Item No 2: Status Report on the Exempted establishments

of Kolkata, Jalpaiguri, Jharkhand & North East Regions

KOLKATA:-

Kolkata region having its Regional Office at Salt Lake, Kolkata and SubRegional Offices at Park Street, Howrah, Barrackpore, Durgapur andPort Blair has a total of 431 exempted/relaxedestablishments{Annexure-A), having membership of 476988.-

-Compliance:-

During the 2009-10 Compliance audit in respect of 384 establishments

was conducted out of which 205 establishments were found to be

violating one or more conditions of exemption Annexure- 8,& C) ,

whereas 26 establishments had defaulted in the payment of

dues(Annexure-F). Actions including initiation of enquiry u/s 7A, issue

of show cause notices u/s 14 and for withdrawal of relaxation as well as

recommending cases for cancellation of exemption were initiated by the

RPFCs against all violators. The replies received to the show cause

notices were examined and appropriate actions have been initiated in a

number of cases. Further in a few cases the replies to the show cause

notice are under examination for initiating necessary action as per the

provisions of the Act and Scheme.

Out of 75 relaxed establishments, Kolkata region has submitted 32

proposals for grant of exemption to Head Office which are being

processed (Annexure- D).The remaining proposals have not been

-recommended either because they are lying closed or have not

submitted their complete proposals.

Cancellation of Exemption:-

-

During the year 2009-10 action for cancellation of exemption or

withdrawal of relaxation was initiated against 97 establishments which

were found to be violating one or more conditions of exemption. Out of

these 97 cases in 36 cases (Annexure - E) exemption/relaxation has

already been cancelled/withdrawn by the appropriate authority after

following the due procedure. Further in respect of 41 establishments

(Annexure G), Head office, EPFO after due approval of the competent

authority has forwarded the cancellation proposals to the appropriate

authority for further necessary action.

The remaining 20 proposals submitted to Head Office are under

process and are being examined and after approval shall be forwarded

to the appropriate authority. (Annexure - H)

-It may be mentioned here that Head Office , EPFO has streamlined the

procedure for cancellation of exemption and a circular dated 30.07.09

was issued clearly mentioning the procedure and documents required

for the purpose, accordingly RPFCs have been submitting complete

cancellation proposals which has helped in expediting the action for

cancellation of exemption.

JALPAIGURI:-A, Jalpaiguri region having RO at Jalpaiguri and a Sub Regional Offices at

Siliguri, Oarjeeling and Jangipur , has a total of 10 exempted/relaxed

establishments, having membership of 5209 members.(Annexure-A).

Out of these 10 establishments, 6 establishments are exempted u/s 17

and the remaining 4 establishments are relaxed u/p 79.

Compliance:-

After the compliance audit of the exempted establishments conducted

during 2009-10, 04 establishments were found to be violating various

conditions of exemption (Annexure-B&C). All the four establishments

had failed to achieve the pattern of investment prescribed by Ministry of

Labour, Government of India and accordingly advisory letters were

issued to follow and achieve the pattern in the next financial year.

"'"During the compliance audit it was found that four establishments had

defaulted in the payment of dues to the trust and EPFO (Annexure-F)

accordingly action u/s 7A has already been initiated against all the four

establishments. FIR u/s 406/409 and prosecution action u/s 14 has also

been initiated against MIs NBSTC for failure to deposit the employees'

share after deduction.

Grant of Exemption:-

Regional Office Jalpaiguri has forwarded 2 cases for grant of

exemption to Head Office which are under process (Annexure D). As

regards the remaining' two establishments, M/s North Bengal State

Transport Corporation is a defaulter establishment and hence its

proposal has not been forwarded to Head Office while MIs Sila Foams

(P) Ltd. has not submitted the required documents for grant of

exemption.

t JHARKHAND:-

, Jharkhand region with its Regional Office at Ranchi and Sub R~gional

Office at Jamshedpur has a total of 73 exempted/relaxed

establishments, having a membership of 156010 members. (Annexure-

A). Region has 50 establishments which are exempted u/s 17, five

establishments are exempted u/p27 A and 18 relaxed establishments.I

Compliance:-

After the last compliance audit, violations of the conditions of exemption

were noticed in 06 establishments. (Annexure- B & C)

In respect of MIs HEC (JH/1465) the establishment was found to be

violating condition no 25 of para 27AA of the EPF scheme'52. As the

establishment is still a relaxed establishment, show cause notice for

withdrawal of relaxation has been issued to the establishment by the

RPFC on 30.08.10.

Further in respect of five other establishments show cause notices for

withdrawal of relaxation has been issued ,as violation of condition no

29 of para 27M of the EPF scheme 1952 (i.e. Change in legal status

due to amalgamation, merger, demerger etc), was noticed in their

cases and accordingly appropriate action as prescribed under the said

para has been initiated.

Although no establishment was found to be defaulting in the deposit of

dues to the trust or EPFO, MIs IFFCO-SAIL Ltd Ramgarh has not

deposited the monthly and yearly returns (Fonn 7PS & 8PS) for the last

two years for which a show cause notice has been issued to the

establishment (Annexure-F).

Jharkhand region is having 18 relaxed establishments (u/p79 of the

EPF scheme '52). Out of these 18, exemption proposals in respect of

05 establishments are pending with the Government of Jharkhand, for

grant of exemption (Annexure- D) and in the remaining cases proposals

have been submitted to Head Office which are being processed.I,....."

