Staff Recommendation: Staff recommends approval of Resolution No 19-81.

Property Location/Zoning
Bridle Creek is located in the north half of Section 18, Township 1 North, Range 67 West of the 6th Principal Meridian. The property is located south of Weld County Road (“WCR”) 10, east of WCR 13 (Colorado Boulevard) and west of WCR 15 (Holly Street). The property that comprises the application area for the proposed development includes parcel numbers:

• 146918100011 The majority of the site is zoned R-2 residential and 4.6+/- acres are zoned C-1 Commercial. Surrounding land use: North: Unincorporated Weld County South: C-R Commercial Residential, C-1 Commercial East: R-1 Residential (Holly Vista Annexation) West: PUD Planned Unit Development, unincorporated Weld County

Background
The area encompassing the preliminary plat was annexed into the City of Dacono by Ordinance 598 and known as the Hingley Farm Annexation. By Ordinance 599, the site was zoned C-1 Commercial and R-2 Residential. Resolution 04-41 approved a preliminary plat for Bridle Creek. By Resolution 09-08, an extension to submit a final plat by June 1, 2011, was granted by the Planning and Zoning Commission. The final plat was never completed and the land use approvals expired in 2011.
Acreage/ Lot Description
Total acres: 304.48 acres Total tracts: 21 tracts Tracts A, B, C, D, G, H, K, L, M, N, O, Q, R, T, and U are subject to future preliminary plat and subdivision procedures.
Existing Conditions The site is currently undeveloped with the exception of a 9 +/-acre oil and gas facility, the Hingley 18H-A167, which is currently under construction. Little Dry Creek bisects the center of the site flowing from the southwest to northeast. The site includes a designated floodplain per FEMA Flood Insurance Rate Map panel 08123C2100E (effective date 1/20/2016) and is within the 100-year flood zone. The site has identified wetlands encompassing approximately 13 acres.
Subdivision Design Standards & Reports
Submittal requirements for preliminary plats are contained in Dacono Municipal Code (DMC) Chapter 17 Article 4. For the purpose of this “super plat” review, many submittal requirements are waived. No design or variances to any requirements of Chapter 17, Sec. 17-71. - Preliminary plats and data, are granted by this preliminary plat.

Tracts: The purpose of this plat is to subdivide the property into twenty-one (21) tracts and right-of-way for future development. Tracts A, B, C, D, G, H, K, L, M, N, O, Q, R, T, and U are subject to future preliminary plat and subdivision procedures. Oil and Gas: A variety of abandoned well locations are located throughout the site. A future preliminary plat will need to reflect the location of these abandoned well locations and provide necessary setbacks. No development or right-of-way construction will be permitted over these sites. The Hingley 18H-A167 wells are currently under construction. All applicable well setbacks will need to be followed and accurately reflected on a future preliminary plat. Additionally, a 30’ pipeline easement runs along the eastern boundary of the site. All development adjacent to this pipeline will be subject to the Dacono Municipal Code Chapter 17 Article 5. Construction Plans: Preliminary construction plans were submitted to the City Engineer. As this preliminary plat application is for large tracts, subject to future preliminary plat and subdivision design standards, many of the submittal requirements were waived for this submittal. The preliminary plat does not waive any future submittal requirements or grant design variances. Right-of-Way: The preliminary plat reflects a new minor collector, Bridle Creek Way, that would create an additional connection between WCR 13 and WCR 15. Future right-of-way for a portion of WCR 10, Graden Blvd. is not reflected on the preliminary plat and may be required as part of the future plats. Internal road right-of-ways are shown on the preliminary plat. Based upon the level of detail provided, it cannot be determined if the roads are sufficient to serve future development. Geotechnical: A Geologic and Preliminary Geotechnical Investigation plan prepared by CTL Thompson, Inc. The purpose of the report was to identify geologic hazards that may exist at the site and to evaluate the subsurface conditions to assist in future site planning. The site contains geologic hazards that should be mitigated during planning and development. No geologic or geotechnical conditions were identified which would preclude development of this site. Geologic hazards at the site that need to be addressed include soft soils, shallow groundwater, potentially unstable slopes, hard bedrock and difficult excavations, regional issues of seismicity and radioactivity, and surface and subsurface mining are the primary geologic concerns pertaining to the development of the site. The Geologic and Preliminary Geotechnical Investigation prepared by CTL Thompson indicates a now shuttered mine shaft, known as the Hingley-Morgan Mine Shaft, is located on the site. While the Geologic and Preliminary Geotechnical Investigation illustrate the approximate location of the now shuttered mine shaft, this is shaft is not noted on the preliminary plat but appears to be near the proposed Bridle Creek Way. Per the Geologic and Preliminary Geotechnical Investigation,

