SUBJECT: ESTIMATE FOR BORING & INSTALLATION OF ONE NO. 12” X 8”(304.80 X 203.20 MM) I/D DEEP BORE TUBEWELL IN LIEU OF LOWDISCHARGE/ABANDONED TUBEWELL NO. RN-22 FEEDING TOWATER WORKS, SECTOR-26, CHANDIGARH (WITH REVERS.E RIG. METHOD OR ANY OTHER METHOD OF LATEST TECHNOLOGY).

The water supply of Chandigarh is based on two sources namely Canal water and deep

tubewells. One of the existing tubewell i.e. RN-22 feeding to Water works, Sec-26 was originally

installed during year 1974 and later re-bored during 1998. With the passage of time the rated capacity of

this tubewell has declined considerably. Therefore the bore has also been got inspected from a renowned

ground water hydrologist. After inspection the consultant recommended to install new tubewell in lieu of

existing tubewell. Accordingly, the estimate to install new deep bore tubewell along with other contingent

works such as pumping machinery, making connection with existing rising main and service line charges

to be paid to U.T., Electy. Deptt. has been prepared. The necessary credit for old material has also been

considered in the estimate. Thus the estimate duly checked for Rs.26.80 lacs has been allowed by the

competent authority to be placed before the Finance and Contract Committee for consideration and

approval.

Accordingly the agenda is hereby placed before Finance and Contract Committee. The

expenditure will be charged to head: 4215 – Water Supply and Sanitation (Plan) – Laying of Additional

Pipe Lines and the detail of Budget allocation is as under:

(i) Total Budget Allocation : Rs.. 200.00 Lacs

(ii) Amount of Estimates already : Rs.. 6.17 LacsSanctioned.

(iii) Up to date expenditure : Rs.. 63.36 Lacs

Subject: Estimate for B/I of one no. 12” x 8” (304.80 x 203.20 mm) i/d deep bore T/W in lieu of abandoned tubewell, Sec-48-D, Chandigarh feeding to distribution lines, Chandigarh with (reveRs.e rig. method or any other method of latest technology).

The existing tubewell in Sec-48-D, Chandigarh was installed by the Engineering wing of

Chandigarh Administration in the year April, 2000. In the year May, 2006, the tubewell started giving out

sandy/muddy water. The discharge of tubewell was reduced and water was not even fit for human

consumption, due to sandy/muddy water. Thus the tubewell was closed in June 2006.

After that the tubewell was got inspection from Sh. M.C. Jindal, Consultant Ground water

hydrologist and after the inspection of the tubewell , the consultant recommended to install the new

tubewell. The copy of report is also appended. As per report, the remarks of the consultant are as under:-

"Make no effort to restore the tubewell as it can not be revived from the present condition.

Abandon the tubewell and seal the top securely so that no one can put any trash inside it" or fall in it. As potential aquifer zones exist at the site a new tubewell may be installed about 10m. away from the abounded tubewell down to about 250m depth.

The above said T/well was used to supply water to the distribution lines of the area sector

48-D. But after the closure of these tubewells there were low pressure complaints of water supply

particularly in the summer season. Moreover the Councilor of the area also requested for re-boring of the

tubewell due to shortage of drinking water. So it has been proposed to rebore the tubewell with suitable

size screen.

Therefore, an estimate amounting to Rs..29.95 Lacs has been prepared for the reboring of

the tubewell having the provision of drilling for tubewell, repair of machinery, gas chlorinator, MS

delivery pipe & special and repair of control panel etc. Necessary credit of existing old material has been

given to estimate. The provision for Electrical connections has been made in this Estimate. The other old

dismantled material from abounded tubewell such as Sub. Cable , M.S. column pipe , submeRs.ible

pumping set, CI specials will be reused and provision of addition quantity has been made in estimate

as per actual requirement at site.

As such, an estimate amounting to Rs.29.95 Lacs duly allowed by the competent authority

is placed before the Finance & Contracts Committee for its consideration and approval. The

expenditure shall be chargeable to the Head:- 4215 W/S & sanitation (plan) providing new T/wells &

laying of additional pipe lines

Regarding purchase of one Tata 207 along with AFT machine

The Fire & Emergency Wing of the Municipal Corporation, Chandigarh is

considered one of the most efficient and well equipped Fire Wings of the country. The Fire Wing

is up graded from time to time with the induction of latest fire fighting equipments/vehicles. The

Fire Wing also responds to the fire calls of the neighbouring states of Punjab and Haryana.

Although the city is well planned with wide roads, streets of NAC Manimajra and surrounding

labour colonies of the city are narrow. The commercial and residential structures located in these

congested areas are inadequately equipped with fire fighting equipments in comparison to the rest

of the city. In the past also whenever there were fire incidents in these labour colonies and

Manimajra, the fire vehicles faced difficulty in reaching the fire spot. Therefore, the need for

small sized fire tenders with AFT machine is felt. At present the Fire & Emergency Wing is

having only two small TATA-207 with AFT machine, which are very much inadequate in view of

the population of the city especially in these congested localities. Due to congested roads and

streets If the fire tenders fail to reach the fire point in time, it can cause irreparable loss to human

life and property. Therefore, it is proposed to purchase one TATA-207 along with AFT machine.

