Agreements We Make With YouWe make the following agreements with you:

General

Definitions Used In This PolicyThroughout this policy, when the following wordsappear in bold type, they are defined as follows:1. Bodily injury means physical harm to the

body, including sickness or disease, andresulting death, except that bodily injury doesnot include:a) any venereal disease;b) Herpes;c) Acquired Immune Deficiency Syndrome

(AIDS);d) AIDS Related Complex (ARC);e) Human Immunodeficiency Virus (HIV);

or any resulting symptom, effect, condition,disease or illness related to a) through e) listedabove.

In addition, bodily injury does not include anysymptom, effect, condition, disease or illnessresulting in any manner from:a) lead in any form;b) asbestos in any form;c) radon in any form; ord) oil, fuel oil, kerosene, liquid propane or

gasoline intended for, or from, a storagetank located at the residence premises.

2. Building structure means a structure withwalls and a roof.

3. Business means:a) any full- or part-time activity of any kind

engaged in for economic gain includingthe use of any part of any premises forsuch purposes. The providing of home daycare services to other than an insuredperson or relative of an insured personfor economic gain is also a business.

However, the mutual exchange of homeday care services is not considered abusiness;

b) the rental or holding for rental of propertyby an insured person. Rental of yourresidence premises is not considered abusiness when:1) it is rented occasionally for

residential purposes;2) a portion is rented to roomers or

boarders, provided not more than tworoomers or boarders reside on theresidence premises at any one time;or

3) a portion is rented as a privategarage.

4. Dwelling means the single family buildingstructure identified as the insured property onthe Policy Declarations, where you reside andwhich is principally used as a privateresidence.

5. Insured person(s) means you and, if aresident of your household:a) any relative; andb) any person under the age of 21 in your

care.

Under Coverage X Family LiabilityProtection and Coverage Y Guest MedicalProtection, insured person also means:a) any person or organization legally

responsible for loss caused by animals orwatercraft covered by this policy whichare owned by an insured person. We donot cover any person or organizationusing or having custody of animals orwatercraft in any business, or withoutpermission of the owner;

b) with respect to the use of any vehiclecovered by this policy, any person whileengaged in the employment of an insuredperson.

6. Insured premises means:a) the residence premises; andb) under Section II only:

1) the part of any other premises, otherstructures and grounds used by youas a residence. This includespremises, structures and grounds

you acquire for your use as a privateresidence while this policy is ineffect;

2) any part of a premises not owned byan insured person but where aninsured person is temporarily living;

3) cemetery plots or burial vaults ownedby an insured person;

4) land owned by or rented to aninsured person where a single familydwelling is being built as thatperson’s residence;

5) any premises used by an insuredperson in connection with theresidence premises;

6) any part of a premises occasionallyrented to an insured person for otherthan business purposes.

7. Occurrence means an accident, includingcontinuous or repeated exposure tosubstantially the same general harmfulconditions during the policy period, resulting inbodily injury or property damage.

8. Property damage means physical injury toor destruction of tangible property, includingloss of its use resulting from such physicalinjury or destruction.

9. Remediation means the reasonable andnecessary treatment, removal or disposal ofmold, fungus, wet rot or dry rot as required tocomplete repair or replacement of property wecover under Coverage A DwellingProtection, Coverage B Other StructuresProtection or Coverage C Personal PropertyProtection damaged by a covered water loss,including payment for any reasonable increasein living expenses necessary to maintain yournormal standard of living if mold, fungus, wetrot or dry rot makes your residence premisesuninhabitable. Remediation also includes anyinvestigation or testing to detect, measure orevaluate mold, fungus, wet rot or dry rot.

10. Residence employee means an employee ofan insured person while performing dutiesarising out of and in the course of employmentin connection with the maintenance or use ofyour residence premises. This includes

similar duties performed elsewhere for aninsured person, not in connection with thebusiness of an insured person.

11. Residence premises means the dwelling,other structures and land located at theaddress stated on the Policy Declarations.

12. We, us or our means the company named onthe Policy Declarations.

13. You or your means the person listed underNamed Insured(s) on the Policy Declarations asthe insured and that person’s resident spouse.

Insuring AgreementIn reliance on the information you have given us, weagree to provide the coverages indicated on thePolicy Declarations. In return, you must pay thepremium when due and comply with the policy termsand conditions, and inform us of any change in title,use or occupancy of the residence premises.

Subject to the terms of this policy, the PolicyDeclarations shows the location of the residencepremises, applicable coverages, limits of liability andpremiums. The policy applies only to losses oroccurrences that take place during the policy period.The Policy Period is shown on the PolicyDeclarations. This policy is not complete without thePolicy Declarations.

This policy imposes joint obligations on the NamedInsured(s) listed on the Policy Declarations as theinsured and on that person’s resident spouse. Thesepersons are defined as you or your. This means thatthe responsibilities, acts and omissions of a persondefined as you or your will be binding upon any otherperson defined as you or your.

This policy imposes joint obligations on personsdefined as an insured person. This means that theresponsibilities, acts and failures to act of a persondefined as an insured person will be binding uponanother person defined as an insured person.

Conformity To State StatutesWhen the policy provisions conflict with the statutesof the state in which the residence premises is

located, the provisions are amended to conform tosuch statutes.

Coverage ChangesWhen we broaden coverage during the premiumperiod without charge, you have the new features ifyou have the coverage to which they apply.Otherwise, the policy can be changed only byendorsement.

The coverage provided and the premium for thepolicy is based on information you have given us.You agree to cooperate with us in determining if thisinformation is correct and complete. You agree that ifthis information changes, is incorrect or incomplete,we may adjust your coverage and premiumaccordingly during the premium period.

Any calculation of your premium or changes in yourcoverage will be made using the rules, rates andforms on file, if required, for our use in your state.The rates in effect at the beginning of your currentpremium period will be used to calculate any changein your premium.

Policy TransferYou may not transfer this policy to another personwithout our written consent.

Continued Coverage After Your DeathIf you die, coverage will continue until the end of thepremium period for:1) your legal representative while acting as such,

but only with respect to the residencepremises and property covered under thispolicy on the date of your death.

2) an insured person, and any person havingproper temporary custody of your propertyuntil a legal representative is appointed andqualified.

CancellationYour Right to Cancel:You may cancel this policy by notifying us of thefuture date you wish to stop coverage.

Our Right to Cancel:We may cancel this policy by mailing notice to you atthe mailing address shown on the Policy

Declarations. When this policy has been in effect forless than 60 days, and it is not a renewal with us, wemay cancel this policy for any reason by giving you atleast 10 days notice before the cancellation takeseffect.

When the policy has been in effect for 60 days ormore, or if it is a renewal with us, we may cancel thispolicy for one or more of the following reasons:1) non-payment of premium;2) the policy was obtained by misrepresentation,

fraud or concealment of material facts;3) material misrepresentation, fraud or

concealment of material facts in presenting aclaim, or violation of any of the policy terms; or

4) there has been a substantial change orincrease in hazard in the risk we originallyaccepted.

If the cancellation is for non-payment of premium,we will give you at least 10 days notice. If thecancellation is for any of the other reasons, we willgive you at least 30 days notice.

Our mailing the notice of cancellation to you will bedeemed proof of notice. Coverage under thispolicy will terminate on the effective date and hourstated on the cancellation notice. Your returnpremium, if any, will be calculated on a pro rata basisand refunded at the time of cancellation or as soonas possible. However, refund of unearned premium isnot a condition of cancellation.

Our Right Not to Renew or Continue:We have the right not to renew or continue the policybeyond the current premium period. If we do notintend to continue or renew the policy, we will mailyou notice at least 30 days before the end of thepremium period. Our mailing the notice ofnonrenewal to you will be deemed proof of notice.

Misrepresentation, Fraud or ConcealmentWe may void this policy if it was obtained bymisrepresentation, fraud or concealment of materialfacts. If we determine that this policy is void, allpremiums paid will be returned to you since therehas been no coverage under this policy.

We do not cover any loss or occurrence in which anyinsured person has concealed or misrepresentedany material fact or circumstance.

What Law Will ApplyThis policy is issued in accordance with the laws ofthe state in which the residence premises is locatedand covers property or risks principally located inthat state. Subject to the following paragraph, thelaws of the state in which the residence premises islocated shall govern any and all claims or disputes inany way related to this policy.

If a covered loss to property, or any other occurrencefor which coverage applies under this policy happensoutside the state in which the residence premises islocated, claims or disputes regarding that coveredloss to property, or any other covered occurrencemay be governed by the laws of the jurisdiction inwhich that covered loss to property, or other coveredoccurrence happened, only if the laws of thatjurisdiction would apply in the absence of acontractual choice of law provision such as this.

Where Lawsuits May Be BroughtSubject to the following two paragraphs, any and alllawsuits in any way related to this policy, shall bebrought, heard and decided only in a state or federalcourt located in the state in which the residencepremises is located. Any and all lawsuits againstpersons not parties to this policy but involved in thesale, administration, performance, or alleged breachof this policy, or otherwise related to this policy, shallbe brought, heard and decided only in a state orfederal court located in the state in which theresidence premises is located, provided that suchpersons are subject to or consent to suit in the courtsspecified in this paragraph.

