By Eddie Sprecco, Chief Executive Officer This may seem like a deja vu Monday, but once again another SDUSD project was won by a Los Angeles area contractor - U.S.S. Cal Builders. With only two!!! bidders , and a shrunken pool of sub-contractors willing to attempt the "PLA" quagmire, USS Cal Builders was the apparent winning bidder to modernize Longfellow Elementary. Their low bid of $19.4 million was well out of the engineer's estimate range of $14.8 to $15.5 million! I like to explain to visitors that San Diego is on a cultural and geographic island. We have the ocean to the west, the border to the south, a desert to the east and a whole division of United States Marines to keep Los Angeles out. And while we can't stand visiting Dodgers and Raiders fans showing up and being obnoxious, nothing is worse than out of area contractors coming in and taking work from local contractors and workers. When San Diego teams are struggling, and the ownership is kicking fans that are already down, there is less competition for game tickets and traffic on I-5 south increases. The Project Labor Agreement at San Diego Unified School District has the same effect - make working with the school district so unpalatable that local contractors sit on the sidelines and watch Los Angeles contractors take their place. Cal Builders. With only two!!!bidders, and a shrunken pool of sub-contractors willing to attempt the "PLA"quagmire, USS Cal Builders was the apparent winning bidder to modernizeLongfellow Elementary. membership and power came first, and "Despite the attorney's caution, he did not sitout a single labor vote or discussion." From that article "Barrera said the so-called project labor agreement was a priority ofhis from the start and that he played a leadership role in getting it through. Becauseone goal of the agreement was to hire workers from impoverished San Diegoneighborhoods" In this way, Richard uses some strange form of political jiu-jitsu tomake PLA's a local job generator, when they are just the opposite. Construction workers already tend to be local, since they need to be physicallypresent to do the work, unlike IT or accounting. The main limiting factor of who coulddo the work, before PLA's, was the commute to the jobsite. It wouldn't be costeffective to import workers from a distance, and still compete against the standardpay set by prevailing wage. Since the "island" of San Diego is mostly non-union, aPLA mandating workers be union members has the obvious effect of opening thedoor to the union heavy Los Angeles Market.

(*Voice of San Diego - April 18th, 2016) To avoid admitting this, union organizers like Richard muddy the waters by toutingPLA local hire "goals." These "goals" fall well short even after intentionally skewingthe numbers by counting workers instead of hours (i.e. one Los Angeles carpenterworking for a year on a project is equal to a San Diego carpenter working for oneday).

(*San Diego Unified School District - Construction Cost, Labor, Contractor Survey &PSA Report 2011) In fact, by not allowing Non-Union apprentices to participate on PLA projects,thousands of San Diego Unified School District graduates are shut out from workingon schools in their own neighborhood! So, by limiting competition, the SDUSD PLA brings in Los Angeles contractors andLos Angeles workers at higher costs while hurting students - all so Richard wouldmake more money for his unions and himself. Keep that in mind residents ofSweetwater Union High School District, Chula Vista Elementary School District andGrossmont-Cuyamaca College District when Richard comes to your neighborhood tosell you some more PLA snake oil:

AGC Members Travel to Washington, DC to Meet with FederalAgenciesBy Brad Barnum, Executive Vice President Every year, AGC of America hosts the Federal Contractors Conference (FEDCON) in Washington, D.C., and every year a number of AGC San Diego members trekacross the country to meet with the leadership of 20 federal agencies and reviewprocurement and contracting issues. Last week, AGC San Diego was once again well represented, as the following joinedover 230 fellow attendees for the three day conference: Diane Koester- Byron - IE Pacific, Inc.Dave Carlin - Soltek Pacific Construction CompanyMark Douglas, Neil Armour - LCPtrackerMatt Ferguson - Straub Construction, Inc.Steve Friar - Hensel PhelpsAlex Galicia - BPI PlumbingJeff Harper, Andrew Anello - Harper Construction Company, Inc.Lars Herman - Herman Construction GroupGita Murthy - RORE, Inc.George Rogers, Eric Taylor - RQ Construction, LLC Jeff Harper serves as the Chair of AGC of America's NAVFAC Committee, whichmet for over three hours with NAVFAC's Joe Gott, Chief Engineer and Director ofCapital Improvements, and Cindy Readal, Director of Acquisition. Items discussedincluded the President's budget and military construction spending, and contactorconcerns related to post-contract award; cost and schedule growth, and HVACsystems commissioning. Partnering continues to be encouraged, as well as timelyresponse and decision making. Legislative issues were presented during the conference, including the President's"Blacklisting" Executive Order - click here for a Call to Action); Water ResourcesReform and Development Act; Civilian "BRAC" (redevelop, repurpose, andmodernize excess federal buildings). Two other issues that we will detail at a laterdate are OSHA's rule to reduce the permissible exposure level of respirablecrystalline silica in the workplace to 50 micrograms per cubic meter; and thePresident's Executive Order that requires federal contractors and subcontractors toprovide employees up to seven days of paid sick leave per year. A number of AGC San Diego members joined Congresswoman Susan Davis and herChief of Staff, Lisa Sherman, for dinner the first evening of the conference.Congresswoman Davis represents the 53rd Congressional District, and she serves onthe House Armed Services Committee, is a ranking Member of the House ArmedServices Subcommittee on Military Personnel, and a member of the Education andWorkforce Committee. There was quite a bit of discussion related to the importanceof military construction and veterans, and of course, the Presidential race was ofinterest to all!