The cost of vehicle and AFT machine will be Rs.24.00 Lac. The position of the funds available is as

under:-

Agenda Item: Fixation of reserve price of Kiosk at Shivalik Garden, Manimajra.….

The committee constituted meant for the fixation of reserve price of three Kiosks

recommended Rs. 10,000/-as reserve price per month of each kiosk in the meeting held on 15-

2-2010 at 11.00 A.M.

TERMS AND CONDITIONS FOR LICNESING OUT FOOD KIOSKS AT SHIVALIK GARDEN MANIMAJRA.

1. The allotment of Kiosks measuring an area of 150sft. approximately for running of Food stall at Shivalik Garden Manimajra shall be on license basis for three years with increase of 10% of the lease money annually. The said area of 150 sft. is subject to minor variation and adjustment by plus/minus 5% depending upon the project requirement (here-in-after referred to as “Kiosk”).

2 The licensor reserves the right to terminate the license at any time after handing over the possession of the said Kiosk by serving upon the licensee a notice to that effect and the licensee shall be able to hand over the vacant possession of the said Kiosk by the date as stipulated in the notice.

3 The licensee shall deposit security equal to six months determined license fee, less the earnest money of Rs. 5000/-, with in 7 days from the date of issue of allotment letter. In case of failure to deposit the security within 7 days from the date of issue of allotment letter, the amount of Rs. 5000./- on account of earnest money deposited by licensee shall stand forfeited.

4 “The licensee will entitle to run Food Kiosks from 9.00 AM to11.00 P.M. The kiosk shall be allowed to be used only for the sale of food stuffs for which it has been allotted. However, no sweets (Mithai) would be allowed to be sold.”

5 The licensee shall pay to the Corporation agreed monthly license fee by 7 th of following month. No part payment will be accepted under any circumstances. In case of default or late payment interest @ 18% shall be charged from the due date to the actual date of payment.

6 The licensee will have to arrange his own electrical connection for the Kiosk allotted to him and shall be responsible to pay electricity charges to the concerned authority at the rates as may be applicable from time to time.

7 The licensee will be liable to pay all such fees, taxes, etc. in respect of space as the Government may levy from time to time under any law.

8 The licensee will at all times keep and maintain the said Kiosk in proper state of cleanliness to the satisfaction of the licensor or his officers and employees duly authorized by him in this behalf.

9 Only disposable type of utensils shall be used for serving the food to customers. No washing of utensils shall be allowed at site. Disposal of waste at proper place shall be the responsibility of the licensee.

10 The licensee shall manage and operate Food Kiosks in the space and abide by the terms and conditions of scheme formulated by the Municipal Corporation, Chandigarh. The licensee shall not use and allowed to be used the said Kiosk for any unlawful activities.

11 The licensee shall no paste any bills, advertisements, posters, notices, cutting etc. under any circumstances.

12 In the event of any damage or injury being caused to the said Kiosk or any property of the licensor by the licensee or his servants or agents or any one upon the said kiosk, the

licensee shall make good all such damage or injury and in the event of his failure to do so within seven days after occurrence of the such damages, the licensor may make good such injury/damage by deducting the amount form the security.

13 “The licensee shall charge the price from the customers not more than the market rate.

14 The licensee shall not sublet, assign or part with possession of the said Kiosk or any part thereof. The licensee shall not be entitled to execute GPA/SPA in favour of other person or enter into partnership with anyone.

15 The licensee shall make payments of electricity, water charges etc. to the authorities concerned, before vacating the said Kiosk on the termination of license. It shall be lawful for the licensor to order for adjustments of arrears on account of electricity, water and other dues outstanding against the licensee from the amount of the security deposit.

16 The licensor shall have full right, power and authority at all times to do through his officers or officials all acts and things which may be necessary or expedient for the purpose of enforcing compliance with the terms and conditions and reservations contained and to recover from the licensee the cost of doing any such act or thing.

17 The rent shall be remitted to the Municipal Corporation, Chandigarh by means of Demand Draft payable to the ‘Commissioner, Municipal Corporation, Chandigarh’ and drawn on any scheduled bank situated at Chandigarh. In case of default for payment of rent, a penalty shall be imposed @ Rs. 5000/- for the first time and @Rs. 10,000/- for the 2nd time besides interest @ 18% per annum as stipulated in clause No. 5. The license shall be terminated on continuous default of non payment of two months and security deposit shall be forfeited.”

18 In the event of non-payment of the license fee or non-use of such premises by the due or extended date not exceeding 60 days or breach or non-observance by the licensee of any of the conditions of the license, it shall be lawful for the licensor to terminate the license and the licensee will not entitle to any compensation, what so ever on account of such termination/cancellation. Provided that on sufficient cause being shown, the licensor may for reasons to be recorded in writing instead of terminating the license on the ground of default in payment of license fee allow the payment to be made with penalty not exceeding the due amount but not less than Rs. 5000/- with in such period, not exceeding three months on the whole, as he may deem reasonable. The amount of penalty shall however, be in addition to the payment of interest @ 18% per annum as specified herein before.