If a covered loss to property, or any other occurrencefor which coverage applies under this policy happensoutside the state in which the residence premises islocated, lawsuits regarding that covered loss toproperty, or any other covered occurrence may alsobe brought in the judicial district where that coveredloss to property, or any other covered occurrencehappened.

Nothing in this provision, Where Lawsuits May BeBrought, shall impair any party’s right to remove astate court lawsuit to a federal court.

Action Against UsNo one may bring an action against us unless therehas been full compliance with all policy terms.

Any action against us to which neither the ActionAgainst Us provision located in Section I Conditionsnor the Action Against Us provision located inSection II Conditions applies must be commencedwithin one year of the date the cause of actionaccrues.

If an action is brought asserting claims relating to theexistence or amount of coverage, or the amount ofloss for which coverage is sought, under differentcoverages of this policy, the claims relating to eachcoverage shall be treated as if they were separateactions for the purpose of the time limit tocommence action.

ArbitrationAny claim or dispute in any way related to this policy,by an insured person against us or us against aninsured person, may be resolved by arbitration onlyupon mutual consent of the parties. Arbitrationpursuant to this provision shall be subject to thefollowing:a) no arbitrator shall have the authority to award

punitive damages or attorney’s fees;b) neither of the parties shall be entitled to

arbitrate any claims or disputes in arepresentative capacity or as a member of aclass; and

c) no arbitrator shall have the authority, withoutthe mutual consent of the parties, toconsolidate claims or disputes in arbitration.

Section I Your Property

Coverage ADwelling Protection

Property We Cover Under Coverage A:1. Your dwelling including attached structures.

Structures connected to your dwelling by onlya fence, utility line, or similar connection arenot considered attached structures.

2. Construction materials and supplies at theresidence premises for use in connection withyour dwelling.

3. Wall-to-wall carpeting fastened to yourdwelling.

Property We Do Not Cover UnderCoverage A:1. Any structure including fences or other

property covered under Coverage B OtherStructures Protection.

2. Land.

3. Satellite dish antennas and their systems,whether or not attached to your dwelling.

Coverage BOther Structures Protection

Property We Cover Under Coverage B:1. Structures at the address shown on the Policy

Declarations separated from your dwelling byclear space.

2. Structures connected to your dwelling by onlya fence, utility line, or similar connection.

3. Construction materials and supplies at theaddress of the residence premises for use inconnection with structures other than yourdwelling.

4. Wall-to-wall carpeting fastened to buildingstructures on the residence premises otherthan your dwelling.

Property We Do Not Cover UnderCoverage B:1. Structures used in whole or in part for

business purposes.

2. Any structure or other property covered underCoverage A Dwelling Protection.

3. Land.

4. Construction materials and supplies at theaddress of the residence premises for use inconnection with the dwelling.

5. Satellite dish antennas and their systems,whether or not attached to buildingstructures.

Losses We Cover Under Coverages Aand B:We will cover sudden and accidental direct physicalloss to property described in Coverage A DwellingProtection and Coverage B Other StructuresProtection except as limited or excluded in thispolicy.

Coverage CPersonal Property Protection

Property We Cover Under Coverage C:1. Personal property owned or used by an

insured person anywhere in the world. Whenpersonal property is located away from theresidence premises, coverage is limited to10% of Coverage C Personal PropertyProtection.

2. At your option, personal property owned by aguest or residence employee while theproperty is in a residence you are occupying.

Limitations On Certain Personal Property:Limitations apply to the following groups of personalproperty. If personal property can reasonably be

considered a part of two or more of the groups listedbelow, the lowest limit will apply. These limitationsdo not increase the amount of insurance underCoverage C Personal Property Protection. Thetotal amount of coverage for each group in any oneloss is as follows:

1. $50 Money, bullion, bank notes, coins andother numismatic property, scrip,stored value cards and smart cards.

2. $200 Property used or intended for use in abusiness while the property is awayfrom the residence premises. Thisdoes not include electronic dataprocessing equipment or therecording or storage media used withthat equipment.

3. $250 Theft of any recording or storagemedia while such property is awayfrom the residence premises,whether or not it is used withelectronic data processing equipmentor in a business. Recording orstorage media includes, but is notlimited to:a) tapes;b) CDs, DVDs and other discs;c) records;d) disks;e) reels;f) cassettes;g) cartridges; orh) programs.

4. $500 Theft of tools and their accessories.

5. $1,000 Theft of jewelry, watches, preciousand semi-precious stones, gold otherthan goldware, silver other thansilverware, pewter other thanpewterware, platinum other thanplatinumware and furs, including anyitem containing fur which representsits principal value.

6. $1,000 Property used or intended for use in abusiness, including property held assamples or for sale or delivery aftersale, while the property is on theresidence premises. This does not

include electronic data processingequipment or the recording orstorage media used with thatequipment.

7. $1,000 Trading cards, subject to a maximumamount of $250 per card.

8. $1,000 Accounts, bills, deeds, evidences ofdebt, letters of credit, notes otherthan bank notes, checks, cashier’schecks, traveler’s checks, passports,securities, tickets, and stamps,including philatelic property.

9. $1,000 Manuscripts, including documentsstored on electronic media.

10. $1,000 Watercraft, including their attachedor unattached trailers, furnishings,equipment, parts, and motors.

11. $1,000 Trailers not used with watercraft.

12. $1,000 Any motorized land vehicle parts,equipment or accessories notattached to or located in or upon anymotorized land vehicle.

13. $1,500 Electronic data processing equipmentand the recording or storage mediaused with that equipment whether ornot the equipment is used in abusiness. Recording or storagemedia will be covered only up to:a) the retail value of the media, if

pre-programmed; orb) the retail value of the media in

blank or unexposed form, ifblank or self-programmed.

14. $2,000 Theft of firearms, their relatedequipment, and accessories.

15. $2,500 Motorized land vehicles used solelyfor the service of the insuredpremises and not licensed for use onpublic roads. This does not includemotorized land vehicles designed forassisting the disabled.

16. $2,500 Theft of goldware, silverware,pewterware and platinumware.

Property We Do Not Cover UnderCoverage C:1. Personal property specifically described and

insured by this or any other insurance.

2. Animals.

3. Motorized land vehicles, including, but notlimited to, any land vehicle powered orassisted by a motor or engine. We do not coverany motorized land vehicle parts, equipment oraccessories attached to or located in or uponany motorized land vehicle. We do covermotorized land vehicles designed for assistingthe disabled or used solely for the service ofthe insured premises and not licensed for useon public roads subject to Limitations OnCertain Personal Property, item 15.

4. Aircraft and aircraft parts. This does notinclude model or hobby craft not designed tocarry people or cargo.

5. Property of roomers, boarders, or tenants notrelated to you.

6. Property located away from the residencepremises and rented or held for rental toothers.

7. Satellite dish antennas and their systems.

Losses We Cover Under Coverage C:We will cover sudden and accidental direct physicalloss to the property described in Coverage CPersonal Property Protection, except as limited orexcluded in this policy, caused by:1. Fire or Lightning.

2. Windstorm or Hail.

We do not cover:a) loss to covered property inside a building

structure, caused by rain, snow, sleet,sand or dust unless the wind or hail firstdamages the roof or walls and the wind

forces rain, snow, sleet, sand or dustthrough the damaged roof or wall;

b) loss to watercraft and their trailers,furnishings, equipment and motors unlessinside a fully enclosed building structure.However, we do cover canoes androwboats on the residence premises.

3. Explosion.

4. Riot or Civil Commotion, including pillage andlooting during, and at the site of, the riot orcivil commotion.

5. Aircraft, including self-propelled missiles andspacecraft.

6. Vehicles.

7. Smoke.

We do not cover loss caused by smoke fromthe manufacturing of controlled substances,agricultural smudging or industrial operations.

8. Vandalism and Malicious Mischief.

We do not cover vandalism or maliciousmischief if your dwelling has been vacant orunoccupied for more than 30 consecutive daysimmediately prior to the vandalism ormalicious mischief. A dwelling underconstruction is not considered vacant orunoccupied.

9. Falling objects.

We do not cover loss to personal propertyinside a building structure unless the fallingobject first damages the exterior walls or roofof the building structure.

10. Weight of ice, snow or sleet which causesdamage to personal property in a buildingstructure, but only if the building structure isdamaged due to the weight of ice, snow orsleet.

11. Increase or decrease of artificially generatedelectrical current to electronics, electricalappliances, fixtures and wiring.

12. Bulging, burning, cracking or rupture of asteam or hot water heating system, an airconditioning system, an automatic fireprotection system or an appliance for heatingwater.

13. Water or steam that escapes from a plumbing,heating or air conditioning system, anautomatic fire protection system, or from ahousehold appliance due to accidentaldischarge or overflow.

