Subject: Providing and fixing of Multiplay equipments.

In the Finance & Contract Committee meeting held on 16.5.2011, it was desired by

the worthy Mayor M.C. that there is lot of complaints from various councillors that playing

equipments are not being fixed as contractual agencies are not completing the works in time and it

was further desired that status of playing equipments of all the wards be prepared and placed

before the General House. Accordingly, the status report has been prepared (Copy enclosed) and

placed before the General House for its information please.

Subject: Rough Cost Estimate for Providing and laying 40mm thick Bituminous Concrete on V-4 road in Sector 21, Chandigarh.

(Amount: Rs.38.74 lacs)

The V-4 road in Sector 21 has been inspected by the Executive Engineer, Roads Division

No. 1, M.C. along with the Sub Divisional Engineer, Roads Sub Division No. 1, M.C. and it is observed

that lot of cracks and pot holes have developed on the road surface, causing inconvenience to the public.

This road was last carpeted in the year October/2006 and is due for recarpetting.

Accordingly, this revised rough cost estimate amounting to Rs.38.74 lacs has been

prepared. The scope of work taken in this estimate is as under:-

1. Dismantling of PCC kerbs & channels.

2. Fixing of new / old PCC kerbs & channels.

3. P/L tack coat @ 3kg/10sqm

4. P/L 40mm thick Bituminous Concrete.

The expenditure on this work will be charged to head “4217 (P) – Roads and Bridges”.

The budget estimate, budget allocation, amount of already approved estimates and expenditure under

this head for Roads Division No. 1 is as under:-

I) Budget Allocation : Rs.900.00 lacs

II) Total amount of Spillover for works approved upto 31.3.2011.

: Rs.2041.97 lacs

III) Total amount of estimates sanctioned after 1.4.2011.

Subject: Rough cost estimate for providing and fixing 60 mm thick paver blocks on berms of V-6 roads, Sector 43-B, Chandigarh.

(Amount Rs.40.12 lacs)

Sh.Kuldeep Singh, Area Councillor inspected the V-6 roads of Sector 43-B, alongwith

the undersigned, Sub Divisional Engineers concerned of Roads Wing, Public Health Wing, Electrical

Deptt., Horticulture Wing in the presence of Residents Welfare Association of this Sector for carrying

out various development works. It has been desired by the Area Councillor and Residents Welfare

Association to provide and fix 60 mm thick paver blocks on berms along V-6 roads in Sector 43, where

sufficient space is available for walk ways to minimize congestion on road.

Accordingly, this rough cost estimate amounting to Rs.40.12 lacs with the

following scope of the work has been framed:

1. Dismantling of existing kerbs.2. Dismantling of existing channels.3. Earth work in excavation.4. Deduct for disposed soil.5. Carriage of earth by mechanical transport including loading and

unloading .6. Preparation of sub grade.7. Providing and laying in position 1:8:16.8. Fixing of old PCC kerbs.9. Fixing of old PCC channels.10.Providing and fixing new kerbs of size 2’-0”x9” having 4” thickness.11.Providing and fixing new channels of size 2’-0”x1’-0” having 3”

thickness.12.Providing and fixing 60 mm thick paver blocks with 20-30 mm on

sand.

The expenditure on this work will be charged under Head “4217 (P)Roads and

Bridges.” The budget estimates, budget allocation, amount of already approved estimates

and expenditure under this head for Roads Division No.3 is as under:-

Subject: RCE for Providing and laying tack coat and 25mm thick SDBC on V-6 road in Sector 8 A,B&C, Chandigarh.

(Amount: Rs.138.78 Lac)

The estimate for the above said work was administratively approved vide CEMC O/o No.

132 dated 15.4.2011 amounting to Rs.110.24 Lac. The work is allotted to the contractual agency and is

in progress. But the total amount of the estimate is enhanced due to difference in rates taken in the

approved estimate and allotted rates i.e. Rs.163/sqm to Rs.170/sqm and increase in the rate of bitumen

from Rs.33552/- to Rs.39005/- i.e. total difference of Rs.5453/-. Moreover, the area is also increased as

while the recarpetting of V-5 in Sector 8, some area is left inadvertently and not taken in the estimate.

Now, it is proposed that during the recarpetting of V-6 roads in Sector 8, the left out portion of V-5 road

be also recarpetted.

Accordingly, this revised rough cost estimate amounting Rs.138.78 lac has been

prepared. The scope of work taken in this estimate is as under:-

1. P/A tack coat @ 3kg/10sqm and 2.5kg/10sqm

2. P/L 50mm thick Bituminous Macadam.

3. P/L 25mm thick Semi Dense Bituminous Macadam.

The expenditure on this work will be charged to head “4217 (P) – Roads and Bridges”. The

budget estimates, budget allocation, amount of already approved estimates and expenditure under this Head

for Roads Division No.1 is as under:

i) Budget Allocation : Rs.900.00 lacs

ii) Total Amount of spill over works approved upto 31.3.2011.

for Roads Division No.1 is as under:

To consider and approve grant of permission/Licence to street vendors i.e. Cobbler (Mochi), Press Man, Cycle Mechanic, Tandoor Wala etc.,

It is submitted that the Municipal Corporation has been receiving re-presentation from Footpath Workers Union of U.T., Chandigarh regarding rehabilitation of Footpath workers. It has been intimated that there are 729 members of Cycle mechanics and Tea/Parontha wala. It has been requested that they may be issued licences as they are being challaned by the Enforcement Wing of the Municipal Corporation, Estate Office, Health Department, and the Police. It has been further requested that besides 729 licences, 40 beat box type booth should be constructed. It has also been requested that in each sector there should be 8 cycle repairers, 8 Barbers, 8 Mochi, 8 Tea Parontha, 8 Pan and Juice, 8 Fruit Sellers.