19 On the termination of license under any of the terms and conditions of the license:-a. The licensee will deliver the vacant possession of the Kiosk in its original state to

the licensor, failing which the Kiosk shall be got vacated in accordance with law.b. The amount of security lying with the licensor after adjusting all the dues, shall

however, be refunded to him without any interest on the amount of security so deposited.

c. “The licensee will submit the No Due Certificate from all concerned Department regarding electricity charges, water charges and other tax/rent payable by the licensee/licensees against the kiosk. The security will be refunded only after submission of N.D.C.”

20 In the event of any question, dispute or difference arising out of this license or in any manner touching this license and solution of which is not expressly provided in the license agreement, the same shall be referred to the sole arbitrator i.e. the Commissioner, Municipal Corporation or any other person appointed by him. The award of the Commissioner, Municipal Corporation shall be final and binding on the parties to the license.

21 The Municipal Corporation, Chandigarh reserves the right to develop any new services in the area in the public interest at any time during the lease period.

22 The licensee shall comply with all the provisions of all the Labour Acts governing the service of his employee. There shall be no relation of the employees of the licensee with the licensor and licensee shall be principal employer of his employees for all intends and purposes. In these terms and conditions unless the context otherwise required.

a. “Licensor”/”Corporation” means the Municipal Corporation, Chandigarh through the Joint Commissioner/Additional Commissioner/Secretary; MCC.

b. “Licensee” means, a person, a firm, or a company to whom the Kiosk is allotted on license basis.

c. “License fee” means, the sum of money payable monthly by the licensee in accordance with the terms and conditions of the license in respect of the Kiosk allotted by the licensor.

d. “License” means, the allotment containing detailed terms and conditions of allotment of the Kiosk.

e. “License agreement” means an agreement containing the terms and conditions on which the Kiosk has been licensed out duly executed between the licensor or licensee.

Subject: Permission for sale of watermelon under the jurisdiction of M.C.,Chd.

The Municipal Corporation, Chandigarh is granting permission for the sale of

watermelon at 37 Nos. locations at different sectors as approved by the F & C.C. in its 84

meeting held on 16.05.2001 (Placed below at Flag ‘A’) and in the F & C.C.98 th meeting held on

05.04.2002 (placed below at Flag ‘B’). The F & C.C. in its 181st meeting held on 18.12.2008 re-

fixed the Licence fee to be charged from the water melon sellers @ Rs. 150/- per day for sites

on V-4 roads and Rs.100/- per day for sites on V-5 roads and further directed that preference

will be given to local and old vendors (Placed at Flag ‘C’)

It is submitted that previously this office had been granting the permission to the

watermelon sellers on first come 1st serve basis. It has been observed that some vendors

submit their applications in the month of Jan / Feb. As there are no guidelines for the policy of

allotment, this office has to allow the sites on first cum 1st serve basis. However the office has to

face problem in granting permission.

It is proposed that a transparent system for granting permission to the water melon

vendors may be approved as under:-

(1) Applications forms for granting the permission for sale of watermelon has been

prepared ( Placed at Flag ‘D’.)

(2) The applications for the permission be invited by 15 th of March through press note

given in the 3-4 leading news papers of English / Hindi and notice board as well as

website of M.C.,Chd (Placed at Flag ‘E)

(3) A security amount of Rs. 5000/- shall be deposited by the applicant which shall be re-

funded on the vacation of site after the expiry of the date of permission granted.

(4) The allotment process shall be finalized by 20th March every year.

(5) The Terms and Conditions of the permission letter has been prepared (Placed at

Flag ‘F’) and are submitted for approval.

Agenda: - Review of rent in respect of liquor vends situated on the Municipal land.

Municipal Corporation, Chandigarh is receiving rent @ Rs 30,000/-(Rs 15,000/- each for

liquor vend and Ahatta). Prior to the year 2006-07, the rent was collected by Excise and Taxation

Department and rent was forwarded to the Municipal Corporation, Chandigarh. From 2006-07 the

Municipal Corporation directly collected the rent from the liquor vends.

These liquor vends are allotted by the Chandigarh Administration under their excise policy

and liquor vend along with the ahatta has been allotted to an individuals/firms. These vends cannot be

auctioned as specific places provided by the Excise and Taxation Department to a particular

individual/firm.

In the state of Haryana as per clause No.5.9 of the Excise Policy, it has been provided that

“Municipal bodies shall be paid @ Rs.3/- per bottle of C.L of 750 ml or equivalent, Rs.5/- per bottle of

IMFS of 750 ml or equivalent and Rs.2/- per bottle of beer of 650 ml capacity or equivalent.” (Copy

placed at Annexure A).

As per the data collected from the Excise Department, there are 16 number of the liquor

vend on the Municipal land(Copy annexed at Annexure B). Out of which 3 number liquor vend has been

issued L-14A license for Country made liquor. The vend for Country made liquor has customer of the low

paid category and resultantly affecting the vends income.

Keeping in view the above point, the rent for liquor vends may be enhanced. Also we may

request the Chandigarh Administration to put duty/cess of Rs. 1/- or Rs.2/- per bottle and revenue of the

same may be transferred to the Municipal Corporation, Chandigarh. As per the information gathered from

the Excise Department the annual sale of bottles are around 2.5 crore to 3 crore.