We do not cover loss to the system orappliance from which the water or steamescapes, or loss from water which backs upthrough sewers or drains or overflows from asump pump, sump pump well or other systemdesigned for the removal of subsurface waterwhich is drained from a foundation area of astructure.

14. Freezing of a plumbing, heating or airconditioning system or a household appliance.

We do not cover loss at the residencepremises under perils 12), 13), and 14) causedby or resulting from freezing while thebuilding structure is vacant, unoccupied orunder construction unless you have usedreasonable care to:a) maintain heat in the building structure; orb) shut off the water supply and drain the

water from the systems and appliances.

15. Theft, or attempted theft, includingdisappearance of property from a known placewhen it is likely that a theft has occurred. Anytheft must be promptly reported to the police.

We do not cover:a) theft or attempted theft committed by an

insured person;b) theft in or from the residence premises

while under construction or of materialsand supplies for use in construction, untilthe dwelling is completed and occupied;

c) theft of any property while at any otherresidence owned, rented to or occupiedby an insured person unless the insuredperson is temporarily residing there;

d) theft of trailers, campers, watercraft,including furnishings, equipment andoutboard motors, away from theresidence premises;

e) theft from that part of the residencepremises rented by you to other than aninsured person.

16. Breakage of glass, meaning damage tocovered personal property caused by breakageof glass constituting a part of any buildingstructure on the residence premises. Thisdoes not include damage to the glass.

Additional Protection

1. Additional Living Expensea) We will pay the reasonable increase in

living expenses necessary to maintainyour normal standard of living when adirect physical loss we cover underCoverage A Dwelling Protection,Coverage B Other StructuresProtection or Coverage C PersonalProperty Protection makes yourresidence premises uninhabitable.However, additional living expense due toremediation of mold, fungus, wet rot ordry rot will not be paid in addition to anyamounts paid or payable under Section I,Conditions Mold, Fungus, Wet Rot andDry Rot Remediation as a Direct Resultof a Covered Water Loss.

Payment for additional living expense as aresult of a covered loss under Coverage A

Dwelling Protection, Coverage BOther Structures Protection or CoverageC Personal Property Protection will belimited to the least of the following:1) the time period required to repair or

replace the property we cover, usingdue diligence and dispatch; or

2) if you permanently relocate, theshortest time for your household tosettle elsewhere; or

3) 12 months.

Additional Living Expense will not exceedthe amount indicated on your PolicyDeclarations.

b) We will pay the reasonable and necessaryincrease in living expenses for up to twoweeks should civil authorities prohibit theuse of the residence premises due to aloss at a neighboring premises caused bya loss we insure against. However,payments for increase in living expensesdue to remediation of mold, fungus, wetrot or dry rot will not be paid in addition toany amounts paid or payable underSection I, Conditions Mold, Fungus,Wet Rot and Dry Rot Remediation as aDirect Result of a Covered Water Loss.

These periods of time are not limited by thetermination of this policy.

We do not cover any lost income or expensedue to the cancellation of a lease oragreement.

No deductible applies to this protection.

2. Credit Card, Debit Card or Automated TellerMachine Card, Bank Fund Transfer Card,Check Forgery and Counterfeit MoneyWe will pay for loss:a) that an insured person is legally required

to pay for the unauthorized use of any1) credit card;2) debit or automated teller machine

card;3) bank fund transfer card;4) code;5) account number;6) personal identification number; or7) other means of account accessthat can be used, alone or in conjunctionwith items 1) through 7) above, to obtainmoney, goods, services, or any other thing

of value, or that can be used to initiate atransfer of funds.

b) caused by forgery or alteration of a checkor negotiable instrument made or drawnupon an insured person’s account;

c) to an insured person through acceptancein good faith of counterfeit United Statesor Canadian paper currency.

Our maximum limit of liability for any one lossis $1,000, regardless of the number of personsinvolved. All loss due to forgery orunauthorized use by or involving any oneperson is considered one loss.

We do not cover:a) loss arising from any business of an

insured person;b) loss caused by or at the direction of an

insured person or any other person whohas been entrusted with any credit card,debit or automated teller machine card, orbank fund transfer card;

c) loss arising out of dishonesty of aninsured person.

When loss is discovered, the insured personmust give us immediate notice. If the lossinvolves a credit card, debit or automatedteller machine card, or bank fund transfercard, the insured person must also giveimmediate notice to the company or bank thatissued the card. Failure to comply with theterms and conditions of the card voids thisprotection.

We will pay only for loss occurring during thepolicy period, including those lossesdiscovered and reported to us within one yearafter the policy has terminated. We have theright to investigate and settle any claim or suitas we deem appropriate. Full payment of theamount of insurance for any one loss ends ourobligation under each claim or suit arisingfrom the loss.

When this coverage applies, we will defendany suit brought against an insured person forthe enforcement of payment that an insuredperson is legally required to make as a result

of the unauthorized use of any credit card,debit or automated teller machine card, orbank fund transfer card issued to or registeredin the name of an insured person. The defensewill be at our expense, with counsel of ourchoice.

When this coverage applies, we have theoption to defend an insured person or theinsured person’s bank against a suit for theenforcement of payment legally required to bemade as a result of forgery or alteration of acheck or negotiable instrument made or drawnupon an insured person’s account. Thedefense will be at our expense, with counsel ofour choice.

No deductible applies to this protection.

3. Debris RemovalWe will pay reasonable expenses you incur toremove debris of covered property damagedby a loss we cover. If the loss to the coveredproperty and the cost of debris removal aremore than the Limit Of Liability shown on thePolicy Declarations for the covered property,we will pay up to an additional 5% of that limitfor debris removal.

4. Emergency Removal Of PropertyWe will pay for sudden and accidental directphysical loss to covered property from anycause while removed from a premises becauseof danger from a loss we cover. Protection islimited to a 30-day period from date ofremoval. This protection does not increase thelimit of liability that applies to the coveredproperty.

5. Fire Department ChargesWe will pay up to $500 for service chargesmade by fire departments called to protectyour property from a loss we cover at theresidence premises. No deductible applies tothis protection.

6. Temporary Repairs After A LossWe will reimburse you up to $5,000 for thereasonable and necessary cost you incur fortemporary repairs to protect covered propertyfrom further imminent covered loss following aloss we cover. This coverage does not increase

the limit of liability applying to the propertybeing repaired.

7. Trees, Shrubs, Plants and LawnsWe will pay up to 5% of the Limit Of Liabilityshown on the Policy Declarations underCoverage A Dwelling Protection for loss totrees, shrubs, plants and lawns at the addressof the residence premises. We will not paymore than $500 for any one tree, shrub, orplant including expenses incurred for removingdebris. This coverage applies only to directphysical loss caused by fire or lightning,explosion, riot or civil commotion, aircraft,vehicles not owned by an occupant of theresidence premises, vandalism or maliciousmischief, theft or collapse of a buildingstructure or any part of a building structure.

We will pay up to $500 for reasonableexpenses you incur for the removal of debris oftrees at the address of the residence premisesfor direct physical loss caused by windstorm,hail, or weight of ice, snow or sleet. The fallentree must have caused damage to propertycovered under Coverage A DwellingProtection or Coverage B Other StructuresProtection.

We do not cover trees, shrubs, plants, or lawnsgrown for business purposes.

This coverage does not increase the limit ofliability applying to the damaged property.

8. Temperature ChangeWe will pay for loss to covered personalproperty in a building structure at theresidence premises resulting from a change intemperature. The change in temperature mustresult from a covered loss to the buildingstructure.

This coverage does not increase the limit ofliability applying to the damaged property.

9. Power InterruptionWe will pay up to $500 for loss to the contentsof freezers and refrigerated units on the

residence premises caused by the interruptionof power which occurs off the residencepremises. If a power interruption is known toan insured person, all reasonable means mustbe used to protect the contents of freezers andrefrigerated units.

This coverage does not increase the limit ofliability applying to the damaged property.

10. Arson RewardWe will pay up to $5,000 for informationleading to an arson conviction in connectionwith a fire loss to property covered underSection I of this policy. The $5,000 limitapplies regardless of the number of personsproviding information.

11. CollapseWe will cover at the residence premisesa) the entire collapse of a covered building

structure;b) the entire collapse of part of a covered

building structure; andc) direct physical loss to covered property

caused by a) or b) above.

For coverage to apply, the collapse of abuilding structure specified in a) or b) abovemust be a sudden and accidental directphysical loss caused by one or more of thefollowing:a) a loss we cover under Section I,

Coverage C Personal PropertyProtection;

b) weight of persons, animals, equipment orcontents;

c) weight of rain, snow or ice which collectson a roof;

d) defective methods or materials used inconstruction, repair, remodeling orrenovation, but only if the collapse occursin the course of such construction, repair,remodeling or renovation.

Collapse as referenced herein means thecovered building structure or part of thecovered building structure has actually fallendown or fallen into pieces unexpectedly and

instantaneously. It does not include settling,cracking, shrinking, bulging, expansion,sagging, or bowing. Furthermore, collapsedoes not include or mean substantial structuralimpairment or imminent collapse.