It is also submitted that the grant of new licences has been stopped from 1991 and the Chandigarh Administration has issued letter No.7393 dated 08.03.2010 (Annexure ‘A’. Secondly, the Govt. of India Ministry of Housing & Urban Poverty Alleviation, New Delhi has also sent a Model Street Vender’s (Protection of livelihood & Regulation of Street Vending) bill 2009 for adoption by the State Govt./Union Territories incompliance with the orders of Hon’ble Supreme Court of India. We have already made a reference to Secretary Local Govt., U.T., Chandigarh vide Memo No. Addl.CMC/Supdt(L)/2011/67 dated 23.03.2011 regarding implementation of the said bill in U.T. A meeting was also held under the Chairmanship of Secretary Local Govt., U.T., Chandigarh on 12.05.2011 and the ACMC-II had attended the meeting. The Municipal Corporation has been asked to conduct a survey of the location and type of work done by various footpath workers/pharri walas within a period of one month-copy of the proceedings is at Annexure-‘B’. Therefore, the Chandigarh Street Vendors (Protection of Livelihood and Regulation of Street Vending) Draft Bill, 2011 is being prepared by the Chandigarh Administration on the lines of Model Street Vendors (Protection of Livelihood and Regulation of Street Vending) Bill 2009 of the Government of India.

Subject: Absence of Sh. Kuldip Singh, Sh. Jatinder Bhatia and Smt. Rita Sharma, Councillors, Municipal Corporation, Chandigarh.

Sh. Kuldip Singh, Senior Deputy Mayor has informed that he has to go to out of India from

26th May, 2011 to 31st August, 2011. He has requested to excuse his absence for this period. (Annexure-

I)

Sh. Jatinder Bhatia, Councillor has informed that he has to go to out of India from

15.6.2011 to 15.8.2011. He has requested to excuse his absence for this period. (Annexure-II0

Smt. Rita Sharma, Councillor has requested that she has to go to out of India from July,

2011 to August, 2011. She has requested to excuse her absence for this period. (Annexure-III)

Subject: - Recarpeting of parking infront of Booth No.47 to 954 and SCF 1011 to 1028 and Roads infront of SCF 1 to 267 in Motor Market, Manimajra.

(Approx. Amount: - Rs.113.27 lacs)

The parking infront of Booth No.47 to 954 and SCF 1011 to 1028 and Roads infront of

SCF 1 to 267 in Motor Market, Manimajra was lastly carpeted in the year 9/2005. As per policy of

Municipal Corporation, the recarpeting is to be done after 5 years, which was due for

recarpeting during this year. The parking infront of Booth No.47 to 954 and SCF 1011 to 1028 and

Roads infront of SCF 1 to 267 in Motor Market, Manimajra was inspected by the Executive Engineer,

Roads Division No.2 alongwith Sub Divisional Engineer, Roads Division No.5, M.C and it has

been observed that lot of cracks and pot holes have been developed on the road surface,

causing inconvenience to the public. Accordingly a rough cost estimate amounting to Rs.113.27

lacs has been prepared for arranging administrative approval and allotment of funds. The

estimate includes the following scope of works.

1. P/L Tack Coat 0.30/kg/sqm

2. P/L Bituminous macadam

3. P/A tack coat 0.25 kg/Sqm

4. P/L 25mm thick SDBC

The expenditure on this work shall be charged under Head “4217 (P) Roads & Bridges”.

The budget allocation cost of already approved estimate and expenditure incurred under this head is as

under:

1. Budget allocation for the year 2010-11 Rs. 700.00 lacs

2. Total amount of estimate sanctioned after 1.04.11 Rs.159.92 lacs

3. The expenditure incurred during current

financial year Rs.399.95 Lacs

Subject: Estimate for B/I one no.12”x8” (304.80x203.20mm) i/d deep bore tubewell (with reverse rig method and any method of latest technology.) and Construction of R.C.C. U.G.R. of 1,00,000 Gallons Capacity along with boosting arrangement in Sector -29 C , Chandigarh.

The estimate has been prepared for B/I one no. 12” x8” (304.80 x 203.20mm) i/d deep

bore t/well and construction of U.G.R. of 1,00,000 Gallons Capacity along with boosting arrangement in

Sector -29 C (CBI & Press Colony), Chandigarh for feeding to distribution water supply system. The

necessity of this estimate has arisen due to low pressure complaints received from residents of Sector 29

C, Chandigarh. The drinking water dose not reaches at 1st floor and over head tanks. It is also noticed and

reported by the residents that the drinking water has to be carried by buckets in the summer season as well

as so many time in winter season from the last 1 to 2 years. It is further added that the Govt. Medical

Collage & Hospital Sector 32, Chandigarh is taking the water from the trunk main (16” i/d) which is

feeding to Sector 29, 30, 31,47, I/A Phase-I (Partial) and I/A Phase –II , Chd. The total Average

consumption of GMCH is about 13,00,000 Ltrs. To 15,00,000 Ltrs. Per day. The GMCH meets up his

daily requirement of water by adjusts the sluice valves, due to that the pressure could not maintained in

Sector 29-C, Chd. The area councillor has also requested to solve the low water pressure problem.

It has been proposed for B/I of 01 No. tubewell and construction of R.C.C. U.G.R. of

capacity 1,00,000 gallons with provision for the pumping machinery along with required number of

C.I./M.S. specials. Provision of D.I. & M.S. pipe taken in the estimate for connection to the U.G.R. with

distribution network. Provision for electricity connection charges and construction of pump chamber

alongwith toilet block has also been made in the estimate.

As such, an estimate amounting to Rs. 67.00 Lacs duly allowed by the competent authority

is placed before the General House of the Municipal Corporation for its consideration and approval.