Subject: Condemnation of vehicles no.CH01-G-0355

The vehicle no.CH01-G-0355 (Mohindra & Mohindra Pick up) was purchased in the year

1989 by Fire Wing and transferred to Public Health Wing Municipal Corporation, Chandigarh after the

formation of Municipal Corporation, Chandigarh. The vehicle has outlived its useful life and its running

has become uneconomical as vehicle is more than 20 yeaRs. old. The vehicle has completed its life of 15

SUBJECT:- TERMS AND CONDITIONS FOR LEASING OUT OF CHILL ROOM ON RENT IN THE NEWLY CONSTRUCTED MODERN AIR CONDITIONED FISH MARKET, SECTOR-41, CHANDIGARH.

1. The quarterly rent as per the bid shall be deposited before 10 th of the fiRs.t month of the

quarter.

2. An amount equivalent to three months lease shall be deposited in the shape of DD as security

which will be refunded after completion of lease period. No interest shall be paid on the

amount of security.

3. Electricity connection will be obtained by Lessee.

4. Electricity charges will be born by the lessee.

5. No commercial activity i.e. sale of fish from this shall be permitted.

6. Initially the lease period will be for fifteen year and amount of lease as agreed shall be

enhanced by 5% after 5 year.

7. Maintenance etc will be done by the lessee.

8. Proper temperature shall be maintained through out the storage of the product.

9. Any required change inside shall be done with prior approval of the Corporation. The plant

shall be handed back to Municipal Corporation in good working condition after the lease

period is over.

10. The rent to be charged from the market shopkeepeRs. will be @ Rs.. 100 per quintal for the

fish kept in it on 24 hourly basis.

11. This cold store is meant for storing the fish stock of this market only.

12. Once the cold store is made functional any need based term/condition required to be added

will be at the discretion of Joint Commissioner which Shall be a binding on the lessee.

13. The peRs.ons who are interested in participation of bid/auction shall have to deposit

Rs..50,000/- as participation money in cash or in the shape of DD in favour of Commissioner

Municipal Corporation, Chandigarh before the start of the auction to become eligible for

participation in the bid/auction for the chiller room/cold store. Amount will be refunded to the

unsuccessful bidder on the spot. In case the successful bidder failed to deposit the required

amount within a stipulated period as mentioned in the Allotment Letter and take the

possession, the amount of participation money of Rs..50,000/- shall be forfeited.

14. In case of failure of the electricity, the lessee shall be responsible for providing refrigeration

facility by operation of the Gen Set. The permission to operate the Gen set will be the

responsibility of the lessee.

15. In case of any defect or fault found, the same shall be got rectified by the lessee himself

otherwise, the rectification shall be done at the cost of lessee and amount will be recovered

from the Security deposit.

16. The lessee shall be responsible for the cleanliness and hygiene in the area.

17. In case of surrender of the Cold store, the The amount equivalent to security deposit shall be

forfeited and bank guarantee shall lapse in favour of the corporation.

18. The licensor reserves the right to terminate the license at any time after handing over the

possession of the said Cold Room by serving upon the licensee a notice to that effect and the

licensee shall be able to hand over the vacant possession of the said cold store by the date as

stipulated in the notice

19. The licensee shall pay to the Corporation agreed monthly license fee by 7 th of following

month. No part payment will be accepted under any circumstances. In case of default or late

payment interest @ 18% shall be charged from the due date to the actual date of payment.

20. The licensee will be liable to pay all such fees, taxes, etc. in respect of space as the

Government may levy from time to time under any law.

21. The licensee will at all times keep and maintain the said Cold Room in proper state of

cleanliness to the satisfaction of the licensor or his officeRs. and employees duly authorized

by him in this behalf.

22. The licensee shall not sublet, assign or part with possession of the said Cold Room or any

part thereof. The licensee shall not be entitled to execute GPA/SPA in favour of other

peRs.on or enter into partneRs.hip with anyone.

23. The licensee shall make payments of electricity, water charges etc. to the authorities

concerned, before vacating the said Cold Room on the termination of license. It shall be

lawful for the licensor to order for adjustments of arreaRs. on account of electricity, water and

other dues outstanding against the licensee from the amount of the security deposit.

24. In the event of any damage or injury being caused to the said Cold Room or any property of

the licensor by the licensee or his servants or agents or any one upon the said Cold Room, the

licensee shall make good all such damage or injury and in the event of his failure to do so

within seven days after occurrence of the such damages, the licensor may make good such

injury/damage by deducting the amount form the security.

25. The licensor shall have full right, power and authority at all times to do through his officeRs.

or officials all acts and things which may be necessary or expedient for the purpose of

enforcing compliance with the terms and conditions and reservations contained and to recover

from the licensee the cost of doing any such act or thing.

26. The rent shall be remitted to the Municipal Corporation, Chandigarh by means of Demand

Draft payable to the ‘Commissioner, Municipal Corporation, Chandigarh’ and drawn on any

scheduled bank situated

at Chandigarh. In case of default for payment of rent, a penalty shall be imposed @ Rs..

5000/- for the fiRs.t time and @Rs.. 10,000/- for the 2nd time besides interest @ 18% per

annum as stipulated in clause No. 5. The license shall be deemed to have been terminated on

continuous default of non payment of rent for two months and security deposit shall be

forfeited.”

