SECOND OPEN LETTER TO RESIDENTS OF ALJUNIED-HOUGANG-PUNGGOL EAST TOWN
Dear Residents,
In my First Open Letter to you in June 2015, I explained three main points concerning various allegations made against Aljunied-Hougang-Punggol East Town Council (AHPETC). These were:
1. AHPETC does not and cannot reserve contracts for “friends” due to the public tender process;
2. The alleged “overpayment” by AHPETC to its former Managing Agent (MA), when compared to rates paid by PAP TCs in 2014, was an exaggeration, looking at the rates paid by PAP TCs in 2011, 2012 and 2013 according to data provided by the Ministry of National Development (MND);
3. The MA rates that AHPETC agreed to pay its MA in 2012 were arrived at taking into account the MA rate paid by the PAP management of Aljunied TC to its former MA.

In this Second Open Letter, I would like to clarify and reassure all residents that AHPETC places your interests at the heart of its work and continues to make improvements to its financial management.
This letter will cover the issue of Conflicts of Interest and AHPETC’s financial position.
1. Conflict of Interest and Related Party Transactions
There have been allegations concerning related party transactions between AHPETC and its former MA, FM Solutions & Services Pte Ltd (FMSS). First, there is no longer any issue, as AHPETC is now directly managed and does not outsource its work to an MA. The previous MA contract expired on 14 July 2015, and there were no bidders to take over the MA services after 14 July 2015.
Since 15 July 2015, AHPETC has been self-managed. This means that AHPETC is now directly hiring staff to handle estate, finance, administration and other tasks, instead of outsourcing the work to an MA. Under direct management, AHPETC's contractors continue to deliver services under the existing contracts, now supervised by TC's directly hired staff.
Second, there was never any conflict of interest whatsoever between the Workers’ Party (WP) or any of its Members of Parliament (MPs) and FMSS. Neither WP nor any of its MPs or members has any interest in the business of FMSS. None of the directors and shareholders of FMSS is a member of WP.
Third, there have been accusations that when the MA was working at AHPETC, the husband and wife team who owned FMSS could freely sign payments to themselves. This is not true. When WP took over in 2011, one of the first decisions made by the new Aljunied-Hougang Town Council was to require any cheques to the MA, no matter how small the amount, to require the counter-signature of AHPETC Chairman and Vice-Chairmen who have no interest in the MA’s business.
2. Financial Position of AHPETC
Some people have accused AHPETC of bankruptcy and running huge deficits that are not sustainable, and also warned residents of other towns not to vote for WP so as not to subsidise AHPETC. These allegations are misguided.
AHPETC filed its audited accounts for FY 14/15, on time, by 31 August 2015. Though these accounts show AHPETC in annual deficit, this is because AHPETC has still NOT received its annual S&CC operating grant of $7.2 million from the government, which would normally have been paid to all Town Councils in April 2014. Taking into account the $7.2 million in grant which AHPETC expects to receive, AHPETC’s annual income and expenditure statement would show an annual surplus of $1.7 million.

The past operating deficit was largely the outcome of higher tender price for various service contracts and start-up costs.
The current positive position came about through a combination of steps taken by AHPETC. These included lowering its utilities costs by using contestable energy, reducing its general and administrative expenditure, and increasing its revenue. Throughout the difficult initial years, AHPETC management believed that it could improve the TC’s financial position, and the latest audit shows that it has. We expect to further consolidate and improve AHPETC’s financial position going forward.
We have done our best to serve residents, and I would like to express appreciation to our staff for their contribution to the progress we have made and to our residents for their support and understanding.

我在2015年6月发出了第一封公开信,信中对有关阿裕尼—后港—榜鹅东市镇会(AHPETC)的指控作出了三点澄清,内容概要如下:
1.通过公开招标,AHPETC不会、也不能将合约保留给其“友人”;
2.对AHPETC在2014年“超额支付”给其管理代理(MA)的费用的指控是夸大其辞的。只要查阅国家发展部(MND)所提供的,显示人民行动党(PAP)所管理的市镇理事会在2011年、2012年以及2013年所支付的管理代理费的数据就可清楚知道事实;
3.AHPETC是在参考了PAP所管理的阿裕尼市镇会在当时所支付的管理代理费后,才拟定其2012年支付给管理公司的代理费。