The expenditure shall be chargeable to the Head:- 4215 W/S & sanitation (plan) providing new T/wells

& laying of additional pipe lines

SUPPLEMENTARY AGENDA ITEM NO. 2

Subject: RCE for Providing and laying 25mm thick SDBC on V-6 road in Sector 34 C, Chandigarh.

(Amount: Rs.56.47 Lac)

The widening of V-6 road in Sector 34 C is in progress and will be completed shortly. The

work of providing paver blocks around parks under pedestrian pathway scheme is also in progress.

These roads were earlier carpeted during June, 2007. The road was inspected by the E.E.R-1 and

noticed that condition of the road is very bad and it further deteriorated due to widening and fixing of

paver blocks. E.E.R.-1 is of the view that bad condition of road cannot be set right by applying patch

work, as such it becomes essential to recarpet the road. Some portion of V-6 road is badly damaged

due to slushy sub base, which will also be set right by relaying the same. Smt. Harjinder Kaur, Area

Councillor has also requested to recarpet the road as area looks quite shabby due to widening, fixing of

paver blocks and due to very bad condition of existing road.

Accordingly, this revised rough cost estimate amounting Rs.56.47 lac with the following

scope of work has be framed.

1. P/A tack coat @ 3kg/10sqm.

2. P/L 25mm thick Semi Dense Bituminous Macadam

3. Extra cost of bitumen due to recent increase by IOC.

The expenditure on this work will be charged to head “4217 (P) – Roads and Bridges”. The

budget estimates, budget allocation, amount of already approved estimates and expenditure under this Head

for Roads Division No.1 is as under:

i) Budget Allocation : Rs.900.00 lacs

ii) Total Amount of spill over works approved upto 31.3.2011.

: Rs.2041.97 lacs

iii) Total Amount of estimates sanctioned after 1.4.2011.

: Rs.677.79 lacs

iv) Total of Sr. No. 2 & 3. : Rs.2719.76 lacs

SUPPLEMENTARY AGENDA ITEM NO. 3

Subject:- Recruitment to the posts of SDEs in Public Health/B&R/Electrical/Building Branch.

After obtaining the approval of the Chandigarh Administration, to fill up 22 posts of

SDEs under direct recruitment quota, a public notice was published in the leading newspapers

on 4-6-2010. The last date to receive the application was 5-7-2010. The MCC in its 154 th

meeting held on 30-6-2010 vide agenda item no. 28 has decided as under:-

“The House considered & unanimously resolved that the advertisement given in the newspapers to fill the posts of SDEs be withdrawn. The office shall prepare a schedule of posts and draft its own recruitment rules within three months and bring before the House for approval.”

The abovesaid resolution passed by the House was sent to the Secretary Local

Govt., Chandigarh Administration vide memo no. SAE-3/Admn./MC/2010/7087 dated 16.8.2010.

In response, the Secretary Local Govt., Chandigarh Administration vide letter no.

6/1/582-FII(8)-2010/9148 dated 10-11-2010 (copy enclosed) has requested to intimate as to

how MCC intend to function effectively in the absence of requisite staff such as this and to take

effective steps these and other posts as desired by the Administrator, especially now that

additional functions have been transferred.

SUPPLEMENTARY AGENDA ITEM NO. 4Subject: Comprehensive Maintenance Contract for 3 No. Large Road Sweeping

Machines Model Dulevo-5000 from 8.4.2011 onwards.

A supplementary agenda item no. 1 was placed before the General House in its 166 th

meeting held on 21.4.2011 regarding Comprehensive Maintenance Contract for 3 No. Large Road Sweeping Machines Model Dulevo-5000 from 8.4.2011 onwards (copy enclosed).

During discussion in the General House, it was pointed out that how much out of contract amount of Rs. 36.99 lacs has been spent by the company during the said period on maintenance. After due deliberations, the agenda item was deferred for discussion in the next meeting.

The detailed information in respect of Road Sweeping Machines is given as under :-

1. Average hours run per day during CMC at present

: 7 hours excluding Sunday/Holiday and rainy day.

2. Average hours per day to be run as per CMC

: There is no condition imposed as to average per hour per day to be run as per comprehensive maintenance contract. The comprehensive maintenance contract will cover the maintenance/repair of complete machine without any hours’/days’ condition.

3. Cost of spare parts replaced due to wear and tear/break-down/ damage

: CH01G 2236 Rs.1,06,560.00CH01G 2237 Rs.3,05,360.00CH01 G 2238 Rs.1,28,710.00

Total cost of spare parts for all 3 vehicles

: Rs.5,40,630.00 inclusive of VAT @ 13.5%

4. Any other information which is relevant

: 1) Service Engineer will provide preventive maintenance.2) Service Engineer will attend complaint within 24 hours to make its operational.3) In case of not attending the complaint after a day, will attract the penalty equivalent to Rs. 4000/- per day.

5. What is annual maintenance contract and value per year per vehicle

: AMC will not cover supply of any spares as required during the contract as a result of wear and tear. All spares have to be procured on need basis by the M.C. at extra cost and value of each vehicle is 4% of the basic value of the machine i.e. equivalent to EURO 7200 INR.

6. What is comprehensive maintenance contract and value per year per vehicle.

: Comprehensive Maintenance Contract will cover supply of all the spares as required during the contract for running of the machine(except accident) will be provided on free of cost basis in the CMC Annex. 2 gives the list of spares which are part of CMC. The value per machine per vehicle is 10% of the basic value of the machine i.e. equivalent to EURO 18000 INR.

The matter is placed before the General House for consideration and approval please.

Subject: Comprehensive Maintenance Contract for 3 No. Large Road Sweeping Machines Model Dulevo-5000 from 8.4.2011 onwards.

