DAILY EXCELSIOR, JAMMU TUESDAY, DECEMBER 13, 2016 (PAGE 7) Ganga launches development works in Bari Brahmana Excelsior Correspondent SAMBA, Dec 12: To boost infrastructural facilities in Bari Brahmana, Minister for Industries and Commerce Chander Parkash Ganga today inaugurated upgraded lanes and drains facilities at Ward No. 10 in Bari Brahmana being devel- oped at a cost of Rs 3.80 lakh. Ganga also kick-started the improvement work of lane and drain at Ward No 11, Kabir Nagar to be completed at an esti- mated cost of Rs 7.58 lakh and construction of a community toi- let complex at Bari Brahmana to be completed at an estimated cost of Rs 10.50 lakh. The funds for community toilet complex would be met by Municipal Committee Bari Brahmana and works will be executed and fur- ther maintained by the Sulabh International. Speaking on the occasion, the Minister said that Government is committed to provide better infrastructural facilities to the people, especial- ly in the remote and far flung areas with special focus on road connectivity, power and water supply, medicare and education. A number of innovative initia- tives have been taken in this direction for which the results will be visible on ground soon, he asserted. Maintaining that the Government is focusing on mak- ing the State open defecation- free, the Minister said that Swachh Bharat Mission (SBM) will be implemented in letter and spirit to achieve its objec- tive. He directed the officers to step up the awareness campaign under the SBM and persuade the people to develop the toilet units in their homes. He sought the support of the locals for maintaining environ- ment neat and clean by manag- ing the garbage in a systematic manner in their localities. Islah-ul-Muslimeen, Jammu Auqaf organize Seerat Conference Speaker, Andrabi call for promoting bonds of mutual brotherhood Excelsior Correspondent JAMMU, Dec 12: In connec- tion with the celebrations of Eid- Milad-ul-Nabi (SAW), Anjuman Islah-ul-Muslimeen Jammu in collaboration with Hajj and Auqaf Department organized a day long Seerat Conference here today. Speaker Legislative Assembly, Kavinder Gupta and Minister of State for Hajj and Auqaf, Syed Farooq Ahmad Andrabi were amongst the prominent participants in the conference. Several prominent Islamic Scholars from different parts of the country participated and extensively deliberated on the teachings of Islam and Prophet Muhammad (SAW). The speak- ers highlighted the teachings and message of Prophet Muhammad (SAW) laying stress on promot- ing human values and love, mutual brotherhood, tolerance, peace and helping the needy and destitute. They emphasized on the universal acceptance and rel- evance of the teachings and message of Prophet Muhammad (SAW). Kavinder Gupta called for promoting bonds of mutual brotherhood and true values of humanity. He said such occa- sions provide an opportunity to the people to come closer and work for the development of the mankind and eradicating social evils from the society. Speaking on the occasion, Syed Farooq Andrabi impressed upon the people to be united and follow the teachings of Prophet Muhammad (SAW). Become job providers, not job seekers: Bali to youth Excelsior Correspondent JAMMU, Dec 12: Minister for Health & Medical Education, Bali Bhagat today inaugurated a blending and processing unit of fitness supplement products, pop- ularly known as "Fitness Universe" (FU) under the name and style "Kerni Fitness Private Limited", first of its kind in the State, at village Seri Panditan in Bhalwal block near here. The Chief Executive Officer (CEO) and owner of the unit, Piyush Kerni is the founder of the FU, and also a local entrepreneur. He is a Mechanical Engineer and a fitness model by profession. According to the owner, the initia- tive is aimed at providing com- pletely Indian, safe and most hygienic products to the con- sumers on competitive rates and to generate employment for the local educated youth. Speaking on the occasion, the Minister appreciated the initiative of the budding entrepreneur and said it would help the consumers of the State to have these products on affordable prices. He said the venture will also provide employ- ment to the local youth and help in boosting State's economy. He said it is the endeavor of the State Government to encour- age the local entrepreneurs to set up their own units and help in overcoming the unemployment problem, adding that Government provides several incentives in the form of subsidy and technical knowhow to the entrepreneurs for establishing income generating units. He called upon the unem- ployed youth to come forward and take up the self-employment ven- tures instead of seeking Government jobs which are limit- ed. The youth should be the job providers instead of job seekers, said the Minister. Pawan takes stock of people’s grievances Excelsior Correspondent UDHAMPUR, Dec 12: MLA Udhampur Assembly Constituency, Pawan Gupta today took stock of people's grievances in a public meeting held at Tikri. During the meeting, locals disclosed that the villages Khilla, Khanui, Tarmara and Pagyal are not blessed with road connectivity and demanded four kilometer road from Tikri to Khilla-Khanui. The residents of Tikri demanded installation of high voltage transformer in their area and blacktopping of badly damaged Tikri-Katra road. The villagers also highlight- ed the problem of monkey men- ace from last several years, adding, several incidents of monkey biting in whole Tikri belt has been taken place. Pawan Gupta gave a patient hearing to the people and said that his sole mission is historic development of Udhampur Assembly Constituency and for the overall development of Tikri belt he is succeeded to get sanc- tioned 21 kilometer link road form Bikhan Gala Tikri to Jib Thathi area at a cost of Rs 20 crore. Migrants appeal leadership to come on single platform Excelsior Correspondent JAMMU, Dec 12: A meeting of Kashmiri