27. In the event of non-payment of the license fee or non-use of such premises by the due or

extended date not exceeding 60 days or breach or non-observance by the licensee of any of

the conditions of the license, it shall be lawful for the licensor to terminate the license and the

licensee will be not entitle for any compensation, what so ever on account of such

termination/cancellation. Provided that on sufficient cause being shown, the licensor may for

reasons to be recorded in writing instead of terminating the license on the ground of default in

payment of license fee allow the payment to be made with penalty not exceeding the due

amount but not less than Rs.5000/- with in such period, not exceeding three months on the

whole, as he may deem reasonable. The amount of penalty shall however, be in addition to

the payment of interest @ 18% per annum as specified herein before.

28. On the termination of license under any of the terms and conditions of the license:-

I) The licensee will deliver the vacant possession of the cold room in its original state to

the licensor, failing which the Cold Room shall be got vacated in accordance with law.

II) The amount of security lying with the licensor after adjusting all the dues, shall

however, be refunded to him without any interest on the amount of security so

deposited.

III) “The licensee will submit the No Due Certificate from all concerned Department

regarding electricity charges, water charges and other tax/rent payable by the

licensee/licensees against the Cold Room. The security will be refunded only after

submission of N.D.C.”

29. In the event of any question, dispute or difference arising out of this license or in any manner

touching this license and solution of which is not expressly provided in the license agreement,

the same shall be referred to the sole arbitrator i.e. the Commissioner, Municipal Corporation

or any other peRs.on appointed by him. The award of the Commissioner, Municipal

Corporation shall be final and binding on the parties to the license.

30. The Municipal Corporation, Chandigarh reserves the right to develop any new services in the

area in the public interest at any time during the lease period.

31. The licensee shall comply with all the provisions of all the Labour Acts governing the service

of his employee. There shall be no relation of the employees of the licensee with the licensor

and licensee shall be principal employer of his employees for all intends and purposes.

In these terms and conditions unless the context otherwise required.

a. “Licensor”/”Corporation” means the Municipal Corporation, Chandigarh through the

Joint Commissioner/Additional Commissioner/Secretary; MCC.

b. “Licensee” means, a peRs.on, a firm, or a company to whom the Cold Room is allotted on

license basis.

c. “License fee” means, the sum of money payable monthly by the licensee in accordance

with the terms and conditions of the license in respect of the Cold Room allotted by the

licensor.

d. “License” means, the allotment containing detailed terms and conditions of allotment of

the Cold Room.

e. “License agreement” means an agreement containing the terms and conditions on which

the Cold Room has been licensed out duly executed between the licensor or licensee.

The above terms and condition for chiller room may kindly be perused. Terms and

condition from Sr. no.1 to 12 have been approved in the 172nd meeting of the F&CC. In the present

scenario and condition imposed in the case of Night Food Street, it is proposed to add the condition from

Sr.No.13 to 31. Term and Condition is placed before the F&CC for perusal and approval.

The shops of following villages have been transferred to the Municipal Corporation,

There are 16 shops which have been transferred to the MCC. The rent of these shops was revised in

the year 2007 @ Rs. 5172/- per month. Out of these 16 shops one shop bearing No 7 has been

allocated for the sale of SJSRY products @ Rs. 100 per day for a maximum period of one week. The

detail of other vacant shops is as under:-

“In case the petitioner deposit 50% of the enhanced rent. They shall not be

dispossed from the shops in possession till the next date of hearing”

The case is still pending in the Hon’ble High Court, therefore the tenants of these shops

are paying rent @ Rs. 2347/- per month. Out of these 10 shops one shop has been allocated for the sale of

SJSRY products @ Rs. 100 per day for a maximum period of one week. The detail other vacant shops are

5 Village Manimajra:-

There are two petrol pump sites and four food kiosks. The rent of these sites is Rs. 41,666/- which is

situated at Motor Market Manimajra and rent of other site is Rs. 81,688/- per month. So far as the

kiosks are concerned three kiosks are vacant and one kiosk bearing No 4 is running and paying rent @

Rs. 8140/- per month. Agenda has been prepared to put before the F&CC in the next meeting for

renting out these three kiosks at Shivalik Garden Manimajra.

6 Village Palsora:-

There is no shop which has been transferred by the Village Panchayat to the Municipal

Corporation Chandigarh, However, 10 vacant sites have been leased out on the monthly

1. The site will be given on lease hold basis for 99 yeaRs.. In addition to the auction

premium rent @ 2 ½ % of the premium is payable every year for the Ist 33 yeaRs.

Further the rent at the rate of 3 ¼ % of the premium for the next 33 yeaRs. and 5% of the

premium for the remaining 33 yeaRs. of the lease period.

2. The peRs.ons who are interested in participation of bid/auction shall have to deposit Rs..2

lacs before the start of the auction to become eligible for participation in the bid/auction

proceedings. . Amount will be refunded to the unsuccessful bidder at the spot.

3. The actual dimensions and area of each shop/booth will be announced before the

commencement of the auction.

4. The Presiding Officer (Officer conducting the auction) reserves to himself the right to

withdraw any number of shops/booths etc that may have been announced for auction and

to accept or reject the highest bid without assigning any reason.