It is submitted that Municipal Corporation Chandigarh had procured 3 No. of Large Road Sweeping Machines from M/s Dulevo International Spa, Italy in the year 2008. The said machines remained under guarantee/warrantee till 31st August. 2009. An agenda was placed before the General House of Municipal Corporation Chandigarh with the rates of Comprehensive Maintenance Contract and Annual Comprehensive Maintenance Contract as per the terms and conditions of the company. General House of Municipal Corporation Chandigarh in its 152nd meeting held on 26.3.2010 taken following decision:-

“The House considered and resolved that the proposal to give Annual Comprehensive Maintenance Contract for 3 Road Sweeping Machines Model Dulevo-5000 Evolution to M/s Dulevo India Private Limited, B -116, Sector 5 Noida @ Euro 18000 considering 1 Euro INR 68.5 i.e. INR Rs. 12,33,000/- per machine at a total cost of Rs.36,99,000/- + Service Tax, be and is hereby approved.”

As per the approval of General House, Annual Comprehensive Maintenance Contract was given to M/s Dulevo India Private Limited, B -116, Sector 5 Noida for a period of one year which will expire on 8.4.2011. The services of the Company remained satisfactory during the said contract and the machines remained functional without any breakdown.

It is proposed that Annual Comprehensive Maintenance Contract be renewed for another one year on the same terms and conditions to maintain the continuity of proper services. However, the value of 18000 Euro will be calculated from the day of renewal of contract i.e. the value of EURO as on date is Rs. 60.63 INR i.e. INR Rs.1091340/- per machine and at the total cost of Rs. 3274020/- + service tax for 3 No. Large Road Sweeping Machines.

Sanawar Montessori School Sector 11 Chandigarh filed a writ petition in Hon’ble High Court of Punjab & Haryana i.e. CWP No. 5144 of 2007 against Chandigarh Administration through Chief Engineer, Capital Projects, Deluxe Building, Sector-9, Chandigarh. Municipal Corporation through Medical Officer (Health), UT, Sector-17 30 Bays Building, Chandigarh & Chief Architecture, Chandigarh Administration, Deluxe Building, Department of Urban Planning Sector-9, Chandigarh through it’s Principal Smt. Harjeet Sehgal in High Court of Punjab and Haryana on grounds as below:

“Civil writ petition under article 226/227 of the Constitution of India for the issuance of a writ of mandamus for directing the respondents to remove the Sehaj Safai Kendra (SSK), Sector 11-A, Chandigarh which falls between the two schools i.e. petitioner’s School and Government School, Sector -11, Chandigarh, resulting into the blockage of Cycle Track which is in existence for more than three decades as per the Annexure P-1 and further resulting into permanent foul smelling, mosquitoes, flies breeding and pollution of air which is a fundamental right of the children granted under Article 21 of the Constitution of India as observed by the Hon’ble Supreme Court of India in M.C. Mehta’s case.

During the hearing of CWP No. 5144 of 2007, vide order dated 25.03.2009 it was observed that the foul smell emanating from the waste garbage lying in the bins of SSK may adversely affect the health of tiny tots studying in the adjoining school. The Medical Officer of the respondent-Municipal Corporation, who was present in court, assured that necessary remedial steps in this regard shall be taken immediately. In compliance thereto, vide order No. MOH/OSD/2009/24 dated 01.04.2009) a protocol was prepared and submitted in the Hon’ble High Court of Punjab & Haryana on 15.05.2009 which is reproduced as under :-

1. The area Sanitary Inspector will be over all responsible for the upkeep and maintenance of Sehaj Safai Kendras and will inspect the same on daily basis as to solid Waste Management.

2. The area Chief Sanitary Inspector will monitor the Sehaj Safai Kendras on every alternate day.

3. Area Health Supervisor will inspect the Sehaj Safai Kendras in his area on weekly basis.

4. The Inspection Register will be maintained at each Sehaj Safai Kendras and the Inspection Note will be given by the supervisory staff for its compliance by the area Sanitary Inspector.

5. House to House Garbage collectors/individuals are to be educated to put their refuse properly in the bin.

6. The littered garbage if any is to be swept and put by the Safaikaramcharies deputed in the said Sehaj Safai Kendra immediately and at no account the same should be found littered outside the bin.

7. The lids of the bins should be closed. However, if the bin lids are missing the same should be got replaced immediately by intimating the Sanitary Inspector (Vehicles) so that the refuse does not remain open to flies/crows etc.

8. The Sehaj Safai Kendras should be washed, mopped on daily basis at least three times a day in order to ensure cleanliness.

9. The tools/instruments etc. used for the maintenance of Sehaj Safai Kendras should be stacked at a proper place in order to avoid any shabby appearance.

10.The Gates of Sehaj Safai Kendras (Big/small) should remain closed throughout the day so that stray animals do not enter the Sehaj Safai Kendras. However, the main gate should be opened only for the conservancy vehicles deputed and a small gate for to and fro movement of the public/staff on duty.

11.Anti-fly measures should be taken by each Sanitary Inspector in consultation with the Entomologist-cum-Parasitologist and necessary spray pumps/insecticides should be procured and the same should be sprayed at frequent intervals in the Sehaj Safai Kendra.

12.The area Health Supervisor will take all maintenance work with the Engineering Wing of Municipal Corporation, Chandigarh under intimation to the MOH office so that all repairs/maintenance work is carried out immediately in respect of Sehaj Safai Kendras.

The above said CWP No.5144 of 2007 was disposed off by the Hon’ble High Court vide order dated 15.05.2009 with following observations.

“Suffice it to say that the Sejah Safai Kendra is one of the essential services need to be provided to the residents of every sector in Chandigarh as that is the only place where the entire garbage, collected from different houses is dumped temporarily before it is taken to the dumping ground outside the city on the same day. The Sehaj Safai Kendra has to be, therefore, essentially located within the sector only to maintain the hygienic conditions in the city. The Petitioner’s prayer for shifting of Sehaj Safai Kendra away from the school, when no other suitable alternative site has been pointed out, cannot be entertained.”