Loss to an awning, fence, patio, deck,pavement, swimming pool, underground pipe,flue, drain, cesspool, fuel oil tank, septic tank,cistern or similar system, foundation, retainingwall, bulkhead, pier, wharf or dock is notincluded, unless the loss is a direct result ofthe collapse of a building structure or part of abuilding structure that is a sudden andaccidental direct physical loss caused by oneor more of the following:a) a loss we cover under Section I,

Coverage C Personal PropertyProtection;

b) weight of persons, animals, equipment orcontents; weight of rain, snow or icewhich collects on a roof;

c) defective methods or materials used inconstruction, repair, remodeling orrenovation, but only if the collapse occursin the course of such construction, repair,remodeling or renovation.

This coverage does not increase the limit ofliability applying to the covered property.

12. LandIf a sudden and accidental direct physical lossresults in both a covered loss to the dwelling,other than the breakage of glass or safetyglazing material, and a loss of land stability,we will pay up to $10,000 as an additionalamount of insurance for repair costsassociated with the land. This includes thecosts required to replace, rebuild, stabilize orotherwise restore the land necessary tosupport that part of the dwelling sustainingthe covered loss.

The Section I Losses We Do Not CoverUnder Coverage A, Coverage B andCoverage C reference to earth movement doesnot apply to the loss of land stability providedunder this Additional Protection.

13. Lock ReplacementWhen a key to a lock is stolen as part of acovered theft loss, we will pay underCoverage A Dwelling Protection thereasonable expenses you incur to replace orre-key exterior door locks at the residencepremises with locks or cylinders of like kindand quality. The limit of liability under thiscoverage following any one theft loss is $500.

This coverage does not increase the limit ofliability that applies to the covered property.

Losses We Do Not Cover UnderCoverage A, Coverage B and Coverage CA. We do not cover loss to the property described

in Coverage A Dwelling Protection orCoverage B Other Structures Protectionconsisting of or caused by the following:1. Freezing of:

a) plumbing, fire protective sprinklersystems, heating or air conditioningsystems;

b) household appliances; orc) swimming pools, hot tubs and spas

within the dwelling, their filtrationand circulation systems;

or discharge, leakage or overflow fromwithin a), b) or c) above, caused byfreezing, while the building structure isvacant, unoccupied or being constructedunless you have used reasonable care to:a) maintain heat in the building

structure; orb) shut off the water supply and drain

the system and appliances.

2. Freezing, thawing, pressure or weight ofwater, snow or ice, whether driven bywind or not. This exclusion applies tofences, pavements, patios, foundations,retaining walls, bulkheads, piers, wharvesand docks. This exclusion also applies toswimming pools, hot tubs, spas, theirfiltration and circulation systems if theswimming pool, hot tub or spa is notlocated within a heated portion of thedwelling.

3. Seepage, meaning continuous or repeatedseepage or leakage over a period ofweeks, months, or years, of water, steamor fuel:a) from a plumbing, heating, air

conditioning or automatic fireprotection system or from within adomestic appliance; or

b) from, within or around any plumbingfixtures, including, but not limited toshower stalls, shower baths, tubinstallations, sinks or other fixturesdesigned for the use of water orsteam.

4. Collapse, except as specifically providedin Section I Additional Protection underitem 11, " Collapse."

5. Theft from your residence premises whileyour dwelling is under construction, or ofmaterials and supplies for use inconstruction, until your dwelling iscompleted and occupied.

6. Vandalism or Malicious Mischief if yourdwelling is vacant or unoccupied for morethan 30 consecutive days immediatelyprior to the vandalism or maliciousmischief. A dwelling under construction isnot considered vacant or unoccupied.

7. a) wear and tear, aging, marring,scratching, deterioration, inherentvice, or latent defect;

b) mechanical breakdown;c) growth of trees, shrubs, plants or

lawns whether or not such growth isabove or below the surface of theground;

d) rust or other corrosion;e) contamination, including, but not

limited to, the presence of toxic,noxious or hazardous gasses,chemicals, liquids, solids or othersubstances at the residencepremises or in the air, land or waterserving the residence premises;

f) smog, smoke from the manufacturingof any controlled substance,

agricultural smudging and industrialoperations;

g) settling, cracking, shrinking, bulgingor expansion of pavements, patios,foundations, walls, floors, roofs orceilings;

h) insects, rodents, birds or domesticanimals. We do cover the breakageof glass or safety glazing materialscaused by birds; or

i) seizure by government authority.

If any of a) through h) cause the suddenand accidental escape of water or steamfrom a plumbing, heating or airconditioning system, household applianceor fire protective sprinkler system withinyour dwelling, we cover the directphysical damage caused by the water orsteam. If loss to covered property iscaused by water or steam not otherwiseexcluded, we will cover the cost of tearingout and replacing any part of yourdwelling necessary to repair the systemor appliance. This does not includedamage to the defective system orappliance from which the water escaped.

8. Soil conditions, including, but not limitedto, corrosive action, chemicals,compounds, elements, suspensions,crystal formations or gels in the soil.

B. We do not cover loss to the property describedin Coverage A Dwelling Protection orCoverage B Other Structures Protectionwhen:1) there are two or more causes of loss to

the covered property; and2) the predominant cause(s) of loss is (are)

excluded under items A.1 through A.8above.

C. We do not cover loss to the property describedin Coverage A Dwelling Protection,Coverage B Other Structures Protection orCoverage C Personal Property Protectionconsisting of or caused by the following:

1. Flood, including, but not limited to,surface water, waves, tidal water oroverflow of any body of water, or sprayfrom any of these, whether or not drivenby wind.

2. Water or any other substance that:a) backs up through sewers or drains;

orb) overflows from a sump pump, sump

pump well or other system designedfor the removal of subsurface waterwhich is drained from a foundationarea of a structure.

3. Water or any other substance on or belowthe surface of the ground, regardless ofits source. This includes water or anyother substance which exerts pressureon, or flows, seeps or leaks through anypart of the residence premises.

We do cover sudden and accidental directphysical loss caused by fire, explosion ortheft resulting from items 1 through 3listed above.

4. Earth movement of any type, including,but not limited to, earthquake, volcaniceruption, lava flow, landslide, subsidence,mudflow, pressure, sinkhole, erosion, orthe sinking, rising, shifting, creeping,expanding, bulging, cracking, settling orcontracting of the earth. This exclusionapplies whether or not the earthmovement is combined with water.

We do cover sudden and accidental directphysical loss caused by fire, explosion,theft or breakage of glass or safetyglazing materials resulting from earthmovement.

5. Enforcement of any building codes,ordinances or laws regulating theconstruction, reconstruction,maintenance, repair, placement ordemolition of any building structure,other structure or land at the residencepremises.

We do cover sudden and accidental directphysical loss to covered property causedby actions of civil authority to prevent thespread of fire.

6. The failure by any insured person to takeall reasonable steps to save and preserveproperty when the property is endangeredby a cause of loss we cover.

7. Any substantial change or increase inhazard, if changed or increased by anymeans within the control or knowledge ofan insured person.

8. Intentional or criminal acts of or at thedirection of any insured person, if theloss that occurs:a) may be reasonably expected to result

from such acts; orb) is the intended result of such acts.

This exclusion applies regardless ofwhether or not the insured person isactually charged with, or convicted of, acrime.

9. Weather Conditions that contribute in anyway with a cause of loss excluded underLosses We Do Not Cover UnderCoverage A, Coverage B and Coverage Cto produce a loss.

10. Planning, Construction or Maintenance,meaning faulty, inadequate or defective:a) planning, zoning, development,

surveying, siting;b) design, specifications, workmanship,

repair, construction, renovation,remodeling, grading, compaction;

c) materials used in repair,construction, renovation orremodeling; or

d) maintenance

of property whether on or off theresidence premises by any person ororganization.

11. Vapors, fumes, acids, toxic chemicals,toxic gasses, toxic liquids, toxic solids,waste materials or other irritants,contaminants or pollutants.

D. We do not cover loss to the property describedin Coverage A Dwelling Protection,Coverage B Other Structures Protection orCoverage C Personal Property Protectionwhen:1) there are two or more causes of loss to

the covered property; and2) the predominant cause(s) of loss is (are)

excluded under items C.1. through C.11above.

E. We do not cover loss to the property describedin Coverage A Dwelling Protection,Coverage B Other Structures Protection orCoverage C Personal Property Protectionconsisting of or caused by mold, fungus, wetrot, dry rot or bacteria. This includes any losswhich, in whole or in part, arises out of, isaggravated by or results from mold, fungus,wet rot, dry rot or bacteria.

This exclusion applies regardless of whethermold, fungus, wet rot, dry rot or bacteria arisesfrom any other cause of loss, including but notlimited to a loss involving water, waterdamage or discharge, which may otherwise becovered by this policy, except as specificallyprovided in Section I, Conditions Mold,Fungus, Wet Rot and Dry Rot Remediation asa Direct Result of a Covered Water Loss.