5. Successful bidder shall pay 25% amount of the bid accepted by Auctioning Officer on the

spot in cash or by means of Demand Draft. In case the successful bidder fails to deposit

25% of the premium at the fall of the hammer his bid participation money shall stand

forfeited. The remaining 75% of the premium shall be paid within a period of 90 days

from the date of auction without any interest, failing which interest @ 20% shall be

charged. In case the bidder fails to pay the remaining 75% amount of the premium as

mentioned above within 90 days of the auction, the Joint Commissioner, Municipal

Corporation Chandigarh exercising the poweRs. of the Estate Officer under the Capital of

Punjab(Development and Regulations) Act,1952 may resume the site or building or both.

6. The sale of shops/booths shall be governed by the provisions of the Capital of Punjab

(Development and Regulation) Act, 1952 and the Chandigarh leasehold of sites and

Buildings Rules 1973 for commercial sites as amended from time to time and rules made

name and complete address of the partneRs. or DirectoRs. of the Company or Joint Hindu

Family etc as the case may be/shall be given immediately after the bid is closed/accepted.

No bid shall be accepted in the name of a firm or a company or on behalf of any other

peRs.on(s) unless the names of all the other peRs.ons taking the offer are given with the

complete specification of shares and the peRs.on making the bid produces a valid and

legal power of attorney authorizing him to bid on other’s behalf.

9. No addition in the name of purchaser shall be allowed after the acceptance of bid. The

name of the peRs.on in whose behalf bid has been accepted shall be made know to the

Joint Commissioner Municipal Corporation, Chandigarh exercising the poweRs. of Estate

Officer under Capital of Punjab(Development and Regulations) Act, 1952 by the bidder at

that very time and no alteration in the name shall be allowed, if the bid is given on behalf

of a firm or company the number of share of each share holder of exact share or each

partner, co-owner or joint owner shall be made known by the bidder immediately on the

fall of the hammer and no subsequent addition or alteration of number of shares declared

at the time of auction shall be allowed.

10. After making payment of whole of sale price, the lessee shall execute the Lease Deed

within a period of six months from the date of auction in such a manner as may be

directed by the Joint Commissioner, Municipal Corporation, Chandigarh exercising the

poweRs. of Estate Officer under Capital of Punjab (Development and Regulations) Act

1952, failing which the Joint Commissioner, Municipal Corporation, Chandigarh may

cancel the allotment and forfeit 25% of the premium. The lessee shall bear and pay all

expenses in respect of the execution of lease deed including the stamp duty and

registration fee payable in respect thereof in accordance with law in force at that time.

11. The shops/booths will be sold in AS IS WHERE IS BASIS.

12. Fragmentation or amalgamation of the shops/booths shall not be permitted.

13. The shops/booths shall not be used for any purpose other that that for which it has been

leased out/auctioned.

14. License under ’The Chandigarh Municipal Corporation (Regulation for the sale of Meat,

Fish and poultry) Bye Laws 2002’ The license of the booth shall obtain a license from

MOH under the ‘The Chandigarh Municipal Corporation (Regulation for the sale of Meat,

Fish and Poultry) Bye Laws 2002’ for sale of fish, meat/poultry from the allotted booths/

shops within 15days of issue of allotment letter.

15. Any internal addition/alteration is not permitted in shops/booths. If necessary to suit the

trade the same will be done by the Municipal Corporation on payment from the allottee.

16. The covered passage (Varandah) in front or in the sides of the building shall not be

encroached upon or used for any purpose other than a public passage.

17. The right use of side wall of the end sites including right of display of advertisement

and benefits derived there from shall vest in the Municipal Corporation, Chandigarh.

18. The Lessee shall be liable to pay all such fee or taxes as may be levied by the Municipal

Corporation, Chandigarh or any other authority or Govt. in respect of site and building or

both under any law.

19. The other terms and conditions of the allotment shall be those as given in the Chandigarh

Lease Hold of sites and Building Rules 1973 as amended from time to time.

20. The letter of allotment will only be issued on receipt of full and final consideration

money.

21. In the event of default, the breach or non-compliance of any of the terms and conditions

of the lease/allotment or for furnishing any wrong or incorrect information, Additional

Commissioner/ Joint Commissioner Municipal Corporation, Chandigarh exercising the

poweRs. of Estate Officer under Capital of Punjab(Development and Regulations) Act

1952 and the rules framed there under shall be competent to cancel the lease/allotment

and forfeit the whole or part of the premium and rent paid by the lessee.

The project for development of the Fish/Meat market was put forth by the Director Animal

Husbandry and Fisheries. According three blocks have been developed as stated above. One Chiller Room

has also been constructed.

The Chandigarh Administration, Finance Department vide its letter no. 11/10/1-UTFI(2)-

2009/1212 dated 2.3.2009 has stated that “in new special trade category as notified in Chandigarh/Sale of

Sites and Building Rules 1960,Meat/Fish has been shown. Meat and Fish being the same trade,_ _ _”

(Copy placed at Annex-A).

It is pertinent to mention that keeping certain booths only for sale of fish trade may not

fetch good revenue as the Fish trade is seasonal and the business is for 4 to 5 months whereas the trade of

meat/poultry products is throughout the year

Hence, the case as detailed above is placed before the committee for decision. Whether to keep some booths only for sale of fish or all the booths to be put on auction may be allowed to sell fish/meat and other poultry products. Decision may also be taken as to number of booths to be put on auction.

