Background Applicants who lodged Development Applications between January 2017 and February 2018 were invited to participate in a DA customer satisfaction survey. The results of this DA customer satisfaction survey have been analysed and possible business improvements identified. The presentation will outline the findings from the DA customer satisfaction survey.

Officer Recommendation That the Planning Committee reviews the progress of the development of Bayside’s Local Environmental Plan and the key outcomes of the LEP Review.
Background As reported at previous Council meetings (13 June 2018, 11 July 2018, 12 September 2018) in response to changes to the Environmental Planning and Assessment Act 1979 (the Act) and the introduction of the Eastern City District Plan, Bayside Council is required to prepare a new Local Environmental Plan and Development Control Plan. The State Government have identified a number of deliverables that must be completed in developing the Local Environmental Plan:

LEP Accelerated Funding
To help in the preparation of Local Environmental Plans in April 2018, the State Government announced $2.5 million funding per Council to 13 Councils across greater Sydney who are facing significant growth and revitalisation in the coming years. This includes Liverpool, Parramatta, Inner West and Penrith Councils. Additional funding for another five Councils was also announced with Councils having to submit a funding bid. Councils who are successful in receiving this funding are required to update their Local Environmental Plans within a two-year timeframe with the final Local Environment Plan required to be submitted to the NSW Department of Planning and Environment by 30 June 2020. As reported at the 12 September Council meeting, Bayside Council was notified on 7 September that it was successful in receiving $2.5 million funding to help in the preparation of a new LEP. Overview of LEP Review
The first stage of developing a Local Environmental Plan is a requirement to undertake an LEP Review as outlined in Section 3.8(4) of the Environmental Planning and Assessment Act. The purpose of this review is to identify how closely aligned the existing local environmental plans are to the actions in the relevant District Plan. The LEP Review provides the background that will identify the priorities for investigation to inform Bayside’s Local Strategic Planning Statement. To help Councils complete the LEP Review, the NSW Department of Planning and Environment coordinated a number of Technical Working Groups (TWG) for Council staff. The key outcomes of these working groups are outlined below: TWG 1 District Roadmap 21 June 2018
This workshop provided an overview of the different stages required to develop Council’s new Local Environmental Plan with particular focus on the LEP Review. As identified above, Section 3.8(4) of the Environmental Planning and Assessment Act requires councils in the Greater Sydney Region to undertake a review of the LEP for their area following the making of a District Plan. The LEP Review report needs to be finalised and submitted to the Department of Planning and Environment for an initial appraisal and reported to the Greater Sydney Commission’s (GSC) Strategic Planning Committee as part of the GSC’s assurance role. The key outcomes of the Bayside’s LEP Review is provided later on this report.
TWG 2 - Local Strategic Planning Statements 5 July
This workshop outlined the timeframe and purpose of the development of a Local Strategic Planning Statement. Local strategic planning statements (LSPS) are to set out:
• The 20-year vision for land use in the local area. • The special characteristics which contribute to local identity. • Shared community values to be maintained and enhanced. • How growth and change will be managed into the future.

These Statements must include:
a Context - The basis for strategic planning in the area, having regard to economic, social and environmental matters.
b Planning priorities - The planning priorities for the area that are consistent with any strategic plan applying to the area and (subject to any such strategic plan) any applicable community strategic plan under section 402 of the Local Government Act.
c Actions - The actions required for achieving those planning priorities.
d Implementation - The basis on which the council is to monitor and report on the implementation of those actions.
The LSPS will be the key resource to understand how strategic and statutory plans will be implemented at the local level. In developing the Local Strategic Planning Statement, Bayside Council will undertake:
a Development of Strategies – Council will undertake a number of issue specific studies (e.g. flooding, heritage, land use limitations, transport) to increase Council’s understanding of the current environmental, economic and social context and the area’s future needs and priorities. These studies will be critical in creating the evidence base for developing Council’s LSPS and LEP.
b Community Engagement – In recognition that this is the first time councils are required to develop an LSPS community engagement will be undertaken both pre and post exhibition. This engagement will include interviews, workshops and surveys. The community engagement plan was reported at Council’s 12 September 2018 Council meeting (Item 8.5).
Greater Sydney councils are required to exhibit their draft Local Strategic Planning Statement by 1 July 2019 with the final version in place by 1 December 2019. The draft Local Strategic Planning Statements are to be submitted to the NSW Department of Planning before going on public exhibition. TWG 3- Sustainability, 23 July
At this workshop, the Department of Planning and Environment and Greater Sydney Commission highlighted:
Key sustainability priorities identified in the Eastern City District Plan.
Importance of green infrastructure in creating liveable cities, particularly in relation to providing community with recreational facilities and addressing heat island effects.
Examples on how to plan, implement, monitor and evaluate the success of the implementing priority sustainability actions.
Initiatives State Government is undertaking to address these priority actions, e.g. WaterSmart Cities, 5 Million Trees initiative, NSW Sport District Plans.
State Government resources to support Council’s delivery of the priority actions.