F. We do not cover loss to the property describedin Coverage A Dwelling Protection,Coverage B Other Structures Protection orCoverage C Personal Property Protectionconsisting of or caused by the following. Theseexclusions apply regardless of whether anyother cause contributed concurrently or in anysequence to produce the loss:1. Nuclear action, meaning nuclear reaction,

discharge, radiation or radioactivecontamination, or any consequence of anyof these. Loss caused by nuclear action isnot considered loss by fire, explosion orsmoke.

We do cover sudden and accidental directphysical loss by fire resulting from nuclearaction.

2. War or warlike acts, including, but notlimited to, insurrection, rebellion orrevolution.

Section I Conditions

1. DeductibleWe will pay when a covered loss exceeds theapplicable deductible shown on the PolicyDeclarations. We will then pay only the excessamount, unless we have indicated otherwisein this policy.

2. Insurable Interest and Our LiabilityIn the event of a covered loss, we will not payfor more than an insured person’s insurableinterest in the property covered, nor more thanthe amount of coverage afforded by this policy.

3. What You Must Do After A LossIn the event of a loss to any property that maybe covered by this policy, you must:a) immediately give us or our agent notice.

Report any theft to the police as soon aspossible. If the loss involves a credit card,debit or automated teller machine card, orbank fund transfer card, give notice to thecompany or bank that issued the card.

b) protect the property from further loss.Make any reasonable repairs necessary toprotect it. Keep an accurate record of anyrepair expenses.

c) separate damaged from undamagedpersonal property. Give us a detailed listof the damaged, destroyed or stolenproperty, showing the quantity, cost,actual cash value and the amount of lossclaimed.

d) give us all accounting records, bills,invoices and other vouchers, or certifiedcopies, which we may reasonably requestto examine and permit us to make copies.

e) produce receipts for any increased coststo maintain your standard of living while

you reside elsewhere, and recordssupporting any claim for loss of rentalincome.

f) as often as we reasonably require:1) show us the damaged property.2) at our request, submit to

examinations under oath, separatelyand apart from any other persondefined as you or insured personand sign a transcript of the same.

3) produce representatives, employees,members of the insured person’shousehold or others to the extent it iswithin the insured person’s power todo so; and

g) within 60 days after the loss, give us asigned, sworn proof of the loss. Thisstatement must include the followinginformation:1) the date, time, location and cause of

loss;2) the interest insured persons and

others have in the property, includingany encumbrances;

3) the actual cash value and amount ofloss for each item damaged,destroyed or stolen;

4) any other insurance that may coverthe loss;

5) any changes in title, use, occupancyor possession of the property thathave occurred during the policyperiod;

6) at our request, the specifications ofany damaged building structure orother structure; and

7) evidence supporting any claim underthe Credit Card, Debit or AutomatedTeller Machine Card, Bank FundTransfer Card, Check Forgery andCounterfeit Money protection. Statethe cause and amount of loss.

We have no duty to provide coverage underthis section if you, an insured person, or arepresentative of either fail to comply withitems a) through g) above, and this failure tocomply is prejudicial to us.

4. Our Settlement OptionsIn the event of a covered loss, we have theoption to:

a) repair, rebuild or replace all or any part ofthe damaged, destroyed or stolenproperty with property of like kind andquality within a reasonable time; or

b) pay for all or any part of the damaged,destroyed or stolen property as describedin Condition 5 " How We Pay For A Loss."

Within 30 days after we receive your signed,sworn proof of loss we will notify you of theoption or options we intend to exercise.

5. How We Pay For A LossUnder Coverage A Dwelling Protection,Coverage B Other Structures Protection andCoverage C Personal Property Protection,payment for covered loss will be by one ormore of the following methods:a) Special Payment. At our option, we may

make payment for a covered loss beforeyou repair, rebuild or replace thedamaged, destroyed or stolen property if:1) the whole amount of loss for property

covered under Coverage ADwelling Protection and Coverage B

Other Structures Protection,without deduction for depreciation, isless than $2,500 and if the propertyis not excluded from the BuildingStructure Reimbursement provision,or;

2) the whole amount of loss for propertycovered under Coverage CPersonal Property Protection,without deduction for depreciation, isless than $2,500 and if your PolicyDeclarations shows that the PersonalProperty Reimbursement provisionapplies, and the property is notexcluded from the Personal PropertyReimbursement provision.

b) Actual Cash Value. If you do not repair orreplace the damaged, destroyed or stolenproperty, payment will be on an actualcash value basis. This means there maybe a deduction for depreciation. Paymentwill not exceed the Limit Of Liabilityshown on the Policy Declarations for thecoverage that applies to the damaged,

destroyed or stolen property, regardless ofthe number of items involved in the loss.

You may make claim for additionalpayment as described in paragraph c) andparagraph d) below, if applicable, if yourepair or replace the damaged, destroyedor stolen covered property within 180days of the actual cash value payment.

c) Building Structure Reimbursement. UnderCoverage A Dwelling Protection andCoverage B Other StructuresProtection, we will make additionalpayment to reimburse you for cost inexcess of actual cash value if you repair,rebuild or replace damaged, destroyed orstolen covered property within 180 daysof the actual cash value payment. Thisadditional payment includes thereasonable and necessary expense fortreatment or removal and disposal ofcontaminants, toxins or pollutants asrequired to complete repair orreplacement of that part of a buildingstructure damaged by a covered loss.This additional payment shall not includeany amounts which may be paid orpayable under Section I, ConditionsMold, Fungus, Wet Rot and Dry RotRemediation as a Direct Result of aCovered Water Loss, and shall not bepayable for any losses excluded inSection I Your Property, under LossesWe Do Not Cover Under Coverage A,Coverage B and Coverage C, section E.

Building Structure Reimbursement will notexceed the smallest of the followingamounts:1) the replacement cost of the part(s) of

the building structure(s) forequivalent construction for similaruse on the same residencepremises;

2) the amount actually and necessarilyspent to repair or replace thedamaged building structure(s) withequivalent construction for similar

use on the same residencepremises; or

3) the Limit Of Liability applicable to thebuilding structure(s) as shown onthe Policy Declarations for CoverageA Dwelling Protection or CoverageB Other Structures Protection,regardless of the number of buildingstructures and structures other thanbuilding structures involved in theloss.

If you replace the damaged buildingstructure(s) at an address other thanshown on the Policy Declarations throughconstruction of a new structure orpurchase of an existing structure, suchreplacement will not increase the amountpayable under Building StructureReimbursement described above. Theamount payable under Building StructureReimbursement described above does notinclude the value of any land associatedwith the replacement structure(s).

Building Structure Reimbursementpayment will be limited to the differencebetween any actual cash value paymentmade for the covered loss to buildingstructures and the smallest of 1), 2) or 3)above.

Building Structure Reimbursement will notapply to:1) property covered under Coverage C

Personal Property Protection;2) property covered under Coverage B

Other Structures Protection that isnot a building structure;

3) wall-to-wall carpeting, fences,awnings and outdoor antennaswhether or not fastened to a buildingstructure; or

4) land.

Payment under a), b), or c) above will notinclude any increased cost due to theenforcement of building codes, ordinances orlaws regulating the construction, reconstruction,

maintenance, repair, relocation or demolition ofbuilding structures or other structures.

d) Personal Property Reimbursement. UnderCoverage C Personal PropertyProtection, we will make additionalpayment to reimburse you for cost inexcess of actual cash value if you repair,rebuild or replace damaged, destroyed orstolen covered personal property or wall-to-wall carpeting within 180 days of theactual cash value payment.

Personal Property Reimbursementpayment will not exceed the smallest ofthe following amounts:1) the amount actually and necessarily

spent to repair or replace theproperty with similar property of likekind and quality;

2) the cost of repair or restoration; or3) the Limit Of Liability shown on the

Policy Declarations for Coverage CPersonal Property Protection, or anyspecial limit of liability described inthe policy, regardless of the numberof items of personal property involvedin the loss.

Personal Property Reimbursement will belimited to the difference between anyactual cash value payment made for thecovered loss to personal property and thesmallest of 1), 2) or 3) above.

Personal Property Reimbursement will notapply to:1) property insured under Coverage A

Dwelling Protection and Coverage BOther Structures Protection,

except wall-to-wall carpeting;2) antiques, fine arts, paintings,

statuary and similar articles which,by their inherent nature, cannot bereplaced;

3) articles whose age or historycontribute substantially to their value.This includes, but is not limited to,memorabilia, souvenirs andcollector’s items;

4) property that was obsolete orunusable for the originally intendedpurpose because of age or conditionprior to the loss; or

5) motorized land vehicles used solelyfor the service of the insuredpremises and not licensed for use onpublic roads. This does not includemotorized land vehicles designed forassisting the disabled.

6. Our Settlement Of LossWe will settle any covered loss with you unlesssome other person or entity is named in thepolicy. We will settle within 60 days after theamount of loss is finally determined. Thisamount may be determined by an agreementbetween you and us, an appraisal award or acourt judgment.