On the basis of approval of Sanitation Committee, the agenda for issuance of Rain Coats

and Gum Shoes to the eligible Group ‘C’ and ‘D’ employees engaged in conservancy services was put up

in the 189th meeting of finance & Contract Committee held on 29.10.2009 and the same was resolved as

under :-

“After deliberations, the Committee unanimously approved the proposal for the issuance of Rain Coats and Gum Shoes to the eligible Group ‘C’ and ‘D’ employees engaged in field duty”.

The limited tendeRs. were called from 15 firms as per provision of General Finance Rules

and 6 no. of firms participated in the tender. The tendeRs. were opened by the Committee in the presence

of ObserveRs. nominated by Municipal Corporation, Chandigarh. On the basis of which, it was found

that M/s Pooja TradeRs., # 726 Phase-II, Indl. Area Chandigarh quoted the lowest rate i.e. Rs.788/- per

Rain Coat and Rs.. 635/- for Gum Shoes and samples of the same were approved by the useRs..

The estimated value for procurement of Rain Coats for 1535 no. of employees is

Rs.12,09,580/- and that of Gum Shoes for 1485 no. of employees is Rs.9,49,325/- to be made

available to the employees engaged in field duty.

Subject: Providing, installing, running and maintenance of three LED Screens in Sector – 17, Chandigarh on Public Private Partnership basis. (P.P.P.basis).

The City Centre Sector – 17, is the major tourist attraction of Chandigarh and it has been

proposed to install one LED Screen of size 36’x24’ and two screens of size 16’x24’ each at different

locations in City Centre, Sector – 17, Chandigarh for eye-catching and to beautify this area. These

screens are proposed to be installed on P.P.P basis to avoid expenditure on its installation and recurring

expenditure on its subsequent running and maintenance by the Corporation, but instead, it will also

generate revenue for the Corporation as license fee. The LED Screens will be allowed to install for a

period of five years and the licensee shall be allowed to run LED screens for displaying of advertisements.

The Municipal Corporation will reserve the right to display slots of 20 minutes duration each during each

peak hours i.e 1.00 P.M. to 3.00 P.M. and 5.00 P.M. to 8.00 P.M. The concept approval to install LED

screens at various location in Sector – 17 and displaying of advertisement thereupon will be sought from

Finance Secretary-cum Secretary Urban Planning-cum-Chief Administrator, Capital Project Chandigarh

on approval of proposal from Municipal Corporation, Chandigarh. The draft of bid document, scope of

work, detailed terms and conditions, eligibility criteria and other relevant documents are enclosed

herewith.

minutes of the meeting are received after a gap of two to three weeks after the meeting. Thereafter, case

is submitted for seeking administrative approval from the competent authority. Subsequently after

administrative approval of the estimates, DNITs are prepared and submitted for approval. After approval

of DNITs, tenders are invited and this process usually takes about three months which affect the

development works.

To cut short the procedure, it is proposed that if the agenda is approved in the respective

sub committees, Finance & Contract Committee, General House the estimate be submitted immediately

for administrative approval from the competent authority in anticipation of the minutes of the meeting of

the committees. The subsequent process of approval of DNIT, calling tenders should also be initiated but

the allotment of the work to the contractual agency will only be made after confirmation of the minutes of

the meeting.

Matter is placed before the Finance & Contract Committee for its consideration and

AGENDA ITEM NO.15

Subject:- Licensing of Taxi Stands sites-Extension of licence period thereof.

Municipal Corporation has allotted 55 taxi stands to the eligible applicants as

notified by the Chandigarh Administration. Out of 55 taxi stands, the period of licence of 37 taxi stands,

which were allotted for the period from 1.4.2007 to 31.3.2010, is going to expire on 31.3.2010. In clause

1 of the Existing Terms and Conditions of Taxi Stand, it has been provided that:-

“Period of licence: - The period of license shall be for a period of three years, extendable up to a total period of years subject to satisfactory performance of terms and conditions by the licensee. In case of extension of license deed the licensor shall be at liberty to modify the terms and conditions of the license deed by giving due notice to the licensee in order to ensure smooth functioning of taxi stands provided the same are in public interest.”

Since the period of the licence of 37 Taxi Stands is going to expire on 31.3.2010,

we shall have either to extend the period of licence of existing licence holders or re-allot the taxi stands by

inviting applications and holding a draw of lots if the numbers of applications are received more than one.

It is pertinent to mention here that ten more Taxi Stands have been notified by the

Chandigarh Administration and process for allotment of the same is under active consideration and as per

the recommendations of Finance & Contract Committee in its 189th meeting held on 29.10.2009, a

committee consisting of the following members stand constituted to examine the proposal in detail:-

2. Shri Jatinder Bhatia Member

3. Shri P.K. Mukherjee Member

4. Joint Commissioner Member Secretary.

The report of the Committee is yet to be finalized. However, some changes in the

terms and conditions for allotment of new Taxi Stands especially for the Licence Fee, are expected.

In the circumstances explained above, the matter is placed before the Finance &

Contract Committee for considering the issue as under:-

(i) We may re-allot 37 Taxi Stands by inviting applications and holding of

draw of lots on existing terms and conditions.