The writ petition is accordingly disposed of with a direction to the respondent – Corporation to meticulously comply with the order dated 01.04.2009, referred to above.

The petitioner has also made some grievance regarding construction of wall of the Sehaj Safai Kendra. It is directed that the wall, if any, be constructed/raised as per the sanctioned site plan.

Municipal Corporation, Chandigarh is strictly implementing the protocol dated 01.04.2009 as per orders dated 15.05.2009 passed by Hon’ble High Court of Punjab & Haryana.

Sanawar Montessori School, Sector-11 Chandigarh through its Principal Smt. Harjeet Sehgal filed a LPA No. 249 of 2010 against Chandigarh Administration through Chief Engineer, Capital Projects, Deluxe Building, Sector-9 Chandigarh, Municipal Corporation through Medical Officer of (Health), UT, Sector-17 30 Bays Building, Chandigarh & Chief Architecture, Chandigarh Administration, Deluxe Building, Department of Urban Planning Sector-9 Chandigarh on the grounds as below.

“L.P.A undersection 10 of the L.P Act for set aside the orders dated 15.05.2009 passed by Hon’ble Mr. Justice Surya Kant, wherein it has been observed by the Hon’ble Court that the petitioner’s prayer for shifting of Sehaj Safai Kendra away from school, when no other suitable alternative site has been pointed out, cannot be entertained. Apart from this, the other prayers to remove 2feet high wall which has been raised against the natural flow of the rain water and regarding construction of pucca road in front of petitioner’s school as per the lay out plan, have not been discussed.

During the hearing of above said case on 31.01.2011, the Hon’ble High Court of Punjab & Haryana passed orders to submit such alternative methods of garbage disposal that may be considered feasible by the Corporation in the form of Status report.

By complying the orders of Hon’ble High Court of Punjab & Haryana, a status report was submitted on dated 11.03.2011. A copy of status report submitted in Hon’ble High Court of Punjab & Haryana on dated 11.03.2011 is annexed at X-1 and Hon’ble High Court of Punjab & Haryana passed the orders on dated 11.03.2011 which are reproduced as under:

“We have perused the status report filed by the Municipal Corporation containing the perceptions of the Corporation with regard to garbage disposal in the city of Chandigarh. The Chandigarh is a small city having a minimum population compared to other cities of the country and over and above all that it is an organized city having well planned sectors. It is inconceivable that in a city like Chandigarh, citizens should be heard to complain about inadequacies in system of garbage disposal. Such problems arise due to the present method of maintaining collection centres where garbage is deposited by the resident at any time of the day and the night and collection and removal thereof from such collection centres though sought to be regulated takes place several hours after the garbage is deposited. The consequential decay in the sort of garbage poses a health hazard towards residents, particularly those residing in the immediate vicinity of the collection centres. We have also perused the measures suggested by the Corporation which have been taken on record by the learned Single Judge and marked with the letter ‘A’. We are not entirely satisfied that what is being recorded in the said document is containing effective methods of garbage disposal.

In the aforesaid circumstances, the Municipal Corporation is directed to seriously reconsider what would be immediate effective measures that can be implemented without bringing in other agencies/departments into picture which is what has been suggested in the status report. Though it is for the Corporation and the residents themselves to provide a solution to the problem of garbage disposal and the role of the Court in such matters has to be avoided unless absolutely necessary, we are of the view that the Corporation should seriously consider implementation of a method by which each resident is made responsible for how the garbage of his household which can be emptied to the garbage disposal trucks has to be operated in specified hours instead of emptying the same into the garbage collection centres that are now in existence. What has been suggested above need not be the final word in the matter and if more effective methods of garbage disposal can be received by the Corporation, it will always be open for the Corporation to adopt such methods. We would expect necessary action in terms of the present directions to be taken by the

Corporation and the result thereof be laid before the Court at the end of four weeks from today.”

The said case is fixed for hearing on 30.5.2011.

The agenda was placed before the General House of Municipal Corporation, Chandigarh in its meeting held on 20.05.2011 after approval from Commissioner, Municipal Corporation Chandigarh for its consideration and directions.

It was decided in the meeting of General House of Municipal Corporation, Chandigarh that the agenda be put up in the Sanitation Committee meeting first.

The matter was placed before the Sanitation Committee in its meeting held on 31.5.2011 for its consideration and approval and the Sanitation Committee resolved as under (copy of Minutes enclosed):

“The Committee after deliberations unanimously resolved and approved to carry on the present system of garbage collection and removal. The other sites for Sehaj Safai Kendras be proposed. It was desired that the sanitation status of Sehaj Safai Kendra of Sector 11 as well as of all other Sehaj Safai Kendras should be maintained properly and pesticidal spray should be done regularly. Sh. Pardeep Chhabra proposed that Sehaj Safai Kendras should be looked after by the Outsourcing Agency. The Committee unanimously resolved and approved the same.”

The said case is fixed for next hearing on 11.7.2011.

The directions issued by the Hon’ble Punjab & Haryana High Court, Chandigarh regarding effective methods of garbage disposal have to be complied with. The matter is placed before the General House for its consideration and decision please.

Annexure-X-1

Status report is regarding Methods of Garbage Disposal System within Municipal limits of Chandigarh is as under:-

Municipal Corporation, Chandigarh is implementing the principles enlisted in the notification issued by Ministry of Environment and Forest vide No. S.O.908(E) dated 25.09.2000 for Municipal solid Wastes(Management and Handling Rules, 2000) within the territorial area of municipal limits as per the provisions of these rules and for any infrastructure development for collection, storage, segregation, transportation, processing and disposal of municipal solid wastes.