这是第二封公开信,我谨此重申,AHPETC始终把居民的利益放在首位,并将会不断改进其财务管理系统。
这封公开信进一步阐明有关利益冲突和AHPETC的财务状况。
(一) 利益冲突与关联交易有指控声称AHPETC与其前管理代理公司FM Solutions&ServicesPteLtd(FMSS)存在关联交易。
第一,这已不再是个讨论的课题。 因为AHPETC现在已经过渡到直接管理的模式,不再将管理工作外包给任何公司。先前的管理代理合同于2015年7月14日到期。再次公开投标时,包括FMSS在内,没有任何公司投标管理代理的合约。
因此,自2015年7月15日起,AHPETC直接管理市镇会,AHPETC直接聘请员工管理产业、财务和行政事宜,没有外包给管理代理公司。
在直接管理的模式下,AHPETC的承包商继续按照现有合同中所列明的条款提供服务,直接受市镇会员工的监督。
第二,工人党,以及其所有的议员与FMSS之间从来就不存在任何利益冲突,也没有任何的业务关系,FMSS也没有任何董事或股东是工人党的党员。
第三,有人指控说,在管理AHPETC期间,FMSS的内部夫妻团队可以随意在支票上签名。这不是事实。工人党于2011年接管市镇会时,所做的第一个决定是,不论付款的数目大小,所有开给管理代理公司的支票一律必须由AHPETC主席和副主席的同时签署,他们与管理代理公司不存在任何的利益关系。

(二) AHPETC的财务状况
有些人指责说AHPETC出现了巨大的营运赤字,无法持续运作下去,甚至面临破产,并警告其他市镇的居民不要投票给工人党,否则会间接将其所管理的市镇的资金转移到AHPETC。这个说法很有误导性。
AHPETC在2015年8月31日的截止期限准时提交2014/15财政年度的审计账目。虽然账目显示AHPETC出现年度亏损,但这是因为AHPETC还尚未收到国家发展部720万元的年度杂费(S&CC)津贴,这笔津贴通常在2014年4月由政府发放给所有的市镇会。如果将这笔720万元的津贴计算在内,AHPETC 2014/15 财政年度的收支账目有170万元的盈余。
过去的营运赤字,主要是因为投标提供各种服务的承包商投标价格提高的结果。AHPETC之所以能转亏为盈,是综合因素所促成。这包括市镇会通过参与能源市场的竞争
性电力价格,成功地降低了市镇会的电费,也同时减少了一般开支和行政费用。此外,市镇会的收入也增加。
在过去几年的艰难过渡时期,AHPETC管理层始终相信我们能改善市镇会的财务状况。最新的审计账目证明了我们的信心是正确的。我们期待在未来继续加强和改善AHPETC的财务状况。
我们竭尽所能,为居民服务。我谨此感谢市镇会员工所做出的贡献,使我们能够有今日的进展。我们也感激居民的支持与谅解。

Para Penduduk yang dihormati,
Dalam Surat Terbuka saya yang pertama kepada anda pada Jun 2015, saya telah menjelaskan tiga perkara utama mengenai pelbagai tuduhan yang dilemparkan terhadap Majlis Bandaran Aljunied-Hougang-Punggol East (AHPETC), seperti yang berikut:
1. AHPETC tidak dan tidak boleh mengkhususkan kontrak-kontrak untuk “kawan-kawan” disebabkan proses tender awam;
2. Dakwaan mengenai “pembayaran berlebihan” oleh AHPETC kepada bekas Ejen Pengurusan (MA), apabila dibandingkan dengan kadar yang dibayar oleh Majlis Bandaran PAP pada 2014, adalah suatu dakwaan yang keterlaluan, jika perbandingan yang sama dibuat kepada kadar yang dibayar oleh Majlis Bandaran PAP pada 2011, 2012 dan 2013 mengikut data yang disediakan oleh Kementerian Pembangunan Negara (MND);
3. Kadar Ejen Pengurusan (MA) yang telah dipersetujui oleh AHPETC sebagai bayaran kepada MA pada 2012 adalah berdasarkan kadar Ejen Pengurusan (MA) yang dibayar oleh pengurusan PAP bagi Majlis Bandaran Aljunied
kepada Ejen Pengurusan (MA) mereka yang sebelum ini.