development is not recommended over the abandoned mine shaft. Future land use applications will need to correctly identify the mine shaft location and the plat may need to be modified to avoid the shaft. Groundwater was encountered at depths ranging from 6 to 24 feet below the existing ground surface. Groundwater levels are likely to affect utility installation and basement depths over portions of the site. Additional foundation, pavement, and soil stabilization recommendations were provided. Drainage: A Phase II Drainage Report, prepared by Galloway & Company, Inc., dated March 22, 2019, was submitted with the application. The conceptual drainage design provides an overview of the plans to convey runoff from both on-and off-site basins to Little Dry Creek without adverse impacts to upstream and downstream facilities. Utilities: A utility master plan was not submitted. A summary of the proposed utilities serving the future development include: Sewer- A Sanitary Sewer Analysis, prepared by Galloway & Company, Inc., dated March 15, 2019, was submitted with the preliminary plat. The report was prepared in accordance with the design criteria as established by the St. Vrain Sanitation District. The applicant is currently working with the District to design and build a lift station to the proposed project. Water- A Potable Water Design Report, prepared by Galloway & Company, Inc., dated March 15, 2019, was submitted with the application. The potable water system design and analysis was completed in general conformance with the City of Dacono design criteria. The proposed water distribution network has the capacity to supply the project site while maintaining a pressure greater than the minimum 20 psi and 1000 gpm required at every fire hydrant delivery node while maintaining velocities less than 7.5 ft/s except for the hydrant laterals. Parks and Open Space: Several tracts are shown as open space. A determination has not been made if the land meets the requirements of usable open space per the DMC Chapter 17 Article 14. Usable open space area shall be unobstructed to the sky, and for one-family and two-family residential developments shall have a minimum dimension of fifty (50) feet and a minimum area of seven thousand (7,000) square feet. Lands within required oil and gas facility setbacks are generally not suitable for public use and will not be considered as part of the required land dedication. Site characteristics of natural significance, such as natural or human-made water bodies (i.e., lakes, streams, creeks), natural areas offering aesthetic or ecological value, or adjacent or off-site facilities or areas may, at the discretion of the City Council, qualify toward meeting the usable open space requirement.
Flood Damage Prevention Standards
The site will be subject to the Dacono Municipal Code Chapter 18 Article 6 6 - Floodplain Damage Prevention as part of any future land use or building applications. Sec. 18-138. – Compliance. No structure or land shall hereafter be located, altered or have its use changed within the Special Flood Hazard Area without full compliance with the terms of Article 6 and other applicable regulations.

Planning and Zoning Commission Recommendation
On August 13, 2019, the Dacono Planning and Zoning Commission held a properly noticed public hearing on the application and recommended approval by PC 19-03.
Staff Recommendation Staff is recommending approval of Resolution 19-81 finding:
1. Adequate water and sanitary sewer facilities can be designed to serve the proposed development.
2. The Geologic and Preliminary Geotechnical Investigation report
provides recommendations to mitigate potential geologic hazards at the site including soft soils, shallow groundwater, and a former mine shaft. No geologic or geotechnical conditions were identified which would preclude development of this site.
3. This preliminary plat subdivides the property into twenty-one (21)
tracts and right-of-way for future development. Tracts are subject to future preliminary plat and subdivision procedures.
4. As the development is subject to future preliminary plat and subdivision procedures, the requirements of Chapter 18, Article 6 Floodplain Damage Prevention can be addressed in forthcoming submittals.
5. The general right-of-way as designed, provides an east-west
alignment through the site. Additional review in future submittals will need to determine if any of the road right-of-way conflicts with plugged and abandoned oil and gas facilities and/or the former Hingley-Morgan Mine Shaft.

RESOLUTION NO. 19-81
A RESOLUTION APPROVING A PRELIMINARY PLAT FOR BRIDLE CREEK
WHEREAS, there has been submitted to the City Council of the City of Dacono a request
for approval of a preliminary subdivision plat for Bridle Creek; and
WHEREAS, all materials related to the proposed preliminary plat have been reviewed by
City Staff and the Dacono Planning and Zoning Commission and found, with conditions, to be in
compliance with City of Dacono subdivision and zoning ordinances, and related City ordinances,
regulations, and policies; and
WHEREAS, the Planning and Zoning Commission has held a properly noticed public
hearing on the proposed preliminary plat, and has forwarded to the City Council a recommendation
of approval, with conditions; and
WHEREAS, the City Council has duly considered the proposed preliminary plat, and has
held a properly noticed public hearing on the application; and
WHEREAS, the City Council finds the proposed preliminary plat should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DACONO, COLORADO:
Section 1. The City Council hereby approves the proposed preliminary subdivision plat for
Bridle Creek.