TWG 4 - Housing and Liveability, 2 August
This workshop provided an overview of:
Need for new housing in Sydney, particularly affordable housing.
How to increase the liveability of neighbourhoods, for example by. o Providing walkable places at a human scale with active street life.
o Prioritising opportunities for people to walk, cycle and use public transport.
o Co-locating schools, health, aged care, sporting and cultural facilities.
What is required in Council’s housing strategy to ensure consistency across the region including: o Demographic factors.
o Supply and demand for housing.
o Local land use opportunities and constraints.
Principles of place-based planning for centres including: o Provide, increase or improve local infrastructure and open space.
o Improve walking, cycling and public transport connections, including through the Greater Sydney Green Grid.
o Protect or expand retail and/or commercial floor space and employment opportunities.
o Support the night-time economy.
TWG 5 - Productivity, 16 August This workshop focused on the role of the LEP in enabling productivity with particular focus on protecting and/or enhancing:
Employment lands.
Industrial zones. This workshop also had a key focus on protecting the movement of freight with request for planning principles to:
Protect existing freight corridors as well as industrial and urban services land.
Plan for future freight requirements including the future supply of land for freight use.
Ensure negative impacts on local communities are minimised for freight movements. TWG 6 - Infrastructure and Priorities, 6 September This workshop provided details on the State Infrastructure Strategy. This 20 year State Infrastructure Strategy makes recommendations for each of NSW’s key infrastructure sectors – transport, energy, water, health, education, justice, social housing, culture, sport and tourism. Recommendations identified include:
Finalise business cases by the end of 2018 to enable the NSW Government to partner with the Commonwealth Government to fund investment in Sydney Gateway, Port Botany Rail Duplication and Foreshore Road/Botany Road, as well as the Moorebank

Intermodal Terminal Road Access Strategy, to remove bottlenecks on connections to and from Sydney Airport and Port Botany.
NSW Government increase investment in walking and cycling infrastructure and parks and open spaces as part of the ongoing integration of health into land use planning and transport strategies.
Department of Education facilitate joint and shared use arrangements.
Representatives from NSW Health and NSW Department of Education also spoke at this forum. NSW Health identified that they wished to work more closely with councils, particularly in relation to zoning, roads, access and parking. The Department of Education discussed options of shared use and joint use programs to increase community access to school facilities. Representatives from NSW Department of Education recently met with Council staff to discuss these opportunities in the Bayside area.
Outcomes of Bayside LEP Review
As highlighted above, the purpose of the LEP Review is to identify how closely aligned the existing Local Environmental Plan is to the actions in the relevant District Plan. The actions in the Eastern City District Plan fall under four key themes:
Infrastructure and collaboration
Productivity
Liveability
Sustainability
Infrastructure and Collaboration The main priority identified in the Bayside Council LEP Review is the need to collaborate with state government agencies, such as RMS and Transport NSW, to ensure the LGA is accessible and congestion issues are reduced. The need to promote accessibility and connectivity was also a priority under the productivity theme. Productivity Central to productivity is the need to retain employment lands, manage land use conflict, support the operations of Sydney Airport and Port Botany and promote activity in our local centres. The primary ways Council will be achieving these actions is through the development of a Land Use Limitations Study, Activity Centres and Employment Lands Strategy and a Transport Strategy. Liveability The LEP review highlights multiple priority Bayside Council needs to focus on to encourage liveability, including housing, heritage social infrastructure and place making. We need to ensure that we can provide suitable housing in the right locations that support our growing community without encroaching on the existing heritage values and the character of our local area. We also need to ensure that our social infrastructure responds to our community’s needs and that the LGA is a welcoming and inclusive place for all. To help achieve these priorities Council will be preparing a Housing Strategy, Heritage Study and a Social Infrastructure Strategy. Sustainability Within the sustainability theme, we will be considering both environmental matters alongside ways to enhance our existing provision of open space. We need to ensure that our waterways and biodiversity assets are identified and protected. We also need to promote

our tree canopy throughout the LGA to enhance the public domain and protect against the impacts of climate change. Developing further strategies to mitigate the impacts of climate changes such as reducing emissions and initiatives to increase energy and water efficiency are also priorities. To achieve these priorities, we will be preparing an Environmental Strategy and a Social Infrastructure Strategy, which will consider ways to connect and improve the existing quantum of open space with the LGA. This information will form the basis of the LEP Review that will be submitted to the NSW Department of Planning and Environment by 31 October 2018. Next Steps
The next key steps for Bayside Council are:
Review the funding agreement for the $2.5 million accelerated LEP funding.
Submit LEP Review to NSW Department of Planning and Environment.
Commence development of technical strategies.
Commence community engagement.
Prepare Draft Local Strategic Planning Statement.
An update on the progress of the development of Bayside Local Environmental Plan will be provided at upcoming Planning Committee meetings.

Summary Bayside West 2036 was released by Department of Planning and Environment on 9 September 2018. The Strategy replaces the Draft Bayside West Land Use and Infrastructure Strategy and outlines principles to inform planning for the Arncliffe and Banksia Priority Precincts. It also outlines items of infrastructure that are required to support growth in that Precinct. A Powerpoint presentation, outlining the key areas of content, will be made to the Planning Committee.
Officer Recommendation That the Planning Committee notes that Bayside West 2036 has been adopted by the Minister for Planning and relates to the Arncliffe and Banksia Priority Precinct and Cooks Cove.

Subject Eastlakes Town Centre State Design Review Panel Decision

Summary A portion of the Eastlakes Town Centre and surrounds has been the subject of a Part 3A Application for a number of years. Most recently the Crown Group lodged an application to modify the approval in relation to the Eastlakes Shopping Centre. The Botany Bay 2031 Planning Stratgey identified the need for a review of planning controls at Eastlakes Town Centre and, as part of the Local Environmental Plan Review, Bayside Council will be undertaking a review of planning controls in the LEP and DCP. The State Design Review Panel considered the Crown Group proposal and determined that Council Startegic Planning review of the centre should inform the future of the Estalakes Town Centre. A presentation will be made to the Planning Committee to provide an update on this project and the recoemmendations of the State Design review Panel.
Officer Recommendation That the Planning Committee notes that the State Design review Panel has considered and made recommendations in relation to a Modification Application for a Part 3A Project Approval at the Eastlakes Town Centre.