OR

We may wait for the finalization of fresh terms and conditions to be suggested by

the Committee constituted for the examination of proposal in detail for the

allotment of ten new Taxi Stands, which have recently been notified by the

Chandigarh Administration.

AGENDA ITEM NO.16

Subject: Estimate for the work of providing DI water supply pipe line in front of cheap houses in lieu of existing water supply line running in the back yard of houses sector 15-D, Chandigarh. Approx. Cost Rs.28.68 Lacs

The water supply distribution system of cheap houses 3375 to 3558 in Sector 15-D is

passing through the back court yard of these houses. These water supply distribution lines were laid

approximately 40 to 45 year back. The back court yards of these houses have been covered by owneRs. by

constructing pucca structures. It is very difficult to repair leakages of these lines. The residents are

complaining that, there is risk of cracks in their houses due to these hidden lines. These water supply lines

have outlived its life and requires replacement. Worthy Mayor Municipal Corporation has visited area on

dt.16-01-10 alogwith C.E. M.C. & S.E.M.C.P.H. and desired to shift these water supply lines in the front

of these houses. There are other 34 Areas where the pipe lines laid on the backcourt yard (List attached

as per Annexure A ) and need shifting of services in front of houses as and when required . But there is

severe problem in Sector-15 Cheep houses due to Developing of cracks and need immediate replacement

of water supply pipe lines in front side of houses.

Accordingly, the estimate has been prepared amounting to Rs.28.68 Lacs for Providing &

Fixing of D.I. Water supply pipe lines in front of Cheap houses. The existing pipe line in the back court

yards will be abandoned as these line can not be extracted. Necessary provision of D.I. pipe lines, CI

specials, road cuts, dismantling of cement conglomerate floor, sand filling etc has been taken in the

estimate. The provision of RCC pipe 8” i/d has also been taken in estimate as a sleeve piece due to

obstruction of sewer & storm main hole etc. The provision of M.S. pipe 4” i/d has also been taken in

estimate for road cut portion & at obstruction points.

The owneRs. have defaulted in constructing Pucca structures on the existing pipe lines

in the backcourt yard of the houses and hence created the additional impediment in repair work. The

matter is being taken up separately with DC cum Estate officer to take action against the

violatoRs./encroacheRs..

The laying of new water supply line in front of houses cannot be considered as wasteful

expenditure as the lines laid in at the back side of houses have outlived its life and the newly laid lines

will be accessible for repair and maintenance. The house owneRs. will have to take the water

connection from the front side at their own cost and the flat rate connections will be converted into

metered connections.

As such, an estimate amounting to Rs..28.68 Lacs duly allowed by the competent authority

is placed before the Finance & Contracts Committee for its consideration and approval. The

expenditure shall be chargeable to the Head:- 4215 (P) W/S & sanitation “Laying of add. pipe line”.

Subject: Payment for Hotline service for environment related complaints.

The Hotline service for environment related complaints has been launched on 15 th August

2009 in U.T., Chandigarh for registering and forwarding environment related complaints with the

approval of H.E. the Administrator, U.T, Chandigarh.

Chandigarh Pollution Control Committee (CPCC) has been designated as the Agency to

collect and forward one time charges of Rs.5.55 Lacs & recurring charges of Rs.40,500/- per month (one

time charges within 30 days i.e. latest by 14th September 2009 & recurring charges by 7th of every month)

from other departments & deposit the payment to M/s DOEACC. For making this service a success on

one time payment is to be equally borne by the beneficiary departments i.e. M.C., Chandigarh State

Transport Authority, Forest Department, Pollution Control Committee, DC Office, U.T., Chandigarh &

Police Department. There are six beneficiary departments and M.C., is also one among the others, as

such the share of M.C. Chandigarh i.e. one time payment Rs. 92,500/- along with recurring charges

Rs.3375/- (payment for ½ month of August 2009) totaling Rs. 95,875/- with addition of Service Tax

Rs.6009/- is required to the deposited to Member Secretary, Chandigarh Pollution Control Committee in

favour of M/s DOEACC.

Therefore, the agenda for depositing Rs.95,875/- alongwith Service Tax Rs.6009/- per

month from September 2009 duly allowed by the competent authority placed before F&CC for

consideration and approval.

An agenda item was placed before the General House of the Corporation in its 150th meeting held

on 29.1.2010 regarding management of Community Centres in Sector 19, 35, 21, 45, 15, 47 & Modern

Housing Complex, Manimajra. The resolution of the House is as under:-

“The House considered and resolved that this agenda be considered in the meeting of Arts, Sports and Culture Committee and necessary amendment in the terms & conditions should be made and brought before the House within one month, so that the House could consider it and necessary amendment could be made, if required.”

As per the decision of the House, the matter has been considered by the Arts, Sports and Culture

Committee and the report submitted by Brig.Kuldeep Singh Chandpuri, Chairman of the said Committee

is annexed as Flag “A” for perusal please.

The rates earlier proposed by the Booking Office, MC, are also annexed as Flag “B”.

The matter is placed before the Finance & Contract Committee for taking decision regarding the

functioning of Community Centre, Sector 11 & 35 as the public is pressing hard for early booking of

Community Centres.