7. AppraisalIf you and we fail to agree on the amount ofloss, either party may make written demandfor an appraisal. Upon such demand, eachparty must select a competent and impartialappraiser and notify the other of theappraiser’s identity within 20 days after thedemand is received. The appraisers will selecta competent and impartial umpire. If theappraisers are unable to agree upon an umpirewithin 15 days, you or we can ask a judge of acourt of record in the state where theresidence premises is located to select anumpire.

The appraisers shall then determine theamount of loss, stating separately the actualcash value and the amount of loss to eachitem. If the appraisers submit a written reportof an agreement to you and to us the amountagreed upon shall be the amount of loss. Ifthey cannot agree, they will submit theirdifferences to the umpire. A written awardagreed upon by any two will determine theamount of loss.

Each party will pay the appraiser it chooses,and equally bear expenses for the umpire andall other appraisal expenses.

8. Abandoned PropertyWe are not obligated to accept any property orresponsibility for any property abandoned byan insured person.

9. Permission Granted To Youa) The residence premises may be vacant or

unoccupied for any length of time, exceptwhere a time limit is indicated in thispolicy for specific perils. A buildingstructure under construction is notconsidered vacant.

b) You may make alterations, additions orrepairs, and you may complete structuresunder construction.

10. Our Rights To Recover PaymentWhen we pay for any loss, an insuredperson’s right to recover from anyone elsebecomes ours up to the amount we have paid.An insured person must protect these rightsand help us enforce them. You may waiveyour rights to recover against another personfor loss involving the property covered by thispolicy. This waiver must be in writing prior tothe date of the loss.

11. Our Rights To Obtain SalvageWe have the option to take all or any part ofthe damaged or destroyed covered propertyupon replacement by us or payment of theagreed or appraised value.

We will notify you of our intent to exercise thisoption within 30 days after we receive yoursigned, sworn proof of loss. If no signed,sworn proof of loss is requested by us, we willnotify you of our intent to exercise this optionwithin 60 days after the date you report theloss to us.

When we settle any loss caused by theft ordisappearance, we have the right to obtain allor part of any property which may berecovered. An insured person must protectthis right and inform us of any propertyrecovered. We will inform you of our intent toexercise this right within 10 days of yournotice of recovery to us.

12. Action Against UsNo one may bring an action against us in anyway related to the existence or amount ofcoverage, or the amount of loss for whichcoverage is sought, under a coverage to whichSection I Conditions applies, unless:a) there has been full compliance with all

policy terms; andb) the action is commenced within one year

after the inception of loss or damage.

13. Loss To A Pair Or SetIf there is a covered loss to a pair or set, wemay:a) repair or replace any part of the pair or set

to restore it to its actual cash value beforethe loss; or

b) pay the difference between the actualcash value of the pair or set before andafter the loss.

14. Glass ReplacementPayment for loss to covered glass includes thecost of using safety glazing materials whenrequired by law.

15. No Benefit To BaileeThis insurance will not benefit any person ororganization who may be caring for orhandling your property for a fee.

16. Other InsuranceIf both this insurance and other insuranceapply to a loss, we will pay the proportionateamount that this insurance bears to the totalamount of all applicable insurance. However,in the event of a loss by theft, this insuranceshall be excess over any other insurance thatcovers loss by theft.

17. Property Insurance AdjustmentWhen the Policy Declarations indicates that theProperty Insurance Adjustment Conditionapplies, you agree that, at each policyanniversary, we may increase the Limit ofLiability shown on the Policy Declarations forCoverage A Dwelling Protection to reflectone of the following:a) the rate of change in the Index identified

in the " Important Payment and Coverage

Information" section of the PolicyDeclarations. The limit of liability forCoverage A Dwelling Protection for thesucceeding premium period will bedetermined by changing the existing limitin proportion to the change in the Indexbetween the time the existing limit wasestablished and the time the change ismade. The resulting amount will berounded to the nearest $1000; or

b) the minimum amount of insurancecoverage we are willing to issue for thesucceeding premium period underCoverage A Dwelling Protection foryour dwelling and other property wecover under Coverage A DwellingProtection.

Any adjustment in the limit of liability forCoverage A Dwelling Protection will result inan adjustment in the limit of liability forCoverage B Other Structures Protection andCoverage C Personal Property Protection inaccordance with our manual of Rules andRates.

Any adjustment in premium resulting from theapplication of this condition will be madebased on premium rates in use by us at thetime a change in limits is made.

We will not reduce the limit of liability shownon the Policy Declarations without yourconsent. You agree that it is yourresponsibility to ensure that each of the limitsof liability shown on the Policy Declarations areappropriate for your insurance needs. If youwant to increase or decrease any of the limitsof liability shown on the Policy Declarations,you must contact us to request such a change.

18. MortgageeA covered loss will be payable to theMortgagee(s) named on the PolicyDeclarations, to the extent of their interest andin the order of precedence. All provisions ofSection I of this policy apply to thesemortgagees.

We will:

a) protect the mortgagee’s interest in acovered building structure in the event ofan increase in hazard, intentional orcriminal acts of, or directed by, aninsured person, failure by any insuredperson to take all reasonable steps tosave and preserve property after a loss, achange in ownership, or foreclosure if themortgagee has no knowledge of theseconditions; and

b) give the mortgagee at least 10 days noticeif we cancel this policy.

The mortgagee will:a) furnish proof of loss within 60 days after

notice of the loss if an insured personfails to do so;

b) pay upon demand any premium due if aninsured person fails to do so;

c) notify us in writing of any change ofownership or occupancy or any increasein hazard of which the mortgagee hasknowledge;

d) give us the mortgagee’s right of recoveryagainst any party liable for loss; and

e) after a loss, and at our option, permit usto satisfy the mortgage requirements andreceive full transfer of the mortgage.

This mortgagee interest provision shall applyto any trustee or loss payee or other securedparty.

19. Mold, Fungus, Wet Rot and Dry RotRemediation as a Direct Result of a CoveredWater LossIn the event of a covered water loss underCoverage A Dwelling Protection,Coverage B Other Structures Protection orCoverage C Personal Property Protection,we will pay up to $5,000 for mold, fungus, wetrot or dry rot remediation.

Remediation means the reasonable andnecessary treatment, removal or disposal ofmold, fungus, wet rot or dry rot as required tocomplete repair or replacement of property wecover under Coverage A DwellingProtection, Coverage B Other Structures

Protection or Coverage C Personal PropertyProtection damaged by a covered water loss,including payment for any reasonable increasein living expenses necessary to maintain yournormal standard of living if mold, fungus, wetrot or dry rot makes your residence premisesuninhabitable. Remediation also includes anyinvestigation or testing to detect, measure orevaluate mold, fungus, wet rot or dry rot.

This Condition does not increase the limits ofliability under Coverage A DwellingProtection, Coverage B Other StructuresProtection or Coverage C Personal PropertyProtection.

Section II Family Liability andGuest Medical Protection

Coverage XFamily Liability Protection

Losses We Cover Under Coverage X:Subject to the terms, conditions and limitations ofthis policy, we will pay damages which an insuredperson becomes legally obligated to pay becauseof bodily injury or property damage arising froman occurrence to which this policy applies, and iscovered by this part of the policy.

We may investigate or settle any claim or suit forcovered damages against an insured person. If aninsured person is sued for these damages, we willprovide a defense with counsel of our choice, evenif the allegations are groundless, false orfraudulent. We are not obligated to defend any suitor pay any claim or judgment after we haveexhausted our limit of liability.

Coverage YGuest Medical Protection

Losses We Cover Under Coverage Y:We will pay the reasonable expenses incurred fornecessary medical, surgical, x-ray and dentalservices; ambulance, hospital, licensed nursing andfuneral services; and prosthetic devices, eye glasses,

hearing aids, and pharmaceuticals. These expensesmust be incurred and the services performed withinthree years from the date of an occurrence causingbodily injury to which this policy applies, and iscovered by this part of the policy.

Each person who sustains bodily injury is entitled tothis protection when that person is:1. on the insured premises with the permission

of an insured person; or2. off the insured premises, if the bodily injury:

a) arises out of a condition on the insuredpremises or immediately adjoining ways;

b) is caused by the activities of an insuredperson or a residence employee;

c) is caused by an animal owned by or in thecare of an insured person; or

d) is sustained by a residence employee.

Additional Protection

We will pay, in addition to the limits of liability:1. Claim Expense

We will pay:a) all costs we incur in the settlement of any

claim or the defense of any suit against aninsured person;

b) interest accruing on damages awardeduntil such time as we have paid, formallyoffered, or deposited in court the amountfor which we are liable under this policy;interest will be paid only on damageswhich do not exceed our limits of liability;

c) premiums on bonds required in any suitwe defend; we will not pay bondpremiums in an amount that is more thanour limit of liability; we have no obligationto apply for or furnish bonds;

d) up to $150 per day for loss of wages andsalary, when we ask you to attend trialsand hearings;

e) any other reasonable expenses incurredby an insured person at our request.