System of disposal of garbage before project sanctioned by Central Pollution Control Board (CPCB) before 2003.

That upto the year 2003, the sanitation i.e. the garbage collection within the sectors was being done by keeping specified number of garbage bins in different parts of the sectors according to their requirement and the said garbage bins were being picked up with the help of tractor trolley or dumper placer as the case may be and the garbage/waste was being transferred to the dumping ground. It would be pertinent to mention here that as per the said system a particular garbage bin was being picked up after a gap of every 3-4 days or as and when filled and most of the garbage bins were being kept on kacha ground. As such the garbage kept in the garbage bins used to spread foul smell in the vicinity and sometimes due to rains the garbage was spreading foul smell causing inconvenience to the residents of the area and there was also a huge problem of stray cattles i.e. cows, dogs etc on each garbage bins placed in open space.

Need for the Project:-

Management of Municipal Solid Waste (MSW) was posing a serious problem to the Chandigarh Municipal Corporation. Solid waste arising out of domestic, horticulture, commercial, industrial and hospital activities was disposed by the people partly at the assigned places e.g. garbage bins and partly on the unauthorized places i.e. open spaces. Although the Chandigarh Municipal Corporation was committed to sanitary disposal of solid waste, the problem appeared to be formidable.

The general practice of disposal of MSW was to dump it on open land and let it undergo natural decomposition. Such practice did no cause much of an inconvenience in

early days as population was less and more free land was available. Now due to serious population explosion and rapid urban agglomeration and the free land for garbage disposal had become scarce. The dumped sites were also found to be congenial for growth of bacterial including pathogenic varieties. Careless dumping also led to contamination of surface water as a result of mixing with leachate containing noxious chemicals and bacteria. The toxic gases produced by the garbage like methane also polluted the environment.

Implementation of Central Pollution Control Board (CPCB) Project:-

Keeping in view the problem of garbage in city a Detailed Project Report for setting up model facilities for management of Municipal Solid Waste for implementation of Municipal Corporation solid Waste (Management & Handling) Rules, 2000 in Chandigarh was prepared by Municipal Corporation, Chandigarh in February, 2003 and was submitted to Central Pollution Control Board New Delhi.

On the basis of Detailed Project Report submitted by Municipal Corporation, Chandigarh the Central Pollution Control Board (Ministry of Environment & Forests) New Delhi sanctioned a Project called as Central Pollution Control Board (CPCB) Project vide Letter No. F.No. B-11012/29/PCP/MSW/2003 dated 27.03.2003 for setting up of model facilities for management of municipal Solid waste for implementation of Municipal Solid Wastes (Management and Handling) Rules, 2000 and a Memorandum of Understanding (MoU) was also signed in March, 2003.

For implementation of Central Pollution Control Board (CPCB) Project, funds was contributed by Central Pollution Control Board, Municipal Corporation, Chandigarh and Chandigarh Administration in the ratio of 50%:30%:20%. The funds were expended for collection, segregation and mass awareness, street sweeping, storage, transportation, intracity Activities etc. Storage facilities named as Sehaj Safai Kendra’s (SSK’s) were also constructed by Municipal Corporation, Chandigarh under this Project on the following 31 Nos. sites earmarked by Chief Architect UT, Chandigarh:-

However, the further Sehaj Safai Kendra’s are being constructed by the Municipal Corporation, Chandigarh at its own cost. The sector in which the Sehaj Safai Kendra (SSK) have been constructed/Setup the garbage bins kept at different places for collection for garbage within the said sectors have been removed and said sectors have been made bin free.

Each Sehaj Safai Kendra (SSK) is surrounded by boundary wall of about 6 feet with two iron gates i.e. the larger one for entry of vehicles for picking up garbage bins and the smaller one for entry of rickshaw/rehris and its entire floor is made of cement concrete with a sewerage connection and a provision for water supply. There are two segregation platforms within the building having R.C.C. roof and apart from the said platforms a garbage bin(s) are kept on the concrete floor. The larger gate of the Kendra normally remains closed and is opened for the to and fro movement of the garbage removal vehicles for picking up to garbage bins kept in the Kendra. It would be pertinent to mention here that the garbage/waste is collected from various parts of the sector is received in the Kendra, the same is immediately put in the garbage bins kept in the said building and the said garbage bins are picked up by the garbage removal vehicles for transferring the same to the dumping ground 3 to 4 times in a day as and when the garbage bin is filled up, leaving no chance for decomposition of the garbage and giving no room for the garbage/waste to emit foul smell.

Municipal Corporation, Chandigarh is implementing the principles enlisted in the notification issued by Ministry of Environment and Forest vide No. S.O.908(E) dated 25.09.2000 for Municipal solid Wastes(Management and Handling Rules, 2000) within the territorial area of municipal limits as per the provisions of these rules and for any infrastructure development for collection, storage, segregation, transportation, processing and disposal of municipal solid wastes as per details given below:-

Collection of Municipal Solid Wastes

The house to house collection of municipal solid wastes have been organized by involving NGOs/resident welfare associations/individuals and the same is being taken to the designated collection points for garbage i.e. Sehaj Safai Kendra’s(SSKs)/Garbage Bins (Central Bin) and the same is also being made applicable for the commercial markets. The door to door collectors segregate the same and the Garbage from Sehaj Safai Kendra’s(SSKs) is being transported through dumper placers/tractor trolleys 3 to 4 times in a day to the Garbage Processing Plant/Dumping Ground. The Slaughter House wastes are being used in the bio-methonation plant and produces electricity for its self consumption. The commercial markets are made to take the services of the service providers for disposing their wastes and the same is being used by them for preparation of feeds. The bio-medical wastes are being taken care by the Chandigarh Pollution Control Committee and the same is being lifted from the health facilities for incineration and disposal as per the Bio-Medical Wastes Management And Handling Rules 1998.