migrants was held at Jagti today under the chair- manship of Pinto Ji in which various problems confronted the community were discussed. The meeting said that during last 27 years of exile the Pandits faced many hardships and both State as well as Central Governments have failed to redress them. The meeting said that time and again the problems were brought in the notice of con- cerned authorities but nothing has been done till date and no concrete policy was adopted to settle them. The meeting said that due to the wrong policies of Government an ancient civiliza- tion of the country is today fac- ing identity crisis and situation at this stage is also in no way better than the days of initial migration. The community feels alien- ated due to step motherly treat- ment of the Government and the only reason for this is that the community is not a vote bank. The meeting said that being a peace loving community the government has taken us for granted and this will force us to come to streets now. The meeting said that the community is facing atrocities through the hands of authorities and there is no end to the human rights violations of the KPs. The meeting appealed the community to unite and urged the community leadership to sink differences and come on a single platform and adopt a Common Minimum Programme (CMP) on demands. Absconder nabbed Excelsior Correspondent JAMMU, Dec 12: Bishnah police nabbed an absconder, who was evading his arrest since long. As per police sources, based on reliable information, a team from Bishnah police station con- ducted raid and arrested an absconder, who was at large since long. The accused has been identi- fied as Parveen Kumar alias Pinna, son of Devraj, a resident of Chorli Bishnah. He was wanted in cases regis- tered under FIR Number 72/2009 under Section 342, 323, 324 and 325 RPC and FIR Number 120/13 under Section 341, 323, 324, 34 RPC and 4/25 Arms Act registered with police station Bishnah, FIR Number 149/13 under Section 4/25 Arms Act reg- istered with police station Nowabad and FIR Number 85/15 under Section 307 RPC and 3/25 Arms Act registered with police station Vijaypur. Further investigation into the cases registered against the accused is going on. Police team led by SHO Bishnah Inspector Paramjit Singh made the arrest under the supervi- sion of SDPO RS Pura Surinder Choudhary and SP Headquarters Jammu RC Kotwal. Cops acquitted in corruption case after 22 yrs long investigation, trial Excelsior Correspondent JAMMU, Dec 12: High Court has acquitted two police cops, who were convicted and sentenced by the trial court, after 22 years long investiga- tion and trial in a corruption case. These cops namely Abdul Rashid and Ramesh Kumar during their posting at Police Post Thathri in March 1994 had taken bribe to release one per- son from the police custody and they were booked by the Vigilance Organization on the receipt of a complaint. The Special Judge Anticorruption had convicted the accused in 2003 and award- ed sentence. However, the con- victs challenged the judgment in the High Court by filing criminal appeal. After hearing Advocate AP Singh appearing for the appel- lant whereas Deputy AG Farz Iqbal appearing for the State, Justice Tashi Rabstan set-aside the conviction and sentence awarded by the trial court and acquitted both the cops of the charges after 22 years long investigation and trial. "Criminal trial is not a fairy tale in which one is free to give flight to one's imagination and fantasy. Crime is an event in real life and is product of inter- play between different human emotions. In arriving at a con- clusion about the guilt of accused, charged with commis- sion of a crime, the court has to judge the evidence by the yard- stick of probabilities, its intrin- sic worth and the animus of witnesses", Justice Rabstan said. "Every case, in the final analysis, would have to depend upon its own facts. The court must bear in mind that human nature is too willing, when faced with brutal crimes, to spin stories out of strong suspi- cions. Though an offence may be gruesome and revolt the human conscience, an accused can be convicted only on legal evidence and not on surmises and conjectures", Justice Rabstan further observed, adding "the law does not permit the court to punish accused on the basis of a moral conviction or suspicion alone". "The burden of proof in a criminal trial never shifts and it is always the burden of prose- cution to prove its case beyond reasonable doubt on the basis of acceptable evidence. In fact, it is a settled principle of crim- inal jurisprudence that the more serious the offence, the stricter the degree of proof required, since a higher degree of assur- ance is required to convict the accused", High Court said. With these observations, court acquitted accused of the charges leveled against them. Association for Welfare of Senior Citizens holds AGM Excelsior Correspondent JAMMU, Dec 12: The annu- al general meeting (AGM) of the Association for Welfare of Senior Citizens (AWSC) was held here on Sunday. During the meeting, the house unanimously decided to continue the existing team to continue for another term of two years. The team consists of AK Arora as president, RC Gupta as general secretary, KK Mahajan and BM Kohli as vice presi- dents, PP Mengi as treasurer and Chander Parkash as well as Dr SL Abrol as joint secretaries. In his welcome address, AK Arora deliberated on the progress made by the associa- tion as also the deliberations the association delegation had with Governor NN Vohra on December 7. The president also elaborated various constraints the association is facing in its day to day working. He also informed the house about vari- ous steps taken to improve the financial condition of the associ- ation. The annual report of the association was read by the sec- retary and the annual accounts were presented by the treasurer. The members were addressed by Ram Anand and Ankit Sharma on different ways of proper sav- ings by the senior citizens. Patron Vikram Gour was also present in the meeting. 