2. Emergency First AidWe will pay reasonable expenses incurred byan insured person for first aid to other personsat the time of an accident involving bodilyinjury covered under this policy.

3. Damage To Property Of OthersAt your request, we will pay up to $500 eachtime an insured person causes propertydamage to someone else’s property. At ouroption, we will pay the cost to either repair orreplace the property damaged by an insuredperson, without deduction for depreciation.

We will not pay for property damagea) to property covered under Section I of this

policy;b) to property intentionally damaged by an

insured person who has attained the ageof 13;

c) to property owned by or rented to aninsured person, any tenant of an insuredperson, or any resident in yourhousehold; or

d) arising out of:1) past or present business activities;2) any act or omission in connection

with a premises, other than aninsured premises, owned, rented orcontrolled by an insured person; or

3) the ownership or use of a motorizedland vehicle, trailer, aircraft,hovercraft or watercraft.

Losses We Do Not Cover UnderCoverage X and Coverage Y

A. Losses We Do Not Cover Under Coverage X:1. We do not cover bodily injury to an

insured person or property damage toproperty owned by an insured personwhenever any benefit of this coveragewould accrue directly or indirectly to aninsured person.

2. We do not cover any property damageconsisting of or caused by vapors, fumes,acids, toxic chemicals, toxic gasses, toxicliquids, toxic solids, waste materials orother irritants, contaminants or pollutants.

3. We do not cover any bodily injury orproperty damage arising out of anyliability statutorily imposed upon anyinsured person in any manner, consisting

of or caused by vapors, fumes, acids,toxic chemicals, toxic gasses, toxicliquids, toxic solids, waste materials orother irritants, contaminants or pollutants.

4. We do not cover any liability an insuredperson assumes arising out of anycontract or agreement.

5. We do not cover property damage toproperty rented to, occupied or used by,or in the care of, an insured person. Thisexclusion does not apply if the propertydamage is caused by fire, explosion orsmoke.

6. We do not cover any liability imposedupon any insured person by anygovernmental authority for bodily injuryor property damage which, in whole or inpart, arises out of, is aggravated by orresults from mold, fungus, wet rot, dry rotor bacteria.

B. Losses We Do Not Cover Under Coverage Y:1. We do not cover bodily injury to any

insured person or regular resident of theinsured premises. However, thisexclusion does not apply to a residenceemployee.

2. We do not cover bodily injury to anyperson on the insured premises becauseof a business activity or professionalservice conducted there.

C. Losses We Do Not Cover Under Coverage Xand Coverage Y:Coverage under Coverage X Family LiabilityProtection will be excluded for bodily injuryand property damage and coverage underCoverage Y Guest Medical Protection willbe excluded for bodily injury as follows:

1. We do not cover any bodily injury orproperty damage intended by, or whichmay reasonably be expected to resultfrom the intentional or criminal acts or

omissions of, any insured person. Thisexclusion applies even if:a) such insured person lacks the

mental capacity to govern his or herconduct;

b) such bodily injury or propertydamage is of a different kind ordegree than intended or reasonablyexpected; or

c) such bodily injury or propertydamage is sustained by a differentperson than intended or reasonablyexpected.

This exclusion applies regardless ofwhether or not such insured person isactually charged with, or convicted of acrime.

2. We do not cover bodily injury to anyperson eligible to receive benefitsrequired to be provided or voluntarilyprovided by an insured person under anyworker’s compensation, non-occupationaldisability or occupational disease law.

3. We do not cover bodily injury or propertydamage arising out of the ownership,maintenance, use, occupancy, renting,loaning, entrusting, loading or unloadingof aircraft.

This exclusion does not apply to bodilyinjury to a residence employee.

4. We do not cover bodily injury or propertydamage arising out of the ownership,maintenance, use, occupancy, renting,loaning, entrusting, loading or unloadingof any motor vehicle or trailer. However,this exclusion does not apply to:a) a motor vehicle in dead storage or

used exclusively on an insuredpremises;

b) any motor vehicle designedprincipally for recreational use offpublic roads, unless that vehicle isowned by an insured person and is

being used away from an insuredpremises;

c) a motorized wheel chair;d) a vehicle used to service an insured

premises which is not designed foruse on public roads and not subjectto motor vehicle registration;

e) a golf cart owned by an insuredperson when used for golfingpurposes;

f) a trailer of the boat, camper, home orutility type unless it is being towed orcarried by a motorized land vehicle;

g) lawn or garden implements under 40horsepower;

h) bodily injury to a residenceemployee.

5. We do not cover bodily injury or propertydamage arising out of the ownership,maintenance, use, occupancy, renting,loaning, entrusting, loading or unloadingof watercraft away from an insuredpremises if the watercraft:a) has inboard or inboard-outboard

motor power of more than 50horsepower;

b) is a sailing vessel 26 feet or more inlength;

c) is powered by one or more outboardmotors with more than 25 totalhorsepower;

d) is designated as an airboat, aircushion, or similar type of watercraft;or

e) is a personal watercraft, meaning acraft propelled by a water jet pumpengine and designed to be operatedby a person or persons sitting,standing or kneeling on the craft.

This exclusion does not apply to bodilyinjury to a residence employee.

6. We do not cover bodily injury or propertydamage arising out of the ownership,maintenance, use, occupancy, renting,loaning, entrusting, loading or unloadingof hovercrafts. This exclusion does not

apply to bodily injury to a residenceemployee.

7. We do not cover bodily injury or propertydamage arising out of:a) the negligent supervision by any

insured person of any person; orb) any liability statutorily imposed on

any insured person

arising from the ownership, maintenance,use, occupancy, renting, loaning,entrusting, loading or unloading of anyaircraft, watercraft, hovercraft, motorizedland vehicle or trailer which is not coveredunder Section II of this policy.

8. We do not cover any bodily injury whichresults in any manner from the discharge,dispersal, release or escape of vapors,fumes, acids, toxic chemicals, toxicgasses, toxic liquids, toxic solids, wastematerials or other irritants, contaminantsor pollutants.

We do cover bodily injury which resultsfrom such discharge if the discharge issudden and accidental.

9. We do not cover bodily injury or propertydamage arising out of the rendering of, orfailure to render, professional services byan insured person.

10. We do not cover bodily injury or propertydamage arising out of the past or presentbusiness activities of an insured person.

We do cover the occasional or part-timebusiness activities of an insured personwho is a student under 21 years of agewho is self-employed and has noemployees.

11. We do not cover bodily injury or propertydamage arising out of any premises, otherthan an insured premises, owned, rentedor controlled by an insured person. This

exclusion does not apply to bodily injuryto a residence employee.

12. We do not cover bodily injury or propertydamage which, in whole or in part, arisesout of, is aggravated by or results frommold, fungus, wet rot, dry rot or bacteria.

13. We do not cover bodily injury or propertydamage caused by war or warlike acts,including, but not limited to, insurrection,rebellion or revolution.

Section II Conditions

1. What You Must Do After An Accidental LossIn the event of bodily injury or propertydamage, you must do the following:a) Promptly notify us or our agent stating:

1) your name and policy number;2) the date, the place and the

circumstances of the loss;3) the name and address of anyone who

might have a claim against aninsured person;

4) the names and addresses of anywitnesses.

b) Promptly send us any legal papersrelating to the accident.

c) At our request, an insured person will:1) cooperate with us and assist us in

any matter concerning a claim orsuit;

2) help us enforce any right of recoveryagainst any person or organizationwho may be liable to an insuredperson;

3) attend any hearing or trial.d) Under the Damage To Property Of Others

protection, give us a sworn statement ofthe loss. This must be made within 60days after the date of loss. Also, aninsured person must be prepared to showus any damaged property under thatperson’s control.

Any insured person will not voluntarily payany money, assume any obligations or incurany expense, other than for first aid to others

at the time of the loss as provided for in thispolicy.

2. What An Injured Person Must Do CoverageY Guest Medical ProtectionIf someone is injured, that person, or someoneacting for that person, must do the following:a) Promptly give us written proof of the loss.

If we request, this must be done underoath.

b) Give us written authorization to obtaincopies of all medical records and reports.

c) Permit doctors we select to examine theinjured person as often as we mayreasonably require.

3. Our Payment Of Loss Coverage Y GuestMedical ProtectionWe may pay the injured person or the providerof the medical services. Payment under thiscoverage is not an admission of liability by usor an insured person.

4. Our Limits Of LiabilityRegardless of the number of insured persons,injured persons, claims, claimants or policiesinvolved, our total liability under Coverage XFamily Liability Protection for damagesresulting from one occurrence will not exceedthe Limit Of Liability shown on the PolicyDeclarations. All bodily injury and propertydamage resulting from continuous or repeatedexposure to the same general conditions isconsidered the result of one occurrence. Ourtotal liability under Coverage Y GuestMedical Protection for all medical expensespayable for bodily injury, to any one person,shall not exceed the "each person" Limit OfLiability shown on the Policy Declarations.

5. BankruptcyWe are not relieved of any obligation under thispolicy because of the bankruptcy or insolvencyof an insured person.