The cycle rickshaw carts are made available to the Safaikaramcharies of Municipal Corporation, Chandigarh for transferring the solid wastes to the Sehaj Safai Kendra’s (SSKs)/central bin and similar carts are being used by the door to door collectors. The horticulture wastes are also removed by the tractor trolleys from the public places as residential areas along with the dry leaves. Special arrangements are made for engaging private tractor trolleys during the season for horticulture wastes/dry leaves. Strict action is initiated against the officials found burning of dry leaves and information, education and communication activities (IEC) is done for awareness of general public.

The stray animals are being checked under the provisions of Stray Cattle Act and animals are impounded and released on the basis of the fine.

The segregation of municipal solid wastes is being made applicable by educating the residents by way of sanitation campaigns, pamphlets, stickers. Partnership Initiative Programme(PIP) is being carried out by taking the help of NGOs and School Education Programme is being undertaken for educating the children in order to bring change in the mindset and public behaviour.

A. Storage of Municipal Solid Wastes

The storage of municipal solid waste has been made effective by placing garbage containers at appropriate places for depositing the solid waste collected through cycle rickshaw carts and the same are being lifted on daily/alternate/weekly based on the solid waste generated in the area and deposited.

B. Sehaj Safai Kendras

The Govt. of India under a pilot project under Central Pollution Control Board sanctioned the grant in the ratio of 50% by Central Pollution Control Board, 30% by Municipal Corporation, Chandigarh and 20% by Chandigarh Administration Vide letter dated 27.03.2003 and signed Memorandum of Undertaking(MOU) between Central Pollution Control Committee(CPCC) and Municipal Corporation, Chandigarh in March 2003 for collection, segregation, Storage, transportation, Processing and disposal of Municipal Solids Waste. Storage facilities named as: Sehaj Safai Kendras in Chandigarh on the sites earmarked by the Chief Architect, U.T., Chandigarh is being constructed by the Municipal Corporation, Chandigarh and 31 No. Sehaj Safai Kendra’s were constructed under Central Pollution Control Board (CPCB) Project. The main concept for infrastructure of Sehaj Safai Kendras is based on the design so that the stored municipal solid waste is not exposed to open and is aesthetically acceptable and is user friendly. The storage facility having 2 to 3 bins each is easy to operate, handle, transfer and transport the waste and is being maintained by a protocol framed by the Municipal Corporation, Chandigarh.

C. Transportation of Municipal Solid Waste

The most effective transports are made available by way of dumper placers as they are fast moving and lift the garbage containers to be replaced by the empty at first instance and the vehicles are made to lift the earmarked garbage containers as per the schedule and to take the same to the Garbage Processing Plant/Dumping Site.

The horticulture waste/dry leaves/open points are attended by the tractor trolleys/trucks (compactors) and the same is covered at the top for not making the same visible to the public nor expose to the open environment preventing their scattering.

D. Processing of Municipal Solid Waste

Municipal Corporation, Chandigarh has established garbage processing plant on Built Operate Own Basis (BOOT) with private entrepreneur on the technology of converting garbage into Refused Derived Fuel (RDF) although the same is still in the stabilizing mode. The wastes not accepted by the plant is dumped in the dumping site.

E. Disposal of Municipal Solid Wastes

The organic wastes, inert waste and other waste that are not suitable either for re-cycling or for biological processing are given the coat of Effective Micro Organism & micronutrients (E.M. Solution) which takes care for smell and fly nuisance and thereafter, given the coat of earth layer / malba for which, the machinery deployed at site.

F. Information, Education and Communication Activity (IEC)The solid waste management is one of the challenging tasks to bring change in the mindset and public behaviour for which sustained efforts are being made by the Municipal Corporation, Chandigarh in active support by the NGOs/resident welfare associations and individuals. The various initiatives initiated by the Municipal Corporation i.e. daily informative scroll on the Siti Cable, Big 92.7 FM, Sanitation Campaigns, Partnership Initiative Programmes, School Education Programme and education of Safai Sewaks etc. apart from monitoring thereof.

Municipal Corporation, Chandigarh has been adjudged as first as to efficiency of garbage disposal, clean record, participation of municipality, cleanliness of roads, dust bin in public places by the survey conducted by ORG – A.C. Nielson in year 2007. The Ministry Of Urban Development, Govt. of India during the year 2009 -10 has again adjudged Chandigarh as 1st city in the country in solid waste management scoring 73.48 points, whereas Mysore has placed as 2nd and Surat as 3rd on the basis of National Rating Survey Data on city sanitation data. The declaration of the same was held in Vigyan Bhawan, New Delhi on 10.05.2010.

The innovative projects/schemes available are being studied to further strengthen the prevailing system and simultaneously mechanizing. The awareness is being done to bring the change in public behavior.

The estimate for providing and laying tack coat and 25mm thick SDBC on V-6 roads in

Sector – 15-A, B C & D, Chandigarh, was administratively approved vide C.E.M.C. o/o No. 304 Dated.

26.8.2010 amounting to Rs.118.29 lac. The work of laying SDBC is in progress but the amount of the

estimate is going to enhance due to difference of allotted rate of SDBC and rates taken in estimate

i.e. Rs. 170/- per sqm and Rs. 155.55/- per sqm and increase in rate of bitumen from Rs.33,552/- to

Rs. 40448.96/- i.e. Rs. 6896.96/-per M.T. Accrodingly the revised estimate amounting to Rs.139.78 lac

has been prepared by the office with the following scope of work:

1. P/A tack coat @ 3 Kg.

2. P/L 25mm thick SDBC.

The expenditure on this work will be charged to “ 4217 (P) Roads and Bridges) . The

Subject: RCE for providing and fixing 80mm thick interlocking paver blocks on internal roads of Charan Singh Colony, Mauli Jagran, Chandigarh.