Proposals of MIs TRF Itd (JH/1302) and MIs Bihar Sponge (JH/12557)

for grant of exemption were put up before the CBT during its 189th and

190th meetings held on 09.04.10 and 15.09.10 respectively. While the

minutes of the 190th meeting are awaited, it was decided during the

189th meeting that the proposal of MIs TRF Itd shall be re-examined by

the RPFC in view of the observations raised by Sh. M.J. Rao, Hon'ble

Member CBT, accordingly the case has been referred to RPFC

Jamshedpur for a thorough re-examination.

~-- During the year 2009-10, RPFC (Jharkhand) withdrew the relaxation in

respect of 05 establishments due to violations of the conditions of

exemption (Annexure E).-NORTH EAST REGION (NER):-

NER with its Regional Office at Guwahati and Sub Regional Offices at

Shillong, Tinsukia and Agartala has a total of 13 exempted/relaxed

establishments, having membership of 10361 members. (Annexure-

A). NER has 11 exempted establishment u/s 17, and the remaining two

are relaxed establishments.

Compliance:-

After the last compliance audit violations of the conditions of exemption

were noticed in 10 establishments. (An nexure- A&B). In majority of the

cases the violations pertain to non achievement of the prescribed

pattern at the end of the financial year by the trust for which advisory

letters have been issued.

In respect of MIs Brahmputra Valley Fertilizers (AS/620) relaxation was

withdrawn by the RPFC due to violation of condition no 25 of para

27M l.e losses suffered by the establishment for 3 consecutive years,

however the establishment appealed against the said orders in the

Hon'ble Guwahati High Court which granted a stay and the matter is

pending in the court.

-,

RPFC (NER) has initiated an enquiry uls 7A of the Act against MIs

Assam Tribune (P) Ltd (AS/40) for default in payment of dues and the

same is under process, while in the case of Mis NEEPCO a thorough

compliance audit is being conducted after complaints of non

compliance in respect of contractors' employees (Annexure-F).

II'"'"'\, Grant of Exemption:-

Two cases for grant of exemption are pending in the region Le MIs

NEEPCO and Mis Tura Christian Hospital (Annexure D). Proposals of

both the establishments were forwarded to Head Office; however the

same have been referred back to the RPFC for clarifications and the

latest compliance audit report.

Item No 3:- Progress of grant of exemption

Clause 56 of the Finance Bill, 2006 amended Part A of the Fourth

Schedule to the Income tax Act relating to recognized provident funds.

The proposed amendment inserted a proviso in sub-rule (1) of rule 3 of

Part A of the Fourth Schedule so as to provide that in a case where

recognition has been accorded to any provident fund on or before 31st

March, 2006 and such provident fund does not satisfy the conditions

set out in clause (ea) of rule 4 of Part A of the Fourth Schedule, and

any other conditions which the B02rd may, by rules specify in this

behalf, the recognition to such provident fund shall be withdrawn.

-Subsequent to the said amendment it become mandatory for the

provident fund of any establishment to which the provisions of section

1(3) or 1(4) of the EPF & MP Act, 1952 applies to obtain ·exemption of

the said Act in order to obtain Income Tax recognition.

Since then EPFO has made all out efforts to ensure that all the pending

proposals for grant of exemption are processed expeditiously.

Comprehensive instructions have been issued to all the field

functionaries vide Head Office circular dated 28.12.07 rationalizing the

process of grant of exemption and stressing the need for a thorough

SCI utiny of all proposals at the level of the field offices and forwarding

the same in a time bound manner to Head office. The circular dated

28.12.07 is also put up on the EPFO website for the benefit of all .

Further, CPFC has vide circular dated 27.04.09 has issued directions

for expeditious processing and forwarding of all applications for grant of

exemption. It has been directed that within 15 days of receipt of a

complete proposal, the same should be forwarded to the Head Office.

Before placing a proposal before the CBT, it is scrutinized to examine

its suitability with respect to the provisions for grant of exemption as

contained under section 17 of the EPF & MP Act. In view of the

Ministry of Labour Government of India's guidelines issued vide letter

dated 27.02.07 all RPFCs furnish a certificate on a checklist of 10

points after 'due verification carried out at their end.

As per Ministry of Labour & Employment letter dated 1.4.08, all cases

of grant of exemption should be placed before the CST, EPF for

consideration before sending the same to Appropriate Governments as

per the provisions of the Act. Accordingly after the approval of the

CPFC all proposals for grant of exemption are placed before the CBT,

EPF for its approval.

-.In March 2009 Ministry of Labour, Government of India also issued

directions that proposals should only be forwarded after the report of

the latest compliance audit is found to be satisfactory. hence a

thorough compliance audit covering all the points as mentioned under

the revised conditions for grant of exemption is undertaken and a copy

of the report is forwarded to the appropriate government.

-- Since January 2008 the following proposals were approved and

forwarded to the appropriate government for consideration.

.- As per information available the Appropriate Government has granted

exemption in 228 cases and relaxation in respect of 15 establishments

was withdrawn by the RPFC after the compliance audit deducted

violations of conditions of exemption. The remaining cases are under

progress with the Appropriate Governments and EPFO.
