Rights Of Nursing Home ResidentsNursing home residents have many rights, including:

• Freedom from discrimination based on race, color, national origindisability, age or religion.

• The right to be treated with dignity and respect.

• Freedom from abuse and neglect. Residents have the right to befree from verbal, sexual, physical, and mental abuse.

• Freedom from restraints. Physical or chemical restraints can’t beused, unless needed to treat medical symptoms.

• The right to be informed about their medical condition, medicationsand to see their own doctor.

Recent Awards & Settlements■ $1.1 million for a woman who was in a nursing home and developeda bedsore that became so infected part of her leg had to be amputated.She made a claim against the nursing home, saying it had too few staffand that the staff on hand didn't take simple steps that would haveprevented the bedsore.

■ $150,000 for an elderly gentleman who suffered from Alzheimer'sdisease and who broke his hip after falling in a nursing home. On theman’s behalf, his son made a claim against the nursing home, sayingstaff failed to properly monitor him and take steps to prevent accidentslike these from happening. The parties settled out of court.

■ $950,000 for an elderly gentleman who was placed in a nursing homeby his children. Just over a year after moving to the facility, the man diedafter developing over 20 bedsores due to the staff not taking proper careof him. The gentleman came to the nursing home weighing nearly 250pounds, and weighed just 148 pounds when he died. The man's familymade a claim against the nursing home. The evidence showed that stafffalsified records to make it look like they did not miss seeing thebedsores when in fact they really had missed seeing them due tonegligence.

■ $250,000, $150,000; and $100,000 for significant pressure sores,developed in hospital or nursing homes, on the low backs of elderlywomen in three separate cases, who suffered from multiple significantmedical conditions.

One area of preventive law thatcan help you and your family a lot isestate planning. Having key estateplanning documents helps makesure your property will go whereyou want when you die and thatyou select the people who willmake decisions for you if you can'tmake them yourself. Key estateplanning documents to have are:

• Wills. Wills let you decide whowill receive your property when youdie. But they also provide othervaluable benefits, including lettingyou select who should be theguardian of your children in caseyou and your spouse die while theyare minors, and letting you selectthe person who will administer yourestate when you die.

• Living Wills. Living wills are very

important to have, as they let youspecify the types of life prolongingtreatment you want — or do notwant — if you are terminally ill andcannot communicate. Living willshelp avoid agonizing disputesbetween family members aboutwhat your wishes are regarding theuse of life sustaining treatment.

• Powers of Attorney. These letyou appoint someone to handleyour financial affairs, authorizingthem to sign documents as if theywere you. You can have a power ofattorney that expires if you becomeincompetent, or you can have onethat stays valid until you die, aslong as you do not revoke it.

A "health care power of attorney"lets you appoint someone to makeyour medical decisions if you cannotmake them yourself. The decisions

can cover various medical matters. Even if you have all necessaryestate planning documents, it isimportant to make sure they are up-to-date. If your will and otherdocuments were made a long timeago, modifications may be neededdue to changes in your financial orfamily situation. We can help makesure you have all the proper docu-ments for planning your estate andthat they are all in accordance withyour current wishes.