4 injured in separate road accidents Excelsior Correspondent SAMBA, Dec 12: Four people were injured in three separate road accidents in Samba district today. According to police one motorcyclist namely Janu, 19, son of Ashwani Kumar of Dagore Samba was injured when his motorcycle bearing registration number JK21C-2067 was hit by tipper JK02BJ-5912 on Jammu- Pathankot National Highway near Barian , Supwal today. The injured was rushed to Government Emergency Hospital Vijaypur by the locals where his condition is stated to be serious. Supwal Police has registered the case in this regard under rele- vant sections of law. A pedestrian namely Sakshi Sharma, 29, wife of Mohit Sharma residents of Samthyal Rattan Pur, Ghagwal was injured when she was hit by a motorcycle JK08C-5520 on Jammu- Pathankot National Highway near Maheshwar Samba today around 10:45 am in which motorcyclist Vishal Singh 32 son of Harbans Singh residents of Sangwali Jatwal was also injured, police said. Both were rushed to Government District Hospital Samba from where the doctors referred them to GMC Jammu. Their condition is stated to be critical. The police has registered a case under relevant sections of law. Another pedestrian was injured when he was hit by an unknown vehicle on border road near Raipur Morh Samba, police said. He was rushed to Government District Hospital Samba from where the doctors referred him to GMC Jammu. He was identified as Dharam Paul 65, son of Radhan resident of Balori Samba. The Samba Police has also registered a case under relevant sections of the law. Medical camp for destitute children Excelsior Correspondent JAMMU, Dec 12: Former minister and additional general secretary of National Conference Dr Mustafa Kamaal inaugurated a medical camp concerning dental care at Balgran, a charitable home for destitute children under the Balgran Charitable Trust at Channi Rama Jammu, set up by Sikh Youth Seva Trust of S. Tejinder Pal Singh (Aman) today. This Trust for the destitute children takes care of higher education of children as well as their rehabilitation and medical treatment and even arranges marriage of inmates if so required. The home has destitute children and even flood and earthquake victims. Each child was given dental care items, provided by this Youth Seva Trust with a pam- phlet giving silent features of proper dental care. Dr Kamaal complimented the services of Sikh Youth Seva Trust for the welfare of this under privileged class of chil- dren. Father arrested for illegally confining daughter Excelsior Correspondent JAMMU, Dec 12: Police arrested a father for illegally confining her daughter in Kadyal Gujjar Basti area, falling under the jurisdiction of RS Pura police station. As per police sources, an information was received by RS Pura police that a lady hailing from Kadyal Gujjar Basti has been illegally confined by her father Kaku Gujjar, son of Ghulam Hussain and nephew. Acting over the informa- tion, a case under FIR Number 186/16 under Section 343, 323, 506, 504 and 34 RPC was regis- tered at RS Pura police station and investigation started. A team from police station RS Pura rushed to the house and rescued the lady, who was tied by her father and nephew with iron chains. Moreover, a case under FIR Number 76/16 under Section 366 and 109 RPC also stands registered with police sta- tion RS Pura on the complaint of Kaku Gujjar regarding the kid- napping of same lady. Further investigation is going on in both the cases. In a statement issued here, today Sunil Pandita representa- tive of relief holders has made an appeal to Revenue, Relief and Rehabilitation Minister Basharat Bukhari to look into the matter. He said ever since the coalition Government of PDP-BJP came to power the relief and ration was delayed for months together which has never happened in last over two decades of migration. He demanded immediate release of ration and relief to camp and non camp inmates. ‘Hike in rates of CAPD ration unjustified’ Coalition Govt unresponsive to public issues: Harshdev Excelsior Correspondent JAMMU, Dec 12: Disseminating the policies and programmes of Panthers Party, NPP chairman and former min- ister Harshdev Singh today claimed that NPP has proved to be the lone crusader fighting for the cause of Jammu region and socio-economic advancement of Dogras. Addressing public meetings at Sail Kori Bail Sarail and Chua in Majalta tehsil today, Singh said that NPP had been fighting from streets to Supreme Court for ensuring justice to the deprived Dogra land. Appealing the people to strengthen their own regional party, Singh vowed not to relent and to take the fight for Jammu to its logical conclusion. Singh lambasted the Coalition Govt particularly the BJP for failing to translate any of its election time promises into reality. He said that BJP had not only ignored its elec- tion manifesto but had inflicted the biggest dent upon Dogra pride by its successive surren- ders on Jammu centric issues. Expressing his strong disap- proval of the recent steep increase in the prices of food grains, NPP leader called upon the Govt to roll back the same in view of severe hardships caused to the common man. He said that huge increase in the prices of ‘atta’ and rice had received all-round condemna- tion from the general public who had been awaiting the arrival of “Achhe Din” with baited breath. He said that the sharp hike of Rs 5 per kg in the price of atta from Rs 8 per kg to Rs 13 per kg with further increase in the price of rice from Rs 10 to Rs 15 was most unreasonable and could not be justified by any stretch of imag- ination. He said that spurt was unprecedented as it amounted to 63% increase in the price of atta and 50% increase in the price of rice which posed the most menacing threat to the pockets of the common man.