Dalam Surat Terbuka yang kedua ini, saya ingin menjelaskan serta memberi jaminan kepada kesemua penduduk-penduduk bahawa AHPETC memberi keutamaan terhadap kepentingan anda semua semasa kami menjalankan segala tugasan kami dan akan terus meningkatkan usaha dalam aspek pengurusan kewangan. Surat kali ini akan membincangkan isu konflik kepentingan dan kedudukan kewangan AHPETC.
1. Konflik Kepentingan Dan Urusan Pihak Berkaitan
Terdapat dakwaan mengenai urusan ‘pihak berkaitan’ di antara AHPETC dengan bekas Ejen Pengurusan (MA), FM Solutions & Services Pte Ltd (FMSS).
Pertama, perkara ini bukan lagi menjadi satu isu, kerana AHPETC kini diuruskan secara langsung (lihat bahagian seterusnya untuk keterangan lanjut) dan

kerja-kerja pengurusan tidak lagi diserahkan kepada Ejen Pengurusan (MA). Kontrak Ejen Pengurusan (MA) yang sebelum in telah berakhir pada 14 Julai 2015 dan tidak ada syarikat menyertai pembidaan untuk mengambil alih perkhidmatan Ejen Pengurusan (MA) selepas 14 Julai 2015.
Sejak 15 Julai 2015, AHPETC menjalankan pengurusannya sendiri. Ini bermakna AHPETC kini menggajikan warga kerjanya sendiri untuk menguruskan estet, kewangan, pentadbiran dan tugas-tugas yang lain. Di bawah pengurusan langsung, kontraktor-kontraktor AHPETC masih menyediakan perkhidmatan di bawah kontrak yang sedia ada, yang kini diselia oleh warga kerja yang digajikan oleh Majlis Bandaran secara langsung.
Kedua, konflik kepentingan tidak pernah berlaku dalam apa bentuk sekalipun di antara Parti Pekerja (WP) atau mana-mana Anggota Parlimennya (AP) dengan FMSS. Sama ada Parti Pekerja, AP-AP nya ataupun anggotanya tidak ada sebarang kepentingan dalam urus niaga FMSS. Tidak ada seorang pun pengarah atau pemegang saham FMSS adalah anggota WP.
Ketiga, terdapat tuduhan bahawa dalam tempoh kontrak Ejen Pengurusan (MA) dengan AHPETC yang lalu, pasukan suami isteri yang menjadi pemilik FMSS bebas untuk menandatangani apa-apa pembayaran kepada syarikat mereka. Ini adalah tidak benar. Apabila WP mengambil alih pada 2011, salah satu keputusan pertama yang diambil oleh Majlis Bandaran Aljunied-Hougang ialah untuk mensyaratkan apa-apa bayaran kepada Ejen Pengurusan (MA), sama ada jumlah yang kecil atau besar, memerlukan tandatangan Pengerusi dan Timbalan Pengerusi AHPETC yang tidak ada kepentingan dalam perniagaan Ejen Pengurusan (MA).
2. Kedudukan kewangan AHPETC
Ada pihak yang menuduh AHPETC telah muflis dan menanggung defisit yang besar, yang tidak mampu ditanggungnya dan juga memberi amaran kepada para penduduk estet lain untuk tidak mengundi WP supaya penduduk tidak membiayai AHPETC. Tuduhan-tuduhan ini tidak berasas.
AHPETC telah memfailkan penyata yang telah diaudit bagi Tahun kewangan 14/15, tepat pada masanya, sebelum 31 Ogos 2015. Walaupun penyata tersebut menunjukkan AHPETC berada dalam defisit, namun ini adalah kerana AHPETC masih BELUM menerima geran operasi S&CC tahunan sebanyak $7.2 juta daripada pemerintah, yang biasanya dibayar kepada semua majlis bandaran pada April 2014. Dengan mengambil kira geran $7.2 juta yang AHPETC sepatutnya terima, maka penyata pendapatan dan perbelanjaan tahunan AHPETC akan menunjukkan lebihan tahunan sebanyak $1.7 juta.
Sebahagian besar defisit yang lalu adalah disebabkan oleh harga tender yang lebih tinggi untuk pelbagai kontrak-kontrak perkhidmatan dan kos permulaan.
Jumlah kedudukan semasa yang positif diraih melalui gabungan beberapa usaha yang diambil oleh AHPETC. Ini termasuk mengurangkan kos utiliti dengan menggunakan tenaga pasaran (contestable energy), mengurangkan perbelanjaan am dan pentadbiran, dan peningkatan dalam pendapatan.
Dalam menempuhi tahun-tahun awal yang sukar, pengurusan AHPETC percaya bahawa ia boleh meningkatkan kedudukan kewangan majlis bandaran, dan audit terkini menunjukkan bahawa perkara ini telah tercapai.