The internal roads of Charan Singh colony were inspected by the E.E. Roads Division

No.2 and Sub Divisional Engineer concerned and noticed that in these roads plying of paver machine

and road rollers are difficult on turns, as such, recarpetting of bituminous layer will not be

effective/durable, as such the road constructed with the paver blocks will be more suitable under

prevailing site conditions. Accordingly the rough cost estimate amounting to Rs.58.37 lacs has been

prepared by the office with the following scope of work:

1. Providing and fixing PCC kerbs and channels.

2. P/L cement concrete 1:8:16 for restoration of pot holes.

3. P/F 80mm thick interlocking paver blocks over 20-30mm thick compacted bed of course sand.

Accordingly the rough cost estimate amounting to Rs.58.37 lacs has been framed. The

expenditure on this work will be charged to “4216 (P) Services to Rehabilitation Colonies”. The budget

estimates, budget allocation, amount of already approved estimates and expenditure under this head for

Roads Division No.2 is as under:

Subject: Regularization of expenditure for the purchase of 3 Nos. of Large Mechanical Road Sweeping Machine Dulevo-5000.

It is submitted that Agenda was placed before the General House of Municipal

Corporation Chandigarh in its 164th meeting held on 28.2.2011 for regularization of the

expenditure of Rs.17,85,427/- incurred in excess for the purchase of 3 No. of Large

Mechanical Road Sweeping Machines Dulevo-5000. The House resolved that the matter be

discussed by the Sanitation Committee first.

Accordingly, the agenda was placed before the Sanitation Committee for consideration and approval. The Sanitation Committee in its meeting held on 18.4.2011 discussed the matter in detail and unanimously resolved as under:

“Since the procurement was ongoing process and rate of Euro fluctuated from time to time along with statutory payments i.e. taxes/duties, the total cost comes to Rs.5,42,63,354/- thereby enhancement of Rs.32,63,354/- excluding the refund amount Rs.14,77,927/- lying in LOC to Municipal Corporation Chandigarh which needs assistance of the House for regularization of expenditure. After deducting the unspent balance Rs.14,77,927/- lying in LOC to the Municipal Corporation, Chandigarh, the Sanitation Committee has approved and regularized the expenditure incurred in excess of provision. However, the burden on the exchequer comes to Rs.17,85,427/- after the adjustment of refund amount.

It is further added that this office has refunded Rs.14,77,927/- the balance amount lying in the LOC.”

The estimate for the above said work was administratively approved vide CEMC O/o No.

412 dated 9.12.2011 amounting to Rs.52.40 Lac. The work is allotted to the contractual agency and is in

progress. But the total amount of the estimate is enhanced due to difference in rates taken in the

approved estimate and allotted rates i.e. Rs.163/sqm to Rs.170/sqm and increase in the rate of bitumen

from Rs.33552/- to Rs.40448- i.e. total difference of Rs.6896/-.

Accordingly, this revised rough cost estimate amounting Rs.66.60 lac with the following

scope of work has be framed.

1. P/L tack coat.

2. P/L 50mm thick Bituminous Macadam.

3. P/L 25mm thick Semi Dense Bituminous Concrete.

The expenditure on this work will be charged to head “4217 (P) – Roads and Bridges”. The

Subject: Issuance of Gur to Safaikaramcharies.

Safaikaramcharies Union demanded to provide 5 Kg. Gur per month to maintain their health as they are working under the unhygienic condition. The demand was discussed in the meeting held by Worthy Mayor, MCC with the President and other members of Safaikaramcharies Union O/o MOH, MCC on 09.05.2011 at 11.00 A.M. in the Committee Room of MCC. In the meeting, Addl. CMC-I, Addl. CMC-II and MOH were present. It was recommended that 1 Kg. Gur per month may be provided to each Safaikaramchari.

It is submitted that there is no provision for providing Gur to the Safaikaramcharies in neighboring states. It is submitted that there are 1300 Safaikaramchari are on regular basis who are eligible and there will be financial implication of Rs. 6,24,000/- annually i.e. @ Rs. 40/- per kg. approximately.

Subject: Regarding enhancement in the rate of Uniform.

The President sweeper Union has given representation to enhance the rates of Uniform being supplied to Safaikaramcharis. On representation of Sweeper Union, worthy CMC constituted a committee comprising of Additional Commissioner, Chairman alongwith M.O.H, Municipal Corporation Chandigarh and Chief Accounts Officer, Municipal Corporation Chandigarh as member to examine the prevailing rate of U.T. Chandigarh and Punjab & Haryana.

After deliberation, it was felt by the Committee that rates prescribed for the uniform by the Chandigarh Administration vide their letter no. 24/1/2/4-HIII(7)-04/18446 dated 2.9.1994 are very old and these rates cannot meet with the requirement of quality of uniform. There has been considerable inflation in the cost of raw material, stitching charges as well as rates of chappals/sandals which would affect the quality of uniform.

The Committee felt that the rates of uniform which are being given by the Punjab & Haryana High Court to the eligible staff appear to be reasonable and recommended that these should be followed and the pattern of supply of uniform every two years be followed.

It is pertinent to mention here that presently the safaikaramcharies are being provided uniform as per prevailing rate of Punjab Govt. adopted by Chandigarh Administration. The matter regarding uniform was taken up to enhance the prevailing rate of Punjab Govt. at par with the rates of Punjab & Haryana High Court.

Worthy Mayor has desired to place the matter before the General House. Therefore the matter regarding enhancement of rate of Uniform at par with the Punjab & Haryana High Court is placed before the General House.