The Chief Executive Officer(CEO) and owner of the unit,Piyush Kerni is the founder of theFU, and also a local entrepreneur.He is a Mechanical Engineer anda fitness model by profession.According to the owner, the initia-tive is aimed at providing com-pletely Indian, safe and mosthygienic products to the con-sumers on competitive rates andto generate employment for thelocal educated youth.

JAMMU, Dec 12: HighCourt has acquitted two policecops, who were convicted andsentenced by the trial court,after 22 years long investiga-tion and trial in a corruptioncase.

These cops namely AbdulRashid and Ramesh Kumarduring their posting at PolicePost Thathri in March 1994 hadtaken bribe to release one per-son from the police custodyand they were booked by theVigilance Organization on thereceipt of a complaint.

The Special JudgeAnticorruption had convictedthe accused in 2003 and award-ed sentence. However, the con-victs challenged the judgmentin the High Court by filingcriminal appeal.

After hearing Advocate APSingh appearing for the appel-lant whereas Deputy AG FarzIqbal appearing for the State,Justice Tashi Rabstan set-aside

the conviction and sentenceawarded by the trial court andacquitted both the cops of thecharges after 22 years longinvestigation and trial.

"Criminal trial is not a fairytale in which one is free to giveflight to one's imagination andfantasy. Crime is an event inreal life and is product of inter-play between different humanemotions. In arriving at a con-clusion about the guilt ofaccused, charged with commis-sion of a crime, the court has tojudge the evidence by the yard-stick of probabilities, its intrin-sic worth and the animus ofwitnesses", Justice Rabstansaid.

"Every case, in the finalanalysis, would have to dependupon its own facts. The courtmust bear in mind that humannature is too willing, whenfaced with brutal crimes, tospin stories out of strong suspi-cions. Though an offence maybe gruesome and revolt thehuman conscience, an accusedcan be convicted only on legalevidence and not on surmisesand conjectures", JusticeRabstan further observed,adding "the law does not permitthe court to punish accused onthe basis of a moral convictionor suspicion alone".

"The burden of proof in acriminal trial never shifts and itis always the burden of prose-cution to prove its case beyondreasonable doubt on the basisof acceptable evidence. In fact,it is a settled principle of crim-inal jurisprudence that the moreserious the offence, the stricterthe degree of proof required,since a higher degree of assur-ance is required to convict theaccused", High Court said.

With these observations,court acquitted accused of thecharges leveled against them.

Bothwere rushed to GovernmentDistrict Hospital Samba fromwhere the doctors referred them toGMC Jammu.

JAMMU, Dec 12: Policearrested a father for illegallyconfining her daughter inKadyal Gujjar Basti area, fallingunder the jurisdiction of RS Purapolice station.

As per police sources, aninformation was received by RSPura police that a lady hailingfrom Kadyal Gujjar Basti hasbeen illegally confined by herfather Kaku Gujjar, son ofGhulam Hussain and nephew.

Acting over the informa-tion, a case under FIR Number186/16 under Section 343, 323,506, 504 and 34 RPC was regis-tered at RS Pura police stationand investigation started.

A team from police stationRS Pura rushed to the house andrescued the lady, who was tiedby her father and nephew withiron chains.