6. Our Rights to Recover Payment Coverage XFamily Liability Protection

When we pay any loss, an insured person’sright to recover from anyone else becomes

ours up to the amount we have paid. Aninsured person must protect these rights andhelp us enforce them.

7. Action Against Usa) No one may bring an action against us in

any way related to the existence oramount of coverage, or the amount of lossfor which coverage is sought, unless therehas been full compliance with all policyterms.

b) No one may bring an action against us inany way related to the existence oramount of coverage, or the amount of lossfor which coverage is sought, underCoverage X Family Liability Protection,unless the obligation of an insured personto pay has been finally determined eitherby judgment against the insured personafter actual trial, or by written agreementof the insured person, injured person andus, and the action against us iscommenced within one year of suchjudgment or agreement.

c) No one may bring an action against us inany way related to the existence oramount of coverage, or the amount of lossfor which coverage is sought, underCoverage Y Guest Medical Protection,unless such action is commenced withinone year after the date the expenses forwhich coverage is sought were actuallyincurred.

d) No one may bring an action against us inany way related to the existence oramount of coverage, or the amount of lossfor which coverage is sought, underSection II Additional Protection, unlesssuch action is commenced within oneyear after the date the claim expenses oremergency first aid expenses for whichcoverage is sought were actually incurred,or within one year after the date of loss tothe property if coverage is being soughtunder the Damage to Property of Othersprovision.

e) No one shall have any right to make us aparty to an action to determine the liabilityof an insured person.

8. Other Insurance Coverage X FamilyLiability ProtectionThis insurance is excess over any other validand collectible insurance except insurance thatis written specifically as excess over the limitsof liability that apply to this policy.

Section III Optional Protection

Optional Coverages You May BuyThe following Optional Coverages may supplementcoverages found in Section I or Section II and applyonly when they are indicated on the PolicyDeclarations. The provisions of this policy apply toeach Optional Coverage in this section unlessmodified by the terms of the specific OptionalCoverage.1. Coverage BC

Building CodesWe will pay up to 10% of the amount ofinsurance on the Policy Declarations underCoverage A Dwelling Protection to complywith local building codes after a covered lossto the dwelling or when repair or replacementresults in increased cost due to theenforcement of any building codes, ordinancesor laws regulating the construction,reconstruction, maintenance, repair ordemolition of the dwelling.

2. Coverage BPIncreased Coverage On Business PropertyThe limitation on business property located onthe residence premises, under Coverage CPersonal Property Protection, is increased tothe amount shown on the Policy Declarations.This increased coverage includes property heldas samples or for sale or delivery after sale,while the property is on the residencepremises.

3. Coverage DPIncreased Coverage On Electronic DataProcessing EquipmentThe limitation on electronic data processingequipment under Coverage C PersonalProperty Protection, and the recording orstorage media used with that equipment, is

increased to the amount shown on the PolicyDeclarations.

4. Coverage FFire Department ChargesThe $500 limit applying to the fire departmentservice charges under Additional Protection isincreased to the amount shown on the PolicyDeclarations.

5. Coverage GLoss AssessmentsIf your residence premises includes a buildingstructure which is constructed in commonwith one or more similar buildings, and youare a member of, and subject to the rules of,an association governing the areas held incommon by all building owners as members ofthe association, the insured premises meansthe building structure occupied exclusively byyour household as a private residence,including the grounds, related structures andprivate approaches to them.

We will pay your share of any specialassessments charged against all buildingowners by the association up to the Limit OfLiability shown on the Policy Declarations, whenthe assessment is made as a result of:a) sudden and accidental direct physical loss

to the property held in common by allbuilding owners caused by a loss wecover under Section I of this policy; or

b) bodily injury or property damage coveredunder Section II of this policy.

Any reduction or elimination of payments forlosses because of any deductible applying tothe insurance coverage of the association ofbuilding owners collectively is not coveredunder this protection.

We will pay only when the assessment leviedagainst the insured person, as a result of anyone loss, for bodily injury or property damageexceeds $250 and then only for the amount ofsuch excess. This coverage is not subject toany deductible applying to Section I of thispolicy.

In the event of an assessment, this coverage issubject to all the exclusions applicable toSections I and II of this policy and the SectionI and II Conditions, except as otherwise noted.

This coverage is excess over any insurancecollectible under any policy or policiescovering the association of building owners.

6. Coverage JExtended Coverage On Jewelry, Watches andFursCoverage C Personal Property Protection isextended to pay for sudden and accidentaldirect physical loss to the following property,subject to the provisions in this coverage:a) jewelry, watches, gems, precious and

semi-precious stones, gold, platinum; andb) furs, including any item containing fur

which represents its principal value.

The total amount of coverage and per itemlimit is shown on the Policy Declarations. Thisamount is not in addition to the amount ofinsurance applying to Coverage C PersonalProperty Protection. However, in no event willcoverage be less than would have applied inthe absence of Coverage J.

We do not cover loss caused by or consistingof:a) intentional or criminal acts of or at the

direction of any insured person, if theloss that occurs:1) may be reasonably expected to result

from such acts; or2) is the intended result of such acts.

b) wear and tear, gradual deterioration,inherent vice, insects or vermin;

c) nuclear action, meaning nuclear reaction,discharge, radiation or radioactivecontamination or any consequence of anyof these. Loss caused by nuclear action isnot considered a loss by fire, explosion orsmoke. We do cover sudden andaccidental direct physical loss by fireresulting from nuclear action.

d) war or warlike acts, including, but notlimited to, insurrection, rebellion orrevolution.

e) failure by any insured person to take allreasonable steps to preserve propertyduring and after a loss or when theproperty is endangered by a cause of losswe cover.

Any deductible shown on the PolicyDeclarations applicable to Coverage CPersonal Property Protection, also applies to aloss under this coverage.

7. Coverage KIncidental Office, Private School Or Studioa) The limits applying to property used or

intended for use in a business underCoverage C Personal PropertyProtection do not apply to equipment,supplies and furnishings used in adescribed office, private school or studioat your residence premises. This doesnot include electronic data processingequipment or the recording or storagemedia used with that equipment.

The Coverage K limits are shown on the PolicyDeclarations. The first limit applies to propertyon the residence premises. The second limitapplies to property while away from theresidence premises. These limits are not inaddition to Coverage C Personal PropertyProtection, Limitations On Certain PersonalProperty on property used or intended for usein a business. The increased coverage doesnot include property held for sample, sale ordelivery after sale.

b) Coverage X Family Liability Protectionand Coverage Y Guest MedicalProtection are extended to cover adescribed office, private school or studiooccupied by an insured person. Theoccupancy of the described property shallnot be considered a business.

We do not cover bodily injury to:a) any employee other than a residence

employee; or

b) any person arising out of corporalpunishment administered by or at thedirection of an insured person.

8. Coverage MIncreased Coverage On MoneyThe limitation on money, bullion, bank notes,coins and other numismatic property, scrip,stored value cards and smart cards underCoverage C Personal Property Protection isincreased to the amount shown on the PolicyDeclarations.

9. Coverage PBusiness PursuitsCoverage X Family Liability Protection andCoverage Y Guest Medical Protection areextended to cover specified business pursuitsof an insured person.

We do not cover:a) bodily injury or property damage arising

out of the business pursuits of an insuredperson when the business is owned orfinancially controlled by the insuredperson. This also means a partnership orjoint venture of which an insured personis a partner or member;

b) bodily injury or property damage arisingout of the rendering of or failure to rendera professional service of any nature, otherthan teaching;

c) bodily injury to a fellow employee of aninsured person arising out of and in thecourse of employment;

d) bodily injury or property damage whenan insured person is a member of ateaching staff or faculty of any school orcollege and the bodily injury or propertydamage arises out of the maintenance oruse of saddle animals, vehicles used with

saddle animals, motorized land vehicles,hovercrafts, aircraft or watercraft whenowned, hired or operated by an insuredperson or used for the purpose ofinstruction; or

e) bodily injury to any person arising out ofcorporal punishment administered by orat the direction of an insured personwhen an insured person is a member ofthe teaching staff or faculty of any schoolof instruction.

10. Coverage SIncreased Coverage On SecuritiesThe $1,000 limitation on accounts, bills, deeds,evidences of debt, letters of credit, notes otherthan bank notes, checks, cashier’s checks,traveler’s checks, passports, securities,tickets, and stamps, including philatelicproperty, covered under Coverage CPersonal Property Protection, is increased tothe amount shown on the Policy Declarations.

11. Coverage SDSatellite Dish AntennasCoverage C Personal Property Protection isextended to pay for sudden and accidentaldirect physical loss to satellite dish antennasand their systems on your residencepremises, subject to the provisions ofCoverage C Personal Property Protection.

The amount of coverage is shown on the PolicyDeclarations.

12. Coverage STIncreased Coverage On Theft Of SilverwareThe limitation on theft of goldware, silverware,pewterware and platinumware underCoverage C Personal Property Protection isincreased to the amount shown on the PolicyDeclarations.
