it is only on

applications under the Divorce Act that there is no form

provided,

Where a matter is remitted back to Saskatchewan for further

evidence, the rule and form now provide for receiving the

evidence in the form of an affidavit, or at an oral hearing.

4. Confirmation of a Provisional Order Made Outsi.de

Saskatchewan: Rules 635 - 637

There are some differences in these rules as to who serves what

on whom, depending which piece of leg.islation the proceeding is

under. Where it is pursuant to the Divorce Act, the local

registrar causes the notice of hearing to be served on the

respondent and the applicant; but where it is pursuant to the

REMO Act, the minister causes the notice of hearing to be served

on the respondent only. The uncompleted financial statement

will be in form 67 where it is pursuant to the Divorce Act, and

in the form provided by regulations under The Enforcement of

Maintenance Orders Act where it is pursuant to the REMO Act.

The local registrar will also send the Maintenance Enforcemept

Office forms to the applicant, so that the order does not end up

in a state of limbo (because the order is made in Saskatchewan,

the court is required to order payment through the office unless

The form of the order after confirmation hearing requires

reasons where the legislation requires reasons, therefore the

rules make no specific reference to the local registrar sending

reasons to the originating court.

IV. UNIFIED FAMILY COURT RULES

There is one exception to the rule that the practice will be

uniform throughout Saskatchewan. Those lawyers practicing in

the Unified Family Court will be able to include their Deserted

Spousels applications in the same Petition by which they

commence the divorce.

Re: Marriage Certificates Required By Saskatchewan Courts For Divorce Purposes

NOTICE OF CHANGE

The Honourable M. J. Batten, Chief Justice of the Court of Queen's Bench, has recently approved a change in the type of marriage certificate to be submitted to Saskatchewan courts in connection with divorce cases.

Effective immediately, intermediate-size marriage certificates (61,:" x 5~") will be issued for divorce purposes. These will replace certified photocopies of original registra'tion docu­ments'which have been issued in the past.

When submitting requests, please indicate clearly if the certificate is required for divorce purposes; this' will help us to fulfill your request more quickly